If you have any kind of personal injury claim in California, individually or as part of a class, you need to hire Chris and Kevin Moon. It's that simple. As a business and employment litigation attorney for both plaintiffs and defendants with more than 70 jury trials under my belt, I know the difference between "litigators" and real trial attorneys. The former are all too common in our profession, adept only at pushing paper, filing motions, and acting like keyboard warriors. But when cases fail to settle and trial looms, those kinds of lawyers find themselves staring into an abyss. They then either fold by unfairly compromising their client's case to avoid exposing their lack of trial experience, or stumble through trial with disastrous consequences. Real trial lawyers, on the other hand, can take any case to the mat and win. They don't bluff, because they don't need to. Not only does this achieve better settlements for their clients, but if the case cannot settle these trial lawyers actually win. Chris and Kevin Moon are both real trial lawyers, and excellent ones at that. They are both tenacious, brilliant and powerfully effective. I know this because I have worked with them both, and have seen their skill and dedication first-hand. Whenever someone calls me with a personal injury matter, I immediately refer them to Chris and Kevin. Even more, they are the lawyers I would want to represent me if I was ever injured. If you are potential client, call them! If you are a defendant on the other side of a case from them, be afraid. Be VERY afraid.

I have worked with Chris Moon for many years and he always given me amazing legal advice. Most recently, Chris helped me with a thorny legal issue. After a short consultation, the matter was resolved relatively quickly, which I really appreciated. The Moon brothers are extremely smart and easy to talk to, which is why I have referred many family and friends to them.

Allan took the time to really understand my situation, he gave me honest and sincere advice, being a small business he advise which way to proceed and to stay away from getting into heavy legal fees, in no way did I ever feel he was trying to "upsell" me in using his services, as he did the complete opposite and advised me to try to sort it our first directly with the other party. - Thank you Allan!

I was sued by a former employer and need a legal team that could effectively defend me and clear my name in a technology dispute. From day one, I was impressed with their professionalism, empathy, sense of ethics, and patience as they worked with me to get the information they needed to represent my interests. Chris Banys was very knowledgeable in this area. He helped me throughout the whole dispute, advised me of my rights and did everything he could to keep the cost down. He started off by reviewing my leases, and sent my landlord various letters. When we filed suit he did everything that he could to move things along. Chris was very aggressive in his approaches because I knew that from prior experiences with my landlord that he had to be. When the case settled Chris got me everything that I deserved and I didn’t have to give my landlord anything. It was a great win and I would always hire him for any matter that comes up. I reached out to Michael Weiner after experiencing difficulties with respect to accurate wage statements from my former employer. I had a signed contract which outlined a commission structure and Michael was able to review my employment contract. He advised me on the correct waiting time penalties that I was owed. Michael explained how the law applied to my predicament and was able to write a clear demand to my employer. His understanding of my predicament was with such kindness and expertise that we were able to resolve the matter in a swift and positive result. Michael's communication style is professional, kind, and extremely responsive. His knowledge and expertise specifically in contract and employment law assisted me to in a very favorable settlement, which exceeded my expectations and my former employers initial offer. Michael fought for me when others did not, and kept my best interests at heart the entire time. He carefully considered each item of negotiation and expertly drafted responses in a timely manner. I will be going to Michael for any and all legal matters that I encounter from now until the future. Thank you, Michael!

Michael was able to provide compassionate legal advice, care, and understanding in a highly stressful situation. I hired Michael to help me with a legal matter (a business where I had been storing valuables absconded with my property and sold it! And we had to sue him to try to get my money back), and after working with him to a very successful conclusion of this legal case, I cannot find enough good things to say about the GREAT GREAT job Michael did. He managed to negotiate a very satisfactory settlement for me that I thought was quite fair value given the reality of what was legally do-able. I believe it was his experience in the law that enabled him to do this, and as well I was very happy in the way Michael worked with me….good communication, good service and in my opinion very fair pricing considering the amount of work he did. I have no connection to Michael other than being someone who hired him for a legal matter who is very satisfied with all aspects of the service he provided. I would definitely recommend him.

