Mr. Martin Handelman and Mr. Steven Witkowitz were both professional and took excellent/outstanding care of my case. They always keep me current and informed on every step of the legal process. I felt safe and protected, I actually felt untouchable because of their expertise and skill. They are powerful lawyers and caring individuals. I am filled with gratitude and warmth for all they have done for me.

Steve was by far the best attorney I've had (and I've had many at this point) with my family law issues. He went above and beyond for me! He handled everything himself, and I wasn't always speaking to a paralegal. His paperwork was phenomenal, and the judge threw the case out in less than ten minutes. I wish he was able to handle everything for me. I think about him often, and the impact he had on my family. Best most caring attorney hands down.

I have been working in Real Estate since the 1990's. Colleen starts communicating with parties usually starting at 6AM. I trust her with all of my seller and buyer clients as well as my own personal purchases and sales. Always great with communication (usually through email which I prefer as well). If I need her on the phone I just ask her to call between her closings and I always get a call back very quickly. FANTASTIC SERVICE :)

This guy is terrible and a liar. Quoted me one price, never contacted me and did nothing for me. Wanted me to get documents for his office and had his secretary call me to push me to do his job. He then told the realtor that I’m making his job difficult for him. He then wanted to charge me double because I told him I’m not getting documents for him that he’s supposed to get himself. I never spoke to him once and ended up switching lawyers. The 2 weeks I was gonna go with him he didn’t do one thing. Should get his law license taken away.

Very aloof, dismissive, and arrogant. He immediately told me it was $400 an hour to retain him, and I told him his office told me there was a free consultation. He said, "sometime yes, sometimes no. in this case you just need to decided whether you want to start a new business and then retain me if you want." If you are going to be arrogant in this business, you better know what you are doing and know more than the prospective client does and, frankly, I honestly believe in this case you did not.

I hired mr fix back in may to do my bankruptcy as he had handled my family court case. So I met with him and paid him $1500 up front as per his request. He gave me the list of things I needed and so I got all those things plus the first credit course certificate that I also sent to him. After that I went in a second time to sign the paperwork that was in June. Since then, I’ve had to call the bankruptcy court only to find out that my bankruptcy was never filed. And whenever I tried calling the office I could never get ahold of anyone because they don’t allow you to leave any messages for them to call you back. So this lawyer basically took my money but never filed my bankruptcy. Then come to find out, he’s been involved with the grievance committee from back in 2003 until present. So I wouldn’t recommend him at all. Especially if he just keeps violating professional codes of conduct within the legal system.

I was the seller, and I didn't come to closing (5 hours away). They wanted to charge 200 to wire funds which is absolutely theft of services since the banks charge $20, and then decided they don't and won't do wire transfers anymore. They waited 4 days to put the funds in the overnight envelope provided by my attorney, and they sent my attorney proceeds to me . Now I have the check but it's not certified funds so I need to wait for funds to clear as r.... meanwhile their clients (buyers) have the key to the house the day of closing. The gentlemen in the firm who answered the phone was amazing, but his hands were tied by the people running the show. If I ever have to do business with this firm I will tell buyers they get the key to the house WHEN I GET PAID. Poor business practices.

STAY AWAY! A foreclosure was entered against me although I'd received no notice from plaintiff at all. I told Lauterbach I wanted the default vacated and case dismissed. I asked him to contact the Court to let them know we were negotiating a retainer agreement. Long story short, he repeatedly presented a proposed retainer agreement which did not reflect the plan I thought we agreed on, he delayed contacting the Court, then literally hours before we were to show up in Court he sent me an email--at 7:30AM in the morning!--"I wish you luck," knowing the Judge consistently rules against anyone who shows up without an attorney, regardless of the case facts. Sure enough, I showed up to Court alone, and the Judge ruled against me (which is another lack-of-due-process/ethics problem, but that's another story). What would possess Lauterbach to behave in this manner is a complete mystery. He KNEW the harm he was causing. Not only unethical, but mentally twisted, in my view. Protect yourself!!! Pick someone else!

