Mr. Adducci made my family feel very relaxed and comfortable in his large, bright office. He was very attentive in receiving information on our background and personal intentions. After learning of our wishes, he proceeded to advise us on the pros and cons of various decisions. His suggestions were sound and logical which appealed to each of us. I would highly recommend Mr. Adducci to anyone who is looking for a knowledgeable, ethical, and trustworthly lawyer.

We hired Louis to represent us on the recommendation of our day to day attorney. We had been sued over a real estate transaction that occurred over 15 years ago. Although the title company was representing us, we were not comfortable with their sense of urgency in the case and we did not want it to drag on for years. Lou came up with a strategy that ensured our case was heard in housing court in a very timely manner. We won the case. With his expedient handling of the issue, we saved thousands of dollars in legal fees. I HIGHLY recommend him without hesitation. Lou Bernstein achieves excellent results in a no-nonsense, professional manner.

As my attorney in a copyright infringement case for over one year, I found Vivek to live up to his billing as one of the rising stars in this area of law in the Chicago area. I found him to be 100% honest extremely intelligent, and also someone who is willing to work tirelessly on behalf of his clients. In a world where lawyers often are viewed in so negatively, I found Vivek to be a breath of fresh air. In my opinion , he stands out as not only a brilliant attorney but one of impeccable integrity. I would reccommend him to anyone.

This attorney gave exceptional representation and their efforts will forever be appreciated!!!!! An attorney that goes above and beyond, advocating with a dedication and knowledge of the law that gave us peace of mind. What impressed me most was their willingness to take on the tougher side of the case, demonstrating their commitment to justice and fairness. Throughout the process, Mark was upfront, honest and transparent, keeping us informed every step of the way. Their responsiveness was remarkable, always available to answer questions and address concerns. When I was sick with worry, a call and response from them made the difference between enjoying my daily life and vacationing time!! Their expertise, made a daunting experience manageable. I felt seen, heard, and supported throughout the entire process. Don’t mistake the tone of voice for impolite behavior. Marks speaks honestly, and gives strategies, with true consideration to time, cost and outcome. I highly recommend Mark to anyone seeking exceptional legal representation.

I’ve had the pleasure of working with John to create my will, living trust, and complete the purchase of my first property in Chicago. Impressed does not even begin to explain my sentiments about my interactions with John. Pros: - He is incredibly amenable and available to his clients. I don’t think I ever went more than 10 minutes without him returning a phone call or email. - He breaks things down so they’re easily digestible for those who have never worked with an Attorney or required the services John provides - He consistently goes above and beyond by providing additional support or insight to assist in decision making - He generally cares about the needs of his clients Cons: - We can’t clone him to make more Johns! It can be an incredibly daunting and overwhelming experience to go through any of the life changes that might require John’s support. However, I can assure you that there aren’t greater hands you could be in.

John is great. We've worked with him on our living will, trust and most recently on our sale of the condo. It was a somewhat tricky transaction due to the buyer's side but he got it done. He is extremely detail oriented, patient and very responsive. He returned our calls on Sundays, New Year's Day and even on his birthday over a weekend. We highly recommend John.

Mr. Khwaja is an extremely dedicated and focused defense attorney. He will thoroughly review all issues that pertain to your case and pursue those that will bring a most positive outcome. His arguments are direct and are reinforced by his knowledge of the current laws. He will apply those laws fiercely and will not back down (as I have witnessed with my previous attorney). He will not hesitate to protect your interests in and out of the courtroom. So far, he has won two cases for me. The first was for a violation of a Federal Housing regulation and the case was dismissed. The most recent case triumph was won (with prejudice) for violation of the Single Refilling Rule. This was the Plaintiff’s third attempt at foreclosure. No doubt they will make further attempts. I have complete confidence and trust in Mr. Khwaja’s abilities to tackle those challenges with ease. He is the best choice anyone can make when choosing an attorney.

