Several calls to her office were rudely answered by her assistant. Did not answer the questions and repeated what I already knew. When I asked what the purpose of her services are _ " to lookout for the best interest of the client" okay please educate me to what the entails. " to look out for the best interest of the client". Great thank you for telling me what I already know. She is the worst attorney and has absolutely no business practicing law NOR being pushed on anyone from the Juneau County Court House. I will be lodging a formal complaint with the State Bar Association.

Rebecca was hired to be a representative and failed to fairly represent both sides. Due to initial bias judgement, was neglectful when provided important information and proof provided by the side she favored less.

I hired Rebecca to represent me in my divorce proceedings. It was clear from the beginning that she assumed that my case was, "just like all the others" and from the get go she was more interested in listening to the opposing counsel than me. The next attorney I hired to replace her confirmed that I was being completely under-represented and the differences in how they conducted business were stark. My next attorney helped me navigate the most challenging thing I have ever dealt with and I walked out of court knowing that I had won. Rebecca promised me that I would walk out of court feeling as though I had lost. She was very difficult to work with and my next attorney made things easy. Rebecca misled me and actually misrepresented my position out of spite after I challenged her on her conduct. Hiring her set me back on time and money and could have cost me custody of my children, which proved easy for my next attorney simply because I am a great father and just needed someone to represent me honestly. Rebecca was the wrong choice.

I hired Mr. Skinner for the probate of my sister's estate. It was a very frustrating experience as I was told I had to spend a great deal of money on depositions and a handwriting expert only to never have the results entered into court because Mr.Skinner said I needed to settled, that was after he demanded another retainer or he would drop me as a client. I was left clueless and helpless because he said he got me to a settlement and would no longer need to represent me unless I now pay his new higher fee. There was still some unforseen situations that occured and I had no representation. For these reasons I would not recommend Mr. Skinner.

Not upfront about fees. Takes weeks to get back to you. Cost over $3000 to file chapter 13 ,twice. And now instead of instead of being honest about my ability to convert 13 -7 for a much lesser amount. I have been advised to withdraw my chapter 13 and refile 7, therefor paying her an additional $1500. I work in the Title Loan industry , what she does isn't any different.

BEWARE!!!! Amy Eddy is a high priced attorney, staff misspelled my name on initial filing of probate documents, Amy doesn't return my emails, phone calls, won't answer my questions but her staff keeps sending my brother invoices for high priced attorney fees. My brother's court documents expired and they have made no progress on closing my Dads estate but attorney Amy Eddy keeps sending my brother her high priced attorneys fees. I feel totally uncomfortable with Amy Eddy handling my Dad's estate. Went to court asked for her to be removed because she isn't helping my brother through the probate process just charging him fees. She won't remove herself because I think she just wants to collect her high priced fees and profit off my deceased Army Veteran father's estate. I will be filing a complaint against her law license with the WI State board of attorneys for attorney misconduct.

In the case of reading these reviews, it has been concluded that he has been just as rude as he was today since 2017. Peter has to be one of the most unprofessional lawyers out there, I called in regards to a case that was filed against me through small claims court, and he had stated that, somebody had tried to be in contact with me multiple times yet the notes that were provided did not correlate with my surroundings by any means, and when I explain that to him, he got defensive. When I started asking questions about everything, he had stated he is saying things, in as little of terms that my brain could possibly understand! 10/10 unprofessional.

He will take more money from you than he gives you ( he took an estimated $26,000 from me in a 9 month time frame!) He is not available in emergency situation or weekends but he will charge you like he is. Don't lock your keys in your car or break down on the side of the road if its the weekend! He will cut off everything he thinks you don't need! Such things as a simple local newspaper subscription and cable! He will also treat you like you are a child, he will talk down to you and humiliate you! He does not return phone calls making you call him numerous times and he will charge you for every phone conversation, every check written, every bill mailed (if he pays your bills that is) and contact with him what so ever he will charge you and he will charge a VERY large amount, a lawyers fee even though he is technically not your lawyer but your trustee! He will give you a very hard time when you need money out of your trust to purchase an item you NEED, like a bed!! He will lie to you, he will say he mailed you a check but he really did not, his Secretary has actually busted him out on that one! He will pay your bills late ruining your credit if he even chooses to pay them at all!!! He also does not follow the rules established for the trust!

I inherited money from my mother who had wanted it to follow the blood line. Wanted to follow her wishes and set something up for my son and grandchildren. Instead she spent a half hour berating me about "throwing my husband under the bus." This was not a huge amount of money and my husband is very well set. I was shocked! Left the office and wrote her a note saying I would no longer need her services. Cost me $700.

