I’m incredibly grateful I found Mary Kennelly of Fox & Fox to represent me on my claim of employment discrimination. I’d never been involved in a lawsuit before and wasn’t sure where to turn, how to find a good attorney, or whether I even had a case. I had just been fired from my job after a series of troubling events with my employer, and it left me shaken. A friend who was familiar with situations like mine and the lawyers who handle them recommended Fox & Fox as the best. I reached out to them, and Mike Fox and Mary Kennelly agreed to represent me. I could not have had better guidance through the legal process, better advocates in the court room, or better partners to navigate a very difficult time in my life. Mike and Mary related to me on a very personal level, always attentive to the stress that I might feel as the litigation progressed through various stages.   They balanced empathy and rigor beautifully: both were supportive and sensitive to what I had been through, while maintaining their intense focus and legal perspective. Mike and Mary bring so much experience and intelligence to their work, and they were alert to aspects of the case I would never have thought of or known to bring up. They were consistently on point when arguing our case, presenting my testimony, and examining my employer’s witnesses. Their preparation and execution impressed me. More than anything, I was proud to be represented by attorneys with such integrity and high ethical standards. Mary and Mike fought for me with respect and grace. They consistently exceeded my expectations and made me feel valued, protected, empowered and understood. I highly recommend Fox & Fox to anyone looking for expert counsel.

I have not come across any lawyer who would spend considerable time over phone without any charge to you to understand whether you have a case and advise you. A lawyer with 42 years experience! Thomas S. Burke is not after your money; he is after a cause - fight employment dsicrimination. He is semi-retired. If you have a case why not speak with him beofre he is fully retired? I pray for his best and for yours too!

Darrell is more than just my attorney, is my friend. With his help I would not have won my 10 year battle with WA State's workman's comp. After an on the job injury in 1998, I developed a chronic pain condition known as Complex Regional Pain Syndrome-(CRPS) Darrell believed me when I said the pain was REAL-not in my head, and he and his staff (Cossette N) helped me win my long battle! Darrell and I have knowon each other now some 15 years.

I had Samuel W. Benedict about 2-3 years ago. He was awesome to work with definitely knows his stuff, he is also very reliable and explains stuff about your case to you in a way that you understand so your not lost. He has gotten my case dropped to 2 years probation. I would definitely recommend him to anyone I know who needs a lawyer. 33 years of practice is amazing, which makes him knowledgeable. I was glad to be represented by him.

I called Attorney Long to find out information about child support and he gave me the MOST information I've ever had on this journey of about 18yrs!!! I have personally had conversations with attorneys face to face and they never took much of an interest. They just made me feel like another case that would be added to their pile of cases. Although I am tired of going through the motions with a parent that is committed to not paying, Attorney Long has encouraged me not to give up! I feel that with the information that's been povided it's given me more insight as well as a will to keep persuing this unlikely situation. I'm most appreciative and confident that things are now about to move forward!

Heather is the definition of a great attorney. She has been diligent in handling my employment case for the last 4 years. She’s always kept me in the loop on where we stand. She never “fluffed” information even if it wasn’t great news for me. I always knew what to expect. She never promised me a pot of gold, rainbows or roses but she did promise to represent me to the best of her ability, and that’s exactly what I received. She brought us to the finish line and I couldn’t be more grateful to her and her services. Professional, patient, responsive and knowledgeable is Mrs. Leonard

As a new business owner, I was looking for an attorney to assist me with setting up operating procedures, rules and regulations for my employees. Tim did a great job in that regard, providing me with an employee handbook tailored to my needs and my particular business. As with most businesses, I have had some issues with some employees and Tim has always been there to provide me with the support I need to protect my business and my investment. He is very responsive to my calls and keeps me updated with changes in the law that may have an impact on my operations. His fees are more than reasonable compared to the larger firms hourly fees and I can’t imagine them providing me the personalized service and quality work that I get from Tim.

