Me. Rivas went above and beyond to take my mom's case with regards to her living trust. My mother felt comfortable as she also spoke Spanish since that was the only form of communication. I searched for many attorneys but out of all of them Ms. Rivas years of experience, all of her reviews, educatiion, and her professional dedication convinced my mom she is the best lawyer for her case. And when my mom met her for the first time she felt so comfortable in speaking with her and loved how Ms. RIVAS explained the "living trust and estate" process. Me. Rivas has a pleasant demeanor and we could tell that she comes from a loving family and really cares for her clients. She made this process very easy to understand and explained all the legalities in detail. She would email or call my mom to keep her informed of every step and that was a big plus. Right away I knew we were I in good hands because she expresses professional interest. My mom and I wholeheartedly highly recommend Ms. Rosemary Rivas for her outstanding and professional dedicated services. Having a great communication with your attorney who cares and understands your needs and who has many years experience is very important. My mom still talks about Ms. Rosemary Rivas profeddiinal services to all her family and friends. Again, we highly recommend Ms. Rivas and we rate her a double 5 stars.

Rosemary Rivas is the epitome of a consummate professional. She is fluent in her field and not only does she make you feel confident in her abilities as a lawyer but also in her obvious empathy as a confidant. She was by my side during an extremely difficult time and made the process as seamless as possible so I wouldn't have to deal with more than was absolutely necessary. I would recommend her without any hesitation and will rely on her if the need arises again in the future.

Alex is a phenomenal lawyer and helped me make it through one of the most agonizing periods of my life where I was facing ongoing and escalating harassment from a nightmare landlord and was being threatened constantly with unlawful entry and unlawful eviction. I never in my life had to resort to dealing with the legal system before and had little idea what to expect, but Alex's experience, professionalism, and compassion made the ordeal the least stressful it could reasonably be and made me feel more at ease knowing that he was confident he could find me a resolution. I'm incredibly thankful for getting to work with Alex on my harassment case and strongly recommend him to anyone.

We highly recommend Alex. We interviewed 3 lawyers to help us with a landlord that was leasing us a house with multiple issues. We chose Alex because of his expertise with renters' rights and his clear way of explaining them. We had some calls and emailed all of our evidence to him to make the case. Alex took over all communication with the landlord and her lawyer. On our end, Alex was always available to answer questions quickly and clearly, we always felt supported. Within a few weeks, he helped us get everything we needed without going to court. He even was with us on Facetime for our final landlord walkthrough. We fully recommend Alex, he is friendly and tough on landlords, exactly what we were looking for.

We initially consulted with Alex when we were going through a difficult situation with a past landlord who was withholding funds from us and demanding additional payment for a situation completely due to landord negligence. Alex first consulted with us on the situation and clearly shared with us our rights as tenants. After hiring Alex, he thoroughly reviewed all the evidence and directly communicated with the landlord outlining tenant rights and our demands. Alex handled all communications and helped us settle out of court. He was extremely professional, knowledgeable, efficient and a pleasure to work with. We cannot recommend Alex more highly!

As a business attorney, I know many estate planning attorneys in San Francisco. But when it came time to do my own estate plan there was only one firm I spoke with - The Atashi Rang Law Firm. Amir and his team took the time to not only craft an estate plan that gave me and my family a great deal of piece of mind, but did a great job of explaining its key provisions to help make sure we understand our plan and that it matches our wishes. If you are looking for an exceptional estate planning law firm, give The Atashi Rang Law Firm a call. You will be very glad that you did.

Amir Atashirang, as my attorney, was excellent and comfortable to work with. He was accessible, understanding, and provided useful information and guidance. He even assisted me with other law-realated matters that was not related to the main reason that I was soliciting his services. He also referred me to other lawyers in my county for other personal issues I needed to deal with. Amir is also concerned about his clients, professional, approachable, and make you feel at ease about everything. He was the first attorney I've worked with and it was a great experience.

Hiring Yuen and Yuen and working with Erika and Frank Yuen to help us settle our parents’ complex estate was the best decision my brother and I made. We found Erika and Frank to be very knowledgeable, easy to work with and available to us for in-person meetings and phone consultants throughout every step of the process. We couldn’t have settled the trust without their help. Thank you Erika and Frank!

