Tom Foley was interested at first. Then came the endless requests for replenishing the retainer (with arbitrary charges that were not verifiable). As the case went on he grew more disinterested even letting me know how "weary" he was of my case! I knew I was in trouble and hired another attorney which never bodes well. If you want someone to stay by your side and fight for your interests he is not your attorney!!

Thomas Foley was disastrous as my legal representation and charged upwards of $3,000 for absolutely nothing. He talked a great game and was nice at our first meeting beyond that things went down hill fast. He was ill prepared for court and actually hurt my case. He misrepresented me to the judge and had zero of the case facts. He had to be corrected by the judge on multiple occasions, and was fired after 10 days. I hired another lawyer who was amazing. Thomas Foley is not a good lawyer. He is the bad ones who give the great ones a bad reputation.

My recent experience was amazing! From to moment I gave Mr. Foley my request for assistance he ran with it. I was left relaxed and in responsible and capable hands, when I asked questions he responded immediately and made my mind rest knowing I was in good hands. The case was settled and dismissed.!! I would recommend Tom Foley over and over again, He has definitely earned my respect and I admire his skills in his chosen field. Thank you to Tom Foley and his team.

*** DON'T HIRE THIS FIRM!!!*** I made a huge mistake in hiring this firm. They placed my case with an LLLT within the firm. It was explained to me that she would be doing paperwork and I would be represented in court by one of the lawyers in the firm. The LLLT didn't file the proper paperwork and the lawyer that was supposed to represent me said I never hired him. They made so many mistakes. Their mistakes cost me my family and over $10k with a good lawyer undoing everything they messed up. I currently have an open review with the Washington State Bar Association against this firm for its failure in my case. Run as fast as you can away from this firm.

If you choose this guy and get screwed around remember it's not because I didn't tell you so. I paid this guy $3,000 cash up front in full to represent me on my first DUI. I am 42 years old I had a perfect driving record prior to this. I was involved in a accident with myself and no other vehicles which resulted in my situation at hand. I hired this guy under recommendation from a pastor at my church who is over the AA ministry. The first time I met with him he sold me a great story about how it was all about finding weak points in the process that they used wow incarcerating me the night of the accident sounded great to me. At that time I informed him that I had a CDL driver's license and that I would love to be able to keep it. Also that I had a 13-year-old child that I am the single father of and have no one to keep her so I can't really do any jail time. He told me don't worry you won't be going to jail we'll get this if nothing else drop down to something less than a DUI. The case resulted with me losing my CDL. Having to do a class. $4800 in legal fees and fines. And a 90-day suspension on my license. But wait that was only the beginning after a year of going back and forth allowing my case to get switched around to multiple prosecutors he ended up settling for a deal that left me with a DUI conviction. I have to serve one day in jail. I have to have SR22 insurance. And I have to have a interlocker on my car for a yr. Now here's the messed up part when I was in court in the judge mentioned something about an interlocker he told me don't worry about it you already took care of that so I was under the impression that I was only supposed to have it for the 90 days of the suspension. After court come to find out I was supposed to have the interlocker the whole time I have been riding around breaking the law for a year and he never even told me that I was supposed to have this on my car. I have been riding all around the state of Washington with my family not knowing that if I got pulled over I will be sent to jail for automatic 30-day sentence. When I asked him about this after court he said don't worry you're moving out of the state anyway so you won't have to worry about the interlocker or anything that has to do with your Washington license. Today I got a paper from Missouri saying that my Missouri license that I don't even have and suspended for 30 days followed by a 60-day restriction. And that I need to get the interlocker put on my car in Missouri as well. Now I don't know what kind of lawyer you're looking for but if you're looking for one that is knowledgeable of the law. Or if you are looking for a lawyer that is not willing to tell you anything to get you to cooperate with scheme he is concocting then pick Aaron Richie. Oh yeah not to mention six points on my Missouri license that I don't even have!! WORST LAWYER EVER!!! I told u not to pick this guy!!

It won't let me put negative or no stars !!! I don't know where to start about how bad of an attorney this guy really is. I'll start by saying he gave me a price and I paid him in full thinking that that would get me the best representation. Boy was I wrong. The first time I met with the guy we sat down in his office I explained to him that I had a CDL and that I would like to keep it he told me he understood. Upon going on to the next phase I realized that my CDL license had been suspended when I asked him about it he said oh I didn't even know you had a CDL how does your lawyer not know that you have a CDL license strike one. Next he told me that I would not be seeing any jail time seeing as it was my first offense and I have never been pulled over or had any interactions with the law the entire 10 years I have been living in Washington. But when it comes time after a year of telling me we're setting it back so we can get it worked out we're setting it back so we can get it worked out. He comes and tells me that he needs me to do 24 hours in jail or 15 days on house arrest not to mention five years bench probation and over $1,000 in fines. When I went to his office and he opened my file not only did he not remember ever meeting me in person there were other people's paperwork in my file folder. Throughout the case I always had to call him to find out what was going to be happening at a court date he never called me to update me or have me on point about what we were going to be doing on court days. Just pretty sloppy all around. Not to mention the final play in court when they ask something and I didn't think it was correct he told me don't worry about it and then after court was like there's nothing we can do now. In other words I would conclude that this is the worst attorney I've ever had he came by recommendation. I am definitely going to go back and let the person who recommended him to me how poor of a job he did. I would not recommend this makeshift attorney to represent me or anybody I know. So if you go forward and use this guy this joker know that you were warned by one dissatisfied client.