As a small business owner it is crucial to have a relationship with an attorney who has the right combination of experience, integrity and knowledge. Based on my involvements with Cathy Kazemi, I can confidently label her as an outstanding all-around lawyer. Our business has had a couple of unfortunate cases come our way over the past few years in which we were required to solicit the services of a legal professional. In the past we tried out a few local attorneys and experienced disastrous results. It seemed that they barely even lifted a figure to help us despite charging outrageous amounts of money. Then I was finally referred to Mrs. Kazemi from another client, and upon seeking her services I was immediately impressed by her passion and dedication towards helping us achieve our goals. One particular aspect of our relationship with her that we particularly appreciate is that she is an excellent communicator. She is always willing to go out of her way to explain what is going on with the status of our case, and what options may be available to our party at any given time. If you are seeking an attorney who possesses a genuine and straightforward personality and will never nickel & dime you, then look no further.

We are a very small business that doesn't make a whole lot of money, a large competitor decided to infiltrate our company, steal trade secrets, slander us online and file a frivolous suit against us. We hired an attorney that did a lot of damage to our case and ran our bill up to around $40,000. 90% of it for unnecessary research and communications (mainly with us over billing). We ran asap and were lucky enough to find Ms. Kazemi. She repaired the serious mistakes in our case unbelievably fast when time was running out, and has been extremely fair and understanding regarding cost. We could not ask for a better attorney. She saved us from going completely out of business and has fought hard for us, negotiated well, always communicated with us to tell us what's gone on and really listened to us when we had questions or explanations about anything. I recommend her to anybody that wants a real, honest, hard working attorney that knows how to fight for what is right. They are so hard to find and we are very lucky to have her as our counsel.

During the last five years, I have been in a custody battle with my ex-husband. My ex was pretty much an absentee father for the first seven years of our child's life, and only came back into her life when she got Leukemia. During this time, my ex decided to get re-married to someone he met after returning to Sacramento. My child was mentally, emotionally, and physically abused by my ex and his new wife. My ex-husband left the military (approximately two years after re-entering our daughter’s life), and decided to take me to court to get his child support lowered and attempt to obtain custody of our daughter. During this time, he lied and attempted to hide the fact he had a severance pay equal to his yearly salary, and was receiving unemployment at the same time. My ex spent the money on home improvements and furniture for him, his wife, and stepchild, instead of saving the money to pay his monthly child support. Because my ex-husband was in the military, and had never been in trouble with the law, owned a home, and had a new spouse at home, he looked like a great guy on paper. Meanwhile, I am a single mother who was living in an apartment at the time, working full time, and earning my degree, so my ex thought he would look like a better caregiver for our daughter. My ex hired an attorney with over 35 years of Family court experience, with a specialty in fighting for a father’s parental rights, and I was Mr. Culbreath’s first Family Law case. Thanks to Mr. Culbreath's legal ingenuity, my ex was not able to hide his income and assets, and was ordered to pay a higher amount of child support than he did before he left the military. Mr. Culbreath was by my side through every attempt my ex-husband tried to get out of his finanacial and parental obligations to my daughter. Mr. Culbreath also obtained an order banning the stepmother from interfering with my daughter’s medical, educational, and religious needs, effectively making my ex take more responsibility for our daughter. Shaun also obtained a stipulation stating my-ex and his wife are not allowed to physically, mentally, or emotionally, degrade or abuse my daughter any longer. To make an already long story, short; my ex-husband went through two more experienced Family Law Attorneys’, and Mr. Culbreath chewed them up and spit them out (figuratively), in court. Mr. Culbreath could combat every argument the opposition threw at him. Mr. Culbreath uses common sense, empathy, legal expertise, and digs into the details of a case before appearing in front of the Judge. Mr. Culbreath always informed the likely hood of success of any argument I wanted to make, and took the time to educate me on the nuances of the law. There was nothing my ex-husband could bring up that Shaun hadn’t already thought of a legal argument for. Mr. Culbreath is a Legal Assassin, and because of his ability to argue the detrimental flaws of my ex’s parenting, I now have 100% physical custody of my daughter. I also hired Mr. Culbreath to handle my Grandmothers estate after her passing, and he made this a painless process as well. Mr. Culbreath is a great attorney whether he is presenting in court, or handling in-office cases. Shaun Culbreath is the only Attorney I trust to handle my legal needs, and recommend him to anyone who has a need of Legal help.

