I was referred to Maria Tobia by a coworker after he received a favorable outcome in his case with her representation. Maria is a passionate attorney that truly cares about her clients. She differs from other attorneys in that she is willing to go the extra mile to assure the best possible outcome. My case took over a year to get resolved and Maria was there the entire time keeping me informed and pushing for a better judgement. She was not willing to accept the first plea deal we were offered as many other attorneys would do because she knew she could do better. Throughout the case, she was always willing to take my calls and texts and answer any questions I had. She is extremely knowledgeable on the law and her passion for her work is what sets her apart from the rest.

I retained Maria for a case i had back in 2011, and let me tell you... She's very precise when attacting fine line issues that can lesser or even get your case "thrown out". I was refferd to her by word of mouth- and the word do travel, because im from brooklyn and she works prodominantly in the bronx. Around that time, i was told that see just "beat" a serious case of one of my fiancee close friends husband. And since my case then was a bit serious, picking her for the task was a "no brainer". The engery was awesome when we first met. She was very compassionate and professional. The D.A. , was ready to go to trail, but I was able to fire the lawyer i had, due to ineffective counsel... and as soon as I had Ms. Tobia on board she was able to turn a situation that was heading for the worst- much better. Actually, to make a long story shorter, she "Beat" the case. The felony was dropped to a misdemeanor and without getting to tectnical, I was able to walk. In a nutshell, Ms. Tobia is very sharp and well rounded when it comes to maneuvering through out court proceedings, preparing and presenting infomation. YES, I recomend Ms. Tobia if your in a jam.

As a business owner and entrepreneur I deal with countless attorneys in different areas of the law, and I have never eperienced professionalism and dedication that rivals Ms. Tobia. Although she is a criminal attorney, she represented me in family court and astounded me with her assertiveness and passion for litigation. This is one attorney who does not avoid trial. Unlike most attorneys, Ms. Tobia is not quick to compromse her clients wishes by settling out of court. She is prepared to go the distance and fight for her clients. She takes a special interest and goes out of her way to provide outstanding representation. I have refered several business asssociates and friends to Ms. Tobia and each of them has not only been impressed with how savvy she is, but more than satisfied with the results of their case. Ms. Tobia manages an elite level of professionalism and skill at a reasonable price, which I'm sure most people would agree is not common among attorneys. I have, and will continue to recommend her services to anyone looking for an excellent, dedicated, thorough and affordable attorney to represent them.

I'm not sure how else to title this explanation other than life saver. Ms. Tobia did the impossible for me by keeping me out of jail. My case was grimm from the beginning, but as she said," it's a marathon not a race and we must be patient." I left my trust in her and she did not disappoint. Because of her efforts, I will not be seeing the inside of a jail cell. I will forever be indebted to Ms. Tobia for the way she handled my case and would highly recommend her to anyone!

We were looking for the help of an attorney on the subject of Estate Planning, which has been troubling us for sometime. We had several questions pertaining to Living Trust, Taxes, Will, Probate, General Power of Attorney and Disability Planning. Based on the recommendation, we sought an appointment to consult Jessica Kiely, PC, Nyack, NY. We were impressed with the office and the cordial reception we received. On the very first visit she dispelled most of our doubts and fears. Jessica explained the legalities, latest requirements and processes in simple terms, easily understandable. Her friendly demeanor and supportive attitude made it very easy for us to work with. Jessica Kiely is undoubtedly among the best attorneys in the field. We are indeed fortunate to have Jessica in our community to help us with Estate Planning and Elder Law. Thank you

Peter is a fantastic attorney and an even better person. He is thoughtful, diligent and hardworking. He helped us fight a greedy builder by working through our town’s planning and zoning boards to stop a monstrosity being built next to our primary residence. And he did so with a tact and grace that he was then able to then help us buy that same property at a significant percentage discount over asking price. Unlike me, he didn’t get angry or take it personal in fighting a multi-year battle against the developer, who routinely lied to our town. He brought in zoning experts, an engineer and an architect to sway the town’s Zoning department and see fit that the developers project fail with multiple variance violations - he did so with an assertive grace that blew my wife and I away! Trust me; I’m cheap but I even told Peter he didn’t charge us enough for his great work. I’m now happy to call Peter a friend and genuinely can’t say good enough things about him. When we needed someone to have our back, Peter came through in a big way for our family, and for the historical integrity of our little community.

Peter is prompt and communicative. I worked with him on three different transactions/deals within 3 months time (he worked with accuracy and professionalism). He plans for the future and thoroughly prepared for any outcome of my cases. His advice was most appreciated with a transaction that I had to walk away from. I felt invincible with him by my side for my other deals. Without a doubt, I will choose Klose & Associates again.

Can a Lawyer Represent Me in Courts Outside of Nyack, New York?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
