I highly recommend Cynthia McMillian. She and the Joseph F. Pippen, Jr. law firm in Largo, FL helped my family in 2014 prior to our father's death, and all through Probate. It was evident throughout that I could have made a bunch of expensive mistakes had I not been working with and advised by her and the Pippen firm. That translates into money saved, worry and stress reduced, and time saved by doing things right, from the start. Besides her friendly and timely responses, she answered a lot of questions (and I ask a lot), handled most things by email (saving many trips to the office), and performed her services at the agreed on fixed fee without my being charged for anything beyond that. Also of great value was helping facilitate the sale of the my Dad's homestead property while it was in probate -- Not sure why, but two local Title firms told me that wasn't possible -- so glad I had Cynthia, Joe Pippen and their associates on my side. I think you'll be glad too!

I met with Mr Sherman for a consultation and soon after hired him to represent my interests. His deep knowledge and unwavering relaxed and even tempered tack served me better then I could ever have anticipated. I would highly recommend him to anyone in search of an Attorney.

Rebekah, with her specialized and unique background in education and law, was able to help me successfully strengthen my child's Individualized Educational Plan. This change to his plan, which was a battle to get accomplished, has greatly helped my child feel more successful in school. Before Rebekah, my son's IEP was not adequately addressing his unique learning style and various educational challenges. My son was overwhelmed with the intense curriculum of school even though he had an IEP. Upon reviewing my son's plan, Rebekah immediately understood what accommodations were missing and why. She was able to work through the red tape of my son's school district to get my son's needs adequately identified and addressed therefore he was finally provided with the accommodations he needed. Throughout this whole process, I found Rebekah easy to work with, very knowledge, always accessible and very persistent and dedicated to my child's cause. I highly recommend Rebekah Hope! She is a very good lawyer and great child advocate.

I’ve had to hire an attorney 6 times in my life. This is only the second attorney that is given me 100% of her efforts ( in my opinion) and diligently listened to my actual concerns and wishes. I left after the case feeling that I got a lot more than I paid for. That is definitely a first. So Jennifer took on my case even though three other attorneys would not because they did not agree with my strategy. We proceeded exactly how I wanted to and wound up with a great outcome. She asked questions, made suggestions, and ultimately formed a plan that we were both comfortable with. In my book that deserves five stars. So I implore you to contact Jennifer should you need an attorney who actually considers your opinions important. And the rarest of things, she always answered my calls and emails promptly. I dare you to find another attorney that will do that alone. Jennifer is a professional, caring, and compassionate attorney who will take your case to heart. Hopefully there will be no seventh time but I know exactly who to call should there be one.

Our family has used Ms. Woods Law Firm of McCarty, Summers for approximately 30 years. Our late father had this firm draft a "Q-Tip" trust for execution many years ago, and when he passed away in 2017, Ms.Wood was responsible for all phases of this tax plan being followed. Since some family members lived out of state, had different circumstances with children, etc since this draft was written, it required different details & accounting to make sure all that were involved were indeed dealt with fairly. As you can imagine some families like ours tend to be "high maintenance", but Ms. Wood was able to navigate through this, keep the flow of documents moving between everyone, working with Morgan Stanley to make sure proper distributions were made and constantly kept all family members "in the loop" ! Further, as the fiduciary of this trust I wanted to make sure that every last detail was followed per my fathers requests and Ms. Wood made my responsibility to the family a smooth transition. Now, the reason I highly recommend Ms. Wood is that she was able to make this all happen in a very timely manner. In closing, believe me when I say if Ms. Wood can handle my family and still keep peace with those involved and most important kept her fee's to "exactly" what we talked about when the exercise began, you have no choice but to use her for your estate planning. In short "she's a rock star" and no I'm not related to her ! Gary

I hope this review helps those who find themselves in a situation where they don't know what to do, how to proceed, where to turn, and feel that at every turn of the legal process they hit a brick wall. My husband and I were in that vey situation and Jamie literally fixed everything! We ended up firing our first attorneys ( whose name I will not mention), as they made our situation even worse and never truly explained the law to us. We then interviewed over 15 different attorneys in the naples area. As soon as we spoke to Jamie, we knew she was the right person for us. Not only will Jamie go to battle for you and fight for you every step of the way, she explains everything to you ( good and bad) so you're never surprised and feel a part of the overall game plan. She has such a warm and kind personality that many times she would just listen to me vent, and remind me that her job was to to take care of the mess we found ourselves in. Lastly, Jamie always let us know her schedule ( if she was out of the office, in all day meetings, etc) so that we would always be able to get in touch with her. Many times she even emailed us on Sundays to make sure we felt comfortable and had our questions answered as soon as possible. I think the world of Jamie. I wish you all the luck, but if you work with Jamie, you wont need it!

