Ohio State Bar Association Ethics Board Re: Complaint Against Attorney Carlo McGinnis Dear Ethics Board Members, I am writing to file a formal complaint against Attorney Carlo McGinnis, in connection with the legal representation he provided in our recent case. Regrettably, the experience we had with Mr. McGinnis was far from satisfactory, and we believe his lack of competence and professionalism had a detrimental impact on the outcome of our case. Upon seeking legal counsel for our case, we were informed by multiple attorneys that we had a strong position and a straightforward path to resolution. It was our belief that any competent attorney would be able to successfully navigate the legal process on our behalf. Unfortunately, we were unaware of Mr. McGinnis's academic background and the fact that he graduated from a law school with a less than stellar reputation. During the course of the trial, it became evident that Mr. McGinnis was ill-equipped to represent our interests effectively. He was consistently outmaneuvered by the opposing counsel, ultimately leaving our case in a precarious position. There were moments when Mr. McGinnis seemed visibly flustered in the courtroom, turning noticeably red when confronted with questions he appeared unable to answer. While we acknowledge that Mr. McGinnis may possess some level of legal acumen, particularly in areas such as drafting wills or contracts, we believe that his performance in our case demonstrated a lack of the requisite skill and expertise necessary for successful litigation. Given the gravity of the situation and the implications of Mr. McGinnis's actions on our case, we respectfully request that the Ethics Board of the Ohio State Bar Association conduct a thorough investigation into this matter. We believe it is vital to uphold the standards of the legal profession and protect clients from the potential consequences of inadequate legal representation. Thank you for your attention to this matter. We are confident that the Ohio State Bar Association will take appropriate measures to address our concerns and ensure that the integrity of the legal profession is maintained.

Mrs. Davis was in charge of a relatives estate that my wife was in charge of. While doing the taxes on the estate she showed us how we SHOULD of had our tax's done . We went back and had the accountant redo our tax's the RIGHT way and it saved us THOUSANDS of dollars. In the process she became our new Attorney, tax consultant and estate planner. Oh did I mention we travel from out of town to use Mrs. Davis?

Abby & Brandy the secretaries for Susan Lee Davis are more knowledgeable than she is, they do all the paperwork and correct all the errors made by the lawyer (had to correct my name twice and it was on all documents I gave her) . She(Sue Davis) is affordable, but only because she takes 50 times longer to get back with you on things IF she ever does at all. She makes you do all the work (calling all insurance companies, title, office, creditors, etc.) so why even hire her for probate to begin with?!? She is always in "a meeting" when you call to speak to her but if you call anonymously like a new client she is available. Imagine that!!!

And when he was limited in his knowledge he found me someone equally as good and monitored the case himself

Linda represented me in 2 divorces, unfortunately. She was stern with her advice on some things I didn't want to pursue, which I was entitled to, but respected my decision not to pursue them. She always answered my calls personally, kept me informed and was always aware of the details of my cases. In both divorces things moved right along and I never felt like I was stalled or put on the back burner. It was like my case was the only one she had. I cannot say enough about her respect, integrity and knowledge. I am going back to her now for real estate purposes and didn't even consider anyone else. In looking up her phone number I ran across this site and took this opportunity to write a review.

This lawyer is what you would call rotten. She does not respect the people she represents. She shares confidential info about your case to people that you do not give consent to. She is very unprofessional and in our case did not work for us, but apparently for her friends within Port Clinton. Look elsewhere for a Lawyer. Let this be a warning, don't be a sucker.

At this time I would not recommended Attorney Tomas Piggott. Tomas will work hard for you and he will show confidence. I believe he is genuinely sincere in the actions he takes. Unfortunate when it became difficult he did abandon his responsibilities. Thomas is over loaded and today is a one man show; he needs improvement in case management today. He has the potential to change this and resume his success. Unfortunately in the past four years he has overloaded himself resulting in fetal endings for the cases he has committed to us. I can only speak on our experiences, and regretfully do not recommend Tomas Piggott till he improves his work habits. He was once an excellent Attorney, I know this because he had represented us for exactly ten years.

