Attorney Clement is a most excellent attorney in every aspect. He was there as agreed early in the morning in court driving a good distance. He had all the case & evidence well presented to the court already in such an outstanding amazing way that when it was the moment to present myself before the Judge I literally didn't even have a chance to say my name or good morning Your Honor because as I was ready to say my first word the Judge was already saying that the charges against me were dismissed and I was told to leave immediately I was free to go ! Thank God for Attorney Clement who in my book is the Best of The Best for it is hard to imagine how can a Defense Attorney do better than that ?

I highly recommend Mark Scialdone for anyone facing a difficult or sensitive divorce and/or child custody case. From our first meeting, he showed incredible kindness and sensitivity, making me feel at ease during a tough time. Mark listened to my concerns and provided strategic advice tailored tomy needs. Communication with my ex-husband is not always the easiest, and Mark was empathetic to this situation and made the court process a lot less stressful than it could have been. His calm demeanor and focus on my best interests helped navigate the challenges we faced. Thanks to his expertise, I reached a fair resolution that supports a positive co-parenting relationship. If you need a compassionate and skilled divorce lawyer, look no further than Mark Scialdone!

Franklin was wonderful through my divorce. My emails and questions were answered almost immediately- eve on the weekends- he was so knowledgeable of the court system and how the day pans out, he moved quickly and with purpose. He was informative as to what I should expect and explained the process of a divorce with my goals in mind. When I needed a criminal lawyer, his father stepped in and they worked together with verbiage and a plan to keep my safety in mind. The best part about Franklin was his ability to turn my overly emotional responses into well spoken, matter of fact, statements and represent me in the most professional manner.

Steve refused to do anything. He missed deadlines, he filed motions without my consent and he was unprepared to represent me. He allowed my wife to hide $250k and he told me he couldn’t subpoena bank records because it was too expensive. I fired him and he retaliated against me by refusing to turn over my legal file and he spread rumors about me that he knew to be false. He told me I owed him 60,000 dollars for his ‘representation’ but he refused to give me an actual bill with any kind of explanation. Don’t go near this guy. He is a horrible person

I recently had need of help correcting an old quitclaim deed on a property in Newbury. I live in Colorado now and needed to do this via phone, email, google meet and snail mail. After calling 2 other attorneys in the area several times and never getting a reply, I took another look at attorneys in the area who did title work and discovered the father son team of Phillip Parry Sr. and Jr. They replied to my inquiry in less than an hour. Within a matter of a few weeks they accomplished the task with great ease on my end and efficiency on theirs. I wholeheartedly recommend this team. Called for representation. Told lawyer what I thought about investigator. Glickman is friends with her so didn’t want the case. Not sure about you, but I wouldn’t want an attorney that prioritizes their relationship with the opposing side over a client. This is especially true when the other side lied in writing. But go for it. Maybe him being friends with the person destroying your life is what you want. Not me. I want an attorney who will call it out.

I was disappointed with the response time from this service and generic answer that they could not take the case. After submitting a form to be contacted on a Friday, I received a reply almost six days later. In contrast, when I reached out to another attorney via a form, I was contacted within ten minutes for intake. Later that day, I had a conversation with an attorney about my situation. Timeliness matters, and unfortunately, this service fell short.

Atty Roark is a cruel and callous woman. At her last firm, which went under, on rt 129 Chelmsford, she called in a legal secretary who had just returned to work a WEEK after losing her husband (37 yrs) and asked her "are you ready to move on with your life". Cold-hearted orb that ruled the night. If somebody shows you who they really are, believe them the first time. I could tell by the other comments that she has not changed. Many excellent and kind attorney's are available. Do your homework. Go elsewhere. ⚖️

