Landlords seem to be granted the upper hand in renting transactions. I called 6 lawyers who all told me NO before I found Grant. I appreciated him taking my case against an unscrupulous landlord who denied me information about the return of my security deposit and thence payment of said deposit. He and Delisa communicated actions needed and proceeded upon my responses. Grant's communications with my ex-landlord resulted in the return of my deposit without having to drag it all out in small claims court. Without hesitation, I will call on Grant for any other legal assistance in his realm of expertise!

If I could give 0 stars I would! My husband applied for an occupational license a month ago and had court today at 10am with Judge Alex Hernandez. As soon as my husband got up there the judge totally dismissed him in less than a minute! Not sure if the judge was in a bad mood but he was extremely rude the way he went about it all. We just moved out here a month ago and after today it sure is feeling like it’s a race thing on why he was treated the way he was today. My husband is not problematic person and works everyday so today was a joke! On top of it I paid $350 to be told TODAY that they don’t do occupational license here when clearly on the website states otherwise. This court system is a JOKE! Definitely can already tell it’s about WHO YOU KNOW here and courts just want to take your hard working money.

Steve Cooper is the ultimate scheister. No secretary, no bookkeeper, no paralegal. Never opened my file. Never read documents. Never prepared for court or mediation. Waits out the court timetable then pressures client to settle because you no longer have a case once he's botched it. The worst. My ex was arrested for dwi and he didn't even get the arresting officer as a witness in my custody case. By the time I got another attorney it was too late to add witnesses. He's a phony with a shingle on Gaston.

The Best lawyer money can buy...I only found this out by using other attorneys. I've used Mr. Cooper since I was a kid. I'm now 42. He had both my cases in the past dismissed, potentially life changing if convicted. I regret not using him this time, I chose one locally to just make it affordable...big mistake. My apologies, but my loss...

I cant put zero stars. She is a worthless attorney. She had a super easy case, open, shut, dismissed with me and she was so lazy that I got screwed. If you get her as a free attorney remember..with her you get what you pay for. If I could go back,I'd get a loan to pay money for a REAL lawyer. Everyone who has had her, had something bad to say, including many other attorneys. I wish I would have known I could have asked for a different one. I'd love to see how many cases she's actually won.

This attorney is court appointed and promised us better service than a court appointed attorney. He said, "I take my cases seriously". This is absolutely a lie! He will never return a phone call everything has to go through his PI and even she is slow at returning calls. Basically to have him as your attorney you have the Prosecutor. He tries to find no defense for you and you are guilty as charged, so lets just take the easy way out and take the states highest plea agreement!!!! Stay away, even no representation is better than this representation!!!

Lack of communication, professionalism and basic courtesy. Secretary doesn’t have a clue when he is in/out. Asked to call back and he wasn’t there, asked to call back on Saturday. Emailed to confirm he was there on Saturday and secretary failed to respond. Mr Bryant left a vm that he would send email to address contract issues. No response to emails, voicemail or text messages. Phone appointment set up and no call. No communication to address. Finally received text from Mr Bryant stating that he would send email addressing contract. He was busy dealing with family and kids. Since that text, no communication whatsoever from secretary or Mr Bryant. Left voicemails, many emails and text messages, no response. Wants a high dollar for subpar nonexistent services. If he didn’t want to handle case, simple communication would suffice instead of wasting my time and aggravation.

I had two years of hell with Cowart as my attorney on a personal injury care. He would disappear, not return calls, change offices, and phone numbers and tell me after the fact. I once spent months trying to reach him on a phone number he gave me only to be told by him later that he never answers that number. I was a wreck dealing with him. After we got a settlement. He wouldn't give it to me. He left the office he was in, and told me after the fact. I had to negotiated the medical bills owed on my own. And paid everything out of my pocket while he held onto the settlement check. Then after all that, he made me gave me no discount even after all the work I had done and made me give him a cashiers check for his fees before he would endorse the settlement check over to me. He is sloppy in his procedures, procrastinates and will bore you endlessly with lawyer stories wasting your time. He is the worst attorney I have ever met Use him only if you want delays, his disappearing continually, lies about things to make himself appear knowledgeable and stress.. My recommendation is to NOT USE THIS attorney.

