My husband and I were considering taking advantage of a franchise opportunity with a California-based franchisor. After visiting one of the established franchise locations in CA, we liked the business model and thought that the service would be well-received in the Cleveland area. We were very close to committing, but wanted a attorney to review the franchise disclosure package. Mr. Dub quickly reviewed the disclosure package and provided a detailed analysis which highlighted a number of things in the agreement which were, "one-sided in needless ways" and which did not, "accommodate the business realities of this new franchisor situation". We shared Mr. Dub's suggested modifications with the franchisor, however there was no room for flexibility with regard to the agreement. In the end, we walked away from this opportunity. While many people could have been successful with the franchise, Mr. Dub helped us to recognize that it was a lot to risk on something that did not fully meet our expectations and requirements. His council was an invaluable investment that undoubtedly saved us a great deal of resources in the long run. He is truly a subject matter expert.

I hired a law firm that did not know what they were doing to help me create my FDD. I got away from them when I found Stan. Thanks to Stan we now have up to date documents with today's franchise law. Stan was referred to me by another firm I was talking to because they felt he would be best for us because this is his specialty. I felt very comfortable with him right away. We just started franchising in 2014 and already sold 5 franchises with several more pending. The FDD Stan wrote has been reviewed by many law firms and everything has checked out right. I feel very good about all the support that Stan has given us to begin our Franchise business. He has been fantastic to work with. He is very professional and tells it like it is. He is a no nonsense straight shooter. I highly recommend Stan if your looking to launch a franchise or need franchise support. Also if you need legal counsel if you bought a franchise Stan can help.

Disorganized and slow. They took a long time to handle anything and seemed to not actually do anything, then they requested we sign an agreement taking way more fees than I have ever seen, so we terminated all services, they must not have realized that we never agreed to any fees and in a letter stated they would take a percentage from any future payments, even though we did not have a contract or agreement.

HE didn't put in motions or discovers, and blamed it on the judge saying the judge didn't want him to proceed. I have it in black and white from him..I allowed him on my case when he returned to his office and said it wouldn't cost me anymore also have that in writing. If you want your home saved the passion he might have once had seems to be gone..I had a wrongful foreclosure actually made the pmts..I have sense terminated this attorney and found someone else to represent me.

I hired Attorney Marc Dann in 2012. I also hired him again this year. Why? Because he was very compassionate, he listened and heard my concerns. Marc Dann is a good attorney and has helped a lot of people. He is upfront about his retainer, with Marc Dann, I felt relieved because he and his firm have kept me informed every step of the way. Attorney Marc Dann is a good lawyer and yes I would recommend him.

Can a Lawyer Represent Me in Courts Outside of Shaker Hts, Ohio?

Whether a lawyer can represent you in courts outside of your city or state depends on their licensure and the jurisdiction of the court:

  • Within the Same State:
Lawyers licensed in a particular state can typically practice anywhere within that state, including all cities and counties. They can represent you in both state and federal courts located in that state.
  • Outside of Their Licensed State:
If your case is in a different state, the lawyer must be licensed in that state to represent you. However, there are exceptions:
    • Pro Hac Vice Admission: An out-of-state lawyer can request special permission to represent a client in a specific case in another state. This requires filing a motion with the court and often working in conjunction with a local attorney.
    • Federal Courts: If your case is in federal court, a lawyer licensed in any state may be able to represent you, provided they are admitted to practice in that particular federal court.
  • International Representation:
For cases outside the United States, different rules apply, and the lawyer may need to comply with the foreign country's legal requirements or collaborate with local counsel.

It's important to discuss your specific situation with the lawyer to determine if they can represent you in the desired jurisdiction and what steps may be necessary to do so.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  • Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing. Most state bar websites have an online directory for this purpose.
  • Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case. Review their website, professional profiles, and case history.
  • Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association's records.
  • Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, Google, or Yelp to gauge client satisfaction and experiences.
  • Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field and adherence to high ethical standards.
  • Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation in the legal community.
  • Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  • Ask for References:
A credible lawyer should be willing to provide references from past clients who can speak to their abilities and professionalism.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  • Relevant Documents:
Bring all documents related to your case, such as:
    • Contracts or agreements
    • Correspondence (emails, letters, texts)
    • Legal notices or court papers
    • Financial records (if applicable)
    • Evidence (photos, videos, receipts)
  • Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and parties involved. This helps the lawyer quickly understand the context.
  • List of Questions:
Write down any questions you have about your case, the legal process, fees, or the lawyer's experience.
  • Financial Information:
If your case involves financial matters, bring relevant documents like pay stubs, tax returns, bank statements, or invoices.
  • Contact Information:
Provide details of any witnesses or other parties relevant to your case, including their names and contact information.
  • Personal Identification:
Bring a valid photo ID for verification purposes.
  • Pen and Notebook:
Take notes during the consultation to remember important points discussed.
  • Budget Constraints:
Be ready to discuss your budget and any financial limitations so the lawyer can provide appropriate guidance on fees and payment options.
  • Openness and Honesty:
Be prepared to discuss your case candidly. Full disclosure allows the lawyer to give accurate advice and anticipate potential challenges.
