Marlene has worked with my company as outsourced counsel for the past 3 years. We are a food manufacturing company and have had to deal with many different arenas that required her attention. Example 1: We were dealing with an HR issue. Marlene was able to resolve this issue through mediation and was able to prove there was no case to push through without spending many hours on the case. Example 2: Contract disputes. She was able on multiple occasions to get a resolution that was favorable on our part. She has access to many boilerplates (employment agreements, NDAs, MNDAs, Contracts, Proposal/R&D templates) that are needed and required for the food industry. Having this setup ahead of time was able to minimize these issues when they did arise. Example 3 The most recent was our company's acquisition. We were acquired by another manufacturer on the west coast and was able to run point and get a favorable deal for us that also worked for the other party involved. Most importantly through the years she became imbedded within our business. You would of never known she was not a full time general counsel. She is worth her weight in gold especially if you are in the food business.

I work in the health care and fitness industry and had been working with a senior partner on obtaining an important patent. Sarah Nagae was brought in as a consulting partner and I was immediately taken with her knowledge in the field, (I believe she has a master degree in exercise physiology). We obtained our patent with very little in the way of revisions. A few years later I wrote another patent and used Sarah Nagae exclusively. I was very pleased with her communication and dedication throughout the project. I have since used her for various contract reviews and royalty agreements. Her character is authentic and impeccable, and she is professional in all manners of her service. I highly recommend Sarah as an Intellectual Properties attorney especially in regards to exercise and health related innovativations.

My patent application in Artificial Intelligence was granted recently. Three years ago while looking for an attorney, I was not only skeptical about finding the right attorney who understands the advanced topics but was also concerned about how best I can cut down the expense since I was fully financing it. Today I can proudly say that Heather M. Colburn exceeded my expectations in all aspects. I had a great experience working with her and strongly recommend her.

My experience so far has been excellent. He communicates well stays on top of any issues, has answered all my questions and concerns in a timely manner. I read over my patent and it seems flawless. My first experience with another patent lawyer was awful, it was a nightmare. I was very wary and definitely not trusting when I was referred to Mr. Nugent. The experience has been great and I have recommended him to several people and all of them have had nothing but positive things to say about him. I would recommend him to anyone, his pricing is fair and he works fast and efficiently.

This attorney, Robert Sailer was recommended to me by an elder care attorney who I know very well and have complete confidence in. She did not disappoint my co-worker and I by sending us to the very best and most experienced patent lawyer in the area. His expertise and vast knowledge regarding how to best protect an idea became obvious the moment he began to gather his needed information. The real skill that sets him apart from any other lawyers I've worked with is his amazing ability to teach the information in such a way that my co-worker and I both felt confident we understood. We had been thoroughly educated about our options, advised which options to pursue and why, then offered complete support from him throughout our initial assignments. We went from clueless to totally confident after what was only supposed to be a consultation. Mr. Sailer is both patient and passionate in his desire to help people accomplish their dream of protecting and launching their idea, product, formula you name it. It is wonderful to be in contact with someone who is truly able to make you see exactly how to accomplish your dream. The "consultation" was free and I don't think he plans on charging for his services until we are ready to basically "purchase our protection" I have only left one other rating for a person in my life, so this person is exceptional or I would not have taken the time to write this review.

We are current clients of Mr. Rudolph and we would highly recommend this attorney to anyone in need of a good man to represent them. Mr. Rudolph has been excellent in representing us in our estate and real estate cases. He is very professional, very kind, very realistic, very knowledgeable, very proficient, very down-do-earth, very attentive, and on and on... we can't say enough good things regarding this attorney. We have gone through a very difficult situation, and it has been such a blessing that we found him. He is extremely knowledgeable, and extremely kind; both of which have helped us tremendously as we have struggled through a very traumatic year. He has gone above and beyond what we would have ever expected, and he continues to do so. We are so pleased to have found this extraordinary attorney, who is also a wonderful human being. Susan has a great sense of how IP strategy should align with Business strategy. She was interested in understanding our technology as well as our business model to be sure that we were developing a valuable, defensible patent. Prior to hiring Perkins Coie, I had read blogs that warned against going to big law firms as an early stage start-up in order to conserve cash and have more personal attention, but Susan and her team proved just the opposite to be true. No time was wasted educating them on the science and the entire legal team felt like part of our company throughout the process. I would recommend Susan to anyone whose IP protection is essential to their company's business strategy.