Update April 2nd 2020- I have been receiving emails from AVVO that James now disputes information in my review. I want to make it clear that they are the ones pestering me by phone and email to write a review. Now that I wrote my honest feelings about the emotional roller coaster and screw-ups working together he wants to try and remove my review. Further reasons to stay away from James Pak Lawyer. They are trying to remove anything potentially negative about them even though they asked for the review. This speaks volumes about how they do business. STAY AWAY. March 20th 2020- I was being pestered by these people non-stop to write a review about their services working on my case. I tried ignoring them since my experience was pretty bad but alas... they kept asking for it. So here it goes. I retained James and his crack team of professionals because they showed up first in Google for personal injury attorney. I see thats not the case anymore and should have chosen one of the others that appeared on there now. I didn't call anyone else because I assumed they were the best. Boy was that a big mistake. Shortly after hiring them they sent me to a local chiropractor for a few months. This was okay, they did a great job although it was constant 3 times a week. Once the chiropractor said everything was better James' receptionist said that they would begin negotiating my case with the insured driver. The weirdest thing happened, after hearing weekly or monthly from someone during the first month or two of my case they went radio silent for over a year. I had ideas of the thousands of dollars they were making off of my case and no one could bother picking up the phone and giving me a call. And then it came... a phone call. From the receptionist. She told me that they've been negotiating hard on my behalf and they have reached a settlement. The offer? 50% lower than the national average for someone with my injuries. How do I know this? After 15 months of radio silence I started calling other attorneys and looking for second opinions. They were all too willing to share their opinions of my case and one looked up my injuries and told me the national average settlement amount. Armed with my new knowledge of the injuries and how personal injury law was negotiated, I declined the offer. I refused to take that low ball offer against my own attorneys advice. And I'm glad that I did! They went back to the insurance company and came back with a little better offer. Which I did take. I needed to put this behind me. It had been a long road. Would I hire this same law office again? Highly unlikely. After speaking to the other law offices in the area for 10 minutes, I was armed with much more information and now know they were all smoke and mirrors. Just because someone shows up on google first, doesn't mean they will negotiate your case properly.

I hired Johnnie Holtmann to represent me in a divorce action. I needed a quick infusion of cash in order to pay some bills, including his attorney bill. He recommended that I use the qualified domestic relations order (QDRO) process to transfer funds from my wife’s account. The court ordered that these funds be transferred as a “fixed” amount. Unfortunately, the result was that the transfer took four months instead of a few weeks. The bottom line was that I relied on his legal recommendations and that damaged me. My credit score suffered because I could not pay my bills in a timely way. I also lost money in the transaction because the monies were not put into a “fixed” account such as a savings account, but were put into a “variable” account that lost roughly 9 percent of its value over that time period.

What a Personal Injury Lawyer Can Do for You

A personal injury lawyer specializes in helping individuals who have been physically or emotionally injured due to the negligence or wrongful actions of another party. Whether you've been hurt in a car accident, suffered a slip and fall, or experienced medical malpractice, a personal injury attorney works to ensure you receive fair compensation for your injuries. They can help you recover damages for medical bills, lost wages, pain and suffering, and other related expenses.

Personal injury lawyers act as your advocate, navigating the legal system on your behalf and dealing with insurance companies to ensure you get the compensation you deserve. They understand how to handle complex legal matters and help you avoid common pitfalls.

When Should I Hire a Personal Injury Lawyer?

Hiring a personal injury lawyer can be beneficial in many situations where you've been harmed due to another's negligence. Some key scenarios include:

  • Severe injuries: If you've suffered significant or permanent injuries that result in substantial medical bills, a lawyer can help ensure you are fairly compensated.
  • Long-term or permanent disability: Injuries that affect your ability to work or require ongoing medical treatment are complex, and a lawyer can help estimate long-term damages.
  • Disputed liability: If the responsible party or their insurance company denies liability for your injury, a lawyer can gather evidence and advocate on your behalf.
  • Insurance company lowball offers: Insurers often try to settle personal injury claims for as little as possible. A lawyer can negotiate to get you a fair settlement.
  • Medical malpractice claims: Injuries caused by a doctor, nurse, or healthcare provider due to negligence require a personal injury lawyer experienced in medical malpractice law.
  • Exposure to hazardous substances: If you've been injured due to exposure to toxins, chemicals, or dangerous substances, a lawyer can help pursue legal action.

Hiring a lawyer early in the process is crucial, especially if you're unsure of the full extent of your injuries or damages.

What Does a Personal Injury Lawyer Do?

