I endorse this lawyer. She provided a fast and clear response to an urgent copyright matter at my company. I appreciate outside counsel that can provide timely, useful advice, without all of the "legal jargon" and caveats. I need advice that I can pass on to my internal stakeholders without having to translate it for non-lawyers to understand. This lawyer is intelligent, friendly and I feel confident her advice is accurate.

We worked with him years ago when we went through several rounds of funding for a biotech start-up. He was on top of it, much more responsive than the partner and we all thought he did a great job in closing the round for us (dealing with ten separate investor groups). He put in the effort to get to know us and understand our business which you don't see with many associates these days. Very nice guy to work with.

He has been with us from our first patent and I foresee him being with us through all of our patents and I.P. needs. It is because of good honest hard-working people like Marc that our business is a success today. Give him a chance, you won't regret it!

Justin is one of the smartest IP lawyers I have ever met in that he is always looking for a way to make things happen. His view is to try to find a way for business persons to do what they want instead of telling them why they can't do something. This is an admirable quality. He looks at legal issues with a critical mind and his recommendations are complete and useful. He has branched out from a traditional law practice to include business and marketing activities. A very well rounded individual and very good lawyer and advocate.

I have been working with Morris for many years, and he is one of the smartest attorneys you'll find. His knowledge of the law is impeccable, and in addition to practicing law, he is also a professor at Cardozo Law School, teaching Intellectual Properties and Trademarks, and Advanced Patent Law. Morris has assisted my company in several patent disputes with those who have infringed on our intellectual properties, and has succeeded beyond our expectations each time!! Not only is he smart, he is also very fair in his billing. He cares about each case and client as if your are family.

There are those gifted individuals who craft in their field, beyond what is taught...that Is Mr. Bergen. His skill with language is a prized asset when it comes to patenting products. After working with Mr. Bergen I acquired 3 patents and enjoyed the journey through each step. Prior to selecting Mr. Bergen, I worked with 3 other attorneys in this field and all made me feel like I had to watch my every move because I was dealing with a "lawyer". With Mr. Bergen, I felt he was fair, honest, and brilliant. That combination made the process enjoyable and understandable when I had to write out the checks. I could not have picked a better fit for what I needed.

Cutrer (a french name from Louisiana) has been in broadcasting since he was 14 and has owned stations and understands technology and seems to know everybody in the industry. My problem was licensing software to radio/tv stations. I needed contracts and tips about how to advertise with little money. He understood what my software does and suggested ways to deal with stations that I hadn't thought of. He put me in touch with several companies that market to radio tv stations. We split the revenue.

We originally retained Gardner Haas as litigation counsel after Plaintiff rejected our offer of a mutual walk away and filed suit. As the case progressed, it became crystal clear that the law firm for the company on the other side was completely outmatched by Gardner Haas. The end result is a settlement that dismissed their suit (with zero payment on our part) and included a significant payment to us on our countersuit. At all times during the course of the litigation, Gardner Haas had a clear strategy and a solid grasp of the facts and the law. They were easy to reach, communicated clearly, and were generally easy to work with. Most importantly, at all times, our interests truly came first (for example, they were sensitive to reputational considerations that were important to us).

As part of a leadership team building a high-tech startup company, I've been confronted with a variety of situations requiring timely, savvy legal perspective. Cy Hersch has been absolutely key to my company making smart decisions in the face of such complexity. Cy has impressed me with many attributes over the course of the past year's work. Beyond his obvious mastery of the law, Cy has tremendous patience and a breadth of ability to understand the technical challenges associated with my business. What I find particularly helpful is Cy's ability to assimliate the technical issues with the underpinning legal points . Consequently, Cy provides me well thought-out suggested courses of action and keen assessment of risk...all with a tremendously pleaseant demeanor and can-do attitude. I could not guide our fledgling company to viabilty and success without Cy! He is a superiour attorney and advisor. If your organization needs superb counsel and professionalism, you cannot do better than Cy Hersch!

Top Questions to Ask a Lawyer

When meeting with a lawyer for the first time, it's important to ask the right questions to understand their expertise and determine if they're the right fit for your legal needs. Here are some top questions to consider:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. What potential outcomes can I expect from my case?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.
  4. What is your approach to handling cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. Who will be working on my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  6. How will you communicate with me throughout the process?
Establish expectations for updates, preferred communication methods, and response times.
  7. What is the likely timeline for resolving my case?
Get an estimate of how long the process may take from start to finish.
  8. Do you have references from past clients?
Testimonials or references can provide insight into the lawyer's professionalism and effectiveness.
  9. What are the strengths and weaknesses of my case?
Understanding potential challenges helps you prepare and sets realistic expectations.
  10. Are there alternative ways to solve my legal problem?
Discuss options like mediation, arbitration, or settlement to resolve the issue efficiently.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  1. Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing.
  2. Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case.
  3. Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association.
  4. Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, or Google to gauge client satisfaction.
  5. Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field.
  6. Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation.
  7. Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  8. Ask for References:
A credible lawyer should be willing to provide references from past clients.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  1. Relevant Documents:
Bring all documents related to your case, such as contracts, correspondence, legal notices, court papers, or evidence.
  2. Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and involved parties.
  3. List of Questions:
Write down any questions you have about your case, the legal process, or the lawyer's experience.
  4. Financial Information:
If applicable, bring financial documents like pay stubs, tax returns, or bank statements.
  5. Contact Information:
Provide details of any witnesses or other parties relevant to your case.
  6. Personal Identification:
Bring a valid ID for verification purposes.
  7. Pen and Notebook:
Take notes during the consultation to remember important points.
  8. Budget Constraints:
Be ready to discuss your budget and any financial limitations.

How Much Does a Lawyer Cost?

The cost of hiring a lawyer varies widely based on several factors:

  • Fee Structures:
    • Hourly Rate:
Lawyers may charge anywhere from $150 to $500 or more per hour, depending on experience and location.
    • Flat Fee:
For routine legal services like drafting a will or handling an uncontested divorce, lawyers might offer a flat fee.
    • Retainer Fee:
An upfront payment against which the lawyer bills hourly fees.
    • Contingency Fee:
Common in personal injury cases; the lawyer receives a percentage (typically 25% to 40%) of any settlement or award.
    • Monthly Retainer:
For ongoing services, businesses might pay a monthly fee for a set number of hours or services.
  • Factors Affecting Cost:
    • Complexity of the Case:
More complex cases require more time and resources, increasing costs.
    • Lawyer's Experience:
Highly experienced lawyers may charge higher fees.
    • Geographic Location:
Legal fees can vary significantly by region or city.
    • Additional Expenses:
Court filing fees, expert witness fees, travel expenses, and administrative costs may be extra.
  • Estimating Total Costs:
Request a detailed fee agreement outlining all potential costs.
Discuss any additional expenses that may arise during the case.
  • Negotiating Fees:
Some lawyers may be willing to negotiate fees or offer payment plans, especially for clients with financial constraints.
  • Pro Bono Services:
For those who cannot afford legal services, some lawyers or legal aid organizations offer services at reduced rates or for free.
