This review is solely for an attempt to schedule a consultation. She answered the phone and asked a question. I attempted to answer but she would interrupt. I'd stop and listen then try to answer again with details. She constantly cut me off and was very condescending, mentioning that the call was free and scolding me for trying to give details. Keep in mind this was a 5 minute and 14 seconds phone call. I was trying to give the details of why I was seeking an attorney. I feel that's the most important information for the attorney to have to be able to determine if my situation is something they can help with. Don't answer the phone if you're too busy to take on a new client and listen to the details of why they're calling. Basic common sense! I eventually disconnected/hung up and I would never use or recommend this person. Social skills are essential for everyday life and maybe more so for an attorney.

We specifically worked with James when we acquired a business. Throughout the entire process James was an excellent advocate while also being consistently available for questions and urgent work items. In my prior career I worked with hundreds of attorneys and had very high standards coming into this relationship with Mountain View Law LLC and they exceeded what we could have even hoped for!

If I could give 0 stars then I would! $20,000 later and they withdraw from representing me because I questioned their actions and choices. Ex spouse was ordered to give me my stuff by or before 3/11/22 and it’s now 5/4/22 and I still don’t have my belongings. The whole process felt like, delay, delay, charge, charge, charge! The very first motion they filed was tossed due to a typo. They will pick and choose when to respond to your calls, texts or emails but the billing department never misses a beat. Zach Santos will make you believe he’s got your back and tell you that you can reach out to him whenever to vent or ask questions however he’ll then say that you’re unprofessional if you question anything. Eryn Sisson his legal aid is even worse! She will yell at you and degrade you on the phone and then not listen to a word you’re trying to say. If you’re in the fight of your life then I highly recommend you look elsewhere! Worst experience ever!

Hilary Newcomb has given me tremendous assistance for over five years in relation to complex circumstances I have faced as a co-Trustee. She is always extremely prompt and comprehensive in her advice, and explains options in detail to ensure that I understand all aspects of every situation. Her team has been similarly helpful, accessible and conscientious. I cannot imagine what the past few years would have been like without Ms. Newcomb's counsel and support.

I reached out to Hilary of HAN legal when my Dad's Trust was suddenly defunded by his girlfriend - after he was diagnosed with severe dementia and had a major stroke. Dad had set me up 8 years prior to be his Trustee and successor POA. After Hilary couldn't reason with the girlfriend, she proposed a straightforward plan for me to pursue Conservatorship and Guardianship. Through the process she kept a professional and diplomatic tone. She proactively and tactfully handled messy & potentially volatile situations, keeping me updated and informed. Hilary even opened channels with a lawyer supporting the girlfriend, offering clarity. Shortly after the lawyer also supported Dad's original plan. Five months later I was my Dad's Conservator & Guardian. I reinstated the funds and took the role he asked me to do. Today the girlfriend and I work together cooperatively on Dad's behalf. This outcome at the onset was unimaginable to me. What a professional handling of the complex situation! Thank you Hilary! You knew what to do!

Joe is an excellent lawyer. I hired him on an employment issue, and he is just superb to work with. He is responsive, very personable, very nice, and knew just where to push and how to get things done. His assistant is a tremendous asset as well - she is whip smart and can handle many issues and does so very efficiently and very well. They are both extremely responsive - and I know you all know how rare this is in law firms. He's just the best.

I attempted four times, to get my case herd. Spoke with first lady that was headed off to vacation. She let me no that she will pass my message off to lady on the next Monday. Asking a few times if it made since, if she got enough info for me to have to wait three days for someone to contact me.. Never happened..I called again, this lady didn't see the notes taken, asked me to explain.. once again as I am in need of help, says I'll call you tomorrow, never did. I call again, an tried connecting online twice at this point.. Fourth call I have to explain situation to be relayed to someone who might have time to hear her as soon as he was free to do so, to expect a call in morning if not that day. Don't not hear a word back as I truly needed the direction or even a simple no but maybe try this person. Kinda made me feel unjusted as I still do, still can't seem to say the right words to have a lawyer call me back for a true consultation. By the reviews I see a great group of people ... I just need a direction please

Mark is extremely well connected. He was highly recommended to me and he exceeded my expectations. I'm ugly and bipolar, and he did a stellar job defending me. It is unfortunate that people don't know how to work with attorney. They have a heavy case load and can't remember the details on the fly. They HAVE to refer to their files before giving an answer. Every case has it's own quirks. And people micromanage because they are infinitely more vested in the outcome (unless it's a contingent fee!--then BUYER BEWARE. you receive a 1/3 and get taxed on 100%). Mark even told me that. How honest is that? BTW, the outcome was better than I expected. Thank you Mark. You really helped me out of a legal nightmare.