A personal injury lawyer provides a wide range of services to guide you through the legal process and maximize your compensation. They can:

  • Evaluate your case: A lawyer will assess the strength of your claim and determine whether you have a viable case.
  • Investigate the incident: Gathering evidence such as police reports, witness statements, medical records, and expert opinions is key to building a strong case.
  • Negotiate with insurance companies: Lawyers handle communications with insurance companies to ensure you receive a fair settlement and aren't taken advantage of.
  • File a lawsuit if necessary: If a fair settlement can't be reached, the lawyer can file a personal injury lawsuit on your behalf and represent you in court.
  • Help calculate damages: This includes medical expenses, lost wages, future medical needs, pain and suffering, and emotional distress.
  • Prepare and file legal documents: Lawyers handle all the paperwork and deadlines associated with your case, including filing motions and discovery requests.
  • Represent you at trial: If your case goes to trial, the lawyer will argue your case before a judge and jury to obtain the compensation you deserve.

How Are Personal Injury Lawyers Paid?

Most personal injury lawyers work on a contingency fee basis. This means they only get paid if they win your case, either through settlement or a court judgment. Here’s how it works:

  • Contingency fee percentage: The lawyer will take a percentage of the settlement or award, typically between 25% and 40%, depending on the complexity of the case and the stage at which it's resolved.
  • Costs and expenses: In addition to the contingency fee, the lawyer may deduct other costs associated with the case, such as filing fees, expert witness fees, and court costs. These expenses are often advanced by the lawyer and repaid out of the settlement.
  • No upfront payment: Since the lawyer’s fee is contingent on winning, you usually don’t pay anything upfront.

Always discuss the lawyer’s fee structure during your consultation to avoid surprises.

How Much Does a Personal Injury Lawyer Cost?

The cost of hiring a personal injury lawyer depends on the specifics of your case and the lawyer’s fee structure. However, since most personal injury lawyers work on a contingency fee basis, the amount you pay will depend on the outcome of your case. Here are some general guidelines:

  • Contingency fees: Typically range from 25% to 40% of the settlement or award. The percentage may increase if the case goes to trial or requires an appeal.
  • Other costs: In addition to the lawyer's fee, you may be responsible for case-related expenses such as expert witness fees, medical record retrieval fees, and court costs. These are often deducted from your settlement, so you won't have to pay out of pocket.

While the cost may seem high, hiring an experienced lawyer can significantly increase the amount you recover, making it a worthwhile investment.

Top Questions to Ask a Personal Injury Lawyer

Before hiring a personal injury lawyer, it's essential to ask questions to ensure you’re choosing the right representation. Here are some important questions to ask:

  1. What is your experience with personal injury cases like mine?
Make sure the lawyer has handled cases involving similar injuries or accidents.
  2. What is your fee structure?
Clarify whether the lawyer charges a contingency fee and what percentage they will take from any settlement or award.
  3. How long will my case take?
While it's hard to predict, a lawyer can give you an estimate based on similar cases they’ve handled.
  4. How often do you take cases to trial?
Some lawyers prefer to settle quickly, while others are more comfortable going to court if necessary.
  5. Will you personally handle my case?
In larger firms, junior lawyers or paralegals may handle some aspects of your case, so it's important to know who will be managing your claim.
  6. Do you have references from past clients?
Speaking with past clients can provide valuable insight into the lawyer’s effectiveness and professionalism.

How to Check the Credibility of a Personal Injury Lawyer

To ensure you’re hiring a credible personal injury lawyer, take the following steps:

  • Check bar association records: Verify that the lawyer is licensed and in good standing with your state’s bar association. Look for any history of disciplinary actions.
  • Read client reviews and testimonials: Online platforms like Avvo, Martindale-Hubbell, and Google reviews can provide insight into the lawyer's reputation and client satisfaction.
  • Look at their track record: Review their experience with personal injury cases, particularly how many cases they’ve successfully resolved or taken to trial.
  • Ask for references: Credible lawyers should be willing to provide references from past clients who can vouch for their work.
  • Check professional memberships: Lawyers who are members of respected organizations, like the American Association for Justice (AAJ), often have a solid reputation in the field.

What Should I Prepare for My First Consultation?

To get the most out of your first meeting with a personal injury lawyer, prepare the following:

  • Detailed account of the accident: Write down everything you remember about the incident, including dates, times, and locations. Include any witnesses or police reports if available.
  • Medical records and bills: Bring any documentation of your injuries, treatments, and associated medical costs.
  • Insurance information: Provide your insurance details and any communication you’ve had with the other party’s insurance company.
  • Employment and income records: If your injury has impacted your ability to work, bring proof of lost wages or reduced earning capacity.
  • Photos or videos: If you have photos of the accident scene, your injuries, or property damage, bring them to your consultation.
  • Questions for the lawyer: Prepare a list of questions to ask, including how the lawyer will handle your case and what you can expect in terms of timeline and outcome.

By preparing thoroughly for your first consultation, you’ll help the lawyer understand your case more quickly and get a better sense of your legal options.