Asked this firm to aid in a fraudulent deed issue. They literally billed me not once, but twice ! before making any progress what so ever. I had them send a simple "threat" letter to begin the run of the mill process of so called legal action. The letter was nothing short of embarrassment and the person receiving the letter must have literally laughed out loud. I know I did. I quickly replied saying the letter is inaccurate and that I'd be glad to answer any questions , but the letter was sent anyway in a rush and I was ignored. It's funny to how I was quickly billed for the mistake. But questions go unanswered for a week. Obviously did not listen or care about my issue, Just wanted the money for Nothing. When I foolishly asked the next steps of the process via email..even though my gut told me to run already , i was ignored for a week and guess what? surprise! I received another bill in the mail for those emails I sent. The balls on some of these lawyers. Yet another example of why you should never pay anyone up front. I just wasted hundreds of dollars for a bogus letter and 2 questions that went unanswered. If that's not bad enough , a child could have wrote the letter 100 times better or had AI do it in seconds. For free . Imagine hiring a plumber and you come home and he's tearing the roof off...does he get paid? Thankfully AI will cut out the use for all lawyer's and the paperwork in the future, 4 of 4 lawyers I've used in my life so far have been absolutely worthless money grabs. It's amazing how a computer made a wonderful argument and letter in seconds. Choose wisely

When my dad’s health was deteriorating and my mom wanted legal guidance to secure/protect their joint assets, I asked our long time corporate council if he could help. He highly recommended SCHNEIDER & GARRASTEGUI, the law office that took care of his elder care needs. So in 2008 Vivian Garrastegui became our elder care attorney and my mom and I were pleased and relieved to have such patient, understanding guidance. Vivian not only met with us, but she allowed us to record some of our meetings so we could share what we were planning/doing with my brother who lived in Pennsylvania. My dad died in late 2008 and in late 2009 my mom was diagnosed with ALS. It soon became apparent that she could not/should not live alone, especially in her 2-story home. Since my home also had stairs, we agreed that my husband and I would sell our home and mom would sell her home, and the three of us would buy single level home to share. Again, we sought Vivian’s help. She gave us guidance on the sale of both houses and she represented us on the purchase of the new home. Vivian also made sure my mom’s ‘ducks were in a row’ (Power of Attorney, Last Will & Testament, Do Not Resuscitate, etc.) so that that mom’s wishes would be followed and her assets would be distributed as she wanted (to her three children and four grandchildren). Mom died in early 2011. Everything went according to plan without a hitch. After my husband suddenly died in January of 2014 I had Vivian make sure my affairs were in order (Health Care Proxy, Living Will, etc.). In August of 2014 I remembered a small life insurance policy that my father-in-law took out on my husband (when my husband was born). In the early years of our marriage we took over the $33 per year premium payments until it was paid in full. I inquired and found that there was about $2,000 payable on my husband’s death. When I tried to collect this I found that the policy’s beneficiary was my mother-in-law, who died in 1989. Again, I sought Vivian’s council to successfully get through the red tape. So, I have been an extremely satisfied client of Vivian Garrastegui for eight years now. I would, without hesitation, highly recommend her and I will, definitely, call on her again when the need arises.

First of all my contract with "Goldsand Cinque" stated Goldsand's retired so it's just Robert Cinque. In my opinion if your able bargain with used car dealers and sly contractors you might get 2 star work from Mr. Cinque. He managed to go through a retainer double the going rate with an incomplete Discovery, no Deposition, no custody issues and a two phone call "negotiation" with opposing council. Mr. Cinque neglected to consult me prior to issuing the Demand for Disclosure nor where their follow ups to correct the stated omissions. Omissions included a property deed to prove joint ownership where spouse had put me on title. Proof spouse used separate funds for another jointly owned/purchased property also omitted; despite the forensic CPA opinion spouse had fleeced comparable funds from me prior to purchase. He convinced me to end Disclosure because he claimed spouse had offered the more valuable of two properties stating it was the best I could. That afternoon he called practically shouting at times that I had to take the less valuable property (-50k ). This was spouse's offer prior to engaging Mr. Cinque. Beside divorces Mr. Cinque stated he offers notary services, all clerical services were executed competently.

Robert Cinque is a razor sharp attorney who defended my case against another attorney bringing suit against me. I knew I chose well witnessing him handle my deposition with such professionalism. It was evident upon the cross-examination of the plaintiff, that Mr. Cinque does his homework and leaves no stone unturned! When going to trial, with a jury, for several days, one never knows what the outcome might be. Witnessing Mr. Cinque's cross examination of the plaintiff and the manner in which he presents evidence to the courtroom, with his low keyed quiet competence and integrity, shows how effective a lawyer he is. He won my case on every count against another attorney as the jury rendered a verdict in favor of me.

