Under extreme stress and time constraints (hours) with complex tax issues, Penniann made the time to talk to me, gave me sound advice, and didn't make me feel like an idiot. She was clear, and concise and could discern the issues plaguing me without me being able to articulate them clearly. Conversing with her gave me hope, and reduced my blood pressure and heart rate.

Dear Penny. Where to start, I came from a family that the Patriarch makes the decision (right or wrong deception or not).  I contacted Penny some sixteen months ago when my brother showed up at my home with a codicil. I was told my mother had a trust in 2010 this was a complete falsehood. He had pilfered my mothers accounts created a mortgage on her paid for home and sold our family cabin. During which I was never told of any of these transaction (remember I as a woman am not allowed to question). When I found Penny she was so understanding and took my case to protect my interests and my mothers legacy. She is a fighter not intimidated by the court system or the family that represent those that mean you harm. I was most impressed that she was always available and responded even on vacation with her family. Another example: her daughter was in collage and a close friend had passed away, she picked up her phone to take my call (above and beyond the call of duty) yet still comforted her daughter. They don't make people like that anymore (remember I said people not just lawyer) Oh she's a lawyer, someone you can trust to always be there and prepared, and have the ability to explain the complex legal system for  myself and husband to understand. I strongly think if you are in my position you should speak to her, before you are deceived by conviction that program you for failure (to be subservient) you deserve answers. Penny will get them! .  We are indebted for your concern, caring, dependability, but most of all your caring and compassion. As always Penny thank you for you support through the difficult time in the past now we have a future! J & R

We hired Mr. Morrison to establish a living trust for our estate. With a new child in our family, property in multiple states, and assets we needed to ensure remained with the family, it was important to us that a document be prepared which outlined all of our wishes. Mr. Morrison took the time to listen to our concerns. He was both friendly and professional. He provided an outline of our living trust and then once we agreed to the specific instructions, he drafted the document promptly and on schedule. Thank you Andrew for your professionalism and kindness, I look forward to recommending your services to all my friends and family as they are required.

Mr. Morrison comprehensively explained the Joint Trust concept and process. He ensured that we understood each segment, our role in providing the required information, his role in ensuring that all Joint Trust legal requirements were met, and walked us through each step of the Joint Trust procedure. Mr. Morrison answered each of our questions in language we could understand and completed the Trust documents consistent with the timeline he originally proposed and we accepted. Most importantly, he walked us through the final Joint Trust documents section-by-section, ensuring that we understood each section and that we could easily locate information as needed. Mr. Morrison also advised us of information that only we could enter into the Joint Trust document and ensured that we understood what was required in those unilateral entries.

I was looking for a specific type of lawyer who was familiar with Federal Government and the complaint process and Attorney Patricia Randle was highly recommended by an associate. She has been representing me since 2017. I have been very satisfied with her services as well as all of her expertise relating to my case. Had it not been for her background and familiarity with government , I would not have reached this level in my case. Not only does she give me sound advice, but she goes beyond the services that I have paid for by providing additional help with this case. Randle & Randle are exceptional! I hired Randle & Randle to represent me in an EEO case because of their vast expertise and years of experience supporting government employees and their reputation for fighting to get the best outcome for their clients. I was very glad I did. I was treated with first class service by Mr. and Mrs. Randle and their staff. Mrs. Randle, as my lead attorney, provided me with sound legal counsel that included full and clear explanations on the application of EEO law and my case options. She was very sympathetic and understood my personal struggle fighting harassment. Being on the point for my case, she was a fierce and professional negotiator with the agency lawyers and she demonstrated a greater level of skill compared to her counterparts. I found the value of their services I received compared to the fees I paid to be a tremendous value especially when she achieved a timely and better outcome of my case than it looked like to me when I hired them. I sure hope I will never experience harassment again, but if I do I will certainly turn to Randle & Randle again! Thank you always

Mr. Davis has worked with me three separate times. He prepared my Will and all those papers you have to have now days - the Power of Attorney and Living Will, financial papers and on and on. My head was swimming. He spent a lot of time with me and made it as painless as possible. It's not fun making a Will. The second time I worked with him, he handled the probate of my father's estate. The third time was the probate of my mother's estate. He was kindness, itself, both times. It's never easy when a parent dies yet he was able to be comforting as well as helpful. He spent more time with me than he probably should have and made sure I understood everything that was happening with the estates. I highly recommend him to anyone with elder law concerns. He leaves no stone unturned and makes sure you, the client, understand and are aware of the ins and outs of the legal stuff older people have to deal with. (His assistant, Michelle, is great, too.)

