I wholeheartedly recommend Mr. West; whose service has proven to be exceptionally valuable, supportive, and distinguished. I believe Mr. West stands out as a true exemplar of legal professionalism and dedicated service. He and his team's unwavering commitment to the betterment of clients, their issues, and the community has been both evident and impactful. Through years of principled dedication, particularly in my extended family law issue, he became a beacon of rationality and disciplined thought which proved vital for my survival during the chaos of an extended custody battle. What distinguishes Mr. West is his profound dedication to ensuring that I received not only expert legal guidance but also compassionate support during my contentious family law situation. His principles and unwavering dedication have significantly contributed to resolving my conflict with integrity and sensitivity. I firmly believe that when seeking counsel, particularly in family law cases where emotions often run high, Mr. West and his team should be at the forefront of consideration.

Gary Craw and Pamela Rood were excellent to work with, they were very professional and respectful, and their experience and knowledge of the processes were critical to a favorable end result— simply said they get things done! Not that I do this often, but if I ever had to go up against the “big auto insurance companies” again, I would most definitely contact Gary and Pam— they will protect your best interests! I was involved in an auto accident in June of 2021. Gary was recommended to me by my employer at the time. The other party was difficult to say the least. Gary and the rest of the team worked diligently and tireless to get me the appropriate settlement amount for my multiple herniated discs. I have and will continue to recommend this firm. Thank you!

My son had Stephen McWhirter represent him in his divorce case. My son’s ex-wife was allowed to lie and defame my son’s character and his ability to parent without being confronted during a cross examine. Mr McWhirter allowed the other attorney to take all the time, delay the final hearing and claim she had full consent from my son before submitting the final hearing to the court. McWhirter not only didn’t stand up for my son but didn’t even stand up for himself with the opposing attorney. $25,000 to be drug through the mud. Disgusting.

Disabled veteran and first time reviewer of anyone. Stay away from this law firm. If you read the low reviews on Google, you'll get the most accurate outlook on the work ethic of this lawyer. I had a restraining order filed on me based on false claims. I had a police incident report practically proving the claims made were false and on my initial meeting, he was quick to say that he would subpoena the police officer that responded to the incident and that he would get the case dismissed. For this he wanted $1,500. As it was part of a divorce with no kids and complicated finances, he charged a total of $3,500 for both. I spoke with a half dozen law firms before going with his since the task was simple enough that even I myself could have done it but since I couldn't afford mistakes, I instead made the mistake of hiring this lawyer. The day before the hearing I had to call him since he had not contacted me regarding the case or his process or anything at all. The reason was that he hadn't done anything- He walked in to the court room less than 5 minutes before the hearing began and asked me questions about the restraining order which I provided to him weeks before. Apparently he took the time to read it right before the hearing itself because instead of fulfilling his promise, he just asked for a continuance or postponement if you're unfamiliar (and billed me for his appearance). The next hearing went exactly the same way, except it was the other party that requested the continuance (and he billed me for his appearance). After I contacted him demanding he file the evidence I provided to him and ask what his plan was for the next hearing, his response was that he was "hoping the other party doesn't show up". He got his wish (and billed me for his appearance) and the case was dismissed without prejudice after him having done nothing and with a smile that implied a victory, said that even though it can be filed again, he would just take care of it then. The next problem was the response to a divorce filing. His paralegal called me multiple times the day it was due, the last of which occurred after 4:00PM while she ironed out the details. The response was filed shortly after that and less than an hour from the deadline, which tells me he wouldn't even have time to proofread it. Although his staff is very diligent , friendly and competent, the opposite is all that can be said for this lawyer. In the first hearing dealing with jurisdiction of my divorce, he lost. For context, the other party represents themselves and is a person in their early 20s with zero college and legal training and that's who he lost to. (and he billed me for all of this) I arranged a meeting in person after this to try to understand why all of this occurred the way it did. The first thing he did in the meeting is remind himself of who I was and my case (he never took the time to learn either of my cases), and after my first query that questioned his level of competence, he immediately offered to withdraw from my case. Having already made the decision to fire him, I pressed forward in the conversation asking him why he failed to get my restraining order case dismissed, to try to get reassurance that he wouldn't lose to court against this person a second time. Instead of providing any explanation, he just reiterated that he would withdraw from my case. I haven't been invoiced for this month yet but I have a feeling I was billed for that as well. The conversation took place over 8 minutes and what I have written here was all he said. The ordeal I've just related cost me over $3,000. And due to his failure to withdraw from my case within a deadline, the opposing party is filing a complaint with the BAR. I am filing one of my own for obvious reasons. I don't see any responses to either positive or negative reviews on google, so use that as reference to his method of addressing really just about anything.