I don’t know where he found these clowns but if you’re trying to do estate planning do yourself and your loved ones a favor and go find a reputable estate attorney. These guys are completely unprofessional. They don’t answer their phones nor do they return phone calls. We had an appointment to meet with the power legal Jen to see my fathers wishes and we sat down stairs in a waiting room for over an hour when we had an appointment! I want to start out by saying Ms Donlon's paralegal is extremely knowledgeable and nice. If for some reason you hire Ms Donlon you will probably deal with her paralegal at least 90% of the time. She didn't show up for my first hearing. When i called to ask her if she was on her way she replied, "Why would I be? I wasn't hired for that." Well she was hired for that and I have the contract to prove it. I asked her multiple times to call about statements from a couple of witnesses. I didn't find out until I fired her 2.5 months later that she didn't get those statements. She said she wouldn't need them for another 5-6 months. Which i thought was even more reason to get them when I requested. She couldn't seem to grasp that concept. I didn't think it was worth my time to explain her job to her so I left. Both options would have yielded the same results. Memories can get a little hazy after time has passed and what what could have been a huge advantage can end up being being worthless because you failed to comprehend something most 6th graders would understand. You are 1000% better off hiring someone else. That is unless you like being talked down to and paying someone to copy your homework.

I hired Miss Donlon in a custody matter. I should of just got a public defender. She Atleast fought for her client.. She was late for the first court date. It was over by the time she even got there. She didn’t listen to anyone of my wants. Never responded back. Day of final court date she had nothing ready. Felt like I did most of the work. When they order came I didn’t even get to see it before it was signed by the judge, It had all sorts of mistakes on it that she wouldn’t fix. She kept the entire retainer for nothing. I would of done better pro se.

In my divorce and child custody hearing Ms. Donlon did not keep in contact with me, almost all communication was initiated by myself and I rarely spoke to anyone but the receptionist. In every case I showed up to court not knowing what to expect and was basically told to give up that there was nothing to do. I could have done no worse had I represented myself as I ended up paying maximum everything with almost no parental rights even though I had proof to counter the lies that were being told. She told me to gather everything I had and send it to her which I did. She had it for two months and informed me on the court date she never even looked at it and that I was going to lose anyway. I feel as though she never did anything for the money she was paid. I can not in good conscience recommend her in any way. I did all the legwork and got nothing in return. Even after asking her to petition for lower child support after I had to move to a different area and take a job making half of what I was she told me no, that I would not even be considered. Afterwards I discovered that was not true and have paid 80% of my income for a year because sure have me bad council and wouldn't go through the effort of helping me, her client.

After checking with my mortgage holder, it was determined that I had been sent a false document suggesting I was in foreclosure. This company is obviously preying upon individuals who believe that they are in dire straights financially. This company should be investigated by a state attorney general, in order to prevent moe victimization. Shame on you! I also have not hired or consulted them. This would be my third time going to Mr Herdzik for representation. He handled two bankruptcies and is currently representing me in a support proceeding. I have a pretty good rapport with him (out of poor/fair/good/great/excellent). I’m not sure how effective he might be, but I trust that he will do his due diligence as he has done in my other two cases. Although I understand that bankruptcy and family law are two different arenas, I trust that he will handle my case with care. I have a unique case, but overall not too complex, more so straightforward. His fee was reasonable…we’ll see how it goes! I’ll be back for an update; )

I hired this guy for a custody case. He's not a good lawyer. He did not advocate for me and did the bare minimum. He seemed out-of-place in the family court setting. He blindly followed the law guardian's recommendations. He filed paperwork that wasn't worded correctly which caused issues. HE DID NOT RETURN MY UNUSED RETAINER MONEY AFTER SEVERAL PHONE CALLS AND LETTERS. UPON ANOTHER LAWYER'S SUGGESTION, I SENT A LETTER VIA REGISTERED MAIL (SO I'D HAVE PROOF IT WAS SENT). Ms. Pezzino is the lawyer who met me at the lowest point of my life. She gave me the time in the day when nobody else would, she listened, she read previous denials in my case, she contacted my doctors, reviewed the records, spent hours and hours working on my appeal. We did not have much time left but she cared enough to spend time despite her own problems and issues and made sure to file an appeal on time. It took several years to fight back and forth but we were able to prevail. I can thank Ms. Melissa A. Pezzino enough for everything she sacrificed for my case. Thank you, MP, you are one of a kind. Highly recommend this lawyer to anyone looking for a good one.

Attorney Ronald far exceeded my expectations. I hired him for my Divorce/Child Custody/Child Support matters. He was professional, kind, generous, and compassionate towards my concerns. He was very patience on phone calls and made me understand the ground reality before I take any decision. I would highly recommend him to those seeking legal assistance.

Hired him and told him we were under pressure to address an issue quickly due to a time constraint. He assured us he could handle it and then did nothing. Did not research any of the leads we gave him, did not file the papers with the court after 8 months had lapsed, after telling us they would be filed within two weeks. Kept cancelling our appointments for personal reasons and just dropped the case. Ran off with our money and we haven't seen a refund yet.

Honestly Mr depalma was a horrid lawyer. He had an attitude and was very disrespectful and he may stick up for his clients in the court house but he doesn't tell the truth when doing so. Not a very good lawyer and I was shocked after reading good reviews.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