My experience with Mr. Nicastro was that his conduct was unethical. I cannot reveal the specifics of the unethical behavior because to do so would definitively reveal my identity. What I can say is that I placed my trust and confidence in Mr. Nicastro but found it deeply disturbing that he (1) conveyed inaccurate information and I believe he chose to do so because of a conflict of interest that he did not disclose to me but that I learned of at a later date, and (2) sought to exploit a vulnerable person for his own benefit. I am sure Mr. Nicastro is a skillful attorney, but my twofold experience with him destroyed my confidence in the legal profession. He might be the right choice if you simply want to win regardless of the tactics, but if you are seeking sound, ethical representation, my experience suggests you may want to look elsewhere.

I hired Steve to handle a probate case. Rarely if ever did i hear from Steve. All my questions were referred to his part time paralegals who would answer via email several days after the question was posed. The first paralegal quit early in the case. The second was a part time lady who was actually quite polite and nice but seemed to rarely work during normal business hours and rarely returned my calls. They continually lost important documents that i had to re submit dragging out the process and at the end of the case the bill was 50% higher than what i was originally quoted.

After confronting this attorney about a number of errors made by him and his incompetent staff I had to hire another attorney when Luaders withdrew admitting he couldn't communicate. Payments were lost by his staff, motions contained errors, he over litigated, was inattentive, and has halitosis breath. Once I received my file I discovered he was writing legal letters that contained the business of other clients in my letter and charged me for communication that included the legal matters of another client! After hiring a new lawyer we filed for a De Novo hearing because of Luader's poor representation. I think Earl plays games like a "good ole boy" and doesn't work for the best interest of the client. I told this guy straight out I refused to pay him a single cent after the mistakes that were made. 24 months of litigation and I am still trying to clean up the mess he made of things.

What a Probate Lawyer Can Do for You

A probate lawyer assists with the legal process of administering a deceased person’s estate. This often involves guiding executors (if a will exists) or beneficiaries (if no will exists) through the probate process to settle the estate according to the deceased’s wishes or applicable laws. Probate lawyers can help validate the will, distribute assets, resolve disputes among heirs, handle outstanding debts or taxes, and ensure the estate is legally and efficiently administered.

Whether you’re an executor of an estate or an heir facing probate proceedings, a probate lawyer can help you navigate the often-complex legal process to ensure the estate is settled correctly.

When Should I Hire a Probate Lawyer?

You should consider hiring a probate lawyer when you are responsible for managing the estate of a deceased individual, especially in the following situations:

  • The estate has substantial assets: If the estate includes significant assets like real estate, investments, or business interests, legal assistance is often necessary to handle the distribution properly.
  • The will is being contested: If there are disputes among heirs regarding the validity of the will or the division of assets, a probate lawyer can help resolve the conflict.
  • The estate includes complex or unclear provisions: If the will contains complicated instructions or there are no clear beneficiaries, a lawyer can ensure that the estate is administered according to legal requirements.
  • There is no will (intestate estate): When a person dies without a will, the estate is subject to intestacy laws, which determine how assets are distributed. A probate lawyer can help navigate this process.
  • Debt or tax issues exist: If the estate owes significant debts or is subject to estate taxes, a probate lawyer can help ensure debts are paid appropriately and taxes are minimized.
  • Probate disputes: If family members or other parties are disputing the distribution of assets or challenging the executor's actions, legal representation is crucial to defending your rights and ensuring the estate is handled properly.

Hiring a probate lawyer early in the process can help avoid costly mistakes and ensure the estate is settled efficiently.

What Does a Probate Lawyer Do?

A probate lawyer provides a wide range of legal services to help manage and settle an estate. Their tasks can include:

  • Validating the will: Filing the will with the probate court and ensuring its legal validity.
  • Guiding executors or administrators: Advising the person responsible for managing the estate on their duties, including inventorying assets, notifying creditors, and paying debts.
  • Filing necessary paperwork: Preparing and submitting the legal documents required to initiate and complete the probate process.
  • Resolving disputes: Mediating or litigating disputes among heirs or between beneficiaries and executors, including challenges to the will or disagreements over asset distribution.
  • Handling debt and tax matters: Ensuring that outstanding debts, taxes, and estate taxes are properly calculated and paid from the estate’s assets.
  • Distributing assets: Ensuring that assets are distributed to the beneficiaries according to the will or intestacy laws, and that all legal requirements are fulfilled.
  • Closing the estate: Completing the final steps of the probate process, including filing a final accounting with the court and formally closing the estate.

