Brittany Kessler is an incredible lawyer and human, for that matter.  I had a very unfortunate and upsetting experience in which I was booked for speeding, being on my cell phone and a DWAI.  I blew under .08 so wasn’t booked for a DUI but what a DWAI means for your record while not criminal is still a terrible blemish.  I was visiting NY from CA so there was the added layer of my being from out of State. Brittany was ALWAYS available to answer my questions and concerns and was kind, empathetic and patient when explaining the way the system works.  She even contacted a CA attorney to clarify what may happen to my license there, should I be convicted.  She was amazing and I couldn’t recommend her more.  She is so professional but also truly cares.  She made the process bearable.  Because of her good relationship with the Court, she was able to have my DWAI dropped and replaced with two much minor tickets.  She put together a thoughtful, well researched and powerful case in my defense and I feel so grateful and lucky to have had her in my corner.  She’s the very best.  I’d like to add that Brittany’s firm Larkin Ingrassia was also supportive and a pleasure to deal with. I hope I don’t need Brittany’s help again but if I ever did I know exactly who I’m calling!

Brittany is the best lawyer! She was with me every step of my case! If I didn’t understand something she explained everything to me in great detail. Her knowledge of the law is excellent. She has great communication skills with her clients, peers, judges, etc. I would recommend Brittany to anyone.

Brittany is amazing. During my DWAI case she was extremely responsive to all of my texts and calls and answered any questions I had. She lead me through each step of the case and I never had a doubt that she didn’t have my best interests at heart. Even when I was freaking out, she was always there to explain everything and comfort me. She was kind and was never judgmental about my situation. Even when she was asked to go to another court hearing on the day of my court hearing she declined so she could be with me. That meant the world to me. I would recommend her to anyone who is looking for a top tier lawyer. She will always have your back.

This was my first offense and I was absolutely blindsided when it came to choosing a lawyer. Luckily, a friend recommended a firm that led me to Brittany and all of her help! She appeared with me during my first court session and instantly calmed my nerves. She maintained her professional responsibilities while also supporting me emotionally throughout two separate court appearances. I had a variety of questions and concerns that she always managed to take care of and she was extremely knowledgeable. Not only did she help me in court, but she also took time after to fully explain anything that I was worried about or needed further details on. I was thankful to begin and end my time going to court with a friendly face and very helpful attorney.

Mr Ziemelis in my opinion, is an invested Attorney. I have retained him a few times. Each and every time he took the time to know the ins and outs of my case. He remembers details as if he were personally involved. He isn't a lawyer that just takes your money and runs. He always responds to emails and questions. His approach is a very honest and real one. He isn't afraid to tell you when you are wrong and sure isn't afraid to argue for your side. Ultimately, he will not take your money if he does not believe you have a case, just to make a quick buck. Honesty and integrity at it's finest with Mr. Ziemelis is what you will get from start to finish.

Can a Lawyer Represent Me in Courts Outside of Middletown, New York?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