Jason was phenomenal! He listened to my issue and provided cost-effective solutions for my debt. I must admit- It is very difficult to come face-to-face with debt; It hurts the ego and has left me with sleepless nights of worry and impending doom. Would give 0 stars if possible. Attorney did absolutely nothing but took a big chunk of backpay. Took myself through my Ssdi claim for almost 4 years including the initial denial and appeals process. Went to a hearing, and judge asked me to come back with an attorney. Found this one through a friend referrel . Worst decision ever for legal representation. She literally did nothing. Except negotiate an inset date that cost me to lose 3 years of backpay, in exchange for a bench decision. Then had the audacity to charge me for fees for Obtaining my med records... Which I took to her and paid out of pocket for, to the record copiers, In order to get them released. She then took 25% of each of my children's backpay as well, which I never retained her for my children. Scam con artist scum attorney. Avoid her at all costs

I was in an auto accident in July, 2015, where I was injured after being forcefully rear-ended and thrust into into another vehicle in front of me. I went to Heuser and Heuser for representation, they readily agreed to take my case, and I was assigned to one of their attorneys, Patrick Salt. The day Mr. Salt took my case was the one and only time I met with, or even spoke to him, until the day he dropped me 19 months later. The only contact I received from the firm during that time as their client, other than periodic letters, were from legal assistants, and ONE face to face with Mr. Salt's paralegal. (He went through three different legal assistants during my time as his client, and each time a new one was brought on, I literally had to give them every detail of my case, the doctors who were treating me, etc. as though the last one had not kept any notes or records of the previous conversations I had with them). I often would not hear from anyone for 2-3 months at a time, then I would have to call to ask how/what was going on with my case. Whatever assistant was there at the time, would either make up some sort of excuse about why I had not been contacted or why things were taking so long, such as saying my doctors had still not sent them my records, or something similar that put blame on someone else. Sometimes they offered me no excuse, and simply told me they would speak with Mr. Salt and get back to me; then another several weeks or months would go by. To make a long story short, Mr. Salt completely neglected my case for a year and a half, then when I assume he realized his neglect had severely hurt my case, or they weren't going to be able to make enough money off of me, I was called in to speak with Mr. Salt for the second and last time at the end of February, 2017. This was when he told me he "didn't feel comfortable" representing me anymore and withdrew from my case. I was given no warning, and when I pleaded with him not to do this to me and asked for a reason why, he refused to give me an explanation, instead, he literally opened his office door and responded with "have a good day." So now I'm left with a stack of paperwork as thick as an encyclopedia, with no idea how to proceed, attempting to find another attorney who is willing to take a tarnished case. Mr. Salt treated me like I wasn't a human being, but just a disposable "case number" that was only worth whatever potential money I could make them, and once he thought they couldn't make enough off me, I was thrown away like a piece of garbage. It was the worst experience I have ever had with someone who is supposed to be a professional.

What a Personal Injury Lawyer Can Do for You

A personal injury lawyer specializes in helping individuals who have been physically or emotionally injured due to the negligence or wrongful actions of another party. Whether you've been hurt in a car accident, suffered a slip and fall, or experienced medical malpractice, a personal injury attorney works to ensure you receive fair compensation for your injuries. They can help you recover damages for medical bills, lost wages, pain and suffering, and other related expenses.

Personal injury lawyers act as your advocate, navigating the legal system on your behalf and dealing with insurance companies to ensure you get the compensation you deserve. They understand how to handle complex legal matters and help you avoid common pitfalls.

When Should I Hire a Personal Injury Lawyer?

Hiring a personal injury lawyer can be beneficial in many situations where you've been harmed due to another's negligence. Some key scenarios include:

  • Severe injuries: If you've suffered significant or permanent injuries that result in substantial medical bills, a lawyer can help ensure you are fairly compensated.
  • Long-term or permanent disability: Injuries that affect your ability to work or require ongoing medical treatment are complex, and a lawyer can help estimate long-term damages.
  • Disputed liability: If the responsible party or their insurance company denies liability for your injury, a lawyer can gather evidence and advocate on your behalf.
  • Insurance company lowball offers: Insurers often try to settle personal injury claims for as little as possible. A lawyer can negotiate to get you a fair settlement.
  • Medical malpractice claims: Injuries caused by a doctor, nurse, or healthcare provider due to negligence require a personal injury lawyer experienced in medical malpractice law.
  • Exposure to hazardous substances: If you've been injured due to exposure to toxins, chemicals, or dangerous substances, a lawyer can help pursue legal action.

Hiring a lawyer early in the process is crucial, especially if you're unsure of the full extent of your injuries or damages.

What Does a Personal Injury Lawyer Do?

