Selecting an attorney is a very personal decision, but I could not have been happier with my choice. Mickey Ross thoroughly exceeded my expectations; I really did not know that working with an attorney and being involved in a legal matter could be such a pleasant and stress-free experience. You would be hard pressed to name Mickey's greatest strength because he is singularly well rounded; he manages to combine genius with compassion, thoughtfulness, professionalism, and OUTSTANDING communication skills. If you are overwhelmed and looking for someone you can trust to offload your burden to, Mickey is it. I felt 100% at ease with him because aside from just being as sharp as they come, he kept me in the loop while still taking the initiative on things; I was confident deferring entirely to his judgment from day 1. Within a week of hiring Mickey, I started sleeping well again and honestly increasingly found myself waking up every day consciously grateful to have him in my life and on my team. I was able to effectively turn my brain off and just relax; Mickey took care of everything immediately, emailed me back immediately, cc'd me on everything, was always available to meet or call if necessary, and always sought approval before acting despite my repeated total faith and deference to his opinions. So, Mickey Ross really is the total package; he is truly a gentleman and a scholar. I am probably still understating my delight with his services, but I will say this: you deserve to be positively euphoric about your representation no matter what, and for me, I found this with Mickey. I cannot recommend anyone more highly; Mickey is supremely, distinctly, phenomenally, exceptionally capable and a delightful person to boot.

Mr. Welch works his craft with precision and grace. A true Master at work, and he comes prepared. Mr. Welch dominated the courtroom in my case so much that after I testified, the defense attorney requested a settlement of the full amount that we were suing for. I simply cannot say enough good things about Michael Welch, he rules with an iron fist, yet strokes with a silk glove. The best of the best. Mr. Welch has become an asset to my business and I am very grateful for him. Mr. Welch is very honest and direct. Hire with confidence.

Even though he wasn't able to take my case, he took the time to get me in front of the person who could. He is very professional, and more importantly it seems like he cares. He cared about his client enough to not loose track of what he needed to do, but cared enough about me to help me find someone who could help. Thanks Again, Chris, Atlanta GA

She was able to answer all of my questions, and make me feel comfortable. She was always responsive with returning phone calls, and very present when discussing my case. I came to Peter with a difficult case involving a dispute with former business partners who were reaping the benefits of my hard work without compensating me at all, despite my my significant ownership of corporate stock. It was an emotional deal for me, but Peter kept me focused on what was important to getting what I was due. He was able to do this with compassion and I never felt bullied into accepting his suggestions. Additionally, he listened to my suggestions as well. He was never arrogant or condescending. As I mentioned, my case was somewhat complex, but Peter immediately zoomed in on the legal weaknesses of my former partners and formulated an excellent strategy to force them to settle the case by buying out my stock. He educated me well on the law behind our case. This was fortunate, as it allowed me to recognize actions taken by the other shareholders that would strengthen our case, and provided us with great ammunition. We ended up forcing the other shareholders to do the right thing and buy out my shares, despite many legal maneuvers on their part. I always felt that Peter was diligently watching my back. I honestly felt that he understood the situation and was as indignant towards my ex-partners' unethical behavior as I was. Peter Hasbrouck has my unconditional support and endorsement. I know that handing out an excellent rating on all five categories may seem excessive, but in my case, he earned every star.

Simply an outstanding experience. I've always been averse up giving money to a lawyer, but my experience at Taylor English Duma teaches me that when life calls for professional help, to call professionals. Matt Rosenkoff is now a most trusted advisor. When I have a need for guidance of any kind, I will consider calling him and asking. I am so glad I found him, and so glad that TED provided such a great place for us to work together. Thankfully there is some extra time left for my retainer. While I could just walk away and bank the money for the time I didn't use, I look forward to the next time I can get stellar legal services with Matt and TED!

