Derek was recommended to me after I received my first ever DWI charge. I was very nervous about the journey ahead and all that it would entail. Derek was there every step of the way. He helped explain everything so that I understood what was happening at each court hearing and what would be expected as follow up. I could count on him for my many fears and questions and he helped give me peace of mind along the way. Derek is extremely knowledgeable and he always has a bigger picture plan in mind. He won’t get caught off guard by anything and is always prepared for multiple outcomes with a backup ready. He fought hard to ultimately get my charge significantly reduced and I felt like I was in good hands throughout the long process. When faced with a serious charge like this you need to have a lawyer that knows everything inside and out, and that is Derek to a tee. I’m beyond grateful to have found him and would highly recommend him to anyone in a similar situation.

It was by chance that we came across Derek for our case and what a great chance it was. He was clear, passionate, understanding, available and ready to defend you and stayed with you throughout the whole process! With his help, we were given an ACD and we could have not done it without him so we can't thank him enough. I definitely recommend Derek to anyone who is looking for an attorney.

Derek helped me understand the gravity of a DWI charge as well as the potential life-long personal & professional consequences and outcomes, and provided me with expert representation throughout a several month process to achieve a reduction with the best possible results. Derek knows the law and has experience in many town courts throughout the region. He consistently provided me with thorough, honest and legally sound advice. Derek was always straightforward and told me what I needed to know rather than what I may have wanted to hear (he tells it like it is and lets you decide how to proceed). Derek prepared me for each court appearance so I knew what to do and what to expect. Outside of court, Derek and I communicated via cell phone, text and email. Derek’s emails were detailed and exceptionally informative, explained legalities in terms I understood, and having the emails proved to be a valuable resource for me to revisit throughout the process. It is an emotional and legally complicated journey to navigate on top of everything else in life, I absolutely recommend engaging an experienced attorney as soon as possible, and I highly recommend considering Derek. Notably, it has now been 10 months since my case was resolved and just last week during the holidays I had some concerns come up with my court certificate of disposition and DMV driving abstract that affect continuation of auto insurance, and Derek was there to answer my questions and provide guidance.

I had to go through an unfortunate Sita where I was falsely accused of harassment as a retaliation to a case I had pending on my accuser. I hired Derek to represent me in my case and he was awesome from the beginning. Extremely responsive, even if he didn't have time to discuss anything, he acknowledged my call. He handled my case with persistence and has great negotiating skills. He was organized, reassuring and gave me a sense of ease whenever I finished discussing my matter with him. I would absolutely hire him again and again, even though I hope I never need him again. Haha

Derek was the best possible lawyer I could've found for my case. What started as basic consultation about my case turned into a nearly 3-year legal battle and Derek was by my side every step of the way. I was on the brink of losing everything that I had worked for and Derek did everything in his power to ensure that didn't happen. He was always quick to respond to any questions I had and gave me all of the information I needed to make informed decisions about my case. He fought hard for me in and out of the courtroom, and ultimately filed a motion that resulted in the dismissal of a charge that had been hanging over my head for years. I cannot thank him enough for everything he has done for me and my family. I would not hesitate to recommend him to anyone.

Can a Lawyer Represent Me in Courts Outside of Rochester, New York?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