I had wanted to make sure that my new employment contract was going to protect me and that it was loophole-free. Michael Malatino of Meredith Malatino Law LLC was fantastic! I was in a time-sensitive situation and needed to know what I was dealing with right away, and Michael handled my inquiry with utmost urgency and care. What appeared to be a simple contract with not much to talk about actually had 3 separate points of concern. Michael reviewed each very clearly with me and prepared me to have a critical conversation with my potential future employer. I am extremely grateful to have been introduced to Michael, as he was thorough, clear and worked with me in the immediate time frame that was necessary. I would highly recommend Michael Malatino of Meredith Malatino Law LLC.

I was a client of David E. Gottlieb (one of the partners at Wigdor) for about 1.5 years. I had met with a few other lawyers and selected Gottlieb because (a) I wanted a "shark" for my case and I could tell he would be very aggressive with the other side and (b) he was extremely solicitous to me, the client - he scheduled a call with me over the weekend once because his week was booked. The client service David provided was outstanding. David explained the legal procedure and jargon to me very clearly through every step and was happy to answer my questions. If I emailed him, I don't think he ever took longer than 12 hours to respond, even on the weekend when I wasn't expecting a reply until Monday. His even-keeled demeanor made me feel calm and relaxed, which was very helpful as there were certainly a few anxiety-inducing moments along the way. David Gottlieb is the kind of professional who actually believes in his work and focuses on getting his clients the best outcome possible to make their situation right. I can't recommend him enough.

Paul was the 2nd chair in my case which involved defamation and civil conspiracy. It involved my termination that was based on a new manager that recruited members of my staff to misuse a corporate hotline and make false allegations. There were other events that ensued over the course of a 90 day period before I was let go. We took on a major corporation who had retained an attorney that enjoyed telling us more than once that he was a Duke School of Law graduate and he had 30 years of trial experience. He and my lead attorney worked together as a team to present my case and I was included in the intense preparation. Each idea was thoughtfully discussed and we game planned together to make the story flow for a jury. He also provided valuable critique to help me keep my testimony sharper so that the jury would focus on the real issues. We all worked together once we got the jury list to do quick online research of the potential jurors. Paul offered significant input into each name. When J. Paul Porter did the close on my case, he was all of 26 years old. His closing was masterful. He pointed out each inconsistency and argued each point. We were also up against a hostile judge that could hardly contain his admiration for the defense counsel, and key points of our evidence were excluded, including the fact that my manager was not properly licensed in SC to be a nurse at the time she was spreading false statements about my competency and character. So the odds were against us. At the time of our verdict the average defamation in SC brought somewhere between 7-15,000K. Not a bad day's work for "kid" against a seasoned 30 year veteran. Paul is young and a good trial lawyer. The jury responded well to his questioning of witnesses and his closing. The only cure for "youth" is life experience and he is getting that. He has positioned himself in a position of being mentored by one of the best in employment law, J. Lewis Cromer. The verdict was delivered almost 18 months ago. I have stayed in touch w/ both he and my lead attorney. You can't go to war against an impossible opponent and come out w/ a win and not feel a closeness you fought along beside. In my case, it was never about the money, although I did suffer financially b/c of the actions of others. To me, it was about my reputation and the damage that had been done. The size of the verdict was a resounding rebuke of a major corporation and the corruption that has been exposed as being hospital wide.

I recently was informed by a company at which I'd been working for over 10 years that they were going to be changing my employment status - either demoting me and cutting my pay, or terminating my employment with a modest severance package. I had to make a decision about which option was best for me and my family - a very difficult decision to make. I decided to seek an attorney's advice, so I filled out an online contact form on Wigdor's site, because of their excellent reputation. I was pleasantly surprised to receive an email response within 1 day directly from a partner at the firm, Lawrence Pearson, who offered to meet with me to discuss my situation. (This was in stark contrast to another firm I also reached out to, who had a paralegal call me, ask some questions, and then took several days for someone to get back to me to set up a follow-up appointment.) When I met with Lawrence, I was immediately put at ease by his patient and confident manner. He listened to my case and gave me frank and useful advice - without asking for a dime. We agreed that, if my firm did not accept the counter-offer I was preparing to give them, I would engage Lawrence to begin some kind of action...but if my firm DID take my counter-offer, then I'd just take the money and not utilize his services. Lawrence was perfectly fine with that, I felt absolutely no pressure. I truly felt he had my best interests in mind. In the event, my company accepted my counter-offer, and I ended up having no need for Lawrence's services - but I feel confident that, had the need arisen, I would have been ably and forcefully represented by Lawrence and his firm. Overall, a 100% positive experience, and I recommend Lawrence highly for anyone facing a similar situation.

