Having decided to rewrite my will, I had to find a qualified attorney. After asking around and not finding anyone, I went online to look up lawyers in my area and read reviews. There were several that sounded good but either didn’t take the time to call me or requested that I make an appointment at $300 an hour. Jay Fox was very gracious. He called me within an hour or two and we talked for maybe 20 minutes to a half hour. He assured me that he didn’t charge for this initial consultation, only if I decided to enlist his services. He was so helpful and detail oriented, unlike me. He thought of everything that I didn’t. He turned an unpleasant chore into a satisfying outcome. I highly recommend this man.

Atty. Jay Fox, is very helpful, knowledgeable and we are very glad that we came across his profile when we were searching on how to start the process of getting trust and will. We could tell that he is very experienced and that he made the process as easy as possible. We could tell that he devoted his time in explaining things to us. We were very intimidated in starting the process but he made us feel reassured and he answered all of our questions. He was available when we needed changes to our documents, very honest and definitely professional. I have recommended him to my friends, coworkers and relatives. He understood our concerns and limitations (being first time in creating trust/ will ). We are extremely grateful that we found him and that he was able to help us with our trust and will creation.

Oh my God! Never in my wildest dream did I ever think I would need a lawyer, but I am blessed to have Mr. Orlando as a friend, who was able to get Mr Scott (my lawyer) to reach out to me ASAP. Being on workman comp really blew through my savings. The firm was very interested in my case and encouraging. When the settlement finally came in, I was satisfied, but my lawyer wasn't. He said, "That's not enough for what you went through, let me see if I can get maybe 5K more for you". Well he did better than that, he got me 12K more! The check cleared and I'm hoping to never need a lawyer again, but if I do this firm will/is my only choice.

The consultation with secretary/answering/paralegal was off putting. She asked questions that made no sense, Then asked why a case was put off by a solicitor for so long? That was a very huge red flag... Next when I told this assistant I wanted to do the attorney consult for $350 she starts asking me more questions? I'm assuming she misheard my request but at this point I was past wanting services with this firm. When I told her thank you but ill look elsewhere, she laughs and says "We've never lost a case". Unfortunately you lost a potential client. So 1 star.

There is not enough kind words in this world to describe how grateful I am for Chris and how hard he worked to help me. I came to him with a difficult situation and he absolutely got me the best out come. I’m more than grateful for him and Tom Womack continues to work tirelessly to end another case we are working on which has been very hard for me, however I trust them with everything because they have proven absolutely worth it. Chris Conowal represented me in two different situations this year. Chris strongly advocated for me and made me feel like I had someone in my corner that was going to fight for me to get me what I wanted. Chris is transparent, honest, and will not put up with nonsense from the opposing party. If you’re looking for an attorney that will fight and work for you, Chris is your guy!

I feel that Chris takes on more than he should and does not allot the appropriate focus needed in certain matters. Several request I made in working with Chris on 2 cases went completely unanswered, most others I would have to ask for more than once. Several administrative mishaps with both cases ranging from mistakes on documents, misunderstanding of court information by his office, and not being made aware of rate increases between the two cases. A lot of promises were made that were never followed through with. Very unpleasant experience.

After my father passed unexpectedly without a will, there was a bit of running around needed in order to take care of the estate. Mr. Bennett was quick to show not only his compassion for the situation but also his willingness to get the job done. Without question, Bob is the best attorney I have had the pleasure of dealing with in 40+ years in the construction business. I am probably 10 years late in doing our Estate planning but the good news is we have picked the perfect lawyer to guide us thru the process. He is well organized, extremely knowledgeable, easy to deal with and you learn very quickly that you have picked the perfect person to put your trust in. He is an absolute pleasure to deal with. He is very attentive to details and prepares the documents in an organized manor. You have a comfortable feeling in dealing with him and you know that he is extremely talented. My only regret is that I did not meet him sooner. Without any reservation I recommend Bob.

Paul was recommended to me when I took my sorority sister to be diagnosed by a psychiatrist for hallucinations. She lived two hours away, had no family and had never been to any doctors, so there was no one to catch the problem early . I looked at the Doctor and said, "ok what do I do now?". He handed me Paul's card and said that he thought I should call him. Well, this was a Godsend. After talking with Paul, I knew exactly what I needed to do. I now have full responsibility for her and he has been with me the whole way from getting her diagnosed with dementia, to helping with all of the legal paperwork and consolidating the finances (after having to find all of them first!) and getting her moved in to an assisted living home where she is getting topnotch care. If you need a responsive and caring lawyer, hire Paul!!

