Linda is beyond professional and to the point. My hope for any legal transaction is that it is quick and smooth; and this is what you get with her help. Her attention to detail is phenomenal. I have dealt with many attorney's and very rarely do you come across someone who has your true interest at heart. I wish I had met her earlier. Thank you, Linda!! I will be sure to use you for future business.

I had the pleasure of retaining Linda for a house closing. The sale turned out to be more complicated than anyone expected, with outstanding liens and botched foreclosure proceedings. But Linda was always on top of things and gave sound and valuable advice through out the entire process.

Frank was so helpful in explaining to all our family members the various options my parents had in preserving the equity value of their home from Medicaid and passing it on with the beneficial stepped up tax basis for us who will someday inherit the home. My parents opted for an irrevocable family trust which Frank established for us at a significant discount in fees from other attorneys we consulted with. Thank you for your patience and help Frank.

A friend recommended Frank to my husband and me for an IRS tax audit that was not going well and was previously being handled by our accountant. Frank was able to reduce our liability to 1/3 of the assessment and was successful in obtaining a waiver of the penalties. He reorganized our business and advised of the proper tax reporting going forward to avoid further audits and penalties. We subsequently retain him for a real estate purchase closing that was smooth sailing.

A week ago Friday I received a very difficult call from a cousin living in New York who informed me she had short time to live and had not had an opportunity to get her affairs in order. Her wish was to spend her remaining time in Korea and time was of the essence. The Friday before Thanksgiving weekend (the day after week connected) Cori went to her hospital bed and started the process of getting our POA and last will and testament in order. Less than a week later my cousin is boarding a plane accompanied by a doctor from travel doctors with her affairs in order for whatever may come. Cori represented a incredibly important piece of this formula and I couldn't be more grateful. Thank you so so much Cori for your compassionate and swift advocacy. Best regards, Tom Kang

In my early years I heard many disturbing stories of how people lost a major part of their inheritance to City, State and Federal tax, after their parents died without having lawful protection from the tax system, and the thought of seeking a protection crossed my mind many times. But I kept postponed it to next week, next month, or next year, and year after year until I became much older and one morning I woke up with a terrible thought of how foolish it would have been If anything happened to me and left my family without protection losing half of what really belongs to them. I spoke to a few attorneys but no one could make clear to me this complicated tax process and the fine print, until I contacted the Vishnick-McGovern-Milizio law firm and spoke with Constantina Papageorgiou who is an elder law attorney. Talking with Constantina was all clear and simple to me. She explained everything with professionalism and care. I did not hesitate. Now I have a peace of mind knowing my hard earnings, my home and everything else are protected, and my family will get to keep everything that belongs to them. Dino Pavlou.

Meg is a knowledgeable, compassionate lawyer. She created an irrevocable trust to protect my mother’s assets in case Mom needs Medicaid. The process has been unexpectedly complicated. I am impressed with Meg’s knowledge of elderlaw, income tax, real estate taxes, etc. Meg patiently explained the options to me, and she tactfully explained the trust to my mother, who is having memory problems. Meg kept my mother’s preferences in mind when she created the trust. I highly recommend Meg as an honest, reliable, intelligent lawyer.

I am an attorney in New York City and my family and I needed a Long Island-based attorney to handle my grandmother and grandfather's estate planning. Based on her stellar reviews, we hired Meg and we were so glad that we did. Meg is an accomplished elder law and estate planning attorney, and I was impressed with her command of her practice area. Equally notable was the patience and thoughtfulness that she demonstrated in explaining each issue and concept to my grandparents. Meg is a wonderful attorney and a true pleasure to work with. Anthony is a wonderful man and an exceptional attorney. My wife and I hired him and his brother Chris for estate planning and financial advisement. Best move we could have made, he is patient and extremely knowledgeable in his field. We had him complete the following: Trust Fund, Power of attorney, Health Care proxies, 4 completed last will and testaments. Chris his Brother: Opened 4 retirement accounts and gave us expert guidance and continues his advise any time we call. They are both available whenever you need them. THANK YOU !!!!!