I work with our El Paso, Texas facility where Jessica handles legal issues we have problems with families (DOPA's) not paying their parents bill and refusing to sell property in order to get them eligible for Medicaid. We have a resident who owes over $54,000. Thanks to Jessica that number will no longer go up. She did something I have never had an attorney do in all my years working in long term care. This financial abuse was reported to ADPS and law enforcement. Nothing was done. Jessica sent me a letter to review that she wanted to send to the Attorney General. It was so well written. Yes this was financial abuse but she also wrote with concern for our resident. She got the ball rolling with that letter. They assigned an investigator to this case. We now have a legal guardian for our resident, the family no longer has access to her pension checks and this guardian will see that the house is sold, the nursing home bill paid off, Medicaid is applied for and our resident's needs met financially. Sending that letter to the Office of the Attorney General was not only a brilliant idea but the fact that she was determined to see the right thing done for our resident - meant so much. We are here to take care of those in our care and with Jessica's help we able to accomplish this.

The Law Office of Stephanie Townsend was recommended by family friends. My father passed away leaving no will or anything organized. I worked with Jessica to handle the legal needs to manage this type of situation, as well as the various bills and other financial responsibilities required. Jessica was helpful, kind, and patient with my many questions. The office is family run, and you are treated with respect and personal attention. This was a very difficult situation, as dealing with death is, and Jessica helped make this part bearable. My husband and I attended an information meeting sponsored by Attorney Gill’s group, and we were so impressed with the clarity with which he explained the benefit of a family trust. Since that time we have set down with Mr. Gill and created a trust which we think organizes and protects our assets. We very much want our family to understand this process, and Mr. Gill has been kind enough to share the same presentation about trusts with our son, and help him understand the process. It is so very comforting to have provided each of our children with Attorney Gill’s contact information and to know he has a copy of all our powers of attorney (health, etc.) If ever we should experience a medical emergency, each of our children carries one contact card—Attorney Gill’s. We know that Gill’s office would fax to anyplace in the world, papers that are pertinent to our care, and they have established a relationship with our children. His materials have also helped us organize contact information regarding our property, insurance, etc, and provided a way we can communicate to our children about our end-of-life wishes in as non-emotional way as possible. Meanwhile, we are blessed to be active and healthy at 70+, and we intend to stop by the office often to keep our records up to date and to be responsible with the resources the good Lord has provided. We contacted Carolina Family Estate Planning after moving to North Carolina from New Jersey - we wanted to make sure all our important documents, including wills, healthcare directives and trust documents were all up to date and compliant with our new state laws. They responded to us immediately, and through several meetings including the most important one with Kellie, we had our (pretty complex!) documents updated and ready for signature within a matter of days. She answered every question clearly and kindly - this kind of thing can be stressful but they she and her team went above and beyond to make us feel secure and at ease. Their office is absolutely the most organized lawyer's offices we have ever been to, right down to the document delivery which came in a tabbed binder and with copies on a flash drive. We bought a brand new 2020 cyclone rv July 5, 2019. We had nothing but problems with it from the very first day. From holes drilled in the drain pipe for the sink to lights strobing in the living area and master bedroom, to awning arms breaking, water leaking in the door to the kitchen, back ramp door filling with water, we even had a situation where the rod for the rear bunks came out and the right seat crashed down and hit my son in the back. Bubbling around the roof, lights burned out all over. it was so bad that every single time that we went to use the rv I had to go pick it up from the repair center, use it, then return it to the repair center. It got so bad that I was dealing with heartland directly. I had my own direct number to a supervisor at heartland. He would call me or I would call him and we would go over the warranty items and he would tell me he was approving them line by line as I was on the phone with him. I would go to pick up my rig and nothing would be repaired! I would send an email to him 3-5 days later I would get a response that everything was approved. 4-6 weeks later I would go to use my rig again and nothing would be fixed. They would print the work orders and show me in black and white that everything had been denied. This went on for 1.5 yrs. I got tired of it. Warranties were expiring or expired and nothing was getting fixed. So in late January 2021 I made 3 calls to different attorneys. I left messages with all 3 giving a brief explanation of what was going on and the problems I was having/dealing with. Tony was the only one who returned my call and within 5 min. I spent over 30 min with him over the phone. He listened to every word that I had to say. He took notes asked me questions so he fully understood my dilemma and then Made some suggestions to me of what to do next. The last thing he said to me before we hung up was “ hang in there and if you ever need anything else call me and ill do whatever I can to help you”. Well 6 weeks later I called him again and hired him to do a demand letter. I had hundreds of emails back and forth with heartland. I had videos of the damage, 30-40 repair orders from 3 different repair facilities, that he had to go through. Within a week he had prepared a demand letter, sent it to heartland and received a response from upper management. 1 week and he was already further up the chain than I got in 1.5 yrs. He didn’t stop there like a normal attorney would have considering I only paid him to do a demand letter. He kept on with them back and forth until we reached an agreement. We are in the final phases now with heartland and of course we agreed to hire him on for the negotiations at a separate rate. Tony saved us big time. For what he did for us and is still currently doing for us was way more and way over the top of what he charged us. There is no way that I could have accomplished what he’s done. I would recommend his law firm to anyone who needs help not with just issues like mine but any issues you have. If you want someone who never stops fighting for you, Tony is the man you want on your side. My husband and I had the best experience with Mr. Conticello P.A. We had a dispute with our landlord and didn't know exactly what the laws were regarding our case or how to move forward legally. I spoke with several different attorneys before hiring this firm and I'm certain I made the right choice! After scheduling a consultation within 48 hours, my husband I were given all the tools we would need to succeed legally in small claims court. Our attorney was patient, knowledgeable, kind, respectful, and very good at communicating the law to us so we could comprehend. I would definitely trust this firm to handle my legal needs in the future.