I am very pleased with the way Mr. Clarke handled our case. He kept us abreast of what was going on and spoke in very plain English. His approach to the case was slightly different than others as he was not looking to litigate the matter but was more than prepared to do so. Instead he convinced us to sit down and mediate with the opposing party so that we could all gain a better understanding of the issues from both perspectives. Doing so enable us to reach a decision without getting the courts involved.

We faced a nuisance suit from an uniformed widow. We felt we could win at trial, but wanted/needed to avoid costs of discovery, motions, and trial. Kim and her wonderful staff were able to gradually convince opposing attorney that victory was very unlikely, and that even if they won, our current financial status would make a significant judgement noncollectable. This entire process dragged out for over a year, yet Kim kept our fees extremely low. She didn't waste fees "holding our hands" or communicating when not necessary. And she virtually always used very abbreviated emails to keep us informed. Kim is my first attorney experience where concern for my costs was paramount. And she WON by settling for only a symbolic amount!

Paul really went the extra mile in our case. We hired him for a drug / controlled substances case. Well, it was more like three different cases in two different counties, including a probation violation case, a new controlled substances violation case, and a different controlled substances case (where a gun was also found, though it wasn't his, but the DA might have said who knows what). So, this was an extremely difficult situation, with three felonies in 2 counties all being processed at the same time! It took a lot of juggling! And on top of all that, our goal was to get the person into rehab, in order to get better, versus just to have time in jail. Paul had so much work to do to make this happen! He worked evenings and weekends without any complaint or reservation. He went above and beyond, helping to identify rehabs that the judge would approve, that the probation officer would approve, that the DA would approve. So many parties to liaise with! Then, he helped to call all the rehabs (due to our limited time to help)! He found out which had availability when. How much they cost. Which offered financial assistance. Even he helped to set up the initial call between the patient/inmate and the rehab facility, which was way harder than we anticipated. Without Paul, it's highly likely that we wouldn't have had an acceptance letter before the hearing, and that might have been the end of his chances of going to rehab versus prison. Paul was professional, courteous, and hard working. He got it done. We are very appreciative.

Barclay is the most talented, committed and capable attorney with whom I have had the pleasure to work in my 25+ years as a CEO. I originally retained Barclay in 1999 when I was leading a small technology company in Atlanta. As my business grew, was acquired and later spun-off into a new entity, Barclay provided invaluable business insight, strategy and legal acumen in areas as diverse as M&A, IP protection, sales contracts, employee matters and dispute resolution. More recently he has assisted me in formation of multiple consulting entities and provided counsel on global contract negotiations with IP protection matters. What is perhaps most unique about Barclay, is his uncompromising standards and commitment to finding a positive commercial outcome for his clients. He remains a trusted partner in all my major business decisions. My confidence in his work is a result of his decades of experience representing consultants, enterprise software vendors, software development and other technology companies and his expertise in addressing the distinct legal issues pertaining to the development, licensing and support of software and services. I highly recommend Barclay Macon and believe that his uniquely personal approach to providing legal advice would be of extraordinary value to any firm needed a trusted legal partner in their corner.

Alex Kaufman is one of the best attorneys out there. He is all about a resolution and he moved very quickly in my case. I am in the process of being sued and within 2 weeks he is very close to getting a global resolution that will not only benefit me but bring closure to an ongoing lawsuit that has been lingering for almost a year. He was the 3rd attorney I hired since being sued and he has gained more results then the previous two attorneys within weeks of hiring him. He is very knowledgeable of the law and he is a straight shooter. He will not tell you what you want to hear but he will tell you the truth and his strategies in dealing with the issues are great. He is very easy to work with, and the greatest thing about Alex, is that he will not drive up a bill unnecessarily. He is helping me through this ordeal and whatever he says he will do, he does. He makes you feel like you are his only client even though his firm is well known and established. So much so that after my previous attorney wasn't representing me anymore, he told me that Alex was the perfect guy for my case. His team is awesome and they too respond very quickly. Its like having your own personal law group within my business. Its Great

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
