Brenda is unorganized, during our initial consult she lost my paperwork that her part time 1-5 legal-aid handed to her, doesn't really seem to have much interest in your legal matters or what you have to say, she was more concerned about avoiding court and trying to rush through a divorce so she can collect her check and move on.

I met him first when I had a small criminal issue. Very professional, kept me updated, and got the BS charges dismissed. When my divorce came up this past year I remembered him. He does those cases too! I cannot recommend him enough. He has saved me twice now. I cannot thank him enough. The best money I ever spent and the nicest, friendliest lawyer you could imagine. Not that expensive either. I talked to two others in town before I knew Wes did divorce cases. One of them made me pay to even talk to him and acted like he didn’t want me there. The other didn’t charge me to talk to her, but she talked the whole time. I was so happy when I thought to call Wes. He was really good about explaining everything and answering questions when I would call. And his assistant (Brittany, I think) was so sweet. I really loved her. I just could not be happier with the services I got. And I didn’t have to go to Knoxville. I highly recommend Wes out of the very body in tazewell

Had an appointment with Christi Hale today at 2:30 pm. I made it 3 weeks after meeting with her in her office. When I arrived at her office today I was met by another attorney and was informed that Christi was busy and he would be taking care of me. I did not know him and he had no clue why I was there and I had to explain my situation all over again. He charged me $50 and did nothing. They should have called me to let me know that she could not see me today and given me the option of making another appointment. Very poor office practices. Will never recommend them to anyone and will never go back.

Mr. Sharp worked with us and quickly filed the paperwork to get my husband and I custody of a young relative. He was communicative and helped us with any concerns. He explained the process in a way that we felt like we understood what our options were and could make the best decisions. I would hire him again but hope I won't have to.

Mr. Matthew Sharp has been fired. He took money for both his personal fee and filing fee to take someone to court, but he never did. He was hired for about two years to do this simple job instead all he did was file with the court after a year when he was about to be dismissed and assume his resignation for not doing his job and not communicating for months at a time...he pocked the serv papers money and never served the papers...I gave him several more months to give him a chance...but he showed me he was just pulling my leg. So he has been fired and stole my funds. He also never gave me my file or showed what work he performed.

We are repeat customers of Takacs. Our first interaction with the firm happened after we moved to Hendersonville. Tim and his staff helped us move our Michigan family trust to Tennessee and we saved several hundred dollars a year not having to pay state income taxes in Tennessee. Our next experience happened when my disabled sister and her disabled husband moved from Virginia to Tennessee. My brother in-law’s disability and declining health had created a lot of outstanding debt. My sister wanted to determine if her husband qualified for Medicaid or any other public benefits that could pay his medical expenses. He needed a will that wouldn’t jeopardize his eligibility for Medicaid. He also wanted to document his end-of-life wishes. Tim Takacs and his team of professionals experienced in nursing, Medicare and Medicaid worked together to help my brother-in-law navigate the complicated application process and get approved for Medicaid. They also provided solid advice to help him get accepted into a local nursing home so he could get the immediate care he needed—with Medicare paying the bill.  Now, 18 months later, my brother-in-law is healthier, has had needed heart valve surgery, and is now out of the nursing home receiving Medicaid assistance and therapy from the comfort of his own home. There will likely be more interactions. In the near future, we will be going back to Takacs McGinnis to have our Michigan Revocable Trusts updated; they were written 15 years ago, when our children still lived at home. Working with an expert team of professionals has been a big relief.  Tim Takacs and his team has saved us from paying unnecessary taxes and they have improved the life and financial situation for my sister and brother-in-law. Everyone on the team really understands the big picture. I recommend them highly.

My family visited Mr. Takacs in desperation in 2009. My elderly parents were living with me and we needed help with daily living tasks., but had limited finances. Mr. Takacs charged my parents $10,000 for a Life Care Plan. He also coached us on how to redistribute my parents' finances so they would qualify for Veteran's benefits. He was very assuring that we would receive benefits SOON. My dad was a Merchant Marine in World War II and we are devastated by this! It is now 2015, both of my parents are dead and we have never seen one VA benefit dime. I would NEVER have taken a chance on this if Mr. Takacs had offered any doubt at all about my dad qualifying for benefits. My sister and I went through tortured days and nights over this.