I used Conticello, PA to obtain legal advice on how to proceed with a Florida based vacation company. Due to COVID, we had to cancel our travel plans and as a result, the company issued a travel voucher for the full balance we originally paid. When we re-booked the trip, they sold us insurance to cover the value of the travel voucher, however, when we had to cancel our plans again, we found out that insurance doesn't cover travel vouchers and the company was also unwilling to give us our voucher back (1 time use only). Anthony answered all of calls/questions and provided several options for us to proceed. Within 1 day of sending a demand letter, the company was willing to reissue us our travel voucher. Anthony also checked in with us to ensure we were able to redeem the voucher without any issues. Without his help we would have lost a significant amount of money as well as a family trip. We were extremely happy with his services and would highly recommend him. He is knowledgeable, patient and most importantly, effective!

Katherine was thorough and did a good job. It was not just us going in and having a wandering discussion about what we wanted to do. She did a really good job of driving the discussion home and putting things out there so we could absorb it and react in the way we wanted to. She’s also very good at follow up, accountability and really having the discipline in terms of how the process went.

Katherine was a joy to work with. She was a great find and we were very fortunate. She knocked the ball out of the park. The experience was easy, pleasant, and non-intimidating. She didn’t put us on the clock and was very flexible. Overall a great experience. I would definitely call them back as a first point of contact for any legal needs I have. If they couldn’t meet my needs I would completely trust their recommendation.