Beware utilizing Merrill O’Sullivan LLP for Estates and Trusts, they have no commitment to their clients after taking your money. In September 2016, my mother utilized Merrill O’Sullivan to establish and set up a Trust, an Advance Directive, Power of Attorney, and Last Will and Testament. She spent thousands of dollars with the firm in consultation and fees for the filings and paperwork. Unfortunately my mother passed away in October 2023. As the Trustee of the Trust, I contacted Merrill O’Sullivan for consultation of the Trust and Will. After a week of the initial contact, they called me back. Instead of setting up a paid meeting, they told me they did not have anyone at the firm that could work with me, and provided the Oregon Bar Association phone number so I could find another law firm to work with. I was shocked and hurt by this decision. My mother had just passed away a week earlier, and I thought I could receive proper guidance of next steps by the firm my mother had trusted. I expressed my disappointment but it did not matter. I’m not sure how this is considered ethical or thoughtful. Frankly I was embarrassed for the person that called me back. It was clear this was not the right decision. I would not consider these actions professional, ethical, or considerate. Their actions indicate they have no followup commitment, once they receive their primary fees. Again, be aware prior to utilizing Merrill O’Sullivan for any Estate or Trust work.

Mike had drawn up my mothers will so I mistakenly thought he was a good source counsel for her estate planning. He always seemed rushed and not up to speed on her file so that our interactions we're always rehashing the last appointment all over again. Hindsight's 20/20 but he failed to offer quality advice regarding power of attorney with my mothers bank account while she was still alive, costing us $24K after her passing. I'm no expert on estate planning but apparently neither is he, I would recommend anyone look elsewhere for those service, I wish I had.

I have just recently finished up a near 2 year long probate and estate case. The case was settled satisfactorily and happy to be finished. This was a long process and have some comments and concerns with choosing Mr. Wasley as my attorney. The Good: Mr. Wasley is knowledgeable and effective. He is responsive in his communication. The Challenges: Mr. Wasley counseled without Empathy. At no time did I ever feel like he cared about my case or myself. I certainly do not need hand holding, however it was quite clear I was just a number not a name. When you have lost your parent and need to go through this process, you expect some level of concern. I felt that many questions or comments I had were bothersome to him. I would think that with how much you have to pay an attorney, that he would welcome questions. I felt inside that I need to apologize for asking a question. I should have retained another attorney, but by the time I realized how it would go, I was already heavily invested. At the time of retaining an attorney, I had quite a hard time finding one available. My suggestion is that if you are in a position where you need an attorney that is somewhat friendly, personable, and empathetic, you should be careful in hiring Mr. Wasley.

