A trusted friend referred me to Mr. Cochran to handle a contract matter that became complicated due to incorrect guidance from another legal resource. Mr. Cochran quickly synthesized the details, recommended a strategy and prepared a thorough response in a timely manner. His expertise in jurisdiction, venue and contract matters were superb. Throughout the time he assisted me he was responsive to communications, knowledgeable and respectful. He clearly had my best interests in mind. I highly recommend Mr. Cochran.

I've worked with several attorneys throughout the years. Shortly after hiring Mr. Rutila to handle a case related to a commercial lease dispute, I decided to consolidate all my legal matters under his care. The reason is simple. Mr. Rutila is the most thorough and conscientious attorney I've ever worked with. He is a dedicated professional who genuinely has his clients best interest in mind at all times. Always going the extra mile and displaying the patience and understanding for what my specific needs are, Mr. Rutila has been a pleasure to work with during some very challenging times. In short, he has made my life much easier knowing that the multitude of legal issues I'm facing are completely under control. I give my highest recommendation to Mr. Rutila and only wish more attorneys operated at his level - unless, of course, they are opposing counsel.

Our general contracting firm has been represented by Marc Erpenbeck a number of times over the past 7 years. He has always been very pragmatic and professional. He is very good at recognizing the legal issues and understanding our potential exposure and risks. When forced to use another attorney (at a different firm) because Marc had a conflict, Marc's value was reinforced. I knew the issue the opposing counsel was trying to make, and I consistently asked our attorney to defend that issue. Over the span of 2 months, I brought up the issue at least 6 times. He failed to heed my request. We lost that case and it cost our firm over $200,000. In the opinion, that issue was the very reason we lost the suit. We had a valid defense and should not have lost on that issue. Some time later, Marc asked for an update on that case. I briefly told him the scenario, and within 5 minutes he brought up the very issue. Summary: 2 months for the other guy, and $200,000 he didn't get it. 5 minutes for Marc and he was all over that issue. Trust me, Marc is good and is well worth the money. He is trustworthy and definitely has your best interests in mind.

Mr. Brechner accepted my case and handled it with unquestionable effectiveness. His partner Mr. Arboleda is also someone I would recommend and found them both to be exactly what a client could hope for from an attorney. Hiring Mr. Brechner led to an outcome that was greater than I had expected. Because of the complexity of the kind of cases Mr. Brechner handles I would advise anyone that it is money well spent when hiring him. If you are considering not hiring an attorney for a case such as Mr. Brechner handles, your decision could cost you a lot more. Be prepared to supply a lot of financial information. it will be a lot of work on your part to get this information, but don't avoid doing it. The process is very involved but you will come out so much better from his services.

Mr. Overton was professional, blunt, and honest in regards to the legal concerns I consulted him about. What I felt was most admirable was he was up front in telling me he was not the attorney for me because he did not have the expertise I was needing. He pointed me in the right direction and gave me his opinion as an attorney as to how he would proceed. His advise and guidance was pivotal in bringing forth a positive resolution to my legal needs.

Mr. Eagleburger was recommended by a mutual relationship of mine that understood I was under a strict deadline in a complex commercial litigation matter. Through the personal referral, Mr. Eagleburger worked around the clock to familiarize himself with my legal needs. I was not only handicapped in my timeline to meet various deadlines, but I was exhausted in resources and working remotely from Cleveland while the litigation was in Maricopa County. I would be doing Mr. Eagelburger a disservice if I did not take time out of my day to illustrate the amount of gratitude, and respect that I have for his passionate legal representation of my needs. Mr. Eagleburger worked through an entire weekend to meet my deadlines and has successfully taken steps for me that no previous counsel has been able to effectively accomplish. I highly recommend Mr. Eagelburger to anybody looking for counsel that will passionately fight for you and put his client first at all costs.

I called Mr. Shoaf for a consultation regarding a dispute with my neighbor. I assumed that I would be charged for the consultation, however, Mr. Shoaf refused. He candidly let me know that my case was simple and that I would likely succeed representing myself based on the information that I provided in our phone call. He also informed me that because my case was a small claims court issue, it was not practical nor necessary to hire an attorney. His communication was also sincere, which helped to put me at ease as this has become an extremely stressful dispute with my neighbor. Mr. Shoaf was even reassuring, neither rushing me nor making me feel insignificant compared to more prestigious clientele. I appreciated his time and sincere demeanor and offered to write this review as a token of my gratitude.

