I have been working with attorney Stephen Chapman (Seneca, SC), with regard to a utility patent. I have found him to be the opposite of a stereotypical attorney type. He has educated me with regard to patents and patent law. I find that he invests so much more than he charges for. He has shown a genuine interest in my patent. It is obvious to me that he is passionate about helping people. I highly recommend his services. I completely trust his motives and his work. I would call him user-friendly with a warm, but professional approach. I wish I had found patent attorney, Stephen Chapman, sooner - I'm sure I would have been able to launch my product years ago! He is a brilliant attorney, in my opinion, with very fair fees. I couldn't ask for more.

My experience with Michael was excellent. He was knowledgeable and fully articulated my situation during the entire process with the other party. I worked with Kamran when I was first starting out in the patent law profession in 2004. We worked together at a private law firm for both domestic/foreign clients, where we were responsible for preparing new application drafts as well as domestic/foreign prosecution for technologies including semiconductor / memory fabrication and telecommunications. Kamran is a hard-working and flexible attorney that can handle projects of all sizes, from establishing basic IP strategy for small companies / solo inventors, as well as servicing larger and more structured clients which require more focused patent prosecution tactics for specific cases. Kamran is both a personal friend and colleague, and I would not hesitate to direct prospective clients his way.

I worked with Drew for 6 years, as an employee of a large consumer products company, and Drew made himself available, seemingly, at any time during any given work-week. Drew worked seamlessly and efficiently, also drawing from his experienced colleagues, during collaborative endeavors to give me an even greater perspective and reduce project timelines. He has a strong technical background with many years of case-driven experience, giving the client a true bargain for what they are receiving. Drew's personality is conducive to an efficient, lively experience, yielding positive, time-tested results. Drew dealt with many complex topics with us, including; international Trade Dress issues, Chemical compounds and applications, mechanical inventions, and many design-patent applications. As a distinguished IP attorney, drew aggressively pursues infringing offenders with incredibly sound arguments, just as well as he is able to, and I think, more importantly, anticipate infringement and build in a wide safety net within your IP position. Drew is a joy to work with and I highly recommend him.

Michelle and Kathleen helped us update our living will and worked attentively, and patiently, with us to ensure that all of our questions and concerns were addressed within our legal document. We had a lot of back and forth conversation in which they were incredibly helpful in allowing us to fully understand the legal ramifications of each choice we were making with the structuring of our will. At the same time, they are incredibly professional and I would highly recommend them to anyone.

We know the partners at SDIP Law back when they worked with Cooley and Paul Hastings. These guys have the brain power, experience and legal strategy of a powerhouse firm. They understood our business, our IP portfolio, and had previous experience as patent examiners. Unlike the other firms we have worked with, they only practice patent and IP law. They have a strong technical background that surpasses some of our own scientists and engineers. In fact, one of the partners has a JD and a PhD in physics. Overall, we worked directly with the partners (not associates) who understood the law, the landscape, and the technical aspect of our IP and business. Their approach ensured that our IP is protected and that our IP and patent portfolio would be monetized to its maximum value. They were professional, easy to work with and they were transparent and fair in billing.

This has been my second attempt at obtaining the same patent. So, needless to say, I had really no idea what I was doing. I originally filed for my provisional patent with legalzoom.com (seemed like a good idea at the time) and soon realized that not only were the lawyers they used not even registered but I had set myself back about a year. Tera went above and beyond for me. After I thought I had done all my homework and considered myself "in the clear", not only was she able to find 2 previous "artworks" that had been submitted in the 90's with pretty much the same exact patent I had in mind (rendering my idea un-patentable), but she worked with me to elaborate on my patent so that mine became an even better product eligible for patentability. Tera was very professional, knowledgable and, above all, HELPFUL. I don't know what I would have done without her. My guess is that my idea would have never actually come to fruition and I would have been spinning my own wheels for years considering how long it takes to actually obtain a patent. I look forward to working with Tera further as this lengthy process unravels. I highly recommend Tera Smith. You will not regret it.