We had a horrible situation with Benjamin Rosenthal. Upon our original consult, he told us we had a very strong case based off a complicated termination that involved being fired after threatening legal counsel. He said that was illegal and if there was a slam dunk, this would be it (although he did say there was no such thing as a slam dunk). Based on this legal advice, we opted to pay hourly and not go contingent which was offered. For the demand letter, we suggested he include some other angles as this was an egregious employment situation and there were other angles that could have helped gain momentum but he insisted this was the best angle and proceeded to send us a draft of the demand letter on only this angle. The demand letter felt more like a copy and paste letter and he had very basic mistakes, such as addressing the parties involved incorrectly. He had to look it up which blew us away that he didn't know how to formally address men in the plural given his profession. He did include our minor revisions and the demand letter was now ready to be sent. JUST BEFORE SENDING IT (AFTER ALREADY RACKING UP CLOSE TO 2K IN LAWYER FEES)... he called in the very late afternoon to say that, oh btw, the statute he had originally referred to was worded quite differently from how he remembered and it pretty much completely invalidated our case. Basically, firing someone for THREATENING counsel IS NOT illegal, firing someone for actually OBTAINING counsel IS illegal. He even admitted it was now an entirely different potential for a favorable outcome as it was now a much weaker case. Instead of the tough slam we thought (and were told) we would be sending, we sent a slow lob that we got absolutely burned with. It was embarrassing. We felt stupid and looked petty in front of our former employers. It felt like a total bait and switch. When you pay someone $350/hr, you expect them to know there stuff. After that bombshell in which we were truly shell shocked, he then says, "I want to get this out today". We had stomach aches knowing how badly things had all the sudden turned and how our former employers would manhandle the situation. It felt like he cared more about getting it done than doing it right or what was in our best interest. He gets paid either way, and that was obvious by how he handled it. The response from our employer's paralegal (yes, they are so cheap, they used a paralegal) absolutely nailed the problem with the wording. This paralegal's response seemed top notch compared to what we sent (although dishonest which was par for the course with this employer). He was detailed, specific, and the tone was effective. I honestly couldn't help but think, so this is what it should have looked like instead of the copy and paste lets-gather-for-tea tone that we sent. There were other things having to do with unemployment that he admitted he didn't know much about so quite honestly, I am not sure what his expertise is but we certainly didn't experience it. I would stay far away and wish we would have. It made an already bad experience, so, so much worse. And, btw, we did free consultations with another lawyer and a 30 year HR professional turned paralegal afterwards and they said that angle was terrible. After receiving the response, Ben kept trying to come up with cases that justified him sending the demand letter, but no one else, including a couple of lawyers, and a 30 year HR professional turned paralegal, believed we had a case on this angle. Lessons learned.... the hard way. Now we get to pay $2k for being humiliated and we have to let all the other valid points go.

I had excepted a sales job position with a company and within 4 months of employment I was dealing with work discrimination and was being discriminated against by my former bosses and was really mistreated because of my disabilities (which they denied of course) After a few months I just couldn't take it anymore and was calling other attorny's on this issue I found that every attorney I called didn't really understand my pain nor did they care about my case until I talk to Ben who immediately step up to the plate right away and defended me, ultimately getting my 2 former bosses FIRED because of what was going on at work. I didn't have any money at the time so Ben told me he would take my case on contingency. Ben not only protected my rights but he also went above and beyond seeking damages for what had happen to me @ work by my former bosses @ which my former company had to pay. I also forgot to mention before hiring Ben I was working with a former attorney who had mess up my case and just went MIA (missing in action) I could never get hold of the guy so then I had to go back looking for an attorney which I then discovered Ben. If you have been made fun of or pick on because of your handicap in life you owe it to yourself to call Ben. Don't give up on the fight most importantly don't let this go on. You have the right as a human being to live in harmony and not to suffer. I can recall many night of not being able to sleep because of what was going on. Despite the fact that I was a hard workeer there are still curuel people in this world looking to make life more difficult and I found Ben to be my guardian angel. Thanks

Extremely disappointed with how Dan has managed our estate case. It has been nearly two months since opposing counsel has requested to close the estate, but Dan continues to ignore any email from my wife or myself. The estate is not worth what he initially thought it would be, and he is no longer motivated to do the right thing by me or my deceased father. TRUST ME when I say a detailed review of this matter and Dans neglect will be posted to this site and sent to the Oregon Bar Association after the estate is settled.

Dan was initially referred to me 30 years ago and I saw him for a divorce and a couple of other matters along the way...then out of nowhere I was indicted on 10 felony counts arrested and humiliated ...so I called Dan who immediately took my case and went to work. One of Dan's biggest strengths is his personal integrity which hasn't gone unnoticed within the legal community. When he says something to a judge or other attorney then they listen and believe him...and rightly so. Dan took less money in order to hire an investigator that would prove to be the difference between winning and losing. I wasn't guilty which always makes it alittle easier but they had wound the net around me pretty good. Dan is an expert of working within the system to get things done. Ive sent him lots of clients throughout the years because I believe that strongly in this guy ...he saved my life because he is really good at what he does.

He has successfully litigated every issue I've had. He's successfully won 2 jury trials and efficiently handled several other legal matters on my behalf! I would strongly recommend that you contact Dan if you ever need a a strong and experienced trial attorney! With 40 years of successful trial experience you would be doing yourself a disservice not to at least have a consultation with him! Thanks for everything Dan!