Mr. Bonner is just about the best attorney I've ever met in over 50 years of business. He recently won a case against an attorney who I was told may have been a former senior partner in the firm. He responds 24/7 from wherever he may be duirng his travels. His hourly fee is well worth the 'investment.' His firm is of extremely high respect in Arizona courts, so he enters a courtroom with a distinct advantage for etiical reputation. And, if you 'have no case' Mr. Bonner will tell you -- not begin invoicing for any 'lost cause.' I've never found reason to disagree with any of his recomendations.

Mr. Fong assisted me with a recent business separation. I was impressed with his ability to simplify a (for me) very complex situation and find a solution that would make me happy. Sarah is just amazing. Many times she has helped myself and my business with legal advice and council. One instance was dealing with a property management that was constantly acting illegally. It was so bad we almost had to take legal action. But Sarah’s expertise and fantastic knowledge made it so we didn’t have to. With her help and an amazing letter she drew up we ended up receiving compensation and having our property properly fixed up to code. I would highly recommend her for all legal services. Having someone so intelligent on your side is invaluable.

We hired Mike as part of a complicated construction litigation matter. We knew that getting him involved would be our best chance to get the case settled, because Mike is not only a great construction lawyer, but also a very reasonable and practical attorney. Many lawyers are happy to run up a big bill while they "process" a case and thereby milk their clients dry. Mike isn't like that. He will work hard to reach the most practical, cost efficient result possible -- hopefully with a speedy settlement, but with litigation if necessary. I could not recommend him more highly.

What a Real Estate Lawyer Can Do for You

A real estate lawyer provides legal assistance in transactions and disputes involving property, including residential and commercial real estate. Whether you're buying, selling, leasing, or developing property, a real estate attorney can help ensure that your transactions are legally sound and your rights are protected. They review contracts, perform due diligence, resolve disputes, and provide legal representation in negotiations and litigation involving property matters.

Real estate lawyers are crucial in safeguarding your investment by ensuring compliance with local, state, and federal real estate laws, as well as protecting you from potential legal pitfalls related to property ownership and transactions.

When Should I Hire a Real Estate Lawyer?

Hiring a real estate lawyer is beneficial in various scenarios, including:

  • Buying or selling property: When navigating complex real estate contracts, it’s advisable to have a lawyer review and ensure that the terms are favorable and legal.
  • Commercial property transactions: For leasing, purchasing, or selling commercial properties, a lawyer can help manage the intricate legal aspects of such transactions.
  • Zoning or land use issues: If you're planning to develop property or change its use, a real estate lawyer can guide you through zoning laws and land use regulations.
  • Resolving property disputes: For boundary disputes, title issues, or disagreements over property rights, a lawyer can help mediate or litigate the matter.
  • Foreclosures or evictions: If you're dealing with foreclosure or managing a tenant eviction, legal representation ensures that the process adheres to local laws and protects your interests.
  • Title and deed issues: Lawyers can help clear title disputes, ensure the legitimacy of property deeds, and handle transfers of ownership.

What Does a Real Estate Lawyer Do?

A real estate lawyer provides a range of services to help with property transactions and disputes, including:

  • Contract drafting and review: Ensuring that purchase agreements, leases, and other contracts are legally binding, fair, and protect your interests.
  • Title search and clearance: Conducting a thorough title search to ensure that the property has no legal claims or liens that could affect ownership.
  • Facilitate closing: Managing the closing process in real estate transactions, including reviewing final documents and ensuring that everything is in order before the transfer of ownership.
  • Resolve disputes: Handling legal disputes related to property ownership, boundaries, zoning, or tenants.
  • Assist in financing: Reviewing loan agreements and mortgage documents to ensure the terms are fair and legally sound.
  • Zoning and land use advice: Guiding clients through the complexities of zoning laws and building regulations for property development or renovation projects.