I had a self defense case and I am a veteran. I recalled all the events as I remembered them but the detective kept badgering me saying if I told him what he wanted to hear he wouldnt issue a warrant I never admitted to anything except defending myself but because I am a veteran he asked me if I was diagnosed with PTSD. I told him I NEVER have been. Since he grabbed my arm and I snatched it back and hit him I agreed to pay the damages not knowing my rights and after receiving poor support from Mr Atkins. My fiance asked him a legitimate question and with several people in the hall he snapped and called her stupid for asking. Then, in front of the man I was going to court over he berated me. Although, I have the right to defend my self because I am a veteran this is what they did to me for assault reduced to Disorderly Conduct: $2000 in restitution and fines and a years probation. I have never been in trouble in over 14 years but I got that for a small black eye. The man its over and I had already spoken realizing our faults and worked things out. This is just the results of poor representation in the court. He introduced me to the court saying, This is a road rage case and he is a veteran with PTSD (ALTHOUGH NO EXPERT SAID IT) and put me through a veterans program. Now, I stand to lose my job thanks to Mr Atkins. The entire point of me agreeing to anything was to save my job. So, they put me on probation. The very thing that will cause me to lose it. Hows that for stupid?

Deborah Tassie used an outdated form for the state of Ohio and also completed forms incorrectly for estate planning, causing the forms to be rejected by the end recipient. She also deleted the original documents she created and did not have them as a reference when I had follow up questions (less than 2 months after initial correspondence and while we were still awaiting final confirmation/acceptance from the end recipient). I certainly understand and respect that mistakes can occur; the core issue was not the mistakes that were made, but her unwillingness and lack of professionalism to fix the issues and correct the forms. I had to find a new lawyer to finish the work she started--and that she was paid in full for--but that she did not complete correctly. She was unwilling to correct the forms based on the end recipient's feedback and instead said the end recipient was wrong. She was completely unaware of, and unwilling to accept, her own mistakes in creating and filling out the legal paperwork. Further, she was inflexible in her way of thinking and trouble shooting problems, following only one formula/approach--even when that approach /formula was rejected (forms returned) by the end recipient. She did not care at all about customer satisfaction and took no steps to try to "right" the situation when I let her know I was unhappy with her legal services. I felt that she only cared about a pay check and did not sense that she takes pride in her work and a job well done. Deborah Tassie is the most difficult and unprofessional lawyer I have ever worked with and while she likely has other, happy, clients, I am not one of them. I would not recommend her services.

I had a problem with a mortgage company. When my husband and I went to sign at closing, the mortgage company had presented the wrong terms to sign (15 year instead of 10). The mortgage company said they could not fix it...that it would have to go into underwriting again...could take weeks. Our realtor recommended Dominic. I presented all of my correspondence with the mortgage company to Mr. Vannucci. He immediately got a letter to them....and the mortgage company had the correct paperwork done within 24 hours. Couldn't be happier. Fee was reasonable too.

After already haveing preconceived notations of me before even getting to know me or my situation she was horrible with communication! Not only that but the day of my court she said she was going to get a continuance but failed to mention that they denied it and I did not show up for court and she made me look bad. Not only that she failed to contact me back after numerous calls text and voicemails left from me. She definitely got more money from me than she deserved. I'm sure they're a great attorney. But he turned me down when I asked for help with my disability case, after stating I'd have a hard time getting approved due to my age (23) and not being totally immobilized (I use a cane, considering a Walker, and I cant leave my home alone so?). I understand not wanting to take on a case he would lose. But that isnt the case here. Its discouraging enough being denied for disability, which most do, but an attorney shouldnt be so quick to refuse someone. Quick update. I got approved. And my amazing attorney from Margolius got a decent check for their work. I'm grateful I was turned away here, I wouldnt have found my attorney!

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.