A personal injury lawyer provides a wide range of services to guide you through the legal process and maximize your compensation. They can:

  • Evaluate your case: A lawyer will assess the strength of your claim and determine whether you have a viable case.
  • Investigate the incident: Gathering evidence such as police reports, witness statements, medical records, and expert opinions is key to building a strong case.
  • Negotiate with insurance companies: Lawyers handle communications with insurance companies to ensure you receive a fair settlement and aren't taken advantage of.
  • File a lawsuit if necessary: If a fair settlement can't be reached, the lawyer can file a personal injury lawsuit on your behalf and represent you in court.
  • Help calculate damages: This includes medical expenses, lost wages, future medical needs, pain and suffering, and emotional distress.
  • Prepare and file legal documents: Lawyers handle all the paperwork and deadlines associated with your case, including filing motions and discovery requests.
  • Represent you at trial: If your case goes to trial, the lawyer will argue your case before a judge and jury to obtain the compensation you deserve.

How Are Personal Injury Lawyers Paid?

Most personal injury lawyers work on a contingency fee basis. This means they only get paid if they win your case, either through settlement or a court judgment. Here’s how it works:

  • Contingency fee percentage: The lawyer will take a percentage of the settlement or award, typically between 25% and 40%, depending on the complexity of the case and the stage at which it's resolved.
  • Costs and expenses: In addition to the contingency fee, the lawyer may deduct other costs associated with the case, such as filing fees, expert witness fees, and court costs. These expenses are often advanced by the lawyer and repaid out of the settlement.
  • No upfront payment: Since the lawyer’s fee is contingent on winning, you usually don’t pay anything upfront.

Always discuss the lawyer’s fee structure during your consultation to avoid surprises.

How Much Does a Personal Injury Lawyer Cost?

The cost of hiring a personal injury lawyer depends on the specifics of your case and the lawyer’s fee structure. However, since most personal injury lawyers work on a contingency fee basis, the amount you pay will depend on the outcome of your case. Here are some general guidelines:

  • Contingency fees: Typically range from 25% to 40% of the settlement or award. The percentage may increase if the case goes to trial or requires an appeal.
  • Other costs: In addition to the lawyer's fee, you may be responsible for case-related expenses such as expert witness fees, medical record retrieval fees, and court costs. These are often deducted from your settlement, so you won't have to pay out of pocket.

While the cost may seem high, hiring an experienced lawyer can significantly increase the amount you recover, making it a worthwhile investment.

Top Questions to Ask a Personal Injury Lawyer

Before hiring a personal injury lawyer, it's essential to ask questions to ensure you’re choosing the right representation. Here are some important questions to ask:

  1. What is your experience with personal injury cases like mine?
Make sure the lawyer has handled cases involving similar injuries or accidents.
  2. What is your fee structure?
Clarify whether the lawyer charges a contingency fee and what percentage they will take from any settlement or award.
  3. How long will my case take?
While it's hard to predict, a lawyer can give you an estimate based on similar cases they’ve handled.
  4. How often do you take cases to trial?
Some lawyers prefer to settle quickly, while others are more comfortable going to court if necessary.
  5. Will you personally handle my case?
In larger firms, junior lawyers or paralegals may handle some aspects of your case, so it's important to know who will be managing your claim.
  6. Do you have references from past clients?
Speaking with past clients can provide valuable insight into the lawyer’s effectiveness and professionalism.

How to Check the Credibility of a Personal Injury Lawyer

To ensure you’re hiring a credible personal injury lawyer, take the following steps:

  • Check bar association records: Verify that the lawyer is licensed and in good standing with your state’s bar association. Look for any history of disciplinary actions.
  • Read client reviews and testimonials: Online platforms like Avvo, Martindale-Hubbell, and Google reviews can provide insight into the lawyer's reputation and client satisfaction.
  • Look at their track record: Review their experience with personal injury cases, particularly how many cases they’ve successfully resolved or taken to trial.
  • Ask for references: Credible lawyers should be willing to provide references from past clients who can vouch for their work.
  • Check professional memberships: Lawyers who are members of respected organizations, like the American Association for Justice (AAJ), often have a solid reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with a personal injury lawyer, prepare the following:

  • Detailed account of the accident: Write down everything you remember about the incident, including dates, times, and locations. Include any witnesses or police reports if available.
  • Medical records and bills: Bring any documentation of your injuries, treatments, and associated medical costs.
  • Insurance information: Provide your insurance details and any communication you’ve had with the other party’s insurance company.
  • Employment and income records: If your injury has impacted your ability to work, bring proof of lost wages or reduced earning capacity.
  • Photos or videos: If you have photos of the accident scene, your injuries, or property damage, bring them to your consultation.
  • Questions for the lawyer: Prepare a list of questions to ask, including how the lawyer will handle your case and what you can expect in terms of timeline and outcome.

By preparing thoroughly for your first consultation, you’ll help the lawyer understand your case more quickly and get a better sense of your legal options.
