Donna was so very helpful with my case. She was able to help me keep my license so I could take care of my children. So so compassionate. Before court I was panicking and she was able to calm me down and ease my mind about it all. I will definitely hire again if she is ever needed. She is absolutely amazing at what she does.

Yancy Belcher is not the attorney you want to hire. I spoke to him via phone at 9:44 am (we spoke for 26 minutes). Two hours later, I called his office back and was told "he had went to lunch" ; I told the receptionist to cancel everything. He then billed me "$775.00". After reading his reviews, everything people said was happening. Price change, etc. Beware of him and his pricing. Due to me being bedridden I never stepped in his office. Just one quick phone call is all that happened.

I hired Tim Ballard for a child custody case during a sensitive period following the loss of our daughter to cancer. While Tim seemed personable, the service and value I received were unsatisfactory. My experience with Mr. Ballard was costly and inefficient compared to previous attorneys. Over $8000 and nearly a year later, the only significant progress was one hour of mediation. The costs seemed excessive: $2000 for mediation prep and almost $100 for a brief email. Additionally, I questioned the 5.5 hours billed (Tim does his own billing and invoicing. One month I received several months billing all of a sudden) for mediation prep half billed on a day when Tim was handling another case. Several months I’m still waiting on discovery questions, child support worksheet, and some bills of my ex spouse to be paid. All of which are “in the works” Communication issues were persistent. I often had to rebrief him on basic case details, yet was billed for these updates. Despite being promised legal aid assistance, this help materialized late, failing to restore my confidence in the firm. The process was drawn out, with mediation dates constantly delayed from May to July to November. I felt my case wasn't advocated for effectively, particularly in dealings with the opposing attorney. Now in the process of switching lawyers, I'm disheartened by the substantial financial and time investment with minimal progress. I'm open to sharing more details with those considering this firm. A major concern was the inefficient communication costing over half the total fees. I preferred meetings over emails for efficiency, but this approach wasn't adopted. There were also missed opportunities, like enrolling my daughter in a new school, and periods where Tim was difficult to contact, though active on social media liking the opposing attorneys instagram posts. In summary, I expected more empathy and proactivity in handling my case. This experience felt like a financial and emotional drain during an already difficult time.

If you’re looking for an attorney who you can count on, who comes to the phone, calls you back and has the best interest for their client DO NOT USE THIS ATTORNEY. This has nothing to do with a personal attack but rather a business threat to you and your legal issues. I have since found out through other residents locally of how badly hiring this attorney resulted in further damage and displayed the same problems others have experienced. DONT do it as you can’t risk legal problems. THIS WOMAN IS TOO GOOD TO SPEAK TO YOU AFTER SHES NEEN PAID. All you’re gonna get is the rudeness of the front receptionist.

Worst type of professionalism I've ever seen in a firm. If your a male don't bother. I can't get thru the secretary because of her personal emotions and unprofessionalism. I've been trying to rehire ms.hendrix for almost a year. (They were recommended to me) I keep getting the same answer. We are not taking case lime that at this time for over a years. I paid 5+ just to be neglected and not treated like a real client. Don't waste your time and money with this bias and unprofessional Firm. Stay away from methville. We hired Ken recently. We found him to be dishonest. He charged us significantly more than he told us he would, waited until the last minute to give us his bill (after we repeatedly asked him for it with no response), and refused to compete a task that all other lawyers perform. I’m sure Ken is a good guy but on this occasion it felt that he was taking advantage of us so it’s only fair that you know. I’d like to think that he has learnt his lesson that people are more important than money.

On 10-20-2021, I paid the $250.00 consultation fee(up front b4 meeting). I still have the cleared check receipt. I and a family member, meet with him for about 1 hr & discussed the property deed work which I needed. He said he would have deed prepared & ready to sign within 7 days. After said timeframe, I called office, spoke to lady & the deed was not ready, lady said would be ready the next week. Another week went by & I called office again. Deed not ready. Left message for him with the lady answering the phone, requesting call back about when this deed would be prepared. No response. I made several more attempts to contact him but received no call back or document. I gave up & realized I was not going to get the promised legal document in this situation. Live and learn, I ended up using another lawyer recommended by a family member,

I paid a retainer to settle a minor right of way dispute. He said we would have this done in six months or less. It's been 3 years and I still can't get a return call. He has told us several times that he was going to get a court date and that he was going to send letters to their attorney and that he would call us. I have no copies to show for any of the letters despite requests and promises that he would provide them. But never have we gotten anything. He has looked me in the eye while shaking my hand saying he would do something first thing in the morning and wouldn't hear from or get a response to inquiries for 6 or more weeks at a time. I should have done a better job of vetting him then I did. I read he has been disciplined by the state licensing body. BUYER BE WARE!!!!!!!!!!!!!!!!!!!!!

