I called The Nourmand Law Firm about not receiving my meal breaks and not being paid properly. From the minute that I met Mr. Nourmand he made me feel comfortable and explained the process to me. After a year he settled my case as a class action and to date I receive calls from my former co-workers thanking me for standing up for my rights and their rights.

My co-workers and I weren’t being paid correctly. We all had a sense of something wrong, but couldn’t quite pin down the details. Without the details, we saw no way of clarifying the pay questions. However, separately, we asked our employer about this, in case there was a mistake or some other explanation. None was offered. Most of us, including myself, found better employment. Some of us kept in contact discussing the former employer’s actions wondering if there was some solution such as State involvement. Labor Board, etc. Even though I didn’t have a lot of research time, I found “Ackermann & Tilajef, P.C.” After the first consultation, I told many of my friends and former co-workers. Turned out that we had a class-action law suit. Working with Craig Ackermann, Mike Malk, The paralegals, and all their excellent interns, was more than a business relationship for me. It was an excellent educational experience. The lessons I’ve learned are as valuable as the compensation they recovered. One valuable lesson is the machinations some employers continually go through to rip off their employees. I ask: “Isn’t it cheaper to obey the law, pay what you’re obligated to, rather than pay company lawyers?” The answer is obviously: “No.” However, with Craig, Mike, and their associates. Such employers might reconsider their legal strategies. Like, obey the laws in the first place. I am very grateful to Craig. You didn’t just get compensation for me and my co-workers. You got us our confidence back, knowing that someone’s watching out for the working folk.

I would not have been as successful in my claim without his help. He is very experienced in dealing with the Labor Commissioner and other lawyers. I trusted him and felt he was always on my side.

I had just been laid off from my job of 16 years when I contacted Kevin (a referral from a friend) to find out how much he would charge to review the lay-off agreement I was supposed to sign before I could receive my severance. Kevin was amazingly helpful. I wasn't expecting that. He seemed genuinely concerned and asked many questions. I felt that all his comments were very useful and they helped give me clarity regarding my rights. At the end of our conversation, he told me to send him the agreement and he would give it a quick review at NO COST! I was shocked but very, very grateful he would do this for me. Within the day, he had emailed me his comments and concerns. I really felt he was looking out for my best interests. His comments enabled me to go back to the company that laid me off and communicate changes that I wanted made to the agreement. Kevin is one of those lawyers who really cares and isn't just focused on fees and billable hours. He is the kind of lawyer that is the "good guy" in movies.

I am so grateful, that I wanted to thank Mr. Kemnitzer publicly and to alert others with a bad car deal to contact him, especially a teenager like me that desperately needed help. I went to purchase a vehicle at and ended up with a nightmare of a contract of about $55,000, which made up of being; overcharged for the vehicle, inflated negative equity on my leased vehicle, and adding an additional $8800 of worthless accessories and insurances. This all happened without the dealership checking my ability to pay for this huge amount. I am very thankful that Mr. Kemnitzer took my case on a contingency. He seemed to immediately grasp the situation and using his knowledge of the law, knew exactly what buttons to push to get the deal done. He showed compassion and at the same time guided me on how to purchase a car in the future from dealerships that use hard sells tactics. He quickly reached a settlement to unwind the deal by cancelling the contract. I walked away without owing the dealer anything. It was an incredible outcome for me. I would highly recommend Mr. Kemnitzer for his knowledge, expertise and negotiating skills that prevented me from having to file bankruptcy and having poor credit for many years to come.

