I am a Licensed Real estate Broker with over 40 years of experience in residential, commercial and land development. Recently, I purchased a 100 acre hunting lodge that the Seller wanted to keep the oil and gas rights. Not having any experience with oil and gas rights, I contact a few real estate attorneys I have done business with in the past and none of them had experience in this sector. I was referred to Rick Linnell. Rick impressed me with his knowledge and experience with oil and gas rights. Rick informed me that if I did not limit or place restrictions on the land access, that the rights holder can place equipment on the surface of the property anywhere, remove trees and other property features without any approval by me or for compensation. Fortunately, I included in the PA that Purchaser would draft the Warranty Deed. Rick and the Seller discussed the issues of surfaces rights, and was able to negotiate acceptable language that was included in the Warranty Deed that allowed the Owner of the property to approve the location of equipment, provide compensation for the land use and share in a small amount of the profits. Additionally, I had numerous issues with the Title Company which required changes to documents, Rick's team handled the changes with incredible speed and accuracy, they truly understand that real estate deals are time sensitive. I have made Linnell and Associates my go to attorneys on all my real estate transactions.