Catherine Clayton represented me in a case of family law. It was a complex and high stress case involving domestic and international issues. I have worked with a few attorneys over the past 15 years. I worked for a law firm when I was in school. I've seen good attorneys and I've seen pathetic ones. No one is perfect, so I offer this review with an open mind. When I first hired Ms. Clayton, she was on top of things and represented me very well. As time passed, she stopped returning my calls and emails. Her office was quick to send me a bill, but when I paid my retainers in lump sums it seemed that my account balance statements were lost in the mail. To this day, I can't even obtain an account balance (2 years later). I was a model client. I always paid up front and never missed a payment. I'm not sure what happened, but she fizzled out and now I have to look for new counsel. It's unfortunate, too, because I worked a second job in order to afford Ms. Clayton's rates. What do I have to show for it? Nothing. If you want nothing, then hire her.

Whatever you do, do not use Laurie Parker to do a Trust. If you do, this is what you can expect. You will pay a large retainer fee before anything is ever initiated (mine was $3000). Then you will be in a several month process with you attempting repeatedly to get Laurie to return your calls & emails. You will finally have to contact her staff to ever get her to follow up with you. There will be so much time elapsed between discussions that Laurie can't even remember what you discussed previously. She will claim that she is too busy and overwhelmed, she will lie & tell you that she sent you emails when she doesn't & that they are having server problems is why she didn't respond to your emails. By the time we got done we had so little confidence in the final product that we just went to a new attorney and basically got absolutely nothing but a great deal of frustration and disappointment from the experience with Laurie … $3000 completely down the drain! Do yourself a favor & find someone competent who will do a Trust in a couple weeks & at a third of the cost of Laurie. She way over complicates the process and honestly does not know what she is doing. If you could give a -0- Star review, that is what she would get from my wife & I.

I don't normally like to rate or give reviews, but I feel I must warn others. This woman should find a new career or retire. She clearly should not be a lawyer. I don't even get how she has been able to work in that nice Franklin law office with her lack of skills and confidence this long? When she was my lawyer there was a lack of focus and no care involved. My case was completely mismanaged, what a complete and utter nightmare this experience was. She took months to even return a call or email, only to respond with information I already had and excuses. I would ask her a question and she would say that she seemed to have a lack of know-how. My simple probate case dragged on and on when it should have been wrapped up so much sooner. This is done on purpose to give you fatigue so that you finally give up. My simple probate case took years and years. I recently spoke to other lawyers about it and they were appalled at the time frame of it all. I would NEVER recommend this women or the firm she represents. I heard they take their sweet time with all these cases as to drain you financially over time. Sorry Laurie A Parker, you asked for this review so here it is.

What an Elder Law Lawyer Can Do for You

An elder law lawyer specializes in legal issues that affect older adults, their families, and caregivers. These lawyers handle a broad range of topics, including estate planning, Medicaid and Medicare, long-term care planning, guardianship, elder abuse, and retirement planning. The goal of an elder law lawyer is to protect the rights, finances, and well-being of elderly individuals and to help them plan for future healthcare and financial security.

If you or a loved one is aging and facing challenges related to healthcare, finances, or legal matters, an elder law lawyer can provide essential guidance to protect your rights and interests as you age.

When Should I Hire an Elder Law Lawyer?

Hiring an elder law lawyer can be beneficial in many situations where older adults need help with legal, financial, or healthcare-related decisions. Common reasons to hire an elder law lawyer include:

  • Estate planning: If you want to create or update a will, set up trusts, or ensure that your assets are distributed according to your wishes, an elder law lawyer can help with comprehensive estate planning.
  • Medicaid and Medicare planning: If you need help qualifying for Medicaid to cover long-term care or need advice on navigating Medicare benefits, a lawyer can guide you through the application process and protect your assets.
  • Long-term care planning: If you’re concerned about paying for nursing home care or assisted living, a lawyer can help you create a financial plan and explore options for government assistance.
  • Guardianship or conservatorship: If a family member is unable to make decisions due to age-related cognitive issues, an elder law lawyer can assist in setting up legal guardianship or conservatorship to ensure their care.
  • Elder abuse and exploitation: If you or a loved one is experiencing physical, emotional, or financial abuse, an elder law lawyer can help you take legal action to stop the abuse and recover damages.
  • Retirement planning: Elder law lawyers can assist with planning for retirement, including managing pensions, Social Security, and other retirement income.
  • Special needs planning: If you have a disabled family member who requires special care, an elder law lawyer can help create trusts or other legal arrangements to ensure their long-term financial and healthcare needs are met.

What Does an Elder Law Lawyer Do?