I recently moved back to Minneapolis because my mother has been dealing with an illness that we just found out is terminal. Upon finding out that she had not written her will or health directive I immediately got some references from a friend who is a lawyer however, this issue is not his specialty. Third call on the list I got to speak to Katherine live, no leaving messages and waiting. I made an appointment for my mother to meet her and have a consult and we both left her office feeling like the greatest weight had been lifted. We immediately knew we were in good hands and that we could cross this task off our list. Katherine is more than we ever expected, very efficient and knowledgeable. She was courteous, respectful and so kind when addressing my mother with sensitive questions and extremely patient when we didn't understand the process. I could tell by my mother's face that she was really happy and this was a much easier process than she imagined because of Katherine's professionalism and enthusiastic manner, it was obvious that she was there to do the best job possible for us and she really enjoys her profession. We would absolutely recommend Katherine, no question. In fact my husband and I will be seeing her for our own future planning. I count this as one of my mother's good days. My mother thanked me and said I did a good job but all I did was have some really good luck on that third phone call.

Not all litigators are great in the courtroom. We all see how thoroughly attorneys prepare for trial. And Chuck was very thorough in his preparation for trial. What stood out for me was Chuck's ability to artfully maneuver and then to sense the right moment to strike and destroy on cross examination. I was impressed. That is what I think you would want in an attorney. I was very satisfied with Chuck's "performance" and our subsequent victory in court. I think you want that more than anything else. I recommend Chuck to anyone.

Attorney Hogan was recommended to me by a friend. I am so lucky! Her office staff, Jennifer and Autumn, were always wonderful. Attorney Hogan, Jennifer, and Autumn always answered my questions quickly with honesty and professionalism. I will pass on her name. People always told me that lawyers were only after your money, no way! Attorney Hogan main goal was to get the job done and she did this with top of the line knowledge. As someone before me posted, it is in her blood.

I have been a client with Theresa Hogan for 3 years. She is very knowledgable, efficient and compassionate with what was a delicate guardianship matter. She is competent and impressive in court and from the interactions that I've personally seen, appears to be well-respected by other attorneys. I would not hesitate to recommend Theresa Hogan. Her paralegal, Jennifer, is excellent as well. I am highly pleased.

I have retained T for over 15 years or so. I'd like to think I can judge an attorney's quality. Through the years, I have worked and been friends with numerous attorneys who are considered excellent by their own peers....including Harvard Law, major Wall St firms and Europe in many facets of the practice. Further, my father was in the judiciary and I think I have a pretty good understanding of what it takes to be exceptional. If someone asks me who my attorney is (although I use several for various specialties,) I say Theresa. T has gone above and beyond so many times for friends and myself. If I chose one special quality in addition to her utter competency and professionalism it is TRUST. I have known T's family since I was a child and law is in their blood. Just good people. We have all heard the nefarious remarks about attorney's and their kinship to sharks. T couldn't be farther from this stigma. I sat with Theresa this week to discuss some business matters and it was more like having coffee with a friend. No rush. I have walked courthouses with Theresa, and, it is obvious she is well known and well respected by the many walking the halls. And, the bonus is Autumn and Jen are the best! I noted the comments by the person (since disproven) which said she did not return calls, etc. Hello? Have you ever worked with an atty before? An atty does not call back unless they have something to tell you. Think about it.....legal wheels turn slow...it saves you billing for wasted phone time . A unique thing with T's staff is they are "up-to-speed" at all times....I can't tell you how many times I have called with a question and they dealt with it in a 30-second call. You won't get that with most attorneys. The office is run like a family....just what you want when dealing with nerve-wracking issues. Professional, classy, thorough....pals. Recommended unequivocally.

If you are dealing with a family matter, I highly recommend working with Tina Corr. Pricing: Tina Corr was fair and consistent with pricing. Her contract was straightforward and easy to read. Prices are reasonable and billing was explicitly spelled out ahead of time so no surprises. Personality: Tina Corr was wonderful to talk to. She gave me the truth even if it wasn't what I wanted to hear. She read everything I sent (and I mean read, not just received) and she responded mindfully to all of my concerns. Efficiency: Tina Corr was responsive (almost always within 24 hours via phone or email!) and efficient with paperwork. Everything was filed correctly on time if not early. I never felt like my lawyer left me hanging. Flexibility: Tina Corr was able to respond specifically to the unique needs and requests I had for my case. I think family cases can be nuanced and mine was no different. Tina Corr was able curate the work on her end to suit my specific circumstance. I attribute this to the fact that she's a good listener and perceptive; qualities that can be difficult to find in a lawyer.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