My case didn't look too great after the state picked it up and wanted to prosecute as a felony. I knew it was time to find an acceptional Attourney with a winning attitude. Someone that doesn't like to lose just as much as me. I made the call. Mr. Hamilton's receptionist took down my information and within a short amount of time I was speaking to Paul about my case. He never made any promises or told me we would get it dismissed. He did listen to me and understood my position. I was told clearly what I could expect at worse. The court date arrives. They gave an offer, which Mr. Hamilton politely declined. I left with intentions of trial. 3 hours later I received a call and he told me my case was dismissed and to come handle the paperwork. With all of this being said, your attorney is only as good as your expectations. I would recommend Paul Hamilton to anyone seeking legal advice/council.

Paul brought me down from numerous felonies to just one. If you EVER, have any sort of legal issues at all, Paul Hamilton out of Nashville is who you need to call. I cant even begin to explain what a terrible situation I was in.. and for him to be able to pull off the deal he did says he is a hell of a lawyer. As bad of a situation I was in, and the charges I faced (which were not minor charges).. for him to be able to bring it down to what he did is absolutely amazing. Even with a DUI, I did not lose my license.. Not only did he save my future career, but he ensured that one single mistake did not ruin my life and turn my kids lives upside down. He stays dedicated to the case and truly cares for his clients. He will listen to what you need and he will go above and beyond to make it happen. You cannot go wrong with this attorney. I had so many bad charges and he made them as if they never happened. I can't begin to describe how easy he made the process

Ashley Scarpetta was consulted to learn if our aging father's will needed fine-tuning to accurately reflect and ultimately fulfill Dad's longstanding wishes for his family. Ashley welcomed our concerns by answering our many questions, educating us in a manner that was easy to grasp. Most importantly, Dad had some highly personal, sensitive matters that had to be considered. Ashley instantly responded in a manner that revealed both her extensive knowledge and her own depth of character. Hiring Ashley to convert Dad's outdated will to a trust brought immediate peace of mind to our father and will infinitely simplify matters in the future. Additionally, we now have the added benefit of an updated health directive that we know reflects my father's wishes, were he ever to become incapacitated. We had not even considered this as Dad had previously prepared a living will 20 years prior -and was now out-dated, as we soon learned. Ashley included this in her services with no additional fee, "because it's that important!" I would highly recommend Ashley Scarpetta for estate planning.

Chris helped me navigate appearances in probate court and cooperated with attorneys from other practices. During these interactions, he always provided information which was helpful for me to understand and plan for the various possible outcomes, and was always able to provide the final result which was best for my family. Chris was a wonderful asset during a difficult time.

Chris did a great job representing my father as we applied for his veterans pension. As a result of Chris's work, my dad's application was approved and he was able to move into the assisted living facility he preferred. After my dad's death, Chris represented the estate in filing for probate and he and his staff did a very efficient job of filing and then completing probate. All of these activities were done under a very fair, fixed fee so we knew our costs right up front and there were no surprises. I recommend Chris wholeheartedly to anyone needing elder care legal services.

A while back, I gave my credit card number to a charlatan for a supposed business opportunity. I immediately realized my error, but this man would not cancel the transaction. He had worked this system for quite some time and knew the tricks to abuse the consumer. So, even the credit card company could not help me to recover my funds. Wally stepped in and looked meticulously at the case. He applied extensive knowledge, understanding, and strategy and soon had the swindler begging to settle. Even though this is a simplified version of how Wally helped me, he utillized expertise and professional skill to recover my money with an efficiency that caused me the least possible stress. I will always go to Wally first when I need legal advice. I first went to him because I trusted him as a person. Having worked with him on this case, I found that my instincts were correct. He is the real deal, and he takes seriously his clients' rights and needs.

Everything was explained to us and our children for whatever happens as we get older. I have contacted her several times to answer more questions that I have and she’s always helpful and patient with me. I always feel like she has our best interest.

I hired Mr. Lambert when it became necessary for me to place my father in a nursing home and we needed assistance applying for Medicaid. My father has Alzheimer's and was incapable of handling his own affairs. I am his power of attorney and cared for him in his home for several years. Ours was a difficult and complicated case for many reasons. It took months to work through the process because of all the issues involved. Mr. Lambert went above and beyond what I ever expected him to do and worked tirelessly for me and my father. His knowledge of elder law was invaluable to us. I cannot recommend him highly enough. He is fair and honest and definitely goes the extra mile for his clients. If I could give more than 5 stars, I would certainly do so! I will be forever grateful for the service he performed for us - we could not have done it without him.

John represented me in a rather complex case. Because of his preparatory work and organization of information a State Supreme Court Justice in Ohio could see the facts clearly. As corporate counsel for a large financial institution headquartered in Atlanta, I retained Ms. Ashby to handle several trust termination and/or modification petitions with the Fulton County Court. Ms. Ashby did an excellent job at a very reasonable rate. She is knowledgeable, easy to work with and delivers results within a reasonable time. She has excellent academic credentials having attended the University of Virginia Law School, a top ten law school. Her work history is also impressive. Generally when hiring outside counsel, I consider all of these factors. I was very pleased with her services.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
