Derek was recommended to me after I received my first ever DWI charge. I was very nervous about the journey ahead and all that it would entail. Derek was there every step of the way. He helped explain everything so that I understood what was happening at each court hearing and what would be expected as follow up. I could count on him for my many fears and questions and he helped give me peace of mind along the way. Derek is extremely knowledgeable and he always has a bigger picture plan in mind. Adam Militello was instrumental in getting my DWI reduced to a DWAI. Thanks to Adam, I have no criminal record. (DWAI is a traffic violation in NY state.) I have been able to move past this experience - and now have a new job in a highly regulated industry. Background check for the new job came back completely clear. What a relief that my terrible mistake doesn’t ruin my career. Adam also advised me every step of the way on what I needed to do to position my case in the best light before I went to court. I.e. get a drug test, be evaluated for substance abuse. I called Adam looking for help late on a Friday afternoon - Adam answered the phone directly and offered no judgement- just good advice. When I picked up my 3rd drinking and driving offense I knew I messed up. I reached out to a few different attorneys and determined Tom was the best fit for me and I wasn't wrong. Mr. Splain knew I messed up pretty big as well, but never made me feel worse than I already felt. Tom was able to get this DWI reduced to a DWAI with all the minimum sanctions. Tom's presence in the court room is second to no one and he is clearly very well connected with the players in the judicial system in the greater Rochester area. My biggest hurdle was the DMV hearing. Tom, was able to get the refusal dismissed. Which to my understanding, is like finding a needle in a haystack!
Tom Splain is one of the premier, top notch, defense attorneys around and I highly recommend him when your backs against the wall!

The day following my son’s arrest, we were in a state of shock and immediately hired a different attorney affiliated with one of those DWI firms that you see heavily advertised on billboards. Over the next couple of months, as details of the case emerged, it became increasingly clear that there were issues with the initial stop and inconsistencies with the evidence, but the attorney did not seem to be fully engaged or have mastery of the facts of the case. Often, I would reach out to him when I found an issue and would get no response or a response at the last minute, as if he only looked at the material the morning before the court appearance. Each court date it seemed like he was “going through the motions” with a foregone conclusion that the case would simply be pled down. When I brought up issues with discovery, or the police report, or frustration that no one was reviewing the full facts of the case, I was most often met with a shrug and some comment along the lines of “that’s just how it is in the criminal justice system.” He advised my son to request and accept a plea deal and had us nearly convinced that if we tried to push forward with motions, etc., we were just risking a worse outcome. But this was my kid, and accepting a sentence without anyone really considering the facts of the case just didn’t feel right, so we reached out to an experienced friend for advice and she said, “Fire that guy. You need to hire Ed Fiandach.”
At our initial consultation with Ed, he immediately identified that there were issues with the traffic stop and cited the relevant case law. He said the right next step was to file motions to suppress the stop. “You should never skip the steps,” he said. When I shared that the other attorney told us that filing motions could result in a worse sentence and maybe the plea is the best we can do, Ed said something that put everything in to focus. He said, “Your son hasn’t even had a defense yet.” He gave us confidence that my son shouldn’t just accept the plea deal. Ed and his team filed the motions, and when the hearing happened, Ed knew exactly what to say and do to show that the prosecution had not established probable cause for the traffic stop. To follow-up, he wrote a memorandum of law that was thorough, detailed, and fact-based that clearly supported his motion to suppress the evidence. Ed knows the law inside and out and through his efforts, my son’s case was dismissed.
Throughout the entire process, Ed was responsive when we had questions, patient, and most importantly, kind to both me and my son. I am forever grateful to Ed and his team for helping my family through this difficult situation.

Facing charges in the #1 county for DWI convictions and a strong case against me, Richard was able to reduce my sentencing to the minimum sentence allowed by law. He kept me out of jail, off probation, and I was able to drive with a conditional license. He quickly answered any questions I had. I got charged with aggravated harassment, 2nd degree comm/alarm. I decided to hire this lawyer as a risk, and he was VERY forth coming with my case with honesty, integrity, and dignity. He was very honest about the outcome of the case although he doesn't promise anything, but can lessen the charge to a much lower degree.
I went to court and this fantastic was able to lower the charge from Misdemeanor Class A to ACD (Adjournment in Contemplation of Dismissal); I gladly took it and I was overjoyed!!! No fines, community service, and/or prison time! FANTASTIC LAWYER! HIGHLY RECOMMEND FOR DISABLED PEOPLE!!!!!

I've knowing Mr Easton for roughly 9 years now. I first hired him for a case that involved a hand full of serious charges that stemmed from a car dealer ship that I worked at. This was a very complex case that he actually plowed right through. The coolest thing I remember about that case while besides the fact that we walked away with a slap on the wrist - was when we walked outside just about every lawyer that was there approached Mr Easton like he was the godfather. The respect and honor these lawyers have for him is just astonishing. This guy is by far one of the top 5 lawyers in the state of NY!