I had plans to travel overseas for a three week vacation with my wife. My Will written by another attorney, was old and needed major revisions. As a Financial Strategist, I know I needed Trust created to ensure my assets were passed on first to my wife and then to my children (and grandchildren) from a previous marriage. Time was short, I had only two weeks to meet with an Estate Planning attorney and have all documents drafted and executed before our vacation. My wife, Boots is a Retirement Income Certified Professional and gets many attorney referrals in the course of her business. Fortunately for us, my wife received a glowing recommendation about Anthony Minko from trusted business colleague. Our meeting with Anthony was productive and enjoyable. He attentively listen to our concerns, asked the right probing questions, offered alternatives for us to consider, explained how to reduce or eliminate Estate Taxes, drew on a notepad the legal documents required and showed how all the parts fit together to ensure we had the proper Will, Trust, Power of Attorney and health care proxy to protect us and our assets now and after we are gone. We have met with other estate attorneys in the past and the Will and Trust package Anthony executed for us was half of what it would have cost through other attorneys we have interviewed. What I like most is being able to pick up the phone and consult with Anthony on estate issues or concerns related to my will & trust without worrying about being billed for each phone call. So not only Anthony do the documents in record time he provided a “superb value package” at a very reasonable cost. We have referred Anthony to our friends and clients and will continue to do so. Thank you Anthony and your talented team for your exceptional client service.

Robert Kurre handled the Trust of my deceased mother. I was totally ignorant of what this process entailed and, as I live out-of-state, this complicated the process. He guided me every step of the way and infinitely patient with me. There was no question he would not answer. Aside from his responsibilities, he referred me to other professionals in New York state who could assist in other facets of my mother's affairs. This was a daunting situation made so much easier by Mr. Kurre and his staff. Should you consult Mr. Kurre, you will be the recipient of the level of expertise only years of practicing law can provide. On every level, I have enjoyed the better part of this relationship. I highly recommend attorney Robert Kurre and his associates.

I went to Alfred Polizzotto Esq. for an estate matter involving litigation, 2 complex real estate transactions which involved a lot of money numbers that changed as bills were paid out on the real estate. The first day I went in to his office I felt comforted that the complex issues could be resolved with his calmness in handling and creating excel spread sheets to organize the 2 real estate transactions, private mortgage money, and bank accounts. He was extremely organized, great with computers, awesome in math, and extremely knowledgeable with the laws on all matters. He gave me a list of what documents to bring him. I had to Order 15 years of bank statements and checks. Once I gave him the copies. He put it all on to excel spread sheets. Then he called the estate attorney and told the attorney his demands for me. In the end everything Mr. Polizzotto asked for I received from the estate. Not one item did I lose because he knew how to litigate and apply real estate law and estate law to the facts at hand. I would not use any one else for law matters. He also worked Professionally with the opposing lawyer and the uncooperative executor. He’s a family oriented lawyer and treats such matters with delicacy and respect.

1. My wife and I are both over eighty. During the pandemic, instead of having us go to his office in Brooklyn, Mr. Polizzotto met with us close to our home on Long Island to discuss our case. 2. Mr. Polizzotto and his staff (Liz) always returned our email within twenty-four hours. 3. After we gathered all our original documents, we were not sure if we should mail to his office or hand deliver it. Mr. Polizzotto personally picked it up from our home, after a whole day's work and rush hour traffic in the dark! 4. When a clerical error was discovered in our application, Mr. Polizzotto redid the entire package himself! 5. Mr. Polizzotto always answered our questions with patience, clarity, reassurance, and in layman's terms so we could understand. 6. Mr. Polizzotto submitted our case on March 1st. It was approved by May 1st. Highly efficient! 7. It's been an unforgettable experience working with Mr. Polizzotto! He is truly a superior professional!

I hired Mr. Polizotto for assistance with elder law planning. It was clear that Mr. Polizzotto was intimately familiar with the nuances of this area of law. He knows how to structure a plan to ensure that the many interests of the client are well represented. He created a plan that included a trust to conserve assets and maximize tax advantages, aid in Medicaid qualification, and ensure favorable transfer of estate assets. Mr. Polizotto did not need to check the law when I had a question; he knew the law. I also hired Mr. Polizotto to assist with Medicaid hearings where the government was seeking to reduce benefits to a family member. We won the decision. In addition, I hired Mr. Polizotto in connection with the sale of a property. His real estate office is a well-oiled, efficient, professional machine. I highly recommend this seasoned lawyer.