Jill has represented me for the past nine years concerning the guardianship of my father. During this period she helped direct me through one of the most difficult periods of my families' life. She was on top of every issue and helped direct me through the many intricacies of being a guardian. Her office staff has always been extremely responsive and provided immediate answers to my many inquiries. This past summer Jill called me after normal business hours on a Friday to assure me of an issue that she knew would be weighing on my mind all weekend. This is very typical of Jill in that always kept me informed. When I received an invoice, there was never sticker shock, or inflated hours. There never needed to be a discussion concerning an invoice, to my Father or me, they were always correct and equitable. I consider myself very fortunate to have Jill as my attor One of the things thatShe has always been I consider myself extremely fortunate to have Jill as my attorney.

TJ and Terri have been helping me and my brother out with a complex probate situation. Not only are they kind and professional during a difficult time for us, but him and Terri have been so supportive. TJ was able to problem solve and get us more money than we could have even hoped for. They have genuinely taken care of us and are not taking the easy road. We've filed objections, he's corresponded with another attorney to expedite things, and he thinks outside of the box. I wish that I lived in FL so I could continue to use him for other things. I absolutely recommend TJ. They are affordable and their quality of work is impressive.

Tim Hanlon is a real estate attorney in West Palm Beach, Florida. He has handled real estate purchases, sale and leases for us, as well as a builder dispute. He has extensive experience in both large and complex, and small and straightforward, transactions. We have benefited from his excellent reputation in the community, as he is able to work quickly and efficiently with other experienced real estate attorneys in the area. I am a former attorney from another state, and would strongly recommend Mr. Hanlon to others.

Florida Litigation Law Firm had done some basic work for me in the past but I had an unforeseen emergency that required me to respond quickly to some specific requirements. David and his team seemed to drop everything and give me amazing attention, they not only addressed the contract but have taken the time over the last 2 years to understand my specific business and its needs. They were able to help me negotiate an even better deal than I had hoped for. They always have my best interests in mind, not just billing me for hours. Many times they have told me where I can get information for free. They are great partners.

My sister and I used Collett for estate planning and elder care advise regarding my recently widowed mom. Collett was simply sensational: warm, knowledgable, professional and meticulously detailed. She listened attentively to our needs and our concerns about protecting the small amount of income that my mom is receiving, and then presented different options, and their implications. I loved how she was focused on my mom, her needs and wishes. It was also immediately apparent that she was incredibly knowledgable about all aspects of elder care law, and different legal implications for a range of related service (power of attorney, health directive, Medicaid eligibility requirements, trusts, guardianships, etc). I liked that she is specifically certified as an elder care legal specialist. Her fees were clearly laid out and very reasonable, I appreciated that she had a flat fee, so we knew exactly what we were paying for and what to expect. Unlike a lot of lawyers, we had to pay for our initial consultation which gets deducted from the fee if you contract her. In retrospect, it was totally worth it. In that time she reviewed a range of documents, a long intake form she sent to us prior, listened carefully and laid out different alternatives for us to consider (whether or not we hired her to execute them). Both the initial consult and the cost for services are flat fees, not hourly. Even though it was a flat fee, I loved that at no point did we feel rushed, quite the contrary, she gave us her complete undivided attention for a pretty long visit and made it clear that we could call on her for any additional questions that might come up. She didn't try to sell us anything we didn't need (we already had an older will for example, which she reviewed and found that it was still valid, and still reflected my mom's wishes) and didn't rush us to make any decisions. We walked into her office anxious and worried, and left breathing a sigh of relief, not only because she took care of what we needed in a timely manner, but because we felt this was someone we could trust. As an added plus, she has a Spanish speaking assistant a few days a week, but she understands quite a bit of Spanish. The office is not that centrally located, but that probably also helps to keep her cost under control. Highly recommended!

Mike Fowler was a personal acquaintance that was there for me when I needed him. My aunt became ill and caught up in the 'elder care system' last year and was in and out of rehab facilities and nursing care. I reached out to him and his daughter for some much needed advice on how to navigate a very poorly run system. What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
