Avoid these attorneys at all costs. I was a customer for 10 years, my original attorney left and we decided to stay. The new attorney makes me extremely uncomfortable. We asked him to help with a simple lease assignment. He ended up bringing on an additional attorney, charged us almost $10,000 for a very common/simple review. We did not ask for 2 attorney's to review this. When communicating with the attorneys they go out of their way to drag out conversations, they act like they don't comprehend what you say and then draw out the conversations to make it look like they actually were getting work done. Most recently, we were potentially acquiring another unit in our franchise. I specifically told them NOT to file paperwork or work on this. Today, we received a bill where they want to charge us for the work I specifically told them not to do. And to top it off, they are claiming that both attorney's put work in on this when they were told not to. I would not trust this company, it seems like have lost their principles, lack transparency, and are deceitful in their practices.

I would not recommend. During my consult I was given incorrect information about home buying/trusts. My lender and their attorney sent me an email with the correct information. I called and asked if I could email this to the office so it could be written up. Secretary said he needed to talk to me (which I already did at the consult), so I asked if I could give her my lender's number because he will have better insight on what is needed. She said he could but he still would have to talk to me since I'm his client (already spoke about my issues and concerns at consult). At this point my confidence for services here are gone since he already provided wrong information, so I told her I would just try to get this done elsewhere. Secretary was pleasant and professional- she is the only reason it's not a one star.

My wife and I hired Brian to help out with a pretty scary legal issue. I was worried we would lose everything, but Brian got everything fixed up and squared away with just a couple of meetings and in a reasonable amount of time. It would be better to have never had to hire a lawyer in the first place, but Brian sure made us feel a lot better while our case was going on. I’d hire him again.

For anyone considering hiring this firm for divorce representation, I highly encourage you to reconsider. Upon retaining them for my own proceeding, I had thought I was hiring the best in Cleveland. In every aspect I felt I was under-represented and there was a complete disregard for communication and explanation of processes. Unanswered emails, phone calls never returned, attempts to reach out to senior partners (that never responded) to try and resolve matters. In short, I can only say that as one of the most stressful situations you will face in life, it is my opinion that you will only be compounding that stress in hiring this firm. A truly disappointing experience.

I do not often take time to review a business, I did wait and think about whether reviewing this business was necessary. If I save one person from wasting time it is worth it. Getting an appointment with Ms. Burley was not the problem, you can set that up online. She did have to reschedule and emailed me right away with other options, not a big deal I am flexible. Her office is a small room in connection with an optometry clinic (I think she owns), again no big deal. I do not judge people on where they work or what it looks like, only the job they do and the type a person they turn out to be. I add this in because she is not a huge company just a small business. The consultation was good and she did not charge me. She was a bit unorganized(again to each their own if you do the job), she was knowledgeable and seemed optimistic and honest. I left her office with items I needed to get back to her, she too, was going to get me the information to pay her in the next day or so. I sent her the requested information, a few questions (total of like 3), moved around some funds so I could pay her that night. I needed the questions answered so I could start to orchestrate my situation with other people, and I wanted to make sure she was paid. I did not receive a reply, after a week and a half I called just to see if she had received my emails. Her receptionist answered said she was really busy that week give her time and that she would shoot over the information for payment. After three weeks and few calls I still had not heard anything from Ms. Burley. No answer on my emails, no explanation, still no information for how to pay. I was not rude ever, not to her, or to her assistant. The last phone call her assistant did seem a little short with me. This time the assistant put me on hold, when the she came back she told me that “Ms. Burley could not see me and that due to my time constraints I should take my business elsewhere.” I waited three weeks to get that reply via her assistant. I was crushed, now I must go through this all over again. I only needed guidance on a few items, also I wanted her to be paid. Honestly the questions I needed answered and the website to pay her would have taken 30 minutes’ tops, I did not have an expectation of her drawing up the paperwork or any extensive digging of information at that time. So, if you are expecting communication or commitment I would find another lawyer because she has neither characteristic.

If she is appointed to your case as a Guardian Ad Litem, I’d recommend your attorney request another one. She was nearly impossible to get in contact with (emails nor phone calls), and she literally waited until the night before her report was due to write it. She saw me interact with my child that I had not seen for a year for only a short period of time (not enough for a decision of this magnitude), and left out or didn’t go into depth about important factors of the case in her report, such as evidence I had shown her. When I met her, she spoke of her job as a realtor and how she was dealing with a client rather than discussing my case. If you research her you’ll see that she has other interests and it is my opinion that she uses this as quick side money. She gets paid $2,000 upfront and does a few hours of work at most while just quoting whatever you say to her in her reports to fill the pages to make it look like she did her job.

