After getting off the phone with Michael Schmitt the first time we spoke, I knew he was top notch. Respectful, Composed, Experienced and Polite were my first thoughts. He is solid in his approach, has it handled and knows how to negotiate any maze of difficult cases. His office staff are high class and professional. Prompt replies to calls and emails are the norm for the law office of Michael Schmitt. You will not be disappointed.

I'm so very thankful I found and retained Michael's services to represent me in my custody and child support case. Michael was extremely attentive, empathetic, knowledgeable, responsive and fought for me every step of the way. From our very first meeting, he explained everything to me and what I could expect and answered all my questions no matter what time of day that I asked. This was one of the most stressful and traumatic times of my life and he was my biggest advocate and fought for me without ever letting up until I got the outcome that I deserved. I can't speak highly enough of Michael. If you're seeking a Family Law attorney, this is the person that you're going to want to go with.

From the first day I met Mr. Schmitt he was very welcoming and concerned for me and my situation. My father passed away and I took in my siblings which he had custody of so we can all stay together. I was having issues with a custody battle and the possibility of them getting split up which I didn’t want and he came to my rescue!! Mr. Schmitt is one of the best family lawyers and was able to keep me and siblings together thanks for all you have done for me and my family!!!

I only had supervised visitation for 3 hours every other Sunday when I first hired Mr. Schmitt. Without an attorney I was not protecting my rights in court and was being taken advantage of. Although I was clean off of drugs for 5 years I still had a hard time getting my joint custody back. Mr. Schmitt was the only attorney I contacted that personally called me back and gave me advice without scheduling an appointment. He seemed very genuine and he offered pricing that was very affordable. I hired Mr. Schmitt with a deposit and a monthly payment. During the pandemic he worked with me when I lost my job and when I didn’t have the money for my payments he told not to worry about and pay when I can. He still showed up to every court date early and seemed to have a fantastic relationship with the judge. He is very knowledgeable, articulate and diligent. I deeply believe the satisfaction of helping someone get their child back means more to him than the money he receives. After passing a hair follicle test that was demanded by my ex and her attorney they still tried to deny my overnight visit request. Not only did Mr. Schmitt see to it that I got my overnight visit. I also got an extra overnight Fri-Sun and a weekly dinner visit not supervised. Also this will be the first Christmas Eve overnight to Christmas I’ll have with my daughter in 8 years. I cannot thank Mr. Schmitt for what he has done for me, my daughter, her sisters and my fiancé. Now that I am back to work I plan on paying him every dollar that is owed and will recommend him every chance I get. I wish I could give him 10 stars because 5 just does no justice for the service he provides.

Mike assisted me with obtaining child support from my child's father. I received more than what I expected. Mike and his staff stayed in communication with me and kept me updated throughout the entire process. Extremely professional, he definitely made a stressful situation much more tranquil.

Can a Lawyer Represent Me in Courts Outside of Rochester, New York?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
