Please, please stay away from this Attorney!!
Initially he made promises to my daughter about the legal services he would provide. My daughter was in a terrible car accident where she was first hit by an 18 wheeler truck which left her vehicle disabled in the middle of the Katy highway. While being disabled another vehicle hit her from behind and pushed her vehicle in front of a second 18 wheeler. To his defense he did get some of the 911 tapes proving she was disabled.
During our initial consult I asked about various possible scenarios that could result from this accident. First - could I be sued since I am the owner of the vehicle, he assured me that would not happen. Well it has happened. The guy who hit her hired an attorney and is suing me and my daughter.
After investigating the driver who hit my daughter, I have full confidence that we will prevail in this lawsuit. My insurance company has won and received 100% reimbursement for all money they paid out for the claim ; plus they have assigned our case to one of the top rated lawyers in the Houston area.
Sewell refused to file a counter suit, which was also discussed during our initial consult. Once we got served, he told us to get my insurance company to represent me and my daughter for the suit. I know this is very common and part of the coverage provided by my insurance company. So no problem , he is not my attorney I understood. However as my daughter’s attorney of record , he should have responded to the motion , appeared as her counsel and filed a counter suit. Due to the short time frame and the amount of time it took to get assigned an attorney by my insurance company I had to file a response to the lawsuit at the court house myself.
He got upset because he wanted my daughter to sue me and my insurance company. This seems unethical to me. He stopped all contact with my daughter, and stopped setting up the therapy sessions he referred her to. My daughter still suffers with neck pain .
A few months ago one of the providers he sent my daughter to for therapy services sent a bill. When I spoke with the representative from the provider’s office , she told me they were seeking payment because Sewell had informed them that he was no longer representing my daughter. I explained to her that this was news to me because he has not sent my daughter written notification that his office no longer represents her.
I believe an attorney has an obligation, ethical or moral, to finish out representation. He should have sent her proper withdrawal notification to terminate their attorney-client relationship. He is obligated to give her information on the statute of limitations for claims against the driver who hit her and their insurance company. And most of all indicate the bases for terminating the relationship. None of this has happened. The attorney client relationship is a fiduciary one, and the client’s interest comes ahead of the attorneys. Not with Sewell . His interest was for a fast pay out . Once the lawsuit was filed , he kicked my daughter to the curb. I feel he tried to take advantage of her. This destroyed the attorney – client relationship .How can you trust an attorney who would do this ? Right after you got served with a lawsuit. I’m not sure if its greed or filing counter suits is outside of his scope of practice. His behavior and actions have demonstrated his lack of professionalism and created many ethical concerns .
