Kevin Koelbel is a very knowledgable attorney who was successful in getting results for me with an Insurance company. I found myself being pursued for a proposed overpayment that was very stressful as well as persistant.I sought out his legal advice and was pleasantly surprised how he zoned in on specific laws in the area of disability and payment. He contacted the insurance company in my behalf and kept me informed the entire time. The insurance company was quick to back down and cancelled all pursuit of any money thanks to Kevin's intervention. I am extremely lucky to have found this outstanding and diligent attorney.

Mr . Koelbel has been my attorney for well over three years. In that three years he has handled several different legal issues for me. In some of these issues we disagreed on how they should have been approached. In each of these disagreements I learned during the process Mr koelbel's approach was the right way to go. Mr. Koelbel is detail oriented, a perfectionist, extremely knowledgeable about the legal process and what to expect at the end of the process. He has the integrity that I required of someone representing me in the complexed legal system we have today. I would highly recommend Mr Koelbel to anyone that needs an attorney.

Asked an attorney friend for a recommendation when I received papers alleging breach of contract and lis pendens involving the sale of my home. Of the four recommendations, I narrowed it down to Mr. Benzinger. Best choice I could have made. A blend of James Spader and Andy Griffith, he was effective in his communication with opposing counsel, resulting in a very acceptable settlement out of court and dismissal of all filings. He took on the worry that I had been carrying and even made me laugh a number of times in our discussion. Great work, Mr. Benzinger. You are now on "speed dial," though I hope it will not ever be necessary...

I have been going though a difficult and prolonged case and fired my previous attorney. Andy has restored my faith in the legal system. He is honest, smart and ethical. He always kept me up to date on how issues were progressing, something my previous lawyer failed miserably at. He gave me realistic expectations and exceeded those expectations. His fees were very fair which was refreshing considering my previous counsel. Highly recommend him and if I ever need a lawyer again, he's the first person I'd call.

David helped me with a case regarding discrimination at my place of employment. I was a good worker, so I never thought it would happen to me. And then it did. It was a complicated case as there were many years of behavior from many people and a variety actions involved. The lawsuit itself lasted for many years too. I always felt confident that David had the knowledge and experience to carry me through every step of the way - and there were a lot of steps! If I had a question, David was prompt to reply. I’m still so impressed with how much David knows about California and federal employment law and how much real life experience he has with all of it. David knows how to build a case from the beginning to go to court. Of course, it’s always better to settle, but you’re in a real pickle if you can’t settle for some reason and your attorney doesn’t know how to win a case in court in front of a judge and jury. David was prepared for every legal angle. It was like playing chess - he was several steps ahead of everyone else. Even in the most stressful situations, David was as cool as a cucumber and a consummate professional. I am so grateful to David for all his help; I really can’t recommend David highly enough!

I needed help with a dire situation at work. Someone didn't like me and wanted me gone, despite an outstanding job performance on record. This was in the public sector so there was also a union involved and procedure that needed to be followed. I knew I needed an attorney, but didn't know how to find one that had the expertise and street smarts that I was looking for. I made numerous phone calls and consulted (in person) with two other attorneys before asking David Duchrow if he'd represent me. I am so happy he said yes. My situation dragged out for months and time and time again, I'd be told one thing by the union (who was there to represent me) and something different by David. With his experience in appeals ("appellate law"), David was always one step ahead of the union because David would already know how this or that situation played out in the courts -- and he was well informed of the latest court decisions. It was this big picture type of thinking that ultimately got me a decent settlement considering the employer started out offering $0. There were times I asked myself, "Do I really want to pay for an attorney? I have a union going to bat for me, won't that be enough?" All I can say is, I'm so very glad I had Mr. Duchrow on my team. I can confidently say that the only reason I got anything at all is because I had David Duchrow guiding and advising. David Duchrow sees the big picture, the chess pieces, even when others trained in the law (and specifically in employment) couldn't see the same things he did with the same information. He's also one of the nicest and even-tempered people I've met. He was always patient and I did ask a lot of questions. David was careful to walk me through the logic of every piece of advice he gave to ensure I got it and understood the reasoning behind his recommendations. This helped me buy in to whatever it was he was suggesting and also gave me confidence when I had to face the ugliness of the situation before me. The other thing I'll say is that his rate is extremely reasonable and David doesn't nickel and dime when representing you. If you're in an employment situation and need an expert eye, someone with true street smarts or find yourself represented by a union, but wondering if you could do better, my short answer is this: Yes, you can do better. David Duchrow is the best I've come across when I was searching for an employment attorney. I'm extremely glad I decided to spend money on proper representation and I'm even more glad that it was on the right attorney.

