Robert Pearson was recommended to me by my long-time tax professional following the death of my husband in a traffic accident. He was extraordinarily patient in explaining to me the various options available, as neither my husband nor myself had established a will. I could not have asked for better service in dealing with the numerous documents and situations relating to my husband as well as in establishing a will and trust in my own name. Over the years, I have contacted his office for updates and other matters, with nominal fees (if any). His associate, Cindy, has also been very helpful. I do not hesitate to recommend this attorney.

May,25,2011, Charged $12,500 did nothing, and did not communicate to elderly Father the Trustee of Family. D Mortensen went to the wrong court first time, stalled and did nothing to help distribute the inheritance. Charged $180 for each death certificate that was handed to the secretary by me personally. Then he claimed he didn't get paid the extra $2500. Never answered a professional question, said he get back to us never did.

We had been putting off creating an estate plan, but when we started a family we knew we couldn't put it off any longer - we didn't want to leave guardianship up to the state. We looked for a competent attorney in the area and are so glad that we decided to go with Mortensen Law. Mr. Mortensen and his staff were very knowledgeable and friendly. They were able to create everything we needed (will, trust, power of attorney, etc) very quickly. What a relief to finally have our wishes on paper. I think we would have done it sooner if we had known how inexpensive and easy it was with Mortensen Law.

I'm convinced that Ann Riley is the most ethical, competent, and intelligent divorce attorney in the Bay Area. I interviewed a lot of lawyers and many of them were simply not confident about the law and fairly apathetic. Ann really cares in a way that is helpful. She doesn't waste your time, she is able to be firm when needed, and is extremely logical. She has a good understanding of the family court system in SF. Opposing counsel was unprofessional and difficult and Ms. Riley refused to engage, knowing that it would cost me more if she did so and that it wouldn't get me any further ahead. A lot of attorneys like to engage in time wasting activities because they know they can get away with billing you for them - there wasn't a single line item in Ms.Riley's bill that was questionable - she deserved every penny of her retainer. I wish I had met Ann under different circumstances but I'm really grateful to have met her when I did. She gives me hope that there are still decent and good people who find value in doing the right thing.

Totally disappointed that they took all of my personal details, rushed me while on the phone, and gave me this excuse that doesn’t make any sense. It’s unrealistic to do an intake if you claim to have too many clients. Why waste anyone’s time. It’s better to really provide a reason as to why you aren’t able to help. I wasn’t sure if I would do business with them, since they request $1,000 up front and they don’t help to access records by subpoena or any private investigation that may be needed. If you talk to them, I would recommend getting your questions answered first, prior to giving them all of your personal details. I totally wasted my time.

Jeff is a really good Negotiator, calm in the face of adversity and always trying to reach a resolution. We're in a bit of an ugly lawsuit and have had lots of damage to our house by our soon to be neighbors... one violation at a time. It was great to see that our attorney was compassionate enough to come by our home (twice) to make sure he understood the entire situation, first hand. Sometimes its hard to explain the small details that tell a story, therefore we feel really lucky to have found Jeff! He's able to see the big picture without losing sight of the detail. To top it off, he has a great sense of humor. grateful we found him!

Attorney Cohen was hired to start immediately to try to recover money that my Mother left me as inheritance. I was in a hurry, tight time line. After he was hired he screwed me around for around 7 months . He took notes and we discussed but he would be very busy or traveling. As I found out later he basically kept me at the back of the line and placed a higer priority on the firms favorite clients. I begged him to get the case in court before my father passed away, he didn't. So, I lost $225,000. that now is in the trust. The trust amont gets divided by 50 % , so I lost $113,000. to my sister. When this happened the firm FMBK would not return my money for this mess. Over $7,000. I have fallen into depression and have not recovered any of my Mothers money. Seyfarth Shaw hired him , I guess either didn't check out his past performance or didn't care. I wonder what this says about another Law Firm and their attorneys. He really screwed me over. I have all the e mails between Jeff and myself, proof of what took place. Find another attorney ! I should of sued him for Malpractice. These are my allegatioins