Dan is an excellent attorney. I’m going on 5 years of a high conflict divorce, going to court ever month. Sometimes twice a month. I’ve seen my share of good and bad attorneys. My case was extraordinarily difficult and terribly damaging to my family, my business associates and myself. My ex wife who is mentally ill forced the property that was purchased as a college fund for my children into foreclosure as a form retaliation for my children telling the judge of the abuse sustained at the hands of her and my ex mother in law. Knowing my ex wife’s thought pattern I knew she’d seek revenge against our children for telling on her and she’d stop payment on their two flat. Since early on in the divorce my ex had a court order removing me as an authorized person on the account for that property. I was left with no way to communicate with the mortgage company to rectify any situations on my own. Foreseeing the situation, I sought a referral from one of my old real estate lawyers for someone to step into the case to protect the properties. On their recommendation a seperate attorney was hired during the divorce solely to protect my interests in the real estate. She did what I knew she would. The attorney was hired 2 months before a payment was even missed on this particular piece of property. His outright refusal to do anything for the $7,500 he collected landed this property not only in foreclosure but let it go to the point that a judgement for sale was entered. Never notifying me of the situation and giving me the brush off the entire time I asked for an update. Completely keeping me in the dark. And when I confronted him about it after it went to judgment for sale; two years later, he excused me of being negligent, even tried to strong arm me. He said there is nothing he could do. He told me to give him another $5,000 and he could keep it going another six months but I was going to lose the property no matter what. Then he started telling me how I really don’t want the property anyway. I told him I had given him $7,500 to protect the property and he literally did nothing. He told me if I wanted a bill, he’d give me one but then I’d have to pay him even more. The entire situation was horrible. He took advantage of my good nature and the terrible position I was in and pretty much extorted me. Then he left me hanging I’m a worse situation than if I never hired him at all, only With $7,500 less. That night with tears in my eyes I told my kids I didn’t think I’d be able to save theIr building. The next day feeling hopeless, I reached out to a friend and was given a referral from their attorney for an attorney who specializes in foreclosure litigation. After talking to her I was then again disappointed that she was too busy to take my case. In reality I think she just didn’t want it. Because my case is so complicated. She told me to call Dan Khwaja. She said “you’ll like this guy”. I called him right away. it was definitely the right move. Dan gave me more information on my first phone call with him than I got in two years with the other thieving attorney. He met with me that same day. We discussed my case and I paid him a retainer. He started working on my case immediately. I was surprised when he texted me on a Friday night and then found out he worked all weekend on my case. As I said I’ve been going to court every month for years and I know a good attorney from a bad one. Dan is not good - he’s excellent. The amount of professionalism and attention to detail is second to none. He takes what he does very seriously and has a soul that is uncommon in most attorneys. He managed to overturn the judgement and get me another chance to save my children’s building. We are not out of the woods yet and mine is a very uncommon case. But with that said I have complete confidence in Dan Khwaja. As a matter of fact, I’m betting my children’s future on him. If you’re in a bad place, don’t know where to turn, call him right now. Time you have is limited. Don’t waste it with anyone else!!!

From Lynn, Chicagoland Most of us would prefer to go an entire lifetime without having to retain a lawyer. In fact, I think it’s fair to say that retaining a lawyer is right up there with having a coloscopy. But if you find yourself in such need, I can think of no better firm than Miner, Barnhill & Galland. I found myself seriously wronged by my employer. Employers, even ones that have integrity, are at a loss for how to evaluate complaints. If weak, short-sighted or unprincipled, they panic and throw employees under the bus. Of course, an employer should have its employees’ backs—that builds fierce loyalty and brings the best out of those who work for the employer. but we know it does not always work that way. Some employers care more about their own wallets and reputations. They will protect themselves at all costs, notwithstanding duties of procedural fairness or obligations under the law of due process. Myopically, they will protect themselves even at the risk of alienating top-performing employees or showing themselves to be morally bankrupt. And that’s when you need this firm. As a lawyer friend advised me when my employer panicked and threw me under the bus: "What u need is a big Chicago lawyer writing on Chicago law firm letterhead, to scare them into acting correctly. It will scare the pants off them. Ideally, you want to retain a named partner.” Getting that without a paying over a $1000 a hour is tough. At so-called Big Law firms, associates with five years’ experience charge as much as my lawyer, who just finished his fifth decade in practice. At Big Law firms, partners prepare the monthly bill to the client and send things on to the client, but far less experienced associates do the actual work. What I wanted in someone representing me was seasoning and perspective. I needed a big stick that would be far less expensive to deploy. I wanted to talk to an attorney with five decades of experience—and I did. George Galland picked up my calls, without fail. He took emails on the weekend, did conference calls at crazy hours. To some people, the word attorney carries a negative connotation but consider the synonym, advocate. My attorney, George Galland, gets in there and advocates for every inch of advantage. In hundreds of pages of documents and emails, he showed my employer each and every way it had violated its own policies, as well as state and federal law. He showed how those appointed internally to review the matter violated basic tenets of due process. Although George only schooled my employer in Due Process 101, he politely engaged my employer’s counsel, which may be the best way to persuade them that they have a problem. He spoke to internal forces that could help to rectify mistakes made by those at the very top. He applied regular pressure in conversations with their lawyer, pointing out that “bad facts make bad law.” There is a second synonym for lawyer, an older understanding, of the counselor. This aspect can be hard to take, but one’s own attorney often has to pull us back, like a good friend does when it appears a bar fight is brewing (say, for example, when one’s opponent in pool is losing and not taking it well). Good counsel will say, “best to head for the exit.” I wanted to take my story public, to get a big newspaper to cover it. That would right the wrong, I thought. Far better, George said, to have my employer pay the full freight and then some. Far better to have them write a check that shows up internally and memorializes the wrong. (True to form, when I shared this review, he edited out the juicier parts.) It is not so often when we are wronged in life that the other guy has to pay for their mistakes. You don't take a knife to a gunfight. You need counsel that is up to the toughest challenges, and there is none better than George Galland.

Robert handled the closing of our home for us. It went smoothly from start to finish and we did not even have to be there for the closing as we were moving out of state. I highly recommend Rauschert and Rauschert!!