Jayson Wolfe and his legal assistant Donna are the absolute best legal team and the one that you need to navigate the complex world of elder care law. Before meeting Jayson and Donna, I attempted contact with two other attorneys to discuss my case, which involved getting my 97-year-old aunt approved for Medicaid and in-home care. The first attorney I tried contacting came well recommended but proved to be impossible to reach, as she never returned phone calls or responded to email messages. The other attorney I chose did have an initial consultation with me by video call, but when it came time to hire him, he suddenly stated that he was too busy to take on my case. I called Jayson’s office feeling overwhelmed, and Donna answered the phone. She was able to schedule an appointment to meet with Jayson within a day. We sat together for an initial meeting that lasted over 90 minutes, during which he answered all of my questions (as I had a lot of them). Within the first 5-10 minutes, I knew that Jayson Wolfe would be the attorney I would hire. Here is what he and his team did for me: • Advised me on the financial transactions that I needed to execute immediately in advance to prepare my aunt to qualify for Medicaid • Walked me through the process of obtaining an irrevocable burial trust for my aunt • Completed and submitted the paperwork needed to obtain certification of my aunt’s disability • Set up an account with a pooled trust to allow my aunt to qualify for Medicaid • Obtained approval for Medicaid in-home care for my aunt • Advised me on the in-home evaluation process • Fought to get me a new placement with a different MLTC (despite me ignoring his initial recommendation) which led to me getting my aunt qualified for a full-time live-in aide All of the above was done for a fixed retainer, saving thousands of dollars. While the above speaks to his competence as an elder law attorney, there is much more to know that explains why Jayson and his team are the best: • Jayson and Donna are kind, caring, and compassionate people who fight for their clients • They treat you like a human being and even more – they treat you like family • They understand the need for communication and are always calling, texting, emailing to keep in touch • They recognize that the process of elder care law is complex and that you will have many questions along the way • They return every call you make to them and answer all of your questions, even after the point at which their legal work is completed, and will never send you invoices to bill for those calls – which is unheard of in most law firms. I would highly recommend contacting Jayson Adam Wolfe if you are struggling with elder care issues. Thanks to him and his team, my aunt will not run out of money and will be able to stay in her home where she feels safe and comfortable. Furthermore, she will save over $10,000 a month from not needing to self-fund her in-home care. My luck changed for the better the day I met Jayson and Donna.

Amie has been more than helpful in assisting me in executing the will and managing the Estate of my late aunt. She has been very knowledgeable in managing the sale of her home while dealing with creditors. Amie has been been able put the big picture together to help advise me in which direction I need to go. Amie has been very pleasant, kind, and compassionate during this entire process. When we meet, she always takes the time to make sure she is able to address any concerns. Additionally, she is very responsive via email and phone calls. I would recommend her to anyone looking into trusts, estate planning, and execution of an Estate.

I recently hired Amie Gartenberg for estate planning after she was recommended to me by a close friend. After being widowed in the past year I was a bit anxious and not very knowledgeable about what was involved other than a new will. It turns out a lot more and Ms Gartenberg was extremely patient and understanding in guiding me through it all. I was totally comfortable from the introduction on, never felt rushed and every question I had was thoroughly covered. I made three visits to the office, always received a friendly greeting and was seen promptly. My completed documents were presented in their own handsome storage box along with all the specific guidelines needed to finalize the estate plan. It was a pleasure to work with Amie Gartenberg and I would recommend her without hesitation.

Amie Gartenberg worked with my parents and my family during a difficult time for us, as my father was ill. She prepared trust and estate documents quickly, explained everything thoroughly, and was so warm and caring during the whole process. She is now continuing to serve as my mother's family lawyer, and we feel very secure and supported by her experienced legal advice and legal action on our behalf. We are very fortunate to have engaged Atty. Gartenberg.

We found George through a legal referral service and we are so happy we did. We needed to sell our house during the pandemic from another part of the state and he, along with his legal assistant Margie, were so responsive and helpful. What could have been a very stressful time, ended up being very easy. George clearly explained the process and was available when we had questions. I would recommend George to anyone looking for real estate legal services.

I can't say enough about Mr Gabor. I had an irs business problem where I ended up with a 90k lien on my home. Mr Gabor immediately put my mind at ease which allowed me to go back to my day to day living and not worry about it. Sure enough my faith in him was validated as he negotiated the amount down from 90k to 15K and got them to put me on a payment plan. Kudos to Mr Gabor & staff.

Since that time Renata was always my go-to attorney in any of my legal matters. She is consistently knowledgeable, professional, pleasant, kind, patient, responsive, trustworthy, intelligent and sharp. Renata will without question look after your best interest. For 17 years I have reached out to Renata with professional matters and personal family matters. I have referred clients, family members and friends to her for legal representation. I have never once been disappointed in the feedback I received. She takes nothing lightly and whatever is important to you is essential to her. I say this with full confidence that Renata Landskind is one of the best in her field. I consider her an asset in my circle and in the community she represents. If you decide to retain Renata, you will surely have an accomplished, competent and talented attorney in your life.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