He believes in winning and he does. He did an excellent job of defending me in a frivolous lawsuit brought against me by an HOA in Parker County District Court and I wish he still lived here so I could avail myself of his services again. He also defended a neighbor against the same Hoa and literally skinned them, and made it look easy. I would highly recommend him if you want a favorable outcome.

What a Sexual Harassment Lawyer Can Do for You

A sexual harassment lawyer specializes in representing individuals who have experienced unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature that affects their employment or creates a hostile work environment. These lawyers help victims understand their rights under federal and state laws, such as Title VII of the Civil Rights Act, and guide them through the process of filing complaints, negotiating settlements, or pursuing litigation. They also assist employers in implementing anti-harassment policies, conducting investigations, and defending against claims.

Whether you're an employee facing harassment or an employer seeking to address or prevent harassment claims, a sexual harassment lawyer can provide the legal expertise needed to navigate these sensitive issues.

When Should I Hire a Sexual Harassment Lawyer?

You should consider hiring a sexual harassment lawyer in the following situations:

  • For Employees:
    • Experiencing workplace harassment: If you are subjected to unwelcome sexual advances, comments, or behavior that creates a hostile or offensive work environment, a lawyer can help you understand your rights and the steps to take.
    • Retaliation for reporting harassment: If you've reported harassment to your employer and are facing retaliation such as demotion, termination, or other adverse actions, a lawyer can help protect your rights.
    • Failure of employer to address complaints: If your employer does not take appropriate action after you've reported harassment, a lawyer can advise on how to escalate the matter legally.
    • Constructive dismissal: If the harassment is so severe that you feel forced to resign, a lawyer can help you pursue a claim for constructive dismissal.
    • Negotiating settlements: If you're considering a settlement with your employer, a lawyer can negotiate on your behalf to ensure you receive fair compensation.
  • For Employers:
    • Receiving a harassment complaint: If an employee has filed a harassment complaint, a lawyer can guide you through the legal obligations for investigating and addressing the complaint.
    • Implementing anti-harassment policies: A lawyer can help you develop and implement policies and training programs to prevent harassment and protect your organization legally.
    • Defending against claims: If your organization is facing a harassment lawsuit, a lawyer can represent you in court or during settlement negotiations.

Hiring a lawyer early can help ensure that your rights are protected and that you take the appropriate legal steps.

What Does a Sexual Harassment Lawyer Do?

A sexual harassment lawyer provides various legal services depending on whether they represent the employee or the employer. Their responsibilities often include:

  • For Employees:
    • Legal consultation: Provide advice on your rights and the merits of your case, helping you understand the legal definitions of harassment and applicable laws.
    • Filing complaints: Assist in filing a complaint with the Equal Employment Opportunity Commission (EEOC) or state agencies, ensuring that all procedural requirements are met.
    • Negotiating settlements: Engage in negotiations with the employer to secure compensation for damages such as lost wages, emotional distress, or punitive damages.
    • Litigation: Represent you in court if a lawsuit is filed, presenting evidence, questioning witnesses, and making legal arguments to support your case.
    • Protection against retaliation: Advise on how to handle retaliation from your employer and take legal action if necessary.
  • For Employers:
    • Policy development: Help create comprehensive anti-harassment policies and training programs to prevent harassment in the workplace.
    • Internal investigations: Guide the investigation process when a complaint is made, ensuring it is thorough, impartial, and compliant with legal standards.
    • Legal defense: Represent the company in responding to EEOC complaints or lawsuits, aiming to resolve the matter efficiently and protect the organization's interests.
    • Compliance advice: Keep the company informed about changes in employment laws related to harassment and recommend best practices to maintain compliance.