If I could give less than one star, I would. As an "impartial" guardian ad litem, she outright LIED in her report to the court. Lied. I'll stand by that. She is not impartial, and I find it no coincidence that she tends to favor fathers as does the magistrate who appointed her. Be wary around her.

Mr. Spiroff was my attorney for my Chapter 13 bankruptcy, which I just recently finished. When I was at court at the beginning of my case, I saw another attorney come in who had to call out his clients' names, because he did not know who they were/what they looked like. Mr. Spiroff and his employees always remember me and remember details of my case. He was able to answer any questions that I had, and helped me through this difficult process. I would definitely recommend him to others.

I was without work and needed to file for relief under the Bankruptcy Laws. I was advised by the Staff at this firm to get a job and that they would work with me. During the time I was looking for a job, my truck was repossessed as well as my house went up for Sherriff's Auction. I was just barely able to save my house by filing a Chapter 13 at the very last minute. I should have been counseled to go Chapter 7, but it turns out that Mr. Spiroff Only does Chapter 13. I feel, and it is my opinion, that I was misled and given very poor advice. My original attorney was replaced suddenly on a Sunday Morning and I ended up working with Mr. Spiroff directly. I subsequently refiled a Chapter 13 with a much better attorney (in my opinion) and have been very happy with the results. I was very disappointed in the professionalism (or in my opinion, a lack of) with this firm.

Justin is eager to take money for a case but does very little to follow up. He does not return emails or phone calls. I am now intervening on this situation for my daughter who first began a bankruptcy case with Justin over two years ago! Today I emailed him that I have hired another bankruptcy attorney, will be reporting him to the Cleveland Board and contacted my personal lawyer to look into Justin's work ethic. My daughter has made numerous phone calls and sent endless emails to Justin with almost no reponse from him. What a Bankruptcy Lawyer Can Do for You

A bankruptcy lawyer specializes in helping individuals and businesses manage overwhelming debt by filing for bankruptcy or exploring alternatives to bankruptcy. They guide clients through the complex legal process of discharging or restructuring debts, represent them in court, and work to protect assets such as homes and cars. Bankruptcy lawyers can also help stop creditor harassment, wage garnishment, and foreclosures through bankruptcy protections.

If you're facing financial hardship, a bankruptcy lawyer can help you decide whether filing for bankruptcy is the right option and assist you through the legal process.

When Should I Hire a Bankruptcy Lawyer?

You should consider hiring a bankruptcy lawyer in the following situations:

  • Unmanageable debt: If you're unable to pay your bills and debts are piling up, a lawyer can help you explore options such as Chapter 7 or Chapter 13 bankruptcy.
  • Foreclosure or repossession: If your home is at risk of foreclosure or your vehicle is in danger of being repossessed, a bankruptcy lawyer can help you use bankruptcy protections to prevent this and potentially reorganize your debts.
  • Wage garnishment: If your wages are being garnished, filing for bankruptcy can stop garnishments and allow you to regain control of your finances.
  • Creditor harassment: If creditors are constantly calling or sending collection notices, a bankruptcy lawyer can stop these actions by filing for bankruptcy, which enacts an automatic stay that halts collection activities.
  • Small business debt: If your business is struggling with debt and cannot meet financial obligations, a lawyer can help you file for Chapter 11 (reorganization) or Chapter 7 (liquidation) bankruptcy.
  • Medical debt or credit card debt: If you have large amounts of unsecured debt like medical bills or credit card balances, a bankruptcy lawyer can help you seek relief through Chapter 7 or Chapter 13 bankruptcy.

Hiring a bankruptcy lawyer early in the process can prevent further financial damage and help you choose the best legal option for debt relief.

What Does a Bankruptcy Lawyer Do?

A bankruptcy lawyer provides a range of services to help individuals and businesses handle their debts. Their responsibilities often include:

  • Evaluating your financial situation: Assessing your income, assets, debts, and expenses to determine if bankruptcy is the right option and which type of bankruptcy (Chapter 7, Chapter 13, or Chapter 11) best suits your situation.
  • Filing bankruptcy petitions: Preparing and filing the necessary documents to initiate your bankruptcy case, ensuring that all legal requirements are met.
  • Stopping creditor harassment: Once the bankruptcy case is filed, an automatic stay is enacted, which stops creditors from pursuing collection efforts. A lawyer ensures this protection is applied immediately.
  • Representing you in court: Representing you in court proceedings, including meetings with creditors and any hearings related to your case.
  • Negotiating with creditors: In Chapter 13 or Chapter 11 bankruptcies, negotiating a repayment plan that restructures your debts and allows you to manage payments more effectively.
  • Advising on asset protection: Guiding you on how to protect certain assets, such as your home or retirement savings, through available bankruptcy exemptions.
  • Explaining the impact on your credit: Informing you about how bankruptcy will affect your credit and advising on steps to rebuild your credit post-bankruptcy.