We hired Erika in 2014 and the ongoing legal relationship has continued to this day. Our Probate was VERY complex and sensitive, involving interactions with additional litigators in different fields. As a former Assistant DA, Erika has experience and contacts outside the Probate arena, which proved helpful to our situation. She is professional and knowledgeable, along with the stamina to 'get the job done' for you. Most importantly, she is sincere about your personal well-being during this difficult process. Our highest recommendation.

The team at Jewell, Stewart and Pratt made our transition from Czech Republic to California go remarkably well. A large amount of paperwork, all very clear and thorough and timing was exactly what they told us and better. Claire, Monique and Mable made a great combo and we highly recommend hiring them when you are looking for results beyond the basics, special requests and international managing of affairs across borders, oceans and mountains of red tape. In 1st moments we thought to do it on our own. Then, realized there were some surprises along the way and that our team got results we were not able to get on our own and we didn’t want any mistakes during an already stressful period of change. This was the best investment in our future we made, by far. No regrets. No surprises. Professional and straight forward. Exactly what you need when moving yourself and family to U.S. Crossing the border with confidence is the best gift you can give yourself.11 minutes at the airport border crossing/special room, amazing. I didn't know Nathan, but he was really good to work with. He answered a bunch of questions I had (no charge which was cool), and walked me through how a revocable trust worked. We also took care of my health directive and he told me what was up with choosing a guardian for my child if I died so that was cool but not great to think about. But he actually gave me some questions and we worked it out in about 15 minutes. SO yeah, dude was cool for a lawyer.

OK, if you want an attorney who is really smart, friendly, and will listen to you, give this guy a call. I have hired Nathan for a number of different legal matters. He defended me when I was sued twice, he walked me through my estate planning, and he helped me negotiate a lease for a commercial space. I think he is an outstanding attorney because he actually LISTENS to me, he calls me back whenever I reach out, and he sends me periodic updates on the legal matters I have hired him for without me having to call first. He also saved me huge hassle when I got divorced, he called me and walked me through what I needed to do to stop my ex-wife getting my assets if I dided, I had no idea changing my living will wasn't enough to accomplish this. If he hadn't walked me through everything, she would still be listed as a beneficiary for my insurance, meaning she, not my sister, would've received the proceeds if I died. The other attorney I spoke with didn't say a word about this. Anyhow. Good luck with your legal issues no matter who you hire.

Deb did a great job with setting up an estate plan for me. She's extremely thorough, and not just on the routine matters of distributing assets. She also made me aware of plenty of important things about how my my finances and creative content (I'm a writer) should be handled that many other lawyers would have overlooked. She works in a personable and compassionate fashion that everyone will appreciate, with fair and reasonable rates, and is accessible for any question or problem that might arise. I've recommended her to friends that are also planning their estates, and they are just as satisfied with her work.

She is very accommodating and helpful. She worked immediately on the issue i consulted her with. She explained very well the legalities involved. I worked with Kelsey first in a difficult family situation for which she'd paired up as a secondary with another lawyer. The situation did not go as I'd wished (through no fault of her own), but I'd noticed her calm yet friendly professionalism from the get-go, so decided to hire her for my own estate planning. I couldn't have asked for a better experience. Estate planning can be difficult, but she stuck with me like a champ, giving me time but gently prodding me when I really needed to take action, and ultimately delivered a really well organized set of documents. I can easily say that this never would have gotten done without her care, tracking, and communication. In all our interactions, her demeanor always struck that tricky balance between compassion and professional rigor, interpersonal warmth and cool-headedness. She will be my go-to for anything in the future, and I'll be recommending her to my friends.

I inherited an art collection, my two partners were both thieves. I was terrified of dealing with these two evil people. Autumn Engles was an amazing representative. She was able to make my abusive partners, back down and when we distributed the art collection I was able to get the best of the collection. Autumn Engles was the reason it all went so smoothly. I was so worked up the day we dissolve my partners trust, but Autumn Engles made it a walk through the park. She kept all the emotions under control and in less than an hour we were done. Thank you Autumn Engles was my savior. Than you for making this really hard situation for me an easy process.