An elder law lawyer provides a wide range of legal services to help older adults and their families navigate the complexities of aging, healthcare, and estate planning. Their responsibilities often include:

  • Drafting wills and trusts: Creating legal documents that outline how an individual’s assets will be distributed after death, ensuring that their wishes are honored.
  • Medicaid and Medicare planning: Helping clients protect their assets while qualifying for government benefits to cover healthcare and long-term care costs.
  • Establishing guardianships: Assisting families in setting up guardianship or conservatorship for loved ones who are unable to make decisions due to mental or physical incapacity.
  • Protecting against elder abuse: Investigating claims of elder abuse or financial exploitation and representing the victim in legal actions to stop the abuse and seek compensation.
  • Planning for long-term care: Developing strategies to cover the costs of nursing homes, assisted living, and other long-term care options without exhausting the elder’s financial resources.
  • Managing probate and estate administration: Guiding families through the probate process to ensure that the decedent’s assets are distributed according to the law and their wishes.
  • Setting up advance directives: Helping clients establish healthcare directives and powers of attorney to ensure their medical and financial decisions are carried out if they become incapacitated.

How Are Elder Law Lawyers Paid?

Elder law lawyers typically charge for their services based on the complexity of the case and the type of legal work involved. Common payment structures include:

  • Hourly rate: Many elder law lawyers charge by the hour, especially for tasks such as drafting documents, handling legal disputes, or providing ongoing legal advice. Hourly rates typically range from $150 to $500 or more, depending on the lawyer’s experience and location.
  • Flat fee: For specific tasks, such as drafting a will or setting up a trust, some lawyers charge a flat fee. This can range from $500 to $5,000 or more, depending on the complexity of the estate plan.
  • Retainer: For long-term legal representation, such as managing a trust or handling guardianship matters, a lawyer may charge a retainer, which is an upfront payment that covers future legal work.
  • Contingency fee: In some elder abuse or financial exploitation cases, a lawyer may work on a contingency fee basis, meaning they only get paid if they recover compensation for the client. This fee is typically a percentage of the settlement or damages awarded.

Be sure to discuss fees with your lawyer during the initial consultation to understand how you will be billed and what the total cost of services might be.

How Much Does an Elder Law Lawyer Cost?

The cost of hiring an elder law lawyer varies depending on the complexity of the case, the lawyer’s experience, and the fee structure. General cost estimates include:

  • Simple estate planning: Drafting basic documents, such as a will or power of attorney, may cost between $500 and $2,000, depending on the complexity of the client’s assets and wishes.
  • Complex estate planning: Setting up more advanced estate plans, such as revocable or irrevocable trusts, Medicaid planning, or special needs trusts, can range from $2,000 to $10,000 or more.
  • Guardianship or conservatorship: Legal fees for setting up guardianship or conservatorship often range from $2,000 to $5,000 or more, depending on the complexity of the case and whether disputes arise.
  • Medicaid planning: Legal fees for Medicaid planning can range from $1,500 to $10,000, depending on the level of asset protection needed and the complexity of the individual’s financial situation.

Always ask for an estimate of fees during your initial consultation to ensure you understand how much the legal services will cost.

Top Questions to Ask an Elder Law Lawyer

Before hiring an elder law lawyer, it’s important to ask the right questions to ensure they have the experience and expertise needed to handle your case. Key questions to ask include:

  1. What experience do you have with elder law cases?
Make sure the lawyer has experience handling cases similar to yours, whether it's estate planning, Medicaid applications, or elder abuse claims.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or a retainer, and ask for a detailed estimate of the total cost.

How to Check the Credibility of an Elder Law Lawyer

To ensure you are hiring a reputable elder law lawyer, follow these steps to verify their credentials and experience:

  • Check their bar status: Verify with your state bar association that the lawyer is licensed to practice and has no history of disciplinary actions.
  • Look for elder law experience: Review the lawyer’s website or professional profile to ensure they specialize in elder law and have experience with cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on elder law issues.
  • Check for certifications: Look for certifications or affiliations with organizations such as the National Academy of Elder Law Attorneys (NAELA), which can indicate the lawyer’s dedication to elder law.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with an elder law lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Existing estate planning documents: If you have a will, trust, or power of attorney in place, bring copies for the lawyer to review.
  • Financial records: Provide details of your assets, including bank accounts, investments, real estate, and retirement accounts, as well as any debts.
  • Medical information: If the case involves guardianship or Medicaid planning, bring relevant medical records that detail the individual's health condition and care needs.
  • Insurance policies: Bring information about health insurance, long-term care insurance, and any other relevant policies.
  • Questions for the lawyer: Write down any questions you have about your legal needs, the process, and the lawyer’s fees.
  • List of family members or beneficiaries: Prepare a list of the individuals you want to include in your estate plan or who will be affected by the legal process.

By preparing thoroughly for your consultation, you can help the lawyer assess your situation more effectively and receive the best legal advice tailored to your needs.