I just wanted to take a moment to Thank You! You and Teresa truly provided “top-notch” service as my Grandmother’s Conservator. From day one you went right to work. I am forever thankful, you were my Grandmother’s voice, when she could no longer find the words. I really appreciated how you expertly guided me through the Conservator process and helped me fulfill all the legal and financial requirements. As this all rings so familiar from my Mother’s passing. I also appreciate how promptly you responded to my phone calls and emails. It helps reduce all the anxiety and restless nights spent worrying about your loved one. You and Teresa did all you could to keep the process moving forward quickly and efficiently. Being 500+ miles away, this was a HUGE task to tackle. I felt 100% confident in you and Teresa handling everything in my absence. You listened to all of my concerns and fears. Even in my Grandmother’s last days of life, she looked very peaceful and well taken care of. Something you don’t always see. I know often times your countless hours and duties go unrecognized when caring for someone. So I wanted to let you know, your services were much appreciated and highly recognized. I would strongly recommend you to anyone who requires timely, legal probate services in the State of Tennessee. I wish you all the Happiest of Holidays! God Bless!

In the short time that I met with Mr. Taylor I quickly learned that he was more interested in representing female clients. Did not return my phone calls for several weeks. The secretary said he was "out of the office" but when I had another family member call to make an appointment as a new client, he was all of the sudden back in the office. During my consultation he seemed like a "know-it-all". He didn't seem to know the law very well and kept having to reference everything I was asking him. I think he cared more about my wallet than about my case. I would find a more competent attorney and not waste your time.

Absolute waste of money. This man is a disgrace to the legal profession: Never responded to any of my (the client's) correspondence to him. Completely ignored my instructions on when to file motions. Completely ignored my restrictions on billable activities. Made harassing telephone calls to my parents threatening them with contempt of court. Never provided me with any written progress reports. Logan had no experience in defamation law. Tried to drag things out as long as possible. Never filed a motion to dismiss. Filed papers without my consent. When you retain Jimmy Logan, he thinks he has a license to bill. He never did even one thing that would be helpful to me. Disclosed confidential information to opposing counsel. Ran up billings as much as possible for activities that had nothing to do with my case. Very unprofessional appearance. Dragged out the proceedings as long as possible.

Paid this guy 1k of a 1500 retainer to file paperwork in order to be heard in a court room. Not only did he NOT tell me he doesn't work those kinds of cases he took it on like he knew what he was doing. He ended up having to call other lawyers, while in my presence, asked them how to go about filing the correct paper work, which paperwork was correct, and who he needed to talk to. After being told what to do by other attorneys he still managed to mess up the paper work, the order that the paper work was diled, All the while judging his client for the way he looks. He is a nice older man somewhat, but very incompetent and a waste of $1,000 that I can't get back and could have used for another attorney. I hired Mr. Wilkinson to represent me in a disputed probate case. He failed to take actions I directed him to take ,and instead spent an inordinate amount of time on insignificant issues, resulting in unnecessary hourly charges for him and the opposing attorney. He failed to present pertinent evidence about appeals court rulings on the ownership of a co-owned bank checking account, resulting in me losing over $14,000. His explanation for refusing to file one motion I directed him to file was that he had other cases before the same judge and was not going to file anything on my behalf that would make the judge angry. He then filed a motion to withdraw, leaving me without representation during a critical phase of the hearings.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.
  3. What is the best approach for my case?
Ask for an honest assessment of your situation and what legal strategies the lawyer recommends.
  4. How long will the process take?
Whether it’s drafting an estate plan or setting up a guardianship, ask the lawyer how long they expect the process to take.
  5. Will you handle my case personally?
In larger firms, junior attorneys or paralegals may handle parts of the case. Make sure you know who will be working on your case directly.
  6. What documents should I bring to the consultation?
Ask the lawyer what documentation or information you should prepare for your consultation, such as medical records, financial statements, or prior legal documents.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