Heather has provided legal counsel for me for two separate problems. The first was an issue concerning the housing situation of my very uncooperative and sometimes hostile mother. Family issues can be very tricky to solve, even when the law is pretty clear. Family members tend to play by different rules when dealing with one another and there is a compassion that you give to relatives that doesn't come into play when dealing with strangers. Nobody understands this more than Heather. Her care and compassion for all parties involved give her unrivaled effectiveness in determining a solution with which everyone can be happy. Instead of just going through the legal motions of removing my mother from her current, undesirable housing - which was the legal help I sought - Heather actually went the extra two miles and found several housing alternatives that would fit my mother's financial requirements. She investigated records and found some government assistance programs for which my mother would be eligible. She thoroughly researched all possible avenues, including mediating discussions with other family members. Her warm-hearted demeanor and obvious compassion make her instantly likable and does not put anyone on the defensive, which I have found can be the most serious obstacle to progress. These factors were enough to overcome my mother's hostility and help her realize the right choice to make. I would hire Heather again in a heartbeat if another such situation arises. Heather is currently representing me in a personal injury claim from a motorcycle accident. I am continually amazed and impressed by her organization and knowledge. Despite being young and newly licensed, she's an excellent researcher and knows when to ask for help. It's obvious to me that she cares most of all about my satisfaction and providing me what I need, rather than serving her own interests. Yet she doesn't just answer my questions, she asks me all the things of which I haven't thought and sees to it that I keep on task when dealing with the seemingly insurmountable piles of bills and insurance paperwork. I can be difficult person with whom to work, because I insist of knowing and understanding everything and doing it my way. Heather doesn't push or prod, but she tells me matter-of-factly what the consequences of each and every one of my proposed actions are. She'll tell me when I'm making a bad choice and after all is said will work tirelessly to whatever ends I choose. I feel very comfortable knowing Heather is representing me and I do not worry. She's not just a great lawyer, she's also a really great, caring person.

What an Estate Planning Lawyer Can Do for You

An estate planning lawyer helps individuals plan for the management and distribution of their assets after death or during incapacitation. Their services involve drafting important legal documents, such as wills, trusts, powers of attorney, and healthcare directives. Estate planning attorneys work to ensure that your assets are transferred according to your wishes, minimize tax liabilities, and avoid probate court. They also help clients plan for potential long-term care needs and protect their estate from being diminished by healthcare costs.

By working with an estate planning lawyer, you can have peace of mind knowing that your loved ones will be cared for and that your estate will be managed efficiently and according to your desires.

When Should I Hire an Estate Planning Lawyer?

Hiring an estate planning lawyer is beneficial in many situations, especially when you want to ensure that your assets are handled properly after death. Common reasons to hire an estate planning lawyer include:

  • Drafting a will: If you want to clearly define how your assets will be distributed after death, an attorney can draft a legally sound will.
  • Creating a trust: For those looking to avoid probate or provide for loved ones over time, setting up a trust can help manage the distribution of assets.
  • Planning for incapacity: An estate lawyer can help draft powers of attorney and healthcare directives so that your financial and medical decisions are made by someone you trust if you become incapacitated.
  • Minimizing estate taxes: If your estate is large, a lawyer can help create strategies to reduce or eliminate federal and state estate taxes.
  • Special circumstances: If you have minor children, blended families, or complex assets like businesses, an estate planning lawyer can create tailored solutions.
  • Guardianship or conservatorship: If you want to designate guardians for minor children or ensure proper care for incapacitated adults, an attorney can help.

Hiring an estate planning lawyer is especially important if your estate is complex or if you want to ensure that your wishes are properly followed.

What Does an Estate Planning Lawyer Do?

An estate planning lawyer provides a range of services designed to help you organize your affairs and ensure your estate is managed according to your wishes. They can:

  • Draft wills and trusts: Creating legally binding documents that dictate how your assets will be distributed and managed.
  • Create powers of attorney and healthcare directives: Appointing someone to make financial or medical decisions for you if you become incapacitated.
  • Minimize taxes: Developing strategies to reduce estate taxes, gift taxes, and other financial liabilities for your heirs.
  • Help avoid probate: Structuring your estate plan to avoid probate, which can save time and money for your beneficiaries.
  • Advise on long-term care planning: Helping you plan for potential healthcare needs in the future, including Medicaid planning and protecting assets from being depleted by nursing home costs.
  • Assist with beneficiary designations: Ensuring that life insurance policies, retirement accounts, and other financial instruments are correctly designated.
  • Handle probate and estate administration: If a loved one has passed away, an estate planning lawyer can help guide you through the probate process or act as an executor.

How Are Estate Planning Lawyers Paid?

