Mr. Morton is a great attorney! He helped me with a traffic matter and was very helpful and informative throughout the process. He also showed up for court and was there even before I was so I didn’t have to stay super long. He makes sure you understand what’s going on with your case and exactly what you need to do to hopefully stay out of trouble. 10/10 would recommend Mr. Morton’s office to help anyone out!

He’s not only a great attorney but a great person. Wonderful to work with he’s knowledgeable, organized and I truly feels he cares about his clients. We were left in a sticky situation after a death in the family and due to all the above things worked out in the end. Grateful for his dedication.

My wife and I searched throughout the community looking for a lawyer. We received various recommendations from banks and financial planners to contact this law firm to make plans for our family. We decided to use this law firm and after our first meeting it was clear we had made the right decision. Mr. Harvell and Mr. Collins and their staff really do hold to their reputation and we sure do recommend them.

Craig helped our family in so many ways! He went above and beyond to respond to text and phone calls. He was spot on with guidance and when he didn’t know the answer he found it and reported back in a timely manner. He was personable, respectful, and always allowed us to lead the way with prompting questions or topics that we didn’t even consider when fighting a battle that needed legal attention. 10/10 would recommend their firm!

I have know Craig Morgan since he was a sophomore in High School. His character and hard work is second to none. A lawyers' traits are usually wisdom, knowledge, and "out of the box" thinking. He has A+'s in all the aforementioned traits. What separates him from the herd is his integrity and character. The man has always been there for me and goes way out of his way to help me in anyway he can! I wish I had the leadership skills and work ethic he has. At the end of the day......if he says he will do something...you can count on it 100%!

Glen was great to work with on our estate planning process. Glen was very thorough and asked all the right questions to have my husband and I think through how we wanted matters handled. Estate planning can be stressful but Glen took care of so many of the details that it was a very easy process for us. I highly recommend Glen to all of my friends and will continue to use his services as my needs change over time.

Alan listened very carefully to our needs and situation. He spent a good deal of time making sure our Special Needs Trust would be set up in a way to protect our children's needs. In the end, we decided to use only a revocable trust, but it was set up in a way to be able to set up a Special Needs Trust for our son in the end. It all was quite complicated (to us) but he was patient, responsive, and thorough. We are very pleased with our final products and would recommend Alan for estate planning.

We sought legal advice from Mr Hartley when our mother unexpectedly fell and had to be placed into a skilled nursing facility. When it became apparent that she would be unable physically to return to her home, we had to quickly determine our options for paying for her long term care. We were at a complete loss as to how to navigate the paperwork and process of the DSS system. Mr Hartley was a godsend to us. He was able to quickly assess our family's situation, outline our options, and advise us how to proceed. He was highly knowledgeable, professional and gracious with us. We would recommend him to any family dealing with the quandary of funding care at a long term care facility, medicaid enrollment, and veterans benefits.

Joel decided to take my $250 consultation fee to get on the phone with me and tell me he couldn’t help me nor was he familiar with the area of law I was needed help in. His information was recommended to me off the MeckBar site for the issue I needed. I sent my requested paperwork in on 8/13 and Instead of emailing me saying “Hey I can’t help with the area you need” he opted to ask me to do paid phone consultation 48 hours later for $250. Immediately upon our phone call he tells me he’s not familiar with the area of law nor would he know a defense. I asked if I would then get a refund for the consultation or lack there of. He said no.

Everyone at this firm has been beyond amazing and patient with us regarding some delays on our side in getting our trust done. In August 2021, we completed and funded (many thanks to Kathy for all of her funding assistance) our trust. It is a wonderful feeling to know that our assets are protected and that everything is in order for our children. My husband and I give our highest recommendation to Carolina Family Estate Planning.

Following my husband's return from the hospital with a diagnosis of Lewy Body Dementia, I found myself in charge of our finances that he so aptly took care of for 42 years. A friend shared his experiences with CFEP with me and I called them the same day. Within six months, under the guidance of CFEP staff I was able to set up a trust insuring that what we had worked so hard for was protected for the rest of our lives and for our children. The staff at CFEP is always very professional and available to answer what might seems the very basic of questions. Since my husband passed last year I continue to rely on CFEP expertise and plan to continue my association with the firm.