Jeff did his best to prolong a litigation that involved relatives stealing my mother’s house after she died. Not only did he harm me financially, in doing so he cost his client ( the defendant) an exorbitant amount as well. When he was called out on his conduct he doubled down. Hopefully the Oregon bar will sanction him. If you use this awful attorney it is at your peril.

Florida Commercial Real Estate Investor here, daughter lives in Bend. We put a piece of residential land under contract to purchase but Seller did not fulfill his obligations to PARTITION as stated in the contract. Do I sue for Specific Performance? Do I have a case? How much will it cost and what will I end up with beyond a judgment? Jeff Hinman Esq was the right guy to answer ALL my questions and his efforts directly with Seller illuminated the fact that Seller is "nuts". Jeff was expert at talking me down off the ledge of anger and together analyzing the situation and the cost benefit of pursuing Specific Performance. I would HIGHLY recommend Jeff Hinman if you have any type of Contract dispute in Bend, Oregon.

I have a serious legal matter concerning a large amount of money with a General Contractor in the area who misappropriated my funds and stalled my job due to nonpayment to the subcontractors and suppliers. I live out of the area but thought it best to hire an attorney in the area where my building project is so I made an appointment with Chris Hearn via Dawn a receptionist at Chris’s office to meet with Chris a week later. About 6 days later I drove 7 hours to meet with Chris the next day. I was looking forward to receiving some professional help as almost 150K of my funds are at stake! I had written Chris 6 days earlier and also cc’d him on important communication with my contractor but with no response from Chris. A day before I was due to travel I called Dawn and mentioned Chris had not responded to my email days before and she asked me to send her the correspondence email so she could look it over and discuss it with him as he was extremely busy and he did not want to be disturbed. She mentioned he was so busy he probably had not read his emails. What kind of attorney does not read his emails concerning important legal matters I thought? So I sent her the email and she said she would call me back that afternoon and let me know if Chris had gotten my initial email and subsequent cc’d emails that were important to my case. Why she needed to discuss my legal matter with him instead of just asking if he was getting my emails was a little strange I thought. She never called me back. Oh well I thought, maybe she is just a little clueless but Chris is the professional lawyer and he his the one the matters here. Well the day before I was to meet I drove 7 hours in preparation to meet Chris in Ashland the following day. In the afternoon that day I get a text from Dawn asking if I had received Chris’s email. I had not. She mentioned in the text Chris was too busy to see me and he had to cancel our appointment. WTF!! I had spent days searching for an attorney, found one, drove down on a 7 hour journey 6 days later to meet the next day and they flippantly without so much as a sincere apology dismiss me as if I don't matter. How unprofessional!!! It is not easy finding a competent attorney in a smaller area that I was not “too busy” and seemed qualified and I was feeling desperate to get some help as my retirement was at stake here. They treated me like I was a third class citizen and flippantly dismissed me at a great inconvenience at a time when I really needed some help. Compassionless boobs in my opinion! How unprofessional!!!!! Avoid and find someone who gives a sh**!

We hired Ms. Vacura on a real estate dispute. We sold our primary residence and the buyers were unhappy. They were suing us for what we thought was a large sum of money. From our initial meeting, we were clear that we wanted the cheapest and quickest resolution to this case. We told Ms. Vacura the specifics of our case and told her that if we were at fault we were more than willing to write a check. However, we were advised that we had a defendable position. As the process proceeded, the fees from Ms. Vacura began to amass and we asked for a budget; which we received. However, ultimately Ms. Vacura went over budget by 2X. In addition, when Ms. Vacura maneuvered the case to bifurcate the damages from the legal fees, we asked that if by settling for even one dollar would we be liable for the plaintiff’s legal fees. Ms. Vacura assured us that this was not the case. She was painfully wrong. After the arbitrators ruled against us, I attempted to calmly discuss the matter of fees with Ms. Vacura and yet she became belligerent. She repetitiously kept saying that “no outcome was ever guaranteed” and that the “arbitrators had the law wrong.” We relied on Ms. Vacura’s professional advice in navigating the waters of this suit and yet we would have been better advised offering the plaintiffs the money they originally demanded. In the end we ended up spending more the money than the initial plaintiff demand. In fact, at one point the plaintiffs proposed a settlement at close to half the initial demand and we were advised by Ms. Vacura not to take the deal. It was clear that Ms. Vacura was more interested in booking hours than settling our case.