In March of 2006 my wife & I were involved in a single vehicle wreck, caused by the mechanical failure of aftermarket parts. I spent 7 months in the hospital & over 2 years later am still relearning to walk. We hired Nick Nuspl as our Attorney, & after sizing up the case, he brought in Marc Lenahan & Appellate Attorney Tom Cowart; as he put it, “3 Attorneys for the price of 1.” The huge obstacle in this case was that the wreck obscured the initial failing. However, the combined legal talents with their observations, plus those of experts in the field, showed that the engineering was flawed & installation was poor. It was then discovered that the total exposure of the defendants Insurance Company was only $1M. By knowing the law, then being polite & co-operative with the defense, we had a settlement, for the full amount, only 26 months after the wreck. Not the more common, partial settlement, in 4 to 6 years! Most Appellate Attorneys get involved when the case goes to trial. Tom, however, was present from the beginning, even coming to house & crawling around the damaged vehicle; in a suit & tie! His expertise helped guide the team in general & made the critical definitive decision on which state to bring the lawsuit in. That decision, I’m told, was based on something, “only one in a thousand attorneys,” would have known. We feel that Tom is a highly skilled & experienced Attorney with integrity & character, who honestly cares about his clients.

susan edwards was a great lawyer, so i thought. she was attentive, and she seemed to follow through with her word. i thought i had got so lucky seeing how she and i came to cross paths..... she was my court appointed attorney. all i knew of "court appointed" attorneys was what i saw in movies and had "heard" from a few girls i met years before, needless to say, it was not encouraging. susan edwards is a lawyer of the worst kind, she led me on to believe i was in good hands, then dumped me off to a stranger for personal gain........i also thought she was "helping" me out with a personal issue, and with that one she just disappeared. and one of my cases ended very badly, and the other is still floating around while i continue to get screwed. do not trust susan edwards

Ms. McNamara came highly recommended to me. Ultimately, and after spending lots of money over many months, I really felt that she cared much more about her reputation in the legal community and how opposing counsel felt much more than helping me get through an awful situation in my life quickly and equitably. She had good attention to detail but ultimately failed to help me in any tangible way. We turn to attorneys to help us navigate the complex legal system and advocate for us and I did not feel I received these things even a little bit from Ms. McNamara. I was genuinely surprised at how poor my experience was given how highly recommended she was to me and how much money I wasted. Would never hire her again.

This unprofessional thing will not work for you. Instead she will have backroom meetings with the opposition and judge against her own client. She will take your money and have you do all the leg work while dragging her feet on your case and refuse to return your calls and messages for assistance. I would not believe any of the positive reviews because there probably fake accounts or people she asked to post positive reviews on her behalf. CHECK HER PROFILE UNDER STATUS AND YOU'LL SEE SHE'S BEEN DISCIPLINED BY THE STATE LICENSING AUTHORITY IN 2019.

What an Appeals Lawyer Can Do for You

An appeals lawyer specializes in representing clients in appellate courts, challenging or defending lower court decisions. If you believe that a legal error was made during your trial or that the court’s decision was unjust, an appeals lawyer can help you appeal the ruling to a higher court. They work to identify mistakes made during the trial, such as improper application of law, exclusion of key evidence, or jury misconduct. On the other hand, if you're defending a favorable judgment, an appeals lawyer can help protect the decision from being overturned.

Appeals lawyers don’t retry the case but instead focus on legal arguments and procedural issues to convince the appellate court to either overturn, modify, or uphold the lower court’s decision.

When Should I Hire an Appeals Lawyer?

Hiring an appeals lawyer is necessary when you are involved in a legal appeal, either as the appellant (the party appealing the case) or the appellee (the party defending the lower court’s ruling). Common situations in which you should hire an appeals lawyer include:

  • Appealing a conviction or ruling: If you’ve been convicted in a criminal case or lost a civil case and believe the decision was based on legal errors or improper procedures, an appeals lawyer can review the case and file an appeal on your behalf.
  • Challenging a sentence: In criminal cases, if you feel that the sentence is excessively harsh or not in line with legal standards, an appeals lawyer can work to reduce or modify the sentence.
  • Defending a lower court ruling: If the opposing party has filed an appeal to overturn a favorable ruling, an appeals lawyer can help defend the judgment and argue that the lower court’s decision should be upheld.
  • Complex legal issues: If your case involves complicated legal issues or interpretations of the law, an appeals lawyer can provide the necessary expertise to argue those points effectively before an appellate court.
  • Reviewing trial errors: Appeals lawyers can examine whether mistakes such as jury misconduct, improper exclusion or admission of evidence, or incorrect jury instructions occurred during the trial.

You should hire an appeals lawyer as soon as you decide to appeal or are informed that the other party is appealing the case, as appellate procedures are time-sensitive.

What Does an Appeals Lawyer Do?

An appeals lawyer provides specialized legal services to challenge or defend a lower court decision. Their role focuses on legal arguments, reviewing the trial record, and persuading the appellate court to either reverse or uphold the ruling. They can:

  • Review the trial record: Appeals lawyers meticulously review transcripts, evidence, and rulings from the original trial to identify any legal errors or procedural mistakes that could be grounds for appeal.
  • Prepare and file briefs: Appeals lawyers write legal briefs that present persuasive arguments to the appellate court. These briefs focus on the legal errors made during the trial and how they affected the outcome.
  • Present oral arguments: In many appeals, lawyers present oral arguments before a panel of judges, explaining why the lower court’s decision should be reversed or upheld based on legal principles.
  • Monitor case law developments: Appeals lawyers stay updated on changes in the law and precedents set by higher courts, which can be crucial in shaping the arguments they present during the appeal.
  • Provide legal advice on the likelihood of success: Appeals lawyers can offer a realistic assessment of your chances of winning the appeal based on the legal errors and evidence from the trial.