The best traffic attorney in North Carolina BY FAR. Scott is a straightforward, trustworthy, and fast-acting solution to your law-related needs. At the start of my case, what he said would happen, happened. He doesn't beat around the bush, so if he tells you your case will turn out a certain way. Then that is the way it'll turn out. His fees are provided to you with proper notice, and they're dead accurate so no need to worry about any sudden bills. He will happily answer any and all questions you may have, and doesn't make you wait for a response. Given he is most definitely the busiest traffic attorney on this end of the state, it's awesome that he still takes the time to confront any concerns or queries you present in a timely manner. 10 out of 10 experience! Thank you Scott!

I approached the Law Office of Kelli Allen in about February of this year ( 2023) to help me submit my Green Card Application. I was assigned to Berna Chacon- a bilingual specialist in data accumulation for Green Card submissions. Thank G-d I was. She was absolutely outstanding. I mean truly- it took me a while to accumulate the necessary data ( necessary being whatever Berna told me to put together) and we submitted my application in June of this year. Today is November 24, 2023, and guess what- I have my Green Card Truly great work by Berna -what a help she was! I couldnt have done it so seamlessly without her!. Prices at this office are reasonable to. And nice, and accomodating people! I would go out of my way to recommend this law office and Berna to handle anybody's immigration matters. What a great job they did and I am one happy camper! Michael F

My husband and I attended an information meeting sponsored by Attorney Gill’s group, and we were so impressed with the clarity with which he explained the benefit of a family trust. Since that time we have set down with Mr. Gill and created a trust which we think organizes and protects our assets. We very much want our family to understand this process, and Mr. Gill has been kind enough to share the same presentation about trusts with our son, and help him understand the process. It is so very comforting to have provided each of our children with Attorney Gill’s contact information and to know he has a copy of all our powers of attorney (health, etc.) If ever we should experience a medical emergency, each of our children carries one contact card—Attorney Gill’s. We know that Gill’s office would fax to anyplace in the world, papers that are pertinent to our care, and they have established a relationship with our children. His materials have also helped us organize contact information regarding our property, insurance, etc, and provided a way we can communicate to our children about our end-of-life wishes in as non-emotional way as possible. Meanwhile, we are blessed to be active and healthy at 70+, and we intend to stop by the office often to keep our records up to date and to be responsible with the resources the good Lord has provided. We contacted Carolina Family Estate Planning after moving to North Carolina from New Jersey - we wanted to make sure all our important documents, including wills, healthcare directives and trust documents were all up to date and compliant with our new state laws. They responded to us immediately, and through several meetings including the most important one with Kellie, we had our (pretty complex!) documents updated and ready for signature within a matter of days. She answered every question clearly and kindly - this kind of thing can be stressful but they she and her team went above and beyond to make us feel secure and at ease. Their office is absolutely the most organized lawyer's offices we have ever been to, right down to the document delivery which came in a tabbed binder and with copies on a flash drive. I can't say enough good things about our experience, and we feel like our family is in expert and caring hands.

We've had our estate plan revised twice by specialist firms. Thus, we have experience working with estate lawyers and can compare them. We found Kellie Corbett to be both an excellent listener and communicator. She suggested alternatives that have greatly improved our plan. In addition, Kellie is also generous with her time and has great patience. In summary, we consider her to be the most effective such lawyer with whom we've had the pleasure of working.

I hired Elspeth Crawford in March of 2015 for a hit and run and a DUI. I consulted with Elspeth the following Monday of my arrest. I hired her for a fair price. She and her partner immediately got my drivers license back from the court house. She told me exactly how she wanted to handle the case, including which witnesses to bring in. On the 4th court continuance, all of my charges were dropped.

My wife and I were named in a lawsuit due to a breach of contract. Our roofing contractor didn't pay his roofing materials supplier, so we were being sued by the supplier also. I hired Elspeth to handle this legal matter. She was very courteous and professional and assured me that this lien on our house and lawsuit would be taken care of. I gave her copies of the insurance checks cashed by the contractor and also checks cashed by him for our portion of the contract such as insurance deductible. With in a few weeks, Elspeth had this matter cleared up and the opposing attorney removed the lien from our house. I would definitely use Elspeth Crawford again if needed!

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