After retiring from being a State lawyer, when I opened up my small custom corset and wedding dress business in 1990, I chose Steve for my business attorney dealing with intellectual property and contract matters, such as obtaining a service mark for my business name, and avoiding litigation by a disgruntled, irrational supplier. Later I also chose him for my personal estate attorney and have consulted with him on multiple occasions over the past 26 years. He has assisted me not only with these legal matters but also represented me in an unlawful detainer to remove a non-rent paying tenant. I always feel Steve is on my side. He assisted me come to a rational response despite my emotions regarding a disrupted relationship with my sister who at the time was Executor of my Georgia-based mother's will. I also had to hire a Georgia lawyer when my mother passed. That lawyer merely did what I asked, was slow to respond to my questions on Georgia law, never answered some questions, and in the midst of much emotional family turmoil, without reason threatened to quit. I was appalled. Steve can manage the emotions that come with legal matters and accomplish what you want but without rushing to litigation. After my own 16 yrs. practicing consumer and employment law, my conclusion is that the rational thing for anyone to do is avoid litigation at all costs unless there is no other choice. Steve's certification in mediation makes him particularly competent to do just that, if you believe the same.

I am an archaeologist with an international profile (see my profile in the London Times website entitled "The Real-life Indiana Jones and the Mansion of Doom"). I have been keenly interested in Homer and his great epic poems, The Iliad and The Odyssey, and I created a multifaceted project to celebrate and research Homer, called The Homeric Project (homericproject.com). A part of that effort was to conduct archaeological fieldwork on a Greek island, searching for the lost Palace of Odysseus from the Odyssey. As part of my overall research on Homer, I believe I have discovered a lost code involving sacred symbolic numbers that Homer, I believe, intentionally incorporated into both his epic poems. I wrote up my research, with my new discoveries, in a research paper entitled, "The Mystery of Homer's Numbers," which I copyrighted with the US Copyright Office in 2013. The reason I retained Mr. Lauson was due to the following. I was conducting my field work in Greece with a colleague, with whom I also spent time writing on a projected book about the project. I had a falling-out with that colleague and terminated the joint project (including the book). In a subsequent letter from the colleague, a claim was made that she had filed a joint co-authorship of my "Homer's Numbers" paper with the US Copyright Office and it was implied that it had not only been applied for, but had actually been accepted and was in force. Therefore, my former colleague made those claims, which were not true. Since I could not stand to have such claims made on my original research, my discoveries and my paper -- and especially after my ex-colleague had an attorney send me a letter re-affirming the false claims -- I was forced to seek a professional attorney to defend me, my work and my reputation. I'm glad I found Mr. Robert Lauson because he did an outstanding job in straightening the mess out. He reviewed the facts I gave him, including a copy of my 2013 copyright which pre-dates the alleged copyright of 2014 by a year. His due diligence also disclosed that my ex-colleague did not submit my paper for copyright as stated. In fact, the copyright was not submitted until May 6 of this year (2015). Mr. Lauson completely agreed with my position on the whole matter and, unlike my ex-colleague's attorney who wrote an inaccurate and disparaging letter to me, Mr. Lauson wrote him back a very professional letter factually pointing out all the "misrepresentations" that my ex-colleague's attorney had stated based on the wrong information he had received from his client. Mr. Lauson also quoted in the same letter the legal precedents which supported my rightful legal interpretation of the case. Furthermore, and subsequent to that letter, Mr. Lauson was proactive with the US Copyright Office and got them to reject my ex-colleague's attempt to make a claim on my exclusive intellectual property. Hopefully that good action will have the effect of being a final termination to the attempt to make any claims on my original research and written research paper. In short, Attorney Robert Lauson was cordial, very professional and knowledgeable about how to handle my case. Moreover, he did an outstanding job of dealing with my adversary's attorney and with straightening out the situation with the US Copyright Office, that resulted in a decision by it in my favor. I can't thank him enough for his good work, which has not only set the record straight but has gone a long way to restoring my peace of mind about my original work and my career.

I was intimidated to speak with a lawyer about an area of the law that was totally foreign to me but I needed a professional opinion of my idea and the likelihood of obtaining a patent. It was as important to me to get an assessment, as it was to learn as much as could about the process. I did not want to drop my idea on a desk and wait for results. A friend of mine referred me to Bob. I knew at the end of our first appointment that he fit my requirements. He explained that his job is to interpret the Patent Law and apply it to my idea, so that if necessary, modifications can me made to be successful with the Patent Office. He made suggestions that gave me food for thought, including that I should consider a trademark for the name. I was very comfortable speaking with him and liked that he took the time to teach me. I left his office feeling good and knowing what I needed to do to keep rolling, what to expect, and that I made contact with a friendly lawyer that will guide me without me being intimidated. Since that appointment, he has communicated with me often to make sure we are progressing. I would recommend him to anyone seeking a patent.