Rich successfully challenged a USPTO trademark ruling for my company. I had a self-submitted trademark application get rejected, so I proceeded to get quotes from six different patent and trademark attorneys in the Seattle area to fight the ruling. While Rich was on the higher end of the hourly rates, the amount of time he quoted for the work was much less than others, making him the value option. His response to the trademark ruling made it clear that he was extremely knowledgeable not only about trademark law, but also about many previous and very relevant trademark rulings that could bolster my case. He was very professional and well worth the money.

I worked with Mike closely throughout the course of 18 months for a Provisional and then Non-Provisional USPTO application. I am an independent inventor who developed a product for a niche healthcare application. I had called and spoke with several different patent agents/attorneys and tried to explain what I was creating, and Mike clearly was the most helpful and genuine choice. I asked him what the process would look like as I had no prior experience in this realm. Mike was extremely professional, as well as encouraging and helpful in his explanations, and took me on as a client shortly after our initial consultation. He was extremely efficient in hearing out and understanding my product, which is rather abstract as most medical devices are, and had an amazing Provisional application completed in just a couple of weeks. Mike is an excellent communicator and used his skills as a Lawyer, as well as his Mechanical Engineering skills, to paint a thorough picture and claims for my product, that led to an ultimate allowance from the USPTO. I was worried going into the Patent process, but Mike took the lead and always made sure that I was aware of deadlines and all of the paperwork that went into the process. We worked together closely to make sure that my ideas and goals for my product were always captured and made priority, and thorough on all angles . He even helped me through a couple of potential design flaws, and brought nothing but exuberance to the project. Personally, he is very down to earth, kind, friendly and has a great demeanor. I would highly recommend Mike.

Richard has a very down to earth quality that lets you feel comfortable right from the get-go. I believe that this was important in allowing me to feel free to discuss all issues that I was having with my business. His approach to meeting my needs is unique, because he takes the time to understand what my objectives are before he starts giving his feedback on the services that he may provide. I really enjoyed working with him. I have worked with lawyers twice his age, and let me tell you that they better watch out for this young hotshot. He has a thirst for learning more, which allows a dynamic process of staying up-to-date on significant law matters, but more importantly he is willing to learn much on the business management side. I run a boutique consulting firm in San Diego, CA that caters to major clients of $100+ Million. Richard has successfully helped me establish many of my contracts. His advice about the liabilities that may be incurred and the risk mitigation strategies have deemed to be invaluable. If anyone would like to contact me as a reference, please email me at [e-mail address removed].

I needed an attorney for a complex case involving an insurance company refusing to pay for covered services that could have potentially resulted in the death of my daughter. I used the bar finder for Thurston County and came up with several names. I called them all, and Paul was the first one to show interest in the case and the reasons given by the insurance company. When I first met Paul I was a little skeptical because of his age, but I was not left with a lot of choices. Paul worked with us on his fee, and understood that we were not in the best situation financially because of how much we had already payed in co-pay costs. Since this is a Federal Based Insurance Company for Retired military personnel, the issues were convoluted, complicated, and to say the very least difficult to navigate. We met with Paul explained the situation and retained him as our attorney. Since that time I have been nothing but completely impressed with this young man's ability. The amount of research he did to ensure that not just the major points, but all points where the insurance company had violated the law, and the contract to provide care were covered, explained and were addressed immediately to get my daughter the care she needed. Even though the hospital has not been paid, they understand the need and are continuing to treat my daughter based on this man's ability to fully explain the legal situation. The hospital that is treating my daughter is not involved in any negative way, and he has been in contact with them to the extent that the hospital is cooperating, even though I am sure they are leery that we may change our minds about who gets into litigation. In short, I would say that if you judge this man simply by age, you would be missing out on a great attorney. I stand behind this review 100%, and have given Paul permission to give my name and number to prospective clients that may be unsure of his qualifications.

A person contacted me, without the use of an attorney, to accuse me of infringing on their patent. I was definitely not infringing, but I consulted with Ms. Oemig about the best course of action I could take to protect my business from that person. The person was threatening to contact a company I do business with to notify them of patent infringement. I hired Ms. Oemig to proactively contact that company so that my business relationship with the company would not be jeopardized. Everything worked out fine in the end thanks to Ms. Oemig's work. Ms. Oemig is knowledgeable, reliable, and timely. I hope I don't have anymore IP issues in the future, but if I ever do, I know whom I'll be contacting.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