Bryan Kemnitzer is a very bright attorney, with great skills as a negotiator as proven by the very desirable results he accomplished for us on two occasions one in 1993 and again in 2016. In each case he has shown extreme knowledge of the law, the ability to negotiate from a position of strength and to reach agreement quickly. There was no Avvo during my first experience in 1993. So since he just completed our second case with my wife's granddaughter, I wanted to take the opportunity to write about my experience on Yelp to emphasis the importance of having an asset such as Bryan on your side. I had a used 1990 Allante with about 32,000 miles. One day the entire brake system failed and had the vehicle towed to the dealer. I began to negotiate with General Motors to replace my car with a brand new one. We reached the point where GM staff could not go the distance to meet my demand. At this point I needed an attorney to close the deal and wrap it up. Bryan was that person. He carefully reviewed the frequency of visits to the Cadillac service center and determined on the spot that the Lemon Law was applicable in this case. He took the case on a contingency basis. He wrote a great letter following the law, detailing damages, loss of use, and penalties. This is where Bryan really shines because once GM received his letter, they responded by agreeing to provide me with a brand new 1993 Allante, at no cost to me. GM also paid the attorney fee. I would recommend to anyone that is confronted with a car deal that has gone sour to contact Bryan. Based on my first experience we turned to Bryan again for a case involving strong tactics used by dealer to sell a 19 year old an expensive vehicle that exceeded her ability to pay and then to make matters worse added worthless accessories to further increase the price. Bryan again displayed his prowess to negotiate and was successful in unwinding the deal. This was an incredible outcome for our granddaughter. It taught her a great lesson without the pain of having to go through bankruptcy and bad credit for many years. We are very grateful and would highly recommended Bryan Kemnitzer to anyone.

I want to thank with all my heart, Bryan and The Kiesel law firm...with special thanks to Bryan, Lance, Ashley, Ken and of course Paul for doing an outstanding job for our family. Our family experienced a horrible tragedy that took the life of my mother. Bryan and his team became our hope for justice! They, as a team guided me through on what seemed to be an unbearable journey and made it comfortably manageable. Money does not bring back our loved ones and money does not fix what is broken but, it is a necessary tool and makes it easier when you’re struggling and stressed on a different different level. Thank you Kiesel law firm for making mine and my family’s struggles easier! Amazing team!!!!

Paul Denis is a tremendously talented Employment / Labor law attorney with a knowledge base that is not limited to Employment / Labor issues but expands to include expertise in a variety of areas of legal matters such as Class Action. He was very responsive to me with regard to any of my urgent matters, but there were times when general communication was not as timely as I liked it to have been yet he responded by email, text and phone during the early morning and late evenings. HE DOES HAVE OTHER CLIENTS…he cannot be at my disposal every second of the day. RIGHT? Giving me even more assurance that HE WAS ON THE JOB in regard to my D.F.E.H. mediation, expanded litigation against employer in regard to civil rights violations and overtime, meal break issues. To that end, I feel that Paul Denis is a competent attorney who knows his business. As far as I have experienced, Paul is the best! Truly he is. I would definitely be interested in having Paul represent me regarding any legal matters that I may encounter in the future.

I am a Plaintiff in a case and she has patiently listened to hours of details regarding my case. Kate Hartman not only understands the information provided to her - she is able to communicate this information in the depositions and when filing declarations, interrogatories, etc. Although I know Kate has other cases and work to do, when I call with a question, she is available to take my call and makes me feel as if I am her only client. She is able to listen without interrupting and after each meeting, phone conversation with Kate I feel confident that she knows what she is doing. I do expert testimony and spend a lot of time with attorneys and in court and I highly recommend Kate Hartman as a very qualified and proactive Attorney.

I had an insurance claim that the insurance company quickly denied coverage for. An attorney friend referred Mr. Les Robertson to me because he's an expert in insurance coverage and has a great reputation. Since the first conversation, Mr. Robertson was warm, empathetic, and very clear at explaining the law related to my situation. He told me the insurance should have provided the coverage and was willing to help. In a surprise turn, the insurance company changed their mind a couple of days later and decided to cover for the claim. I didn't need to work with Mr Robertson further but I will not hesitate at all to reach out to him again if there is a need. Highly recommend him!