How Are Sexual Harassment Lawyers Paid?

Sexual harassment lawyers typically charge for their services in various ways, depending on the nature of the case and representation:

  • For Employees:
    • Contingency fee: Many lawyers represent employees on a contingency fee basis, meaning they only get paid if they win or settle the case. The fee is usually a percentage of the recovered amount, typically ranging from 25% to 40%.
    • Hourly rate: Some lawyers may charge an hourly rate, especially if the case is unlikely to result in monetary compensation but still requires legal assistance.
  • For Employers:
    • Hourly rate: Lawyers representing employers usually charge by the hour, with rates ranging from $200 to $600 or more, depending on their experience and the case complexity.
    • Retainer: Employers may pay a retainer fee for ongoing legal services, especially if they require regular legal counsel on employment matters.

It's important to discuss fees during the initial consultation to understand the cost structure and any additional expenses.

How Much Does a Sexual Harassment Lawyer Cost?

The cost of hiring a sexual harassment lawyer varies based on several factors:

  • For Employees:
    • Contingency fees: If working on a contingency basis, you typically won't pay any upfront fees. If you win or settle, the lawyer's fee will be a percentage of the compensation. For example, if you settle for $50,000 with a 30% contingency fee, the lawyer would receive $15,000.
    • Hourly rates: If charged hourly, fees can range from $200 to $600 per hour. Total costs depend on the number of hours worked.
  • For Employers:
    • Hourly rates: Legal fees can range from $200 to $600 per hour. A straightforward case might cost between $5,000 and $20,000, while more complex litigation could exceed $50,000.
    • Retainer fees: Ongoing legal services may require a retainer ranging from $5,000 to $25,000 or more, depending on the anticipated legal work.

Always request a detailed fee agreement to understand all potential costs.

Top Questions to Ask a Sexual Harassment Lawyer

Before hiring a sexual harassment lawyer, consider asking the following questions:

  1. What experience do you have with sexual harassment cases?
Ensure the lawyer has a strong background in handling cases similar to yours.
  2. How do you charge for your services?
Understand the fee structure, including contingency fees, hourly rates, and any additional costs.
  3. What are the strengths and weaknesses of my case?
Get an honest assessment to set realistic expectations.
  4. What is the likely timeline for my case?
Ask how long the process might take, from filing a complaint to resolution.
  5. Will my case go to trial?
Discuss the likelihood of settling versus going to court.
  6. How involved will I need to be?
Understand what will be required of you throughout the process.
  7. What outcomes can I expect?
Discuss potential remedies, such as compensation, policy changes, or reinstatement.

How to Check the Credibility of a Sexual Harassment Lawyer

To ensure you're hiring a reputable lawyer:

  • Verify their license: Check with your state bar association to confirm they are licensed and in good standing.
  • Review their experience: Look for lawyers who specialize in employment law, particularly sexual harassment cases.
  • Read client reviews: Check online reviews and testimonials on platforms like Avvo or Martindale-Hubbell.
  • Ask for references: A credible lawyer should provide references from past clients.
  • Professional memberships: Membership in organizations like the National Employment Lawyers Association (NELA) can indicate a focus on employment law.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting:

  • Detailed account: Prepare a written timeline of incidents, including dates, locations, and individuals involved.
  • Documentation: Bring any relevant documents, such as emails, text messages, voicemails, photographs, or witness statements.
  • Employment records: Provide your employment contract, employee handbook, performance reviews, and any prior complaints filed.
  • Questions: Write down any questions you have about your case, the legal process, or the lawyer's experience.
  • List of witnesses: Note any colleagues or individuals who may have witnessed the harassment or can support your claims.

Being well-prepared will help the lawyer assess your case effectively and provide accurate legal advice.
