We needed to sell our parents’ home. Probate was needed for two people to clear title to the house. Attorney Roberts handled the probate cases and prepared for the real estate closing. Attorney Roberts negotiated with MassHealth and obtained lien releases. Attorney Roberts handled the real estate closing and we distributed proceeds from the real estate closing to me and my brothers and sisters.

This lawyer is expensive, evasive and does things backwards. Instead of driving the conversation based on his clients’ priorities, he pushes his own agenda-literally, which he will give to you at the meeting. That sets the tone for the meeting-he’s not there to listen and serve the needs of his client. He avoided providing direct answers to direct questions. He was condescending. He was narcissistic. He is more concerned with taking a fee for service than providing value for service. Having worked with a lawyer prior to him on other matters, I had a good benchmark for how a lawyer should be when acting as an ally. This guy acted more like a robot, spitting out information he’s spit out before, and provided the equivalent experience of someone saying “look it up on the Internet.” Waste of time and money. I do not recommend.

After my first application for disability was denied by Social Security, I called Attorney Roberts, and he started working on my case. The treatment of my condition by a medical specialist had been interrupted, because I didn’t have health insurance. Attorney Roberts explained how I could get health insurance coverage, so I could go back and get treatment from that doctor again. Attorney Roberts then asked the doctor for detailed testimony to explain my condition. My specialist has many patients, and declined to provide detailed testimony to supplement the medical treatment notes and other information that was already in my medical records. Attorney Roberts gathered all of the medical records and went with me to the Social Security Disability hearing. But the Administrative Law Judge (ALJ) said she did not believe that the pain caused by my condition prevented me from working, because I had collected unemployment compensation after losing my last job. She said she believed that I could still work, because I had received unemployment insurance. Attorney Roberts appealed the case to federal court, but the federal Judge decided there was nothing he could do in my case, because the issue was “credibility” (the ALJ believed that I could still work). As soon as we received that Federal Court decision, Attorney Roberts helped me file a new application. Attorney Roberts re-contacted the specialist who treats my condition, and explained that without his testimony, Social Security would never understand how severe my condition is, and my claim would be denied again. By then, I had regular appointments with the specialist, since I had health insurance. The specialist decided this time to provide the written testimony, and Social Security immediately allowed my claim. I recovered retroactive benefits going back 1 year before the day we filed the second application. Attorney Roberts stayed with my case until I got the result that I needed.

Adrienne was great to work with! She was prompt, knowledgeable, and super helpful. My green card application has been "pending" for multiple years and there were plans to go on a family vacation. However, it had been so long that even my extension had expired as well. My partner and I met with Adrienne for the hour consultation. She convinced me while this application was being considered applying for citizenship might be worth it, so I could vote, and additionally not have to deal with these travel logistics in the future. I had spent weeks and months trying to get a call to get an appointment and nothing was happening and I was getting extremely frustrated. It was coming down to the wire, and I required an ADIT stamp in my passport to travel. I went into the office, chatting with someone on the US Immigration website, called - all to no avail. Adrienne was able to call the office and get the name of the supervisor on duty. She called and let me know if I could go down to the immigration office that day and ask for Officer ____ (I don't remember his name), I could get a stamp and be on my way. Sure enough we went in, asked for the supervisor and he took us back. It took a total of 5 minutes, he took my expired card, put in a stamp in my passport and I was good to go. If it wasn't for Adrienne I never would have been able to go on my family vacation. She was as sincere as she was helpful. Thanks, Adrienne!

Personally hired this lawyer to draft estate planning instruments. While Mr. McNamara seemed personable and knowledgeable at our initial meeting, our actual experience was unfortunately quite different. We later learned that many of the instruments he drafted did not adequately protect our interests. When meeting with him a few years after the initial drafting of the documents, he asked why did you do this, why didn’t you do that. Well that was clearly our question to him, he’s the lawyer. He was non responsive on several occasions and quite curt in some of our in-person meetings. He was a disappointment and clearly did not know the details of the law that were vital to the legal services we hired and paid him for. This review is in no way any sort of retaliation, it truthfully depicts our real life experience with Mr. McNamara. Others who are reviewing their choices for a lawyer for themselves or their elder family member(s) should be aware of this kind of information, which will better prepare them to make the best informed decision when selecting the right attorney for them and/or their family.

I am a small business owner in the Cape Cod area. Tim Macnamara set up my LLC Corporation for me. He was very informative and accurate with his information, making me aware of the different options that I had for my business. After going through the details with me and deciding which was best for my needs, he very promptly handled all of the paperwork with the state and provided me with copies of all necessary documents. It all seemed like such a huge hassle to me at first but Tim took care of things with the greatest of ease. He has then contacted me and taken care of all things needed when ever it was necessary. He was very nice and personable and I would recommend him to anyone who needed the same.

Mr. McNamara was hired by me, as executrix of my mother's estate, in June of last year. He has done an excellent job so far. I just wanted to comment on a negative review I read on this website about him. I think it was written by one of my family members who, unfortunately for Mr. MacNamara has been taking her frustration and anger towards her siblings out on him! These comments are untrue! He is a very kind compassionate man who has been very patient with us, even in dealing with the financial difficulties of the estate. I am so grateful to him for all he's done for us!