We had an urgent real estate issue which involved the improper clouding of the title to our property. We had spoken to several attorneys in the Portland area and even formally retained another attorney before it became evident that he misrepresented his experience in that area of law. (Also, despite knowing that we had an impending deadline, he took our retainer and the very next day, went on a 5 day vacation without ever disclosing that he been planning on leaving town for several months.) After getting our retainer back from the first lawyer, we did speak with a couple of other local attorneys regarding our legal problem. They were fine but seemed to be inclined toward escalating the matter instead of looking for a way to resolve it expeditiously and, without great expense. I was fortunate to speak with Ms. Vacura prior to retaining anyone else. Ms. Vacura along with her capable associate, attorney John Rake, offered a sensible option before initiating any aggressive legal action. Now don't misunderstand, this firm is a highly regarded aggressive and successful, litigation firm. Yet, instead of encouraging us to pursue that tact, they offered us a practical option. And it worked! We could not be more pleased. And when it comes to billing, you often DO NOT get what you pay for when it comes to legal representation. But both Ms. Vacura and John Rake, were up front regarding their services and fees, and they quite reasonable. I highly recommend considering a consultation with Larkins-Vacura before committing to retaining any other law firm in the Portland metro area.

When I first interviewed 3 attorneys for my lawsuit I knew what type of Lawyer I needed. I needed a tiger because I knew It was going to be a long, hard battle against someone who had 18 years of complete control of a business in which I was 50 per cent owner. She made sense out of 57 boxes of evidence and a thousand bits of paper and e-mail all the while she and her staff were trying to keep up my morale. She worked long and hard on this case and even though this case took a lot out of her(2 1/2 weeks of trial) she always had a smile for me and others. Needless to say I did pick a tiger. She won the case hands down.

What a Litigation Lawyer Can Do for You

A litigation lawyer specializes in representing individuals, businesses, or organizations involved in legal disputes. Whether you're the one filing a lawsuit or you're being sued, a litigation attorney will advocate on your behalf throughout the entire legal process. Their goal is to resolve disputes, either through negotiation, settlement, or trial. Litigation lawyers can help with a wide range of disputes, including contract disagreements, real estate issues, employment disputes, personal injury claims, and more.

Litigation lawyers provide strategic legal advice and manage all aspects of your case, from filing motions to representing you in court, ensuring that your rights are protected and that you have the best chance of achieving a favorable outcome.

When Should I Hire a Litigation Lawyer?

You should consider hiring a litigation lawyer if you're involved in a legal dispute that you cannot resolve on your own. Common situations include:

  • Breach of contract disputes: If a party to a contract fails to fulfill their obligations, a litigation lawyer can help you seek damages or enforce the agreement.
  • Business disputes: Litigation lawyers can represent you in cases of partnership disagreements, intellectual property disputes, or business fraud.
  • Employment disputes: If you're facing issues like wrongful termination, workplace discrimination, or wage disputes, a litigation lawyer can help resolve these matters through negotiation or court action.
  • Personal injury claims: If you've been injured due to someone else's negligence and are seeking compensation, a litigation attorney can help you pursue your case.
  • Real estate or property disputes: When there are conflicts over property ownership, boundary issues, or lease agreements, a litigation lawyer can assist in resolving the dispute.

Hiring a lawyer early in the process is beneficial, especially if a lawsuit seems imminent or you have already been served with legal documents.

What Does a Litigation Lawyer Do?

A litigation lawyer handles all aspects of your case, from the initial investigation to the trial and even the appeals process, if necessary. Their role includes:

  • Case assessment and investigation: Analyzing the facts of your case and advising whether it’s worth pursuing or defending.
  • Pleadings and motions: Drafting and filing documents to initiate or respond to a lawsuit, including complaints, motions to dismiss, and answers.
  • Discovery: Gathering evidence, including depositions, interrogatories, and document requests, to build your case.
  • Negotiations and settlement discussions: Attempting to resolve disputes through mediation, arbitration, or settlement talks before going to trial.
  • Trial representation: Presenting your case in court, examining witnesses, introducing evidence, and making legal arguments before a judge or jury.
  • Appeals: If necessary, filing appeals to challenge or defend the outcome of the trial.