Estate planning lawyers typically charge for their services in one of several ways, depending on the complexity of your estate and the type of services you need. Common payment structures include:

  • Flat fee: Many estate planning services, such as drafting a will or trust, are charged on a flat-fee basis. The fee covers all work related to preparing the document.
  • Hourly rate: For more complex planning, such as estate tax strategy or trust administration, lawyers may charge by the hour. Rates vary based on the lawyer’s experience and location.
  • Retainer: Some lawyers require a retainer for more complex cases, such as ongoing trust management or estate administration. The retainer is an upfront payment that covers future legal services.

It’s important to discuss fees with your lawyer upfront to avoid unexpected costs.

How Much Does an Estate Planning Lawyer Cost?

The cost of hiring an estate planning lawyer depends on the complexity of your estate and the services you require. Here are some general guidelines:

  • Simple wills or powers of attorney: A straightforward will or power of attorney may cost between $300 and $1,500, depending on your location and the lawyer’s experience.
  • Trust creation: Establishing a trust, such as a living trust or revocable trust, can cost between $1,000 and $3,000 or more, depending on the complexity of your assets and estate planning needs.
  • Comprehensive estate planning packages: Some lawyers offer packages that include wills, trusts, powers of attorney, and healthcare directives, which may range from $2,000 to $5,000 or more, depending on the estate’s complexity.
  • Hourly rates: For ongoing services like estate administration or tax planning, lawyers may charge hourly rates ranging from $150 to $500 or more, depending on the lawyer’s experience.

Always get a clear estimate of costs during your initial consultation to ensure the services fit within your budget.

Top Questions to Ask an Estate Planning Lawyer

Before hiring an estate planning lawyer, it’s important to ask questions to ensure they are the right fit for your needs. Here are key questions to ask during your consultation:

  1. What is your experience with estate planning?
Ensure the lawyer has substantial experience drafting wills, creating trusts, and handling other estate planning services.
  2. How will you charge for your services?
Clarify whether the lawyer charges a flat fee or by the hour and ask for a detailed estimate of costs.
  3. What strategies do you recommend for my estate?
A good lawyer should be able to explain the best strategies for minimizing taxes, avoiding probate, and ensuring your assets are distributed according to your wishes.
  4. How often should I update my estate plan?
Ask how frequently you should revisit your estate plan, especially if your financial situation or family dynamics change.
  5. Do you offer ongoing support or updates?
Some lawyers provide periodic reviews or updates to ensure your estate plan stays current with changes in your circumstances or the law.
  6. How will you help my beneficiaries if something happens to me?
Ensure the lawyer is willing to guide your heirs through the estate administration process or help manage your trust after you’re gone.

How to Check the Credibility of an Estate Planning Lawyer

To ensure you’re hiring a credible estate planning lawyer, follow these steps:

  • Verify their state bar license: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no history of disciplinary actions.
  • Look for estate planning certifications: Some lawyers are certified as estate planning specialists, which indicates they have extensive knowledge in this area of law.
  • Read client reviews and testimonials: Online reviews on sites like Avvo, Google, or Martindale-Hubbell can provide insight into the lawyer’s professionalism and client satisfaction.
  • Ask for references: A credible lawyer should be able to provide references from previous clients who can speak to their expertise and client service.
  • Check for membership in professional organizations: Lawyers who are members of organizations like the National Academy of Elder Law Attorneys (NAELA) or the American College of Trust and Estate Counsel (ACTEC) often have a strong reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an estate planning lawyer, it’s important to come prepared. Here’s what you should bring:

  • List of assets and liabilities: Provide a detailed inventory of your assets, including real estate, bank accounts, retirement funds, investments, and personal property, as well as any debts you may have.
  • List of beneficiaries: Be ready to discuss who you want to receive your assets and in what proportions. This includes naming guardians for minor children if applicable.
  • Existing estate documents: Bring copies of any existing wills, trusts, powers of attorney, or other relevant estate planning documents.
  • Questions about your estate goals: Write down your goals, such as avoiding probate, reducing taxes, or setting up charitable donations, so your lawyer can tailor a plan to meet your needs.
  • Information on medical and financial decision-makers: Be prepared to discuss who you want to appoint for healthcare and financial decisions if you become incapacitated.

By being well-prepared, you can ensure a productive consultation and begin building a comprehensive estate plan that meets your needs and protects your loved ones.