How Are Real Estate Lawyers Paid?

Real estate lawyers typically charge for their services in the following ways:

  • Flat fee: Many real estate transactions, such as reviewing a sales contract or assisting with a closing, are charged on a flat-fee basis.
  • Hourly rates: If a lawyer is handling complex disputes or litigation, they may charge by the hour. Hourly rates can vary significantly based on the lawyer’s experience and location.
  • Contingency fees: In rare cases, such as property disputes or claims for damages, a lawyer may work on a contingency fee basis, meaning they only get paid if you win or settle the case.
  • Retainer: For ongoing legal support, some clients may pay a retainer, which is an upfront fee used as a deposit for future legal services.

It's important to clarify the fee structure with your attorney before hiring them to avoid any surprises.

How Much Does a Real Estate Lawyer Cost?

The cost of a real estate lawyer varies based on the complexity of the matter, the location of the property, and the lawyer’s experience. Key factors that affect pricing include:

  • Type of transaction or issue: Simple tasks, like contract reviews, typically cost less than handling a complex property dispute or litigation.
  • Experience and location: More experienced lawyers or those in high-demand areas, like urban centers, often charge higher rates.
  • Billing structure: Lawyers may charge a flat fee for basic services like document review or hourly for more time-intensive work such as disputes or litigation.

Flat fees for straightforward services like closing assistance may range from $500 to $1,500.

Hourly rates can range from $150 to $400 or more, depending on the attorney’s experience and location.

Always discuss fees upfront to understand the overall cost of the legal service you're receiving.

Top Questions to Ask a Real Estate Lawyer

Before hiring a real estate lawyer, ask the following questions to ensure they are the right fit for your legal needs:

  1. What experience do you have with real estate law?
Ensure the lawyer has experience in the type of real estate transaction or dispute you’re facing, whether residential, commercial, or development-related.
  2. What is your fee structure?
Ask how the lawyer charges for services - whether it's a flat fee, hourly rate, or retainer - so there are no surprises later on.
  3. How long will the process take?
Especially important for real estate transactions or disputes with deadlines, ask for a general estimate of how long the process will last.
  4. Have you handled cases similar to mine?
Experience with similar transactions or disputes can give you confidence that the lawyer knows how to handle your case.
  5. Will you handle my case personally, or will it be passed to another attorney?
Confirm who will be handling the bulk of your case work, especially in larger firms where junior lawyers may take on some responsibilities.
  6. Can you provide references?
Speaking with past clients can give you insight into the lawyer's experience and how they handle cases.

How to Check the Credibility of a Real Estate Lawyer

To ensure you’re hiring a reputable real estate lawyer, take these steps:

  • Check with the state bar association: Verify that the lawyer is licensed and in good standing with no disciplinary actions on their record.
  • Read online reviews and testimonials: Look for reviews on legal directories and platforms like Avvo or Martindale-Hubbell to see what past clients have said.
  • Ask for references: A credible lawyer should have past clients willing to share their experiences.
  • Review their track record and expertise: Look at the lawyer’s website or LinkedIn profile for information about their experience in real estate law and any relevant cases they’ve handled.
  • Membership in professional organizations: Lawyers who are members of respected legal or real estate organizations, like the American Bar Association’s Real Property Division, often signal credibility and expertise.

What Should I Prepare for My First Consultation?

To make your first meeting with a real estate lawyer productive, you should prepare the following materials:

  • Relevant property documents: Bring purchase agreements, lease contracts, mortgage documents, zoning permits, or any other paperwork related to your case.
  • A summary of the issue or transaction: Be ready to explain the situation, whether it's a property dispute, contract negotiation, or development issue.
  • Questions about the legal process: Prepare a list of questions about how the lawyer will handle your case and what steps are involved.
  • Financial documents or loan agreements: If the case involves financing or a mortgage, bring any related documents for the lawyer to review.
  • Your goals and timeline: Be clear about what outcome you're hoping for, and if there are any deadlines that need to be considered, such as closing dates or legal filings.

By coming prepared, you can ensure that your consultation is efficient and informative, allowing you to assess whether the lawyer is the right fit for your real estate needs.
