Hiring Stephen Bilkis to represent me was the best step as I faced criminal charges that could negatively impact my life. His approach led to a very positive outcome. He is a sharp, respected, and efficient lawyer. I am also very grateful for the firm’s excellent professional staff, particularly Danielle Rizzo, who answers all my questions, responds without delay, ensures we get everything right, and conducts herself with warmth and friendliness.

I had terrible experience with Malory Carbone with my divorce . She did nothing good for me , I end up losing a lot to my husband , who didn’t even hire a lawyer and end up with much more . She was very cold and unprofessional ( she took calls during meeting with me and was using my time , which was 250/h) . Second it supposed she to be easy divorce because no children , and we were agree on most of stuff. At the end I lost a lot and she didn’t give me good advises and was distracted with all calls and wasn’t helpful at all. Will never recommend her as divorce lawyer.

Malorie was asked to represent my mother on a Monday, with a custody trial set for that Thursday. In less than two full days to prepare, she not only got up to speed on the case, she was outstanding in the court room. Her ability to ask the right questions with so little time to prepare was truly exceptional service. We are grateful for her help.

I have had a terrible experience working with this firm and Matthew especially. This should have been a very simple Real Estate Transaction and he made it extremely difficult. I have worked with a plethora of real estate attorneys and have never experienced one like Matthew. He is nearly impossible to get in touch with and very rarely answers the phone. After weeks of working, Matthew killed the deal. I do not recommend working with this firm.

A total CON, offering free seminars and roping in people to "steal their money" , 2 of us personally just in our own family have been scammed by them. Lies, Lies, Lies. Paperwork not completed or worded properly, no calls back, lies that they call yet we have 100% proof they don't, this lawyer needs disbarred immediately. Never had a lawyer so incompetent. When your family's estate is at risk this is a disgrace. Do NOT USE these People. You will regret it. UPDATE: MARCH 29 1PM He calls talk about unprofessional, basically trying to say no calls were returned because he felt they were not important. And trying to call us liars on the return calls 😂. Your family pays a lawyer they are to work for them all their is to it. Only called back after we notified the secretary we were reporting the situation to Buffalo. Takes turning them in to the Bar to get a response pretty sad.

My review and stars only refer to Raykin, Yelena. This lawyer is unprofessional and always in a rush. She is not available to do any closings after 2 pm because she said she will get stuck in traffic on her way home. People from the bank agreed to come at 3 pm and she rudely denied my request. She sent a very rude email telling me that if I am late for the closing she will charge a few hundred dollars extra. The closing only took 30 minutes! Stay away from her, she is NOT flexible and willing to work with her clients! Nasty person... I don't even know why we need a lawyer because she was completely useless.

I trusted him and followed his instructions to a tee! He charged just one flat fee. No hidden fees. I was never intimidated to call him! Thanks to Andrew, my Mom got into a facility. I highly recommend him. He is a "real person", not a typical condescending attorney! Thank -you, Andrew!

I hired Andrew when my mom’s managed long term care agency denied additional hours of home health care that she needed due to worsening health. He successfully represented her interests at the fair hearings which reversed the denial of additional hours so that she now receives the necessary amount of home health care. My mom also had hired Andrew several years ago when she needed to update her power of attorney and healthcare proxy, as well as to establish a family trust so that she would be able to remain at home rather than go into a nursing home if she ever needed home health care. A few years later she needed home health care and Andrew processed her Medicaid application. We were fortunate to have had his legal counsel and representation.

I hired Attorney Toombs to help me after my mother passed with her will and sell her home. What an amazing job! The process was much longer than I thought it would be, and there were a few times that I was the one holding the process up by not getting what she needed to her in a timely manner. However, the overall outcome was great, for what I was doing. I never once felt that my file wasn't being worked on even though she has many clients. Her staff are very kind and helpful. I even went ahead and hired her to do my own estate planning. Top notch attorney. I have recommended her to all my friends and am glad I ignored these reviews. People come to sites like this to complain. I however was not swayed and I'm glad I wasn't.

My sister and I were honored to care for our elderly mother who remained at home and passed away recently. In the process, we were advised by Ms. Kruper and by other attorneys in the Law Offices of Margaret Ann Carrozza, Bayside, NY. For example, the firm prepared the Trust for us and provided essential documentary evidence that permitted us to obtain a favorable decision in arguing for reimbursement of personal expenditures by my sister and me before my mother was deemed eligible for partial Medicaid assistance. Most significantly, we found Ms. Kruper to make herself available to assist us by providing pertinent information to guide us in addressing legal parameters on any matters we faced in regard to our mother's care. We have been most appreciative for the quality of this service that really is at the heart of the profession of law.

He fought for my kids, took his time explaining everything and even though he’s constantly in the court houses he was responsive, Honest and passionate about what he does. I had an extremely negative experience with this law firm and would not recommend their services to anyone. If I could give them 0 stars I would do so. I had my initial consultation with David which lasted only a few minutes. I had some questions about my situation, but he told me he does not work for free and he did not give me any further advice until I signed a retainer agreement. A few days later I received a text from a paralegal asking if I was still interested in their services and to pay a $2,500 retainer. The amount was a surprise to me because David had said that the retainer would be $1,000 during our initial consultation. The invoice they sent me for the retainer was also marked "Past Due" even though it was sent to me before I ever signed a retainer agreement. I believe they did this to get me to pay as soon as possible. After some back and forth with their paralegal over text, I paid $1,000 so that the firm could draft a letter to my landlord. The paralegal then told me to send important documents that I had to the firm. I asked them what documents I should send but never got a response, which is ridiculous because they are supposed to be advising me as to what is important. After hearing nothing I decided to send them a small amount of documents showing I lived at the apartment like cable bills. I followed up with them, and they told me the letter would be ready by 5pm on a Monday. They missed that deadline without giving me any explanation and despite my multiple texts asking them for an update. And while they were very quick to respond to my messages when it came to paying their retainer, it took them several days to get back to me about the status of my letter. Based on this, I told them I no longer wanted them to represent me and asked that they refund me. They sent me a receipt showing that I was only refunded $160 out of my $1,000 retainer, and without any explanation of the work they did. I wrote to the firm the next day requesting a full refund. David called me but mostly talked down to me instead of listening to my concerns and said things like "well you signed the retainer agreement." The firm then sent me a timesheet showing about 2.5 hours of work. According to that time sheet, it took them 1 hour to review the documents I sent (which were just my cable bills and a certificate). They also apparently billed me 1 hour for drafting the letter, which I never received. They also refused to give me a copy of the letter until I said I would be filing a complaint. The letter that it apparently took them an hour to draft was a couple of sentences that I could have done myself. It's unbelievable that this letter reflects two hours of attorney work. They also billed me for almost half an hour for texts I had with their office at their attorney rates. It was a complete surprise to me that I had ever texted any attorney because the person that was texting me said they were a paralegal, and I received messages like "all attorneys are in court right now". When I asked them about this, they claimed an attorney was texting me some of the time. If that is true, that attorney never identified themself as such and almost all of the texts were about payment of their retainer. Why should I have to pay them for that? Ultimately, I received no value from this firm and they refuse to refund me in full. Avoid at all costs

This office was responsible for my mortgage paperwork, and largely messed up the amount to be held back for school taxes and then emailed me a couple months later to just casually send them a check for over $1500, as if I didn’t just purchase a house and expect that they had already taken care of the tax amounts properly. Horrible experience and now I am not financially sound right before the holidays. What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