Matthew helped me draw up contracts for my music business. I understood very basic levels of what I needed and he took my basic needs and created amazing templates for me to use for all future bookings and music that we obtain. Additionally he explained in great detail each section of the contracts so I knew what I was giving my artists. It was a very enjoyable and educational experience. I will recommend Matthew any time I know of somebody looking for quality legal work.

Matthew Batista assisted me with matters of the Fair Housing Act. Over the course of a month, he gave me professional counsel and was able to break the law down and explain it to me in understandable terms. He went above and beyond, drafting me written correspondence for my communication with my landlord, and explained the applicable law to further my knowledge about the issue, making my points of communication with my landlord streamlined and compelling. He made himself available for advice whenever I needed him while being approachable and understanding. Mr. Batista is the most professional lawyer I have sought out and I’ll be coming to him with any further matters.

Simon is a competent and generous attorney. When we were having a major issue in the rebuild of our home after water damage, he got on the phone with us the same day, and he spent a full hour coming up with a game plan to get things back on track. Truly kind of him, and his advice was sound and balanced.

What an Intellectual Property Lawyer Can Do for You

An intellectual property (IP) lawyer specializes in protecting the rights related to creations of the mind, including inventions, designs, logos, brands, artistic works, and trade secrets. IP lawyers help clients secure legal rights to their intellectual property, enforce those rights, and defend against infringement claims. They can also assist with licensing agreements, negotiating royalties, and managing intellectual property portfolios.

Whether you're a business seeking to protect a trademark, an inventor patenting a new product, or an artist protecting your work from unauthorized use, an intellectual property lawyer ensures that your creations are legally safeguarded and helps you navigate the complex landscape of IP law.

When Should I Hire an Intellectual Property Lawyer?

Hiring an intellectual property lawyer is beneficial in many situations where you need to secure, protect, or defend your intellectual property rights. Key scenarios include:

  • Filing a patent: If you've invented a new product or process, a lawyer can help you apply for a patent and ensure the protection of your invention.
  • Trademarking a logo or brand name: To protect your business's brand identity, a lawyer can assist in trademarking logos, names, slogans, or symbols.
  • Copyright protection: If you’ve created an original work (e.g., a book, music, or software), a lawyer can help you register your copyright and ensure your rights are protected.
  • Trade secrets protection: For businesses with proprietary information, a lawyer can draft agreements to protect trade secrets and ensure they remain confidential.
  • Defending against infringement: If someone is using your intellectual property without permission, a lawyer can help you take legal action to stop the infringement and seek damages.
  • Licensing agreements: If you want to allow others to use your intellectual property for a fee, an IP lawyer can draft or negotiate licensing agreements that protect your interests.
  • IP portfolio management: If you have multiple forms of intellectual property, a lawyer can help you manage your IP portfolio, ensuring all assets are protected and strategically utilized.

Hiring a lawyer early in the process can help you avoid legal pitfalls and ensure that your intellectual property is adequately protected from the start.

What Does an Intellectual Property Lawyer Do?

An intellectual property lawyer provides a wide range of services to protect and enforce your intellectual property rights. They can:

  • File patents and trademarks: Helping you prepare and submit patent or trademark applications to protect your inventions, brands, or logos.
  • Register copyrights: Assisting with the registration of original creative works to ensure your rights are protected under copyright law.
  • Litigate infringement cases: Representing you in court if your intellectual property has been used without authorization or if you're accused of infringement.
  • Draft licensing agreements: Creating contracts that allow others to use your intellectual property while ensuring you retain control and receive appropriate compensation.
  • Manage IP portfolios: Helping businesses and individuals manage multiple forms of intellectual property, including patents, trademarks, copyrights, and trade secrets.
  • Conduct due diligence in business deals: Ensuring that intellectual property assets are properly valued and protected during mergers, acquisitions, or licensing agreements.
  • Monitor and enforce IP rights: Monitoring for potential infringement and taking legal action when necessary to protect your IP from unauthorized use.

How Are Intellectual Property Lawyers Paid?