I am not one to write many recommendations but I am compelled to do so because of the superior service I have received over the years. Specifically I have been a client of Chris Agostino for over a decade and I could not articulate in writing how much I appreciate him and his firm. Chris has provided guidance on both personal and business issues over the years and I forever grateful for everything he has done for me. In fact, over the years we have developed more than a client/attorney relationship...I consider him a friend and trusted advisor that I have referred to multiple individuals and business owners to him and his firm. I give my highest personal and personal reccomendation to RIW and Chris Agostino. Call me if you have any questions or are considering engagement with this firm.

My family hired Attorney Low for a consultation to discuss estate planning options for our elderly father. It was not a good experience. We paid $450 for a 90-minute consultation. Attorney Low was 25 minutes late for the appointment, and ended the session after 65 minutes. There was a specific, crucial legal point that she said she would look into as a follow-up to the session. After two weeks of silence, I emailed asking whether she had looked into the issue yet, and noted that this was time-sensitive for our family. I got no response. After another two weeks, I emailed again, asking if she had looked into it. Again, I noted that this was an extremely time-sensitive issue for our elderly father. Again, I got no response. It appeared during the booking process and in the actual consultation that the office --which is a small practice-- was extremely understaffed, and undergoing some turnover. That happens. But the bigger issue is that Attorney Low was disrespectful -- disrespectful of our time by starting late, disrespectful of our finances by ending the consultation two-thirds into the time for which we paid hundreds of dollars, and disrespectful of our needs by failing to follow through at all -- and ignoring multiple attempts to follow up. It was unprofessional.

My prior lawyer was giving up his practice and refered Att. Cormier to me. The rates he charged seem to be in line with others and there was no pressure to pay ahead, etc. I enjoyed working with Att. I was involved in an auto accident. My vehicle was was struck on the highway by a bus that was in service for a major Bus company. That bus company has the reputation of fighting tooth & nail, anything possible to not pay up. They use every rotten trick in the book, they had a team of high priced top notch killers working for them, they make it as difficult as possible so that others won't dare to sue that particular bus company... but then The Law Office of Frank Prokos, LLC got on their azzes. My ex-husband and I divorced and he moved back to Massachusetts and I live in Georgia; so I had to hire a Mass. Attorney for an ongoing custody battle for my daughter. Well let’s just say Ms. Zawadzkas knew it would be easy money for her ($5,000.00) to be exact; She had me agree to everything and anything my ex-husband and his attorney wanted. Which I thought hey she knows what is best …. Right….. WRONG. She not only made my case worse than it was before when it started but didn’t even fight for my case, for me, for my daughter and my family. She is absolutely hands down the WORST attorney I have ever dealt with, worked with and that’s saying a-lot as I used to work as a paralegal for over 11 years. So unprofessional, unproductive and uncaring. If you need a child custody/family law attorney. Please BEWARE and look elsewhere.

I won't give this clown any stars. This is a smooth talking, over priced clown, that talks out his back side. This system does not care about your children,or family. It's a race to see who can bleed you dry first. Save your money, and represent yourself. Thomas will tell you he knows the guidelines, but in the end, it proves he doesn't. He doesn't do any research, and shows up to court unprepared. He even showed to a trial with his girlfriend, and only cared about spending the day in the city. The Massachusetts system is broken, and these people will bleed you dry. Stay away from this guy. Tommy was referred to me. Even after reading one star reviews. I'm warming you all. It's true, don't hire this man. He's not worth any dollar amount.

Thomas Jaffarian, I call him the Commander of the Court because of what I didn't realize when I started my divorce. Tom's command of the law and his experience will allow you to take control of the process, rather than just becoming another victim of divorce. Let me summarize what he managed to do for me: - maintain ownership of my properties - equal parenting time - children locked into my towns school district - Zero alimony payments - Reasonable buyout to my Ex - I did not spend hours waiting on some bench at the courthouse - I did not wait weeks or months for hearings - Most importantly his ability to work with the opposing council to achieve a very fair deal. I highly recommend hiring Tom, you will not be disappointed.

We needed to Probate my father's will. Little property, no dissension in the family. Of course or initial meeting went well. We met the attorney, she took our money. That is the last you hear from her. The motivator to do this was so that we could establish the value of the estate before it gained value and set the lien by the nursing home. We agreed. 5 years later,. I am still waiting.. "We mailed the documents", Weeks later I get some random invoice instead. "Ok, we will email them since the originals are lost", a week later and no email. Can I get a detailing of our payments and charges? "I'll email". Nothing. The basic premise of the contract, to establish a value of the nursing home lien? "That isn't possible". So, unless you wish to spend money, for years, with zero result, take your money elsewhere.

Nick seemed to be overwhelmed with other matters, missing the deadline for discovery, waiting for over 2 months to give my discovery requests to the other party. The "kicker" was him missed a pre-trial conference, at which time opposing attorney strategically moved for a default judgement, which the court granted, leaving little issue of the facts to be contended at trial. Subsequent efforts for the judge to set aside her ruling were to no avail. I protested to Nick and received a full refund, but I still lost in court.

Everyone who ever used him said he takes so long. Wish we knew this ahead of time. Would have went with a different attorney. I guess he doesnt understand that online reviews can make or break a business. His FB account shows 5 stars which must be a lie. I hate giving negative reviews but I guess I'm going to have to until this situation is resolved. Once it is resolved I will update the review.

After initial payment, week later we met to discus where we stood concerning Elder law.Said he would get back to us in a couple of weeks. Five years sent a letter to us apologizing for the delay, and promised a response in two weeks..Almost a year later no response.Notified his office that I did not expect to hear from him again and chalked off my loss as a lesson learned.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
