3
Failure to communicate important information and updates to clients

I am very pleased with the outcome of my case. It took some time, but that is to be expected. Tom kept me informed often so I always knew what was going on with the case. Anyone I spoke to at their office was always professional and helpful. Hopefully you never get into a bad accident, but if you do... call these guys.

We purchased a new construction using this company, and that’s when all the nightmare and life-ruiner began. At first we have been working with another attorney Michele in their firm for over 1 year, but last 1-2 weeks before closing, she suddenly went on absence and handed our case to Jeanine, without any notice in plan in advance. After a couple of times of discussion with Jeanine, I found her very unprofessional, and emailed her company requesting to assign a more experienced lawyer. But they declined my request and say Jeanine is very experienced. Around closing date, the house does NOT have gas or heating. She just told us our option is either to push back the closing with $250/day of fine, or close and wait for gas. We felt it unreasonable but just trusted her. She finally chose closing to be on Nov 15th, saying it's requested by seller. On the site, the seller’s attorney came into the room first. When just 2 of us were there, I asked him why he picked this date, and he said it’s my attorney who picked it! (But I clearly told my attorney to push the date as late as possible!) On site, they also agreed to finish everything on the punchlist by 12/15/2022, and mentioned that the gas is very fast, would take just a 'turn-on', at most a week, or just a couple of weeks. Under all the misleading and pressure, I was kind of ‘forced’ to sign the contract and close the house. And we ran out of places to live until end of March, 2023!!! From all the broker/lawyer/real estate related person I’ve talked to after this happened, their first reaction is that my attorney should have never let me close under such condition. Being an ‘experienced’ person in real estate industry, she should have known that a house have no gas can never obtain a CO! And should have talked to the town town to retract the CO so that the seller can only sell the house to me after they obtained a valid CO! (I knew this because after several months' wait in vain, I called the town and they said they would forfeit the CO and need to reissue a new one until it has gas!) During the 5 months, we lived here and there with a 2-yr-old! (didn't rent a place as they always tell us the gas will be there 'next week'). A lot of other troubles came – we had to hand wash our clothes and hang them dry in winter, we had to run here and there without stable living environment and exposing to all the virus. Also we love natural food, we purely breastfeed our baby until 1, and hand-cook every single meal and all snacks/cakes are home-made to her. But for more than 5 months, we can not cook for her at all, but had to order unhealthy adult take-out food for her. Moreover, as we are floating around, we cannot really send her to local school or not even have in-home nanny (ironically we bought a house in the school district and have to pay all the expensive taxes even we can't live there!) In the end we couldn’t bear our 2-year-old daughter to wander with us, and had to send her back to our hometown in China. She’s been living in another country for 4 months without parents! We missed our planned Thanksgiving and Christmas in our new house, missed New Year and traditional Lunar New Year, missed valentine’s day and all the important dates and holidays. A lot of stuff were in the house without gas for months and have grown mold, including part of the floors! Newly purchase items turn useless or passed the return deadline. We lost 40k including a forever scar on the forehead of my 2-yr-old due to fell in the driveway of the new house. I called the law firm when Michele returned, planning to request seller to reimburse us. And her first sentence is that 'Jeanine screwed you up'. But she declines to work in the case and said Jeanine had to take over as she's the one in closing. Nevertheless, Jeanine is not really responding, and today I just found out seller sent her their new attorney's contact many times but she did not act on it or tell me about it! We now totally feel regretful of using this attorney firm! No one in the firm is thinking on behalf of their clients!

We worked with Zach on our wills and related documents. Throughout the process, he was attentive, patient, knowledgeable, and responsive. When last-minute questions arose days before we planned to sign our documents, Zach responded patiently and thoroughly, consulted with colleagues as necessary, and made relevant changes immediately (even on the weekend). He has provided us with clear-headed and calm guidance every step of the way. We cannot recommend Zach's services enough. Thank you!

Can a Lawyer Represent Me in Courts Outside of Syosset, New York?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