David did very well with my case, which involved several complicated issues against a big Fortune 100 company. He was extremely easy to work with, responded to my inquiries in a timely manner, and very patiently remained a strong and assuring presence for me throughout the case. If you have a complicated legal matter, then David is the lawyer you want on you side. He just simply rules as an attorney. Good luck to you!

In my opinion, Gary is the best family attorney in Orange County. Being an attorney myself, I consulted with every big name in town for my divorce. I needed to relocate my kids to Los Angeles and enforce my child support order. Every attorney in town told me it couldn't be done. Except Gary. He did a fantastic job and I was granted the right to move away with my children and ex was held accountable for his failure to pay support including an award of sanctions. Gary really listened to my concerns, kept my expectations reasonable and was fair in his billings. I highly recommend Gary and I am grateful I found him.

Kevin Clancy literally saved our business. I don’t know how to state this more clearly. We were a new business in our first year and we were sued by a hostile competitor hell-bent on putting us out of business. They hired bull-dog attorneys and outspent us 4 to 1, doing everything possible to intimidate us, tie our hands, occupy our time and drain our cash. But we had Kevin in our corner. He was calm and effective when they jumped and screamed. He was intelligent and strategic when they tried to outflank us. And he was passionate and persuasive in defending us in court. Kevin was brilliant in his legal work and equally impressive in the way he coached us through an extremely difficult time. He made it possible for us to focus on the challenges of starting a new business while also fighting for our professional lives in court. It was a year I will never forget, but the story has a very happy ending. Our business is doing great. If this review sounds over the top, well good. That’ accurate. If it sounds fake, ask Judge William Maki about Kevin Clancy and the six young defendants who were regulars in his courtroom in the summer of 2009.

My life was about to change in 24 hours because of a corrupt police station that was coming after me. I was accused of doing something that I have not done, and I had to prove it fast that I was innocent. I did not know where to turn and what to do. I turned to John Maher, and he was there for me. During the whole process Mr. Maher was very calm, collected all the necessary documents, and constantly followed up with updates. My case was a very complicated case that involved UCMJ and mutiple military appeal boards. We are still in the appeal process for a DIscharge upgrade review. I have full confidence due to John's attention to detail and eagerness to lead from the front. John also represented me in a successful VA compensation claim. John continually kept me updated throughout all processes, via email, phone and in person. He flew into Memphis and we met up to discuss going forward with my cases. Very nice and humble man. I have both used John personally and referred him to several of my close friends who have had significant government employee or military issues. I have watched as he handled very complex issues with relatively hostile chains of command and his analysis and presentation is nothing short of brilliant. He is a level head when things seem to be falling apart and he is incredible when it comes to dismantling institutional stupidity. He does it all with candor that is professional but that will cut right through bureaucratic malevolence. My only regret is that I did not meet him sooner. I have experience with attorneys who talk big but then hand your case off to a junior partner or law clerk. With John, you can expect his close personal attention. This is evidenced by the rapid manner in which he responds to your inquiries and the depth of detail and thinking that goes into his work. If you were my friend or family in the most dire of straits, he is the attorney I would recommend.

Greg May reviewed my case dismissed on summary judgment, gave me an honest assessment of its merits, the risks, and proceeded to snatch victory from the jaws of defeat. His research was thorough but efficient; the resulting briefs read like a conversation between legal scholars, and the quality of his work was even commented on by the Court. The result was a stunning reversal. On any level of what a client expects in professional representation I could not make a higher recommendation.

Greg has helped me with 5 cases in the past couple years and I have hit home runs each time. The first of these was a business/employment dispute which I was successful in trial. The defendants appealed, and we in turn also appealed the attorneys fees portion of the case. Greg wrote our appeal and the opposition to their appeal. He is meticulous, well reasoned, and for me 100% successful. He argued our case on appeal. We won on our opposition and we won on our attorneys fees appeal which was remanded to trial court and the fees multiplied as a result. Greg helped us on two Employment MSJ oppositions, both of which were successful...One in federal court, and one in state court. Both cases were later settled in large part due to the quality of Greg's arguments. The fourth case in which I received Greg's assistance was an appeal on a trial in which we were successful against one Defendant and unsuccessful against a second - premises liability case. After Greg's thorough briefing on appeal, the respondents called us to settle and gave us everything we requested on appeal plus interest and appellate costs. Finally, we have one more case pending in appellate court. In this employment case, our case was dismissed out of state court. We appealed using Greg as our appellate counsel. The opposition was so weak that we didn't bother to reply and are currently awaiting argument to be set. I cannot recommend Greg enough. He is amazing. Smart. Thorough. My not so secret weapon to success in difficult situations!