I contacted Joshua Fields's firm Kirtland & Packard regarding a potential class action law suit. He returned my call within the hour and discussed details with me for a full hour!! The consultation was not a part of his schedule for the day, but he even put effort into researching my issue before he called me! He took his time discussing with me, asking questions, and researching my issue. I felt like I was talking to a therapist. His communication style is validating & empowering. I contacted him earlier than when I anticipated I'd actually need him, so he continued to reach out to me on his own time to ask for updates for several months!! We subsequently had multiple lengthy conversations. He is thorough, always on time, and very organized despite how complex my issue was. Thankfully my issue was resolved, but he was so ready and supportive to fight for my rights. I highly recommend him, with no hesitation!!

What a Class Action Lawyer Can Do for You

A class action lawyer specializes in representing groups of individuals who have suffered similar harm or injury due to the actions of a company, organization, or government entity. These lawyers file lawsuits on behalf of a large group (the "class") of individuals, seeking compensation or relief for damages caused by things like defective products, environmental harm, consumer fraud, or employment violations. Class action lawyers are skilled in managing complex legal processes that involve numerous plaintiffs and large-scale legal claims.

If you’ve been harmed by a product, service, or corporate action that also affected many others, a class action lawyer can help you join or initiate a collective lawsuit to seek justice and compensation.

When Should I Hire a Class Action Lawyer?

You should consider hiring a class action lawyer if you and a group of people have experienced harm or damages under similar circumstances. Common scenarios include:

  • Defective products: If a product you purchased caused injury, illness, or other harm due to a defect, a class action lawyer can help you join a lawsuit against the manufacturer or retailer.
  • Consumer fraud: If a company has misled consumers through false advertising, deceptive business practices, or scams, a class action lawsuit can be filed to seek compensation on behalf of all affected customers.
  • Employment violations: If your employer has violated labor laws - such as failing to pay overtime, denying benefits, or enforcing discriminatory policies - a class action lawyer can represent a group of employees seeking justice.
  • Data breaches: If a company’s negligence led to a data breach that compromised your personal information, you may be able to join a class action lawsuit seeking compensation for the breach.
  • Environmental damage: If you or your community has been harmed by environmental hazards, such as pollution or toxic waste, a class action lawyer can file a collective lawsuit against the responsible party.
  • Unfair financial practices: If a bank, lender, or credit card company engaged in fraudulent or illegal financial practices, a class action lawyer can help a group of consumers recover losses.

Hiring a lawyer early in the process helps ensure that you meet legal deadlines and that your case is properly prepared for a potential class action lawsuit.

What Does a Class Action Lawyer Do?

A class action lawyer provides a range of legal services to represent large groups of individuals in lawsuits. Their responsibilities often include:

  • Investigating the claim: The lawyer investigates the facts of the case, including gathering evidence of harm, identifying potential plaintiffs, and determining whether a class action lawsuit is the best course of action.
  • Filing the lawsuit: The lawyer files the class action lawsuit on behalf of the named plaintiffs (the representative plaintiffs) and others who have experienced similar harm.
  • Class certification: One of the first steps in a class action is getting the court to certify the case as a class action. The lawyer will argue that the case meets the legal requirements for certification, such as the number of plaintiffs and commonality of harm.
  • Communicating with plaintiffs: Class action lawyers keep plaintiffs informed throughout the process, including notifying potential class members about the lawsuit and giving them the opportunity to join the case.
  • Negotiating settlements: Many class action lawsuits are resolved through settlements before going to trial. The lawyer will negotiate with the defendant to reach a settlement that compensates the class for their losses.
  • Representing the class in court: If the case goes to trial, the lawyer will represent the entire class, presenting evidence, questioning witnesses, and arguing for the plaintiffs.
  • Managing claims distribution: Once a settlement or verdict is reached, the lawyer helps manage the process of distributing compensation to class members, ensuring that all eligible plaintiffs receive their share of the award.

How Are Class Action Lawyers Paid?