Top Questions to Ask a Lawyer

When meeting with a lawyer for the first time, it's important to ask the right questions to understand their expertise and determine if they're the right fit for your legal needs. Here are some top questions to consider:

  1. What experience do you have with cases similar to mine?
Ensure the lawyer has relevant experience in the specific area of law pertaining to your case.
  2. How do you charge for your services, and what are the estimated costs?
Understand the fee structure, including hourly rates, flat fees, retainer fees, and any additional expenses.
  3. What potential outcomes can I expect from my case?
While no lawyer can guarantee results, they can provide an assessment of possible scenarios based on their experience.
  4. What is your approach to handling cases like mine?
Learn about their strategy, whether they prefer negotiation, mediation, or litigation.
  5. Who will be working on my case?
Find out if the lawyer will handle your case personally or delegate tasks to other attorneys or paralegals.
  6. How will you communicate with me throughout the process?
Establish expectations for updates, preferred communication methods, and response times.
  7. What is the likely timeline for resolving my case?
Get an estimate of how long the process may take from start to finish.
  8. Do you have references from past clients?
Testimonials or references can provide insight into the lawyer's professionalism and effectiveness.
  9. What are the strengths and weaknesses of my case?
Understanding potential challenges helps you prepare and sets realistic expectations.
  10. Are there alternative ways to solve my legal problem?
Discuss options like mediation, arbitration, or settlement to resolve the issue efficiently.

How to Check the Credibility of a Lawyer

Before hiring a lawyer, it's crucial to verify their credibility and ensure they're qualified to handle your case:

  1. Verify Their License:
Check with your state's bar association to confirm the lawyer is licensed and in good standing.
  2. Experience and Specialization:
Ensure the lawyer specializes in the area of law relevant to your case.
  3. Disciplinary Record:
Look up any history of disciplinary actions or complaints through the state bar association.
  4. Client Reviews and Testimonials:
Read reviews on legal directories like Avvo, Martindale-Hubbell, or Google to gauge client satisfaction.
  5. Professional Memberships:
Membership in professional organizations or specialty bar associations can indicate a commitment to their field.
  6. Awards and Recognitions:
Honors from reputable organizations reflect expertise and a positive reputation.
  7. Consultation Assessment:
Use the initial consultation to evaluate their communication skills, responsiveness, and willingness to address your concerns.
  8. Ask for References:
A credible lawyer should be willing to provide references from past clients.

What Should I Prepare for My First Consultation?

To make the most of your initial meeting with a lawyer, come prepared with:

  1. Relevant Documents:
Bring all documents related to your case, such as contracts, correspondence, legal notices, court papers, or evidence.
  2. Written Summary:
Prepare a concise written summary of your situation, including key dates, events, and involved parties.
  3. List of Questions:
Write down any questions you have about your case, the legal process, or the lawyer's experience.
  4. Financial Information:
If applicable, bring financial documents like pay stubs, tax returns, or bank statements.
  5. Contact Information:
Provide details of any witnesses or other parties relevant to your case.
  6. Personal Identification:
Bring a valid ID for verification purposes.
  7. Pen and Notebook:
Take notes during the consultation to remember important points.
  8. Budget Constraints:
Be ready to discuss your budget and any financial limitations.

How Much Does a Lawyer Cost?

The cost of hiring a lawyer varies widely based on several factors:

  • Fee Structures:
    • Hourly Rate:
Lawyers may charge anywhere from $150 to $500 or more per hour, depending on experience and location.
    • Flat Fee:
For routine legal services like drafting a will or handling an uncontested divorce, lawyers might offer a flat fee.
    • Retainer Fee:
An upfront payment against which the lawyer bills hourly fees.
    • Contingency Fee:
Common in personal injury cases; the lawyer receives a percentage (typically 25% to 40%) of any settlement or award.
    • Monthly Retainer:
For ongoing services, businesses might pay a monthly fee for a set number of hours or services.
  • Factors Affecting Cost:
    • Complexity of the Case:
More complex cases require more time and resources, increasing costs.
    • Lawyer's Experience:
Highly experienced lawyers may charge higher fees.
    • Geographic Location:
Legal fees can vary significantly by region or city.
    • Additional Expenses:
Court filing fees, expert witness fees, travel expenses, and administrative costs may be extra.
  • Estimating Total Costs:
Request a detailed fee agreement outlining all potential costs.
Discuss any additional expenses that may arise during the case.
  • Negotiating Fees:
Some lawyers may be willing to negotiate fees or offer payment plans, especially for clients with financial constraints.
  • Pro Bono Services:
For those who cannot afford legal services, some lawyers or legal aid organizations offer services at reduced rates or for free.
