I'm delighted to have Mr. Bunn involved in a potentially difficult legal estate-related family situation across three states. He has been thorough and complete in his representation of my interests and keeping me informed of my responsibilities and obligations. I couldn't have completed the task without his help. He came highly recommended from another attorney and choosing him was a sound decision on my part. It's always great to know someone who really knows his field!

David Rowe was my immigration attorney for nearly six years, culminating in my becoming a naturalized citizen in November of 2021. Firstly, I found him to be very knowledgeable, with a wealth of experience as an immigration lawyer. Mr. Rowe was also dependable, approachable, hard working, and clearly a man of great integrity. His advice was always well thought out and pertinent, and he was extremely supportive, making himself available throughout the entire process. Additionally, he was upfront and very fair regarding his fees. I would thoroughly recommend him to anybody who is going through the lengthy and complex immigration process.

Mr. McGill used his knowledge of the law to help me circumvent legal and ethical barriers to rewrite my elderly girlfriend’s Trust and estate documents. His network of associates helped me obfuscate my intentions so I have successfully taken control of assets that were intended for her members of her family. I used her funds to essentially put myself in control of her life and no one can do anything about it. If you seek revenge on those more successful than yourself, look no further than Edmond McGill. Revenge is not only on the menu, it is all that is served.

I hired Esther Wang, Jason Oei, and their amazing team in 2016 after my elderly widowed father relocated from Arizona to California to reunite with his his high school girlfriend. Given his fragile health, we had an initial consult with Esther to explain his assets and financial situation in order to plan for the day he might need long term care. She recommended a solid plan to protect his rental property in Phoenix, and life insurance equity. We worked with her staff attorney Jason Oei to implement the details of this plan which included creating a trust, updated power of attorney docs, and a will. Jason was so helpful to represent us with several details concerning the title on my father's property in Arizona, and the homeowners association (which potentially had implications for his ability to continue renting out his property following transfer to the trust.) Jason helped us navigate all of this with confidence and patience, and he followed up on unresolved issues proactively. More recently, my father had a serious illness which put him in the hospital for months, followed by 80 days of in-patient skilled nursing. We again hired the firm to advise on spend down and to handle his Medi-Cal application. Medi-Cal expert Kristie Reyland was so helpful, remained available to answer all my questions (and as a worrier, I had MANY), and put me at ease while we awaited the application to be approved. As a Texas resident, I was familiar with the need for good long-term care planning with local counsel who know your state's ins/outs for Medicaid eligibility and asset protection. We hired a fantastic attorney for our TX-residing mother-in-law and she was worth every penny. Through that experience, I knew how important it was to find California experts on elder law, particularly Medi-Cal planning. While Redlands is nowhere convenient to my father's residence in the San Fernando Valley of LA County, I knew after consulting with Esther that she and her team were exactly who we needed to hire for help with my father. Dad was very comfortable with Jason, and everything was explained so well. They are generous with their time, and truly get the job done for the price they quoted. They were also generous with their time to provide objective advice before I had even decided to move forward paying a retainer. They are a great example that if you build a helpful and trusting relationship with a client on the front end, they will want to do business with you.

I had (well, still have) a really difficult case regarding my wife and one year old daughter. I can't say much since the case is ongoing, but it was challenging enough just to get the case moved back to San Francisco where it should have been in the first place. Brett was honest with me that it was going to be tough, but he came through in court today and got the job done. He worked hard to accumulate and present all the right evidence, did a bang up job in the court room, and got results. He's a laid back guy, but aggressive when needed. And he has a great rapport with everyone in the North Butte County courthouse.

With my original probate attorney, I constantly felt as if I was questioning his abilities. I started researching a few referrals and found E. Schneider. I was confident after my 1st phone conversation with him. He was comfortable answering my questions, his concern was not making sure I retained him. I explained my goal for the estate initially and have not had to ask him for the next step. He initiates the next step and has completed necessary paperwork in a timely manner. He makes recommendations but leaves the decisions to me. He has taken steps beyond his call of duty that have been beneficial to the estate and to me personally. I am very thankful to him, something I never imagined I would be saying about a lawyer. I would recommend him to family and friends without hesitation.

I was referred to Stephen Hann in 2010 by a VP of the corporation where I worked who said he handled their divorce and custody with efficiency and expertise. I was in an extremely difficult and complicated marriage and custody situation and needed sound immediate legal help. After interviewing several other attorneys, and during the span of these 7 years, his advice and insight has not only proved 100% correct, even when it was challenging for me to accept; but has brought me to a healthy and successful place with my ex and our son. Sensitive, critical and painful decisions and actions were necessary. Mr. Hann's professionalism and substantial experience literally saved mine and my son's life. As a family law professional, I highly recommend Stephen E. Hann. There are many incompetent legal professionals in the open market. Mr. Hann is one of the few you can indeed trust.

I went to Mr. Scott after my husband past away and I was left with a large amount of debt I could not afford to pay. He negotiated one of my large debts and I was able to pay one fourth of the amount owed. I had two other debts I never had to pay. I was amazed at his understanding and patience. I would highly recomment him if you are having financial problems. He is definitely a trustworthy person.

Lawyers are needed at different times in all of lives for various reason.Bankruptcy is a very sensitive issue. There are so many attorneys out there to assist with this matter. Some promise this can be done or other can do this for only"for a low fee" .There are many different advertising approaches that are used.Attorney Yancy has no big gimmick or no "for only 400" I can save your home and diginity approach.Let me tell you first hand I had a very complicated chap. 13 case.It involved divorce issues that were not resolved tax issues that were out of control even to the point of going physically to the IRS,lengthy other issues that the average attorney would not go te distance for their client or have the knowledge tohandle.Although Attorney Yancy is not an tax attorney I can attest that with his dedication I had a debt with the IRS for 52,000.00 in previous taxes. After going and meeting with the IRS my taxes are now less than 8,000, I am still in my home,I still have my cars and even more I don't have the feeling of being a failure that is usually associated with bankruptcy filings. One thing that sets Attorney Yancy above many others, is he is truly a man of God and holds himself to that standard. Thanks Attorney Yancy your professionalism and dedication have changed my life in way that now I can move forward with my head up and my burdens lifted!

John took such good care of my mom's estate planning, he was very patience and took the time to make sure she understood all her choices and tax benefits and, what results would happen in each senario, so she was able to find the best solution and have peace of mind. (Which is so important) When she passed away, he was very kind and sensitive for our loss, and we're so grateful that he is taking care of the distribution of the estate and has helped all 8 of us with our individual needs and give us plenty of information to guide us forward. I will definitely use John for my personal estate planning and I would recommend him to my friends and family.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