How Are Bankruptcy Lawyers Paid?

Bankruptcy lawyers typically charge for their services in different ways depending on the complexity of the case and the type of bankruptcy being filed. Common payment structures include:

  • Flat fee: Many bankruptcy lawyers charge a flat fee for handling Chapter 7 or Chapter 13 bankruptcy cases. This fee usually covers the entire process, from preparing and filing paperwork to representing you in court.
  • Hourly rate: For more complex cases, such as Chapter 11 bankruptcy (often used by businesses), some lawyers charge an hourly rate. Hourly rates typically range from $150 to $500 or more.
  • Retainer: In cases where ongoing legal services are required, such as in Chapter 11 bankruptcies or complex Chapter 13 cases, a lawyer may request a retainer, which is an upfront payment billed against as the lawyer works on the case.

It’s important to discuss fees with your lawyer upfront, as bankruptcy law requires lawyers to disclose all fees and ensure they are reasonable and fair.

How Much Does a Bankruptcy Lawyer Cost?

The cost of hiring a bankruptcy lawyer varies depending on the type of bankruptcy and the complexity of the case. General cost estimates include:

  • Chapter 7 bankruptcy: For individuals, legal fees usually range from $1,000 to $3,500. This flat fee generally covers the entire process.
  • Chapter 13 bankruptcy: For individuals filing Chapter 13, legal fees typically range from $2,500 to $6,000. This cost is higher because of the additional work required to create and manage the repayment plan.
  • Chapter 11 bankruptcy (for businesses): Chapter 11 bankruptcy is more complex and usually more expensive, with legal fees ranging from $10,000 to $50,000 or more, depending on the size of the business and the complexity of the debt restructuring.
  • Filing fees: In addition to legal fees, there are also court filing fees, which are $338 for Chapter 7 and $313 for Chapter 13 as of 2024.

Always ask for a detailed cost estimate during your consultation to understand what services are included and whether payment plans are available.

Top Questions to Ask a Bankruptcy Lawyer

Before hiring a bankruptcy lawyer, it’s important to ask key questions to ensure they have the experience and knowledge to handle your case effectively. Key questions to ask include:

  1. What experience do you have with bankruptcy cases?
Ensure the lawyer has experience handling cases similar to yours, whether it's Chapter 7, Chapter 13, or Chapter 11 bankruptcy.
  2. How do you charge for your services?
Clarify whether the lawyer charges a flat fee or hourly rate, and ask for a detailed breakdown of costs, including filing fees and additional expenses.
  3. Which type of bankruptcy is best for me?
Ask the lawyer to explain whether Chapter 7, Chapter 13, or Chapter 11 is the best option based on your financial situation and long-term goals.
  4. What debts can be discharged?
Ask which of your debts will be forgiven through bankruptcy and which debts (such as certain taxes or student loans) may not be dischargeable.
  5. How long will the process take?
Bankruptcy cases can take time to resolve, so ask the lawyer how long they expect the process to last, from filing to discharge.
  6. Will I be able to keep my assets?
Ask if you will be able to keep important assets, such as your home or car, and what exemptions might apply.
  7. What happens after bankruptcy?
Ask about the impact of bankruptcy on your credit score and what steps you can take to rebuild your credit after the bankruptcy is finalized.

How to Check the Credibility of a Bankruptcy Lawyer

To ensure you are hiring a reputable bankruptcy lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for bankruptcy experience: Review the lawyer’s website or professional profile to ensure they specialize in bankruptcy law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and ability to handle bankruptcy cases.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have worked with them on bankruptcy matters.
  • Check for certifications or memberships: Look for lawyers who are members of organizations such as the National Association of Consumer Bankruptcy Attorneys (NACBA) or who have specialized bankruptcy law certifications.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a bankruptcy lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • List of debts: Prepare a detailed list of all your debts, including credit cards, personal loans, medical bills, and any secured debts such as mortgages or car loans.
  • Income and expense records: Bring documents that show your current income, such as pay stubs or tax returns, and a list of your monthly expenses, including rent, utilities, and other essential costs.
  • Asset information: Provide information on any assets you own, such as your home, car, investments, or other valuable property.
  • Credit reports: If possible, bring copies of your credit reports to give the lawyer a clear view of your financial situation.
  • Questions for the lawyer: Prepare a list of questions you have about the bankruptcy process, the lawyer’s fees, and what to expect after filing for bankruptcy.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and provide the best possible legal advice tailored to your needs.