Class action lawyers are typically paid on a contingency fee basis, meaning they only get paid if the class action lawsuit is successful. Here’s how their payment structure generally works:

  • Contingency fee: Class action lawyers usually take a percentage of the settlement or judgment as their fee. This percentage typically ranges from 25% to 40%, depending on the complexity of the case and the amount of work involved.
  • No upfront fees: You generally won’t have to pay any fees upfront. The lawyer covers the costs of the lawsuit, such as filing fees, expert witness fees, and court costs, and is reimbursed from the settlement or award.
  • Court approval of fees: In class action cases, the court must approve the lawyer’s fee to ensure that it is reasonable. This helps protect class members from paying excessive legal fees.

Always discuss fee arrangements with your lawyer at the outset to understand how much they will be paid if the lawsuit is successful.

How Much Does a Class Action Lawyer Cost?

Class action lawyers generally work on contingency, meaning they don’t get paid unless the lawsuit is successful. Here’s a breakdown of potential costs:

  • Contingency fee: Class action lawyers typically charge between 25% and 40% of the settlement or judgment. For example, if the lawsuit settles for $10 million and the lawyer’s fee is 30%, the lawyer would receive $3 million, and the remaining $7 million would be distributed to the class members.
  • Court costs and expenses: In addition to the contingency fee, the lawyer will deduct the costs associated with the lawsuit, such as court filing fees, expert witness fees, and investigation costs. These costs are usually reimbursed from the settlement or award.
  • No cost if the case is lost: If the class action lawsuit is unsuccessful, you typically won’t owe any legal fees or costs. The lawyer assumes the financial risk of the case.

It’s important to discuss potential costs and fee structures with your lawyer before the case proceeds to ensure transparency and avoid any surprises.

Top Questions to Ask a Class Action Lawyer

Before hiring a class action lawyer, you should ask key questions to ensure they have the experience and skills needed to handle your case effectively. Key questions to ask include:

  1. What experience do you have with class action lawsuits?
Ensure the lawyer has a successful track record of handling class action cases, particularly in the area of law relevant to your case (e.g., consumer fraud, employment, defective products).
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee, and ask for a detailed explanation of what percentage they charge and how expenses will be handled.
  3. What are the chances of success in my case?
Ask the lawyer for an honest assessment of the strengths and weaknesses of your case and the likelihood of certification as a class action.
  4. How long will the process take?
Class action lawsuits can take time to resolve, so ask the lawyer how long they expect the case to last, from certification to settlement or trial.
  5. Will I need to appear in court?
Ask if your participation will be required in court or whether the lawyer will handle most aspects of the case on behalf of the class.
  6. What is the expected settlement or recovery?
Ask about potential outcomes, including the expected settlement or damages, and how compensation will be distributed among class members.
  7. What happens if the case is lost?
Confirm that you won’t owe any legal fees or expenses if the case is unsuccessful.

How to Check the Credibility of a Class Action Lawyer

To ensure you are hiring a reputable class action lawyer, take the following steps to verify their credentials and experience:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for class action experience: Review the lawyer’s website or professional profile to ensure they specialize in class action cases and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate in class action lawsuits.
  • Ask for references: A reputable lawyer should be able to provide references from past clients who have been involved in class action cases.
  • Check for certifications or memberships: Membership in organizations like the American Association for Justice (AAJ) or specific class action sections can indicate the lawyer’s expertise in handling large-scale litigation.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a class action lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • Details of the harm you’ve experienced: Provide a clear explanation of the harm or damages you’ve suffered, whether it’s a defective product, financial loss, or harm due to employment violations.
  • Evidence of the issue: Bring any documents, emails, receipts, contracts, or photos that support your claim. If others have experienced the same harm, gather their testimonies or contact information if possible.
  • Information about the responsible party: If you know which company, organization, or government entity is responsible, bring any information you have about them, including names, addresses, or prior legal actions.
  • Questions about the process: Prepare a list of questions about the class action process, your potential role in the lawsuit, and what you can expect in terms of outcomes and timelines.
  • Contact information for other potential class members (if available): If you know others who have been similarly affected, provide their contact information so the lawyer can assess whether they may join the class action.

By preparing thoroughly for your consultation, you can help the lawyer evaluate your case effectively and provide the best legal guidance for pursuing a class action lawsuit.