Intellectual property lawyers typically charge for their services in different ways, depending on the complexity of the work and the type of intellectual property being protected. Common payment structures include:

  • Flat fee: For specific services such as filing a trademark or copyright application, many lawyers charge a flat fee that covers all the work required for that service.
  • Hourly rate: For more complex tasks, such as drafting licensing agreements or litigating infringement cases, lawyers may charge by the hour. Hourly rates vary depending on the lawyer’s experience and location.
  • Contingency fee: In some cases, particularly for IP litigation, a lawyer may work on a contingency basis, meaning they only get paid if they win or settle the case. Their fee would typically be a percentage of the settlement or damages awarded.
  • Retainer: For ongoing IP needs, some clients may pay a retainer fee upfront to secure the lawyer’s services, which the lawyer then bills against as they work on the case.

It’s essential to discuss fees and payment arrangements with your lawyer upfront to ensure there are no surprises.

How Much Does an Intellectual Property Lawyer Cost?

The cost of hiring an intellectual property lawyer depends on the complexity of the case and the type of intellectual property involved. General cost estimates include:

  • Trademark registration: The cost of registering a trademark can range from $500 to $2,000, depending on the complexity of the application and whether there are any issues during the registration process.
  • Patent filing: Filing a patent is often more expensive, with costs ranging from $5,000 to $15,000 or more, depending on the type of patent (utility, design, etc.) and the complexity of the invention.
  • Copyright registration: Registering a copyright is usually less costly, with fees typically ranging from $300 to $1,500 for most creative works.
  • Litigation: If you’re involved in an IP dispute or infringement case, litigation can be costly, with fees ranging from $10,000 to hundreds of thousands of dollars, depending on the complexity and duration of the case.
  • Licensing agreements: Drafting or negotiating a licensing agreement can range from $1,000 to $5,000 or more, depending on the terms and complexity of the agreement.

Always get a clear estimate of costs during your initial consultation to ensure that the services are within your budget.

Top Questions to Ask an Intellectual Property Lawyer

Before hiring an intellectual property lawyer, it’s essential to ask questions that will help you determine if they are the right fit for your case. Here are some key questions to ask:

  1. What experience do you have with intellectual property law?
Ensure that the lawyer has substantial experience with your specific type of intellectual property, whether it’s patents, trademarks, copyrights, or trade secrets.
  2. How do you charge for your services?
Clarify whether the lawyer charges by the hour, a flat fee, or contingency, and get a clear estimate of what your case will cost.
  3. What is the likelihood of success with my application or case?
A good lawyer should provide an honest assessment of the chances of successfully obtaining a patent, trademark, or copyright or winning an infringement case.
  4. How long will the process take?
Ask about the expected timeline for filing your application or resolving your dispute, as IP matters can sometimes take months or years to finalize.
  5. What steps will you take to protect my intellectual property?
Ask the lawyer how they will help ensure your intellectual property is fully protected and what strategies they use to enforce IP rights.
  6. Have you handled cases similar to mine?
If your case involves specific industries or technologies, ask whether the lawyer has worked with similar clients and what the outcomes were.

How to Check the Credibility of an Intellectual Property Lawyer

To ensure that you’re hiring a reputable intellectual property lawyer, take the following steps:

  • Check their standing with the state bar: Verify that the lawyer is licensed to practice in your state and has no history of disciplinary actions.
  • Look for specific IP experience: Check their website or professional profile to ensure they specialize in intellectual property law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what past clients have said about their experience with the lawyer.
  • Ask for references: A reputable lawyer should be willing to provide references from past clients who can speak to their professionalism and success in handling IP matters.
  • Check for certifications or memberships: Membership in organizations like the International Trademark Association (INTA) or the American Intellectual Property Law Association (AIPLA) can indicate expertise in intellectual property law.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with an intellectual property lawyer, it’s important to come prepared with relevant information and documents. Here’s what you should bring:

  • A detailed description of your invention, brand, or creative work: Be prepared to explain what you are seeking to protect, including any unique aspects or characteristics of your intellectual property.
  • Any existing IP registrations or applications: If you’ve already filed for trademarks, patents, or copyrights, bring copies of the relevant documents.
  • Information on potential infringers: If you are dealing with an infringement issue, provide details of the alleged infringer, including evidence of the infringement, such as images, documents, or correspondence.
  • Questions about the process: Write down any questions you have about protecting or enforcing your intellectual property rights, including timelines, costs, and potential outcomes.
  • Your goals: Be clear about what you want to achieve, whether it’s securing a patent, protecting a brand, or enforcing your IP rights against unauthorized use.

Being prepared for your first consultation will help the lawyer assess your situation more effectively and provide you with the best possible advice for protecting your intellectual property.