Atty Nolan was in bed with the DA's office under Michael O'Keefe's rule. He set my daughter up and worked with the DA to lock my daughter up. After 5 1/2 years of waiting for trial, he left my daughter no choice but to take a deal, which he lied to her about the specifics. He said she'd be home in 3.8 years yet no one in MCI Framingham can tell us when she's getting out. Like most women who end up in the legal system, my daughter was a victim of domestic violence, at the hands of her accuser, before she became a defendant, and Attorney Nolan treated her like a common criminal instead. In the end, our family didn't have the courage or wherewithal to hire a new attorney as we had already paid attorney Nolan and his crew an exorbitant amount of fees. We also never saw any of the results of the work from the experts he hired and we paid for. We are convinced Atty Nolan was hiding exculpatory evidence uncovered by the experts, as he continually refused to present to the court exculpatory evidence presented to us by the state. At every turn, if we found contradictory information against the state's evidence, Atty Nolan would blatantly ignore the facts presented and do what HE wanted INSTEAD OF WHAT HIS CLIENT WANTED. He also ignored most emails and phone calls to his office from my daughter's camp over the 5 1/2 year period that we dealt with him. Two weeks after my daughter's incarceration, attorney Nolan posted on his Facebook page that he was endorsing for District Attorney, the prosecutor who initially pressed charges against my daughter (I accused this prosecutor of malicious prosecution and provided the evidence to attorney Nolan to support it, which he completely ignored, as he defended the prosecutor saying that the prosecutor, Dan Higgins, was a "good guy" and that the prosecutor's father was a former FBI agent and reasoned that Higgins wasn't capable of malicious prosecution because of that.) Also, the ADAs on the case are guilty of providing false information in their documents and briefs presented to the court, atty Nolan either willingly ignored the discrepancies or he simply isn't a savvy enough attorney to have caught them. I personally believe he ignored the blatant lies purposely, I base that on my total personal experience with him during my daughter's court case. My daughter is black, gay and dresses masculine, she's also a bigger girl, which is worse than being black or gay in many Cape Codders' eyes. I feel that she ended up in prison due to these factors and these factors alone. I believe that Attorney Nolan along with law enforcement on Cape Cod, took one look at my daughter and determined her guilt based on her looks, race, sexuality and size.

Mr. Brown represented me years ago in a family law matter. Personally, I think he's a genuine guy. He knows the law and he will represent you based on how you want to be represented...because we all have a choice. I could have been a raging lunatic in my case and we probably would have won a lot sooner, but I chose to maintain myself with dignity and to be as honest as I can without slandering the other person...despite how they behaved against me. Mr. Brown respected my wishes and I would recommend him based on his character even further more. He always demonstrated good ethics with me. A lot of lawyers attitude and actions encourage people to think they are not such great people; but this one is different. If you need someone, call Mr. Brown. He'll take care of you and you will appreciate it!

Throughout the entire process of planning, discussing, customizing and polishing Kathleen was the consummate professional - devoted to the task, generous with her time, patient with our limited legal knowledge and thorough in her translations of often confounding legalese. I will make this short and to the point Mr Mesmar is a con man he has never practiced law for any law firm, so were does he get his experience from. Yes he says he went to law school graduated passed the bar (I wonder how much of that is true, going to research it).It seems to me that law is a job that requires experience by having worked in the chosen field. It’s not like hey you get hired some company and has a6 week job training and then you are judged if you are accepted and can do the job. Law professionals take people lives in their hands much like doctors. You really on their expertise and not their ability to lie and con you into believing that they are knowledgeable and experienced in their profession. If you question him and dig into his marlaki you will see his reactions show his transparency that he really has no clue. He has a great ability to make you believe that he is likeable trustworthy and honest with your best interest in his responses to you. Ask him about how to proceed in the case or how much money he is payed He will not give you a straight answer for his fees, and gets ticked off regarding law strategy. His answer I will handle the strategy not you I have the law degree I went to law school not you. I have spoken to other lawyers and non were so demeaning towards me as he was. They were all respectful listened and responded in a manner that was in line with a client lawyer relationship. He must have missed that class. Well never have I been made to feel like I was a victim and only my money mattered not my life.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