How Are Appeals Lawyers Paid?

Appeals lawyers typically charge for their services based on the complexity of the appeal and the amount of work required to prepare briefs and present arguments. Common payment structures include:

  • Hourly rate: Many appeals lawyers charge by the hour due to the significant amount of research, writing, and preparation involved in appeals. Hourly rates can range from $200 to $600 or more, depending on the lawyer’s experience and the case’s complexity.
  • Flat fee: For some straightforward appeals, a lawyer may charge a flat fee that covers all the work necessary to complete the appeal.
  • Retainer fee: In complex or high-stakes appeals, a lawyer may require a retainer, an upfront payment that covers the initial stages of the appeal. The lawyer then bills against this retainer for ongoing work.

It's important to discuss fees and costs upfront with your lawyer during the initial consultation to ensure you understand the financial commitment involved.

How Much Does an Appeals Lawyer Cost?

The cost of hiring an appeals lawyer varies depending on factors such as the complexity of the case, the lawyer’s experience, and the amount of work involved. General cost estimates include:

  • Straightforward appeals: For simpler appeals, such as those involving minor legal errors, fees can range from $5,000 to $15,000, depending on the scope of work.
  • Complex appeals: Appeals that involve complicated legal issues, multiple grounds for appeal, or high-stakes outcomes can cost anywhere from $20,000 to $100,000 or more, especially if the case requires extensive legal research, brief writing, and oral arguments.
  • Hourly rates: Many appeals lawyers charge hourly rates ranging from $200 to $600 per hour, with higher rates often associated with more experienced attorneys or particularly challenging cases.

Before proceeding with your appeal, it’s crucial to ask for a clear estimate of the costs involved so you can budget appropriately.

Top Questions to Ask an Appeals Lawyer

Before hiring an appeals lawyer, it’s essential to ask questions to ensure they are well-suited for your case and that you understand the appeals process. Important questions include:

  1. What experience do you have with appeals?
Ensure the lawyer has substantial experience handling appellate cases, particularly in the area of law relevant to your case (e.g., criminal, civil, family, etc.).
  2. How do you charge for appeals?
Ask whether the lawyer charges an hourly rate, a flat fee, or a retainer, and request an estimate of the total costs for handling your appeal.
  3. What is the likelihood of success for my appeal?
A good appeals lawyer should provide an honest assessment of your case’s strengths and weaknesses and the chances of winning the appeal.
  4. How long will the appeal process take?
Ask for an estimate of how long the appeal process might take, from filing the initial briefs to a final decision by the appellate court.
  5. Will you personally handle my appeal?
In larger law firms, junior attorneys or legal assistants may handle some of the research or drafting. Clarify who will be responsible for preparing and arguing your case.
  6. What is your approach to handling appeals?
Some lawyers may be more inclined to focus on procedural issues, while others emphasize broader legal arguments. Make sure the lawyer’s approach aligns with your goals.

How to Check the Credibility of an Appeals Lawyer

To ensure that you’re hiring a reputable appeals lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for appellate experience: Review the lawyer’s website or profile to ensure they specialize in appellate law and have successfully handled appeals similar to yours.
  • Check client reviews and testimonials: Look for client feedback on platforms like Avvo, Martindale-Hubbell, or Google to get insight into the lawyer’s track record and client satisfaction.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their expertise and success in handling appeals.
  • Look for recognition in appellate law: Membership in organizations like the American Academy of Appellate Lawyers (AAAL) or awards and recognition in appellate law can indicate a lawyer’s expertise in this specialized area.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with an appeals lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Trial transcripts and court records: The lawyer will need a complete record of the original trial, including transcripts, motions, exhibits, and the final judgment or order.
  • Legal briefs from the trial: If any briefs or motions were filed during the trial, bring copies so the appeals lawyer can review the legal arguments that were presented.
  • Written decision or verdict: Bring the court’s written ruling, verdict, or decision so the lawyer can identify any potential errors or issues to raise on appeal.
  • Questions about the appeal process: Write down any questions you have about the appeal’s timeline, costs, and potential outcomes.
  • List of potential legal errors: If you believe specific mistakes were made during the trial (e.g., improper evidence, legal misinterpretations), provide a list of those issues.

Being well-prepared for your consultation allows the lawyer to assess your case more effectively and provide the best guidance on how to proceed with your appeal.