Litigation lawyers are also skilled negotiators and often work to resolve disputes outside of court to save time, money, and stress for their clients.

How Are Litigation Lawyers Paid?

Litigation lawyers typically use a variety of fee structures depending on the type of case, the complexity of the legal matter, and the financial circumstances of the client. Common payment arrangements include:

  • Hourly rates: Many litigation attorneys charge by the hour, with rates varying based on experience and geographic location.
  • Flat fees: For specific, predictable legal tasks (such as filing a motion), lawyers may offer a flat fee.
  • Contingency fees: In personal injury or other cases where you seek damages, a lawyer may work on a contingency basis, taking a percentage of the settlement or award if you win.
  • Retainer: Some clients pay a retainer fee upfront to secure ongoing legal services. The lawyer then bills against this retainer as work is done.

The exact structure should be discussed in the initial consultation to ensure you understand how and when you'll be charged.

How Much Does a Litigation Lawyer Cost?

The cost of a litigation lawyer varies significantly depending on the nature of the dispute and the lawyer’s experience. Factors affecting the cost include:

  • The complexity of the case: More complex litigation involving extensive discovery, expert witnesses, or multi-party suits typically costs more.
  • Time spent: Litigation cases can be time-consuming, especially if they go to trial. The longer the case, the higher the legal fees.
  • Type of fee arrangement: Hourly rates can range from $200 to over $1,000 per hour, depending on the lawyer’s reputation and location. Contingency fees generally range from 25% to 40% of the settlement or award.
  • Stage of litigation: Cases that settle early in the process are often less expensive than those that proceed to trial or appeal.

It’s crucial to ask about cost estimates during your initial consultation to avoid surprises.

Top Questions to Ask a Litigation Lawyer

Before hiring a litigation lawyer, it's essential to ask key questions to ensure you're choosing the right representation:

  1. What is your experience with cases like mine?
Ensure that the lawyer has experience handling your specific type of dispute, whether it's a contract issue, personal injury, or business matter.
  2. What are the potential outcomes of my case?
Ask for an honest assessment of your case's strengths, weaknesses, and the likelihood of success.
  3. What is your fee structure?
Clarify how you'll be charged, whether by the hour, a flat fee, or on a contingency basis.
  4. How long do you expect my case to take?
While it's hard to predict, an experienced lawyer can give you a rough estimate based on similar cases.
  5. How often do you settle cases versus going to trial?
Some lawyers are more inclined to settle, while others may be more experienced in the courtroom. It’s important to understand their strategy.
  6. What is your approach to resolving disputes?
Some lawyers prefer aggressive litigation, while others focus on settlement or mediation. Choose one whose approach aligns with your goals.

How to Check the Credibility of a Litigation Lawyer

To verify a litigation lawyer’s credibility, consider the following steps:

  • Check bar association records: Ensure the lawyer is in good standing with the state bar and has no history of disciplinary actions.
  • Read client reviews and testimonials: Online reviews can provide insight into the lawyer’s professionalism and track record.
  • Look for litigation experience: Review the lawyer’s website or professional profile to ensure they have handled cases like yours and have a record of success.
  • Request references: Ask the lawyer to provide references from past clients who can speak to their effectiveness and approach.
  • Research their trial experience: If your case is likely to go to trial, ensure the lawyer has a history of courtroom success.

What Should I Prepare for My First Consultation?

To make your first consultation with a litigation lawyer productive, you should prepare the following:

  • A clear outline of the dispute: Provide a timeline and key details about the legal issue you're facing.
  • Any relevant documents: Bring contracts, emails, letters, or any other documentation that pertains to the case.
  • A list of key players: Provide the names of individuals or companies involved in the dispute.
  • Questions about fees and the litigation process: Make sure you understand how the lawyer plans to approach your case and how you will be charged.
  • Your goals and expectations: Be clear about what outcome you're hoping for, whether it's a settlement, compensation, or another resolution.

By coming prepared, you can ensure that your initial meeting with the lawyer is both efficient and insightful, giving you a better sense of how to proceed with your case.