How Are Probate Lawyers Paid?

Probate lawyers typically charge for their services based on the complexity of the estate and the nature of the legal work involved. Common payment structures include:

  • Hourly rate: Most probate lawyers charge by the hour, with rates depending on the lawyer’s experience and the complexity of the estate. Hourly rates can range from $150 to $500 or more.
  • Flat fee: For simple estates or straightforward probate tasks, some lawyers may charge a flat fee that covers all of the necessary legal work.
  • Percentage of the estate: In some states, probate lawyers are allowed to charge a percentage of the estate's value as their fee. This percentage typically ranges from 2% to 5%, depending on the size of the estate and state regulations.
  • Retainer fee: Some lawyers may require an upfront retainer fee, which is billed against as the probate process progresses.

It’s important to clarify the fee structure during your initial consultation to understand how you will be charged and avoid unexpected costs.

How Much Does a Probate Lawyer Cost?

The cost of hiring a probate lawyer depends on several factors, including the complexity of the estate, the type of legal issues involved, and the lawyer’s fee structure. General cost estimates include:

  • Simple estates: For estates with straightforward assets and no disputes, probate legal fees can range from $2,500 to $10,000, depending on the lawyer's fees and the state's probate laws.
  • Complex estates: For larger or more complicated estates with multiple properties, business interests, or disputes, probate costs can exceed $10,000 and may reach $20,000 or more.
  • Hourly rates: If charged by the hour, expect rates between $150 and $500, depending on the lawyer’s expertise and geographic location.
  • Percentage fees: In some cases, a probate lawyer may charge 2% to 5% of the estate’s value, particularly for larger estates or those involving complex legal matters.

Always ask for a clear estimate of fees during your initial consultation to understand the total cost of probate representation.

Top Questions to Ask a Probate Lawyer

Before hiring a probate lawyer, it’s essential to ask the right questions to ensure you’re hiring someone qualified to handle your estate needs. Key questions include:

  1. What experience do you have with probate cases like mine?
Ensure the lawyer has experience with estates of similar complexity, especially if disputes or high-value assets are involved.
  2. How do you charge for your services?
Ask whether the lawyer charges an hourly rate, a flat fee, or a percentage of the estate, and request a cost estimate.
  3. What is the likely timeline for my probate case?
While it’s hard to predict exactly, an experienced lawyer can give you a general idea of how long the probate process may take based on the specifics of your estate.
  4. What steps will you take to manage and distribute the estate?
Ask about the lawyer’s approach to handling debts, taxes, and asset distribution.
  5. Will you be handling my case personally?
In larger firms, junior attorneys or paralegals may handle some aspects of your case, so it’s important to know who will be working on your probate case.
  6. What are potential challenges we may face?
A good lawyer will be able to anticipate possible issues, such as will contests or creditor claims, and explain how they would handle them.

How to Check the Credibility of a Probate Lawyer

To ensure you’re hiring a reputable probate lawyer, follow these steps to check their credentials and experience:

  • Verify their state bar status: Check with your state’s bar association to confirm the lawyer is licensed to practice and has no history of disciplinary action.
  • Look for probate experience: Review the lawyer’s website or professional profile to ensure they specialize in probate law and have experience handling estates of similar complexity.
  • Read client reviews and testimonials: Look for online reviews on platforms like Avvo or Martindale-Hubbell to see what past clients have said about the lawyer’s probate experience.
  • Ask for references: A credible lawyer should be able to provide references from past clients who can vouch for their professionalism and expertise in handling probate matters.
  • Look for membership in professional organizations: Membership in organizations like the American Academy of Estate Planning Attorneys (AAEPA) or the National Academy of Elder Law Attorneys (NAELA) can indicate a lawyer's commitment to estate and probate law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a probate lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • A copy of the will or trust (if applicable): Bring any estate planning documents left by the deceased, including wills, trusts, or powers of attorney.
  • List of assets and debts: Prepare a detailed list of the deceased’s assets (e.g., real estate, bank accounts, investments) and outstanding debts (e.g., loans, mortgages, credit cards).
  • Death certificate: Bring a certified copy of the deceased person’s death certificate.
  • Contact information for heirs and beneficiaries: Have a list of all individuals or entities named in the will or who are entitled to inherit under intestacy laws.
  • Questions about the probate process: Write down any questions you have about the process, costs, and potential issues you might face.
  • Relevant financial records: If available, bring any relevant financial documents, such as bank statements, property deeds, and tax returns.

By coming prepared, you can ensure a productive consultation and allow the lawyer to provide the best advice for your situation.
