Allan Brady and Heather Witters of Brady & Witters are the most helpful and caring personal injury lawyers I've ever met. I have an extremely unique case that requires a lot of time and research and this law firm has taken the initiative to assist where no other firms would. Additionally, my life could easily be jeopardized without a very much and desperately needed surgery in which this firm guided me into the right direction of obtaining. I highly recommend Brady & Witters to anyone who is in search of an attorney that wants immediate results and cares!

John Nelson is an outstanding, one in a million, brilliant attorney. Equally important, he's very compassionate and possesses a very wise, moral and ethical compass. With respect to his work, he efficiently and consistently provides not only what you thought was important, but always anticipates and takes care of other areas that you had no idea were legally important to consider related to, in my case, the process of having my books published, copyrights, related contracts, and digital/cyberspace safety issues. His counsel has also prevented potential problems. In closing, I am extremely grateful that I ultimately chose him as my attorney to take care of all the legal needs for the aforementioned, because as a result of the excellent legal support and counsel he has provided, I will be able to achieve my targeted goals. Having worked with him, I am also even more inspired to also focus on some new creative writing/music projects, knowing I can always depend on his legal support as I move towards getting more of my work published and released!!!

I will definitely be recommending Michelle's services to my colleagues and team members and look forward to reaching out to her in the future.

As a member of the Florida Bar for over 20 years, I have professionally recommended a great number of lawyers. John Crabtree is my first personal referral. John represented me in several appeals in Family Court involving the custody of my daughter. I could not have found a better lawyer for this cause. His knowledge, expertise and good nature combine to form an excellent advocate. I will turn to John for any future appellate needs and would highly recommend him.

Keith approaches problems with humor, insight, and integrity. Sometimes a simple solution is at hand - a letter written, a phone call placed - that will help advance the client's objective without necessarily advancing the bottom line. He clearly demonstrated empathy for some dumb mistakes I had made while explaining every step of the process. He seems to like to help people who want to help themselves but doesn't judge their circumstances. I'd recommend Keith for his unusual talent for illuminating an otherwise confusing and stressful process while advocating strongly for his client.

Sometimes life throws a bunch of things your way that necessitates not only hiring one lawyer, but possibly many. If you're at the point when you're looking for an appellate lawyer, please know you have my sympathy. It's a place I never thought I'd end up. Bill was one of three names that I was given by my attorney, and he was also the attorney who came up when I spoke to other attorneys and paralegals I knew. There really aren't that many who truly specialize in this field... who are Florida Bar rated in appellate law...and who've tried the number of cases Bill has before the Florida District Courts and even Florida Supreme Court. I found that some people who say they've done appeals, really haven't done all that many. You can actually research your potential attorneys on the 1dca.org website. It's a small bunch of those who are truly experienced. From the get-go, you know that you're talking to a person who has years of experience handling appeals and will truly do all he can for your case. He also promised me "brutal honesty" with regards to my case--which is something I respect. He's also a really nice guy. Appeals are not cheap, but Bill's hourly rate is, by all accounts, fair. Given the level of experience, he could easily charge more. My only regret is not consulting him sooner when it looked like an appeal may be likely. Don't make my same mistake. Update: Experience matters. There's a difference between 30 and 300 cases. There's a reason Bill's name is always included when attorneys are asked for an appellate lawyer recommendation. I knew he was experienced, but I didn't really get it until I read his work for my case. He meticulously chooses each word and crafts a well thought out argument with case law to back up his point of view. Comparing his work to those of my Ex's attorney--made it apparently clear that experience matters and his reputation is justified. We won, BTW.

I contacted Heather for an appeal. She was extremely patient and took a lot more time than I would have expected to review my case. Unfortunately, we decided it would not be worth the expense to appeal. She explained everything as if I was her only client and paying her for the consultation over the phone. If had known of her, I would have hired her for the original case.

Attorney Antoinette Appel is the best lawyer that we have ever worked with. Our family and I had a case that had been going on since 1993. My previous lawyers for the case were all incompetent except Attorney Appel, David Bogenschutz, and Robert Malove. Our other lawyers included Ira Still, Barry Butin, Amina Khan and many other lawyers who did not care even a little. Attorney Appel immediately met with us one evening for hours and never even mentioned money. The other attorneys mentioned money even before we told them about the case. They were all incompetent, arrogant and untrustworthy. Butin, for instance, conspired with the District Attorney and one of the Judges against me. Khan tried to inflict pain upon one of our loved ones by stabbing her with a pen. Still never even met with us once within a 10-year period. None of the attorneys were able to get the issues resolved except Attorney Appel and her wonderful retired attorney associate. Suddenly, on the day of the rushed and unconstitutional pro-se trial, Attorney Appel walked into the courtroom, graced everyone with her beauty, charm, professionalism, knowledge and power and the case was finally finalized. She is the best of the best. We would trust her with our lives and all else we own in the world. GOD did not create a better human being who is so intelligent, down to earth, and full of grace.

Jonathan Saunders handled what was, for me and my family, a mountain of a case. He showed up at a time when my current attorney was ineffective even though I had the statutes and laws on my side. He swooped in and within 30 days everything shifted in our favor. I felt like we were fighting a goliath and had little chance until he showed up with his exceptional knowledge of the law, incredible cousel, and excellent reputation amongst other legal professionals. He was our superhero! He put a period on our case and never broke a sweat. I would recommend Jonathan Saunders to anyone who seeks an honorable attorney, that goes above and beyond to help his clients understand their situation and options. He listens and he cares! He truly believes in seeking and attaining mercy and justice for every client. A note to future clients; Don't mistake his kindness for weakness. Behind that compassionate, kind, face and enormous intellect is a warrior with a law degree.

Chandra and I worked have together on several trials. I served as a witness for a national bank and Chandra was trial counsel. The thing I like about her is that she was always prepared. Some of the other attorneys I have worked with either didn't seem to know the law/procedure or just didn't review the cases beforehand. That might be because of their workload; but, not Chandra. She was always ready for every possible scenario. The other thing I like about her was that she always got back to me quickly, even at night and on the weekends.

Mr. Beck was extremely knowledgeable and thorough in his handling of my real estate dispute, involving a condo-hotel development. Unlike other attorneys I had interviewed prior to Mr. Beck, he immediately gained a quick understanding of my case, was very accessible via telephone and always kept me up to date on developments as they occurred. Also, as compared to other attorneys (with even less credentials and experience), Mr. Beck's fees were very reasonable and fair. In the end, I got my case resolved very successfully, and would highly recommend Mr. Beck to individuals whom are facing legal issues related to real estate. I can honestly say that Mr. Beck was the most knowledgeble, professional and communicative attorney that I have ever dealt with, and I would recommend him at the highest level.

If you are dealing with a Family-Related legal situation, I implore you to retain Tom Sasser. His professionalism, skill, and tireless advocacy for his clients is unparalleled. I retained Mr. Sasser after a series of previous lawyers had seriously jeopardized my legal position. If I had retained him initially, I would saved a ton of heartache (and a ton of money!). His retainer fee is justifiably high, but in addition to his exceptional representation, he is extremely judicious in his use of client resources. Not only did Mr. Sasser help me recover from my weakened position, but he achieved as good an outcome in my case as I could have ever hoped for. He literally saved my family, and I am eternally grateful. If you are absolutely unable to afford to retain him personally, than I strongly recommend retaining one of his associates. It is clear that he holds everyone in his firm to his exacting standards, and keeps tabs on all the cases his firm is engaged with. I give him my highest recommendation, and urge anyone in need of family legal counsel to hire him or one of his associates.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