Bill Peterson and the MCPY staff took the stress and worry out of pursing our suit. The case involved jurisdictions in Colorado and Indiana. Initially, we attempted to handle the case ourselves. After several months of frustrating calls and emails with the company we were pursing, we retained MCPY. We elected to meet in person with Bill (rather than virtually) who clearly explained our options and best courses of action. Immediately, MCPY collaborated with their contacts in Indiana and aggressively fought for our family to obtain an expedited and fair resolution. As a retired police officer and former military, I wanted an honest but aggressive law firm to assist us. If not for the expertise and network of professionals associated with MCPY, we certainly would not have had the positive outcome (especially not as quickly) that resulted from our decision to retain MCPY for our litigation. A sincere THANK YOU to MCPY, Bill and the rest of the staff who helped us.

I hired Ilana to review and revamp my estate plan that was over 15 years old. She came to my home with a notary to do the final signing of the paperwork and was professional and friendly all along the way. Very highly recommend Ilana Block!

I was arrested for concealed carry charges and Don did a wonderful job to help me get the best deal. I was going to be convicted of felony in Santa Clara county. Don spoke with the DA and I recieved a deal on my first court date. I was originally going to get a felony but it was reduced to a misdemeanor with court probation for two years and no weapons for 5. He still helps me to this day with anything and everything pertaining to my case. I am in the process of getting my record cleared. If your having trouble with any gun related offenses I would give his office a call. He's just an all around great lawyer.

Amanda represented me during my divorce and I am extremely happy with the final outcome. Any divorce is messy and scary - Amanda reviewed the facts of the complaint and then set about explaining the process and the steps that needed to be taken. Her obvious professionalism and knowledge were reassuring and provided the peace of mind I badly needed. My divorce had some messy sticking points (I considered them unreasonable demands) that had to be addressed during Mediation; this is where Amanda really shined. She clearly demonstrated her ability to think outside the box and offered some very innovative alternatives to the demands. The end result was a settlement that exceeded my most optimistic hopes. Throughout the process, Amanda has earned my respect and trust. Her professionalism, knowledge, creativity and personal standards are remarkable. I wholly endorse Amanda and recommend her to anyone who needs legal representation for any family law matter.

Kevin was recommended to us by our family attorney due to his expertise and familiarity with the Vallejo courts. We are so glad she did! From the outset, he demonstrated a unique ability to explain complex issues so that we completely understood the situation and our options. Most impressive was his unfailing energy and enthusiasm, which we very much appreciated as the months dragged on. Our case lasted from Feb thru Aug 2015 and Kevin kept us informed every step of the way - just as he promised he would. We also appreciate that our cost was very reasonable and exactly what he said it would be despite the lengthy process. I'll never forget the day he called to share the news that the case was dropped as a result of the outstanding brief he put authored. Had we not had Kevin, I'm sad to say that we probably would have accepted an unfair judgement just to get it over with. We could not recommend Kevin more highly!

Very knowledgeable, considerate, and compassionate One being a character not always found in every attorney. When an attorney states not interested because a significant monetary gain is not involved, one is then forced to ask - why is that more of a priority than supporting and protecting the Rights of those who come to you for help - - like the oath doctors take, Do no harm. When consideration and compassion are removed from any matter/situation what really exists? Thank You to each and every attorney who responded to my question and a very special Thanks to Attorney Damadeo because you restored my belief that not everyone values monetary gains instead of Justice being the Priority so that it always Prevails.

At a time that i was lost in a sea of confusion and emotional pain over the sudden death of my ex wife and the loss of our daughter to the family courts for "best Interest" as i would move her away from school and friends to live with me in Florida, our daughter was placed with a man not her father who not only has a record for violence on my ex wife but also a record for neglect/abuse on this very child. It was at this time that a friend who knew what i was going through and how many attorneys had been involved recommended Mr Baruch. It was a breath of fresh air as i was beginning to think very poor thoughts about the whole legal system here was a man with ethics and obvious legal knowledge-he made no promises and only spoke to the facts of the case, his empathy for his clients shows through in every phone call and message- all done with a steel like determination to do the right thing. I know from my experience that in Mr Baruch I finally have a counselor that will fight to the end for my families right to be together in peace .

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