He talked to a few colleges about my case, that is all he has done after having the case over a 2 years. I asked for some of my retainer back and that was over 8 months ago, he has not given me a dime. He is suppose to send me a statement when he takes money out of the retainer. He never has. I hired Michael as a Probate Attorney when my dad passed away and he was TERRIBLE. He was nice before I initially hired him. Once he was hired he showed his true self. He wouldn't return my calls. He didn't want to give me my file back after I fired him. He wanted me to pay for the copies, when the file belong to me. He was always rude whenever I called to speak wit him about doing his job. He cost me additional fees, because I hired another attorney to do the work. For a while he had me feeling that all attorneys were like him but now I know they are not. I am an attorney in Lake County California. I work in Mendocino county sometimes, but often refer Meredith Lintott to people who call in from Mendocino county. I am writing this because of the prior poor review. I have had a case with Meredith Lintott and found she was an exceptional and tough adversary. I found her work to be great and her demeanor to be very professional. I found her to be of high integrity. She absolutely has no idea that I am writing this. I would fight just as hard against her as I always do in my cases so she is not a "buddy" so to speak. But as a professional who often identifies her as a professional doing family law in Mendocino to people seeking representation there I am honored to be able to give her 5 stars.

I was overly pleased with this lawyers performance both in court and via court documents. So much so that once the job was completed I felt as though I was somewhat at a loss for words. It seemed like a mere “Thank you” would have been too generic and insufficient. My husband and I were both very pleased with the results from the bifurcation process that we had undergone with the lawyer and we were pleased with the support and guidance that we’ve received from him and his staff throughout the process. It took a lot of frustration and stress off of our plates, enabling us to focus our energies elsewhere and we are utterly grateful to him for that. I will more than likely be in touch with him in the very near future regarding upcoming proceedings with this and other related legal matters.

I was referred to Ed Koons and consulted him regarding a matter of property. He never once mentioned price of the consult in any emails or via phone conversations. However he did say I have a case and he did mention a set price roughly $1300 to move forward with my case. I told him I would be deploying out of country and would have to wait until I got back. While deployed I received numerous bills of $225 for the consult (which he never once mentioned before). I called his office in attempts to have that fee removed and proceed with the case which would cost roughly $1300. However his office was determined that I owed $225 for the consult and the bill would stand, telling me it was a “verbal contract” (I did not know there were such things as verbal contracts in the matters of law) May I say again, *There was never any mention of a consult fee at all!* Sorry Mr. Koons but you just lost $1300 because you wanted $200. ***Any one consulting this office, get all the charges in writing, or you may end up getting unexpected bills from this Firm***

Ms. Leong crafted my parents' trust documents in 2000 as well as amendments and restatements over the next 18 years. Then, in July 2022, due to a financial emergency, Ms. Leong was very responsive and timely in effecting the necessary paperwork to allow for a change in trustee. All was good until it was time to administer the trust following my mom’s passing in February. Two main issues arose during the trust administration. First, according to Probate Section 16061.7, the trustee is required to notify the trust’s beneficiaries within 60 days of the death of a settlor and provide specific details as well as a copy of the trust. Ms. Leong advised that this notification seemed unnecessary, and the notification, meeting the requirements of that code, was the first order of business of the attorney I hired to replace Ms. Leong. Second, Ms. Leong promised to respond to client communications “promptly” and took up to five business days to respond, even with follow-ups from the Client. When challenged, she did not accept responsibility and instead offered insincere apologies. The subsequent attorney I hired not only handled the legally required notification, but he also suggested drafting a waiver of a formal accounting to preserve the trust’s assets from large legal and CPA fees that would be required if a beneficiary insisted on that detailed accounting. Ms. Leong made no such suggestion. My goal was to bring this trust matter full circle, as Ms. Leong had drafted all the documents and knew the history. Unfortunately, in my opinion, this matter did not get the attention that it deserved, thus motivating me to change attorneys and incur additional expense that could and should have been avoided.

There are so many decisions to be made when making a plan like this, like, who should be in charge if something happened to us and what choices we would like that person to make for us. Mr Magro was very patient with us and answered our questions in a way that was really easy to understand. We received the documents from him on the date he promised and his fee was super reasonable. What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