What a Real Estate Lawyer Can Do for You

A real estate lawyer provides legal assistance in transactions and disputes involving property, including residential and commercial real estate. Whether you're buying, selling, leasing, or developing property, a real estate attorney can help ensure that your transactions are legally sound and your rights are protected. They review contracts, perform due diligence, resolve disputes, and provide legal representation in negotiations and litigation involving property matters.

Real estate lawyers are crucial in safeguarding your investment by ensuring compliance with local, state, and federal real estate laws, as well as protecting you from potential legal pitfalls related to property ownership and transactions.

When Should I Hire a Real Estate Lawyer?

Hiring a real estate lawyer is beneficial in various scenarios, including:

  • Buying or selling property: When navigating complex real estate contracts, it’s advisable to have a lawyer review and ensure that the terms are favorable and legal.
  • Commercial property transactions: For leasing, purchasing, or selling commercial properties, a lawyer can help manage the intricate legal aspects of such transactions.
  • Zoning or land use issues: If you're planning to develop property or change its use, a real estate lawyer can guide you through zoning laws and land use regulations.
  • Resolving property disputes: For boundary disputes, title issues, or disagreements over property rights, a lawyer can help mediate or litigate the matter.
  • Foreclosures or evictions: If you're dealing with foreclosure or managing a tenant eviction, legal representation ensures that the process adheres to local laws and protects your interests.
  • Title and deed issues: Lawyers can help clear title disputes, ensure the legitimacy of property deeds, and handle transfers of ownership.

What Does a Real Estate Lawyer Do?

A real estate lawyer provides a range of services to help with property transactions and disputes, including:

  • Contract drafting and review: Ensuring that purchase agreements, leases, and other contracts are legally binding, fair, and protect your interests.
  • Title search and clearance: Conducting a thorough title search to ensure that the property has no legal claims or liens that could affect ownership.
  • Facilitate closing: Managing the closing process in real estate transactions, including reviewing final documents and ensuring that everything is in order before the transfer of ownership.
  • Resolve disputes: Handling legal disputes related to property ownership, boundaries, zoning, or tenants.
  • Assist in financing: Reviewing loan agreements and mortgage documents to ensure the terms are fair and legally sound.
  • Zoning and land use advice: Guiding clients through the complexities of zoning laws and building regulations for property development or renovation projects.

How Are Real Estate Lawyers Paid?

Real estate lawyers typically charge for their services in the following ways:

  • Flat fee: Many real estate transactions, such as reviewing a sales contract or assisting with a closing, are charged on a flat-fee basis.
  • Hourly rates: If a lawyer is handling complex disputes or litigation, they may charge by the hour. Hourly rates can vary significantly based on the lawyer’s experience and location.
  • Contingency fees: In rare cases, such as property disputes or claims for damages, a lawyer may work on a contingency fee basis, meaning they only get paid if you win or settle the case.
  • Retainer: For ongoing legal support, some clients may pay a retainer, which is an upfront fee used as a deposit for future legal services.

It's important to clarify the fee structure with your attorney before hiring them to avoid any surprises.

How Much Does a Real Estate Lawyer Cost?

The cost of a real estate lawyer varies based on the complexity of the matter, the location of the property, and the lawyer’s experience. Key factors that affect pricing include:

  • Type of transaction or issue: Simple tasks, like contract reviews, typically cost less than handling a complex property dispute or litigation.
  • Experience and location: More experienced lawyers or those in high-demand areas, like urban centers, often charge higher rates.
  • Billing structure: Lawyers may charge a flat fee for basic services like document review or hourly for more time-intensive work such as disputes or litigation.

Flat fees for straightforward services like closing assistance may range from $500 to $1,500.

Hourly rates can range from $150 to $400 or more, depending on the attorney’s experience and location.

Always discuss fees upfront to understand the overall cost of the legal service you're receiving.

Top Questions to Ask a Real Estate Lawyer

Before hiring a real estate lawyer, ask the following questions to ensure they are the right fit for your legal needs:

  1. What experience do you have with real estate law?
Ensure the lawyer has experience in the type of real estate transaction or dispute you’re facing, whether residential, commercial, or development-related.
  2. What is your fee structure?
Ask how the lawyer charges for services - whether it's a flat fee, hourly rate, or retainer - so there are no surprises later on.
  3. How long will the process take?
Especially important for real estate transactions or disputes with deadlines, ask for a general estimate of how long the process will last.
  4. Have you handled cases similar to mine?
Experience with similar transactions or disputes can give you confidence that the lawyer knows how to handle your case.
  5. Will you handle my case personally, or will it be passed to another attorney?
Confirm who will be handling the bulk of your case work, especially in larger firms where junior lawyers may take on some responsibilities.
  6. Can you provide references?
Speaking with past clients can give you insight into the lawyer's experience and how they handle cases.

How to Check the Credibility of a Real Estate Lawyer

To ensure you’re hiring a reputable real estate lawyer, take these steps:

  • Check with the state bar association: Verify that the lawyer is licensed and in good standing with no disciplinary actions on their record.
  • Read online reviews and testimonials: Look for reviews on legal directories and platforms like Avvo or Martindale-Hubbell to see what past clients have said.
  • Ask for references: A credible lawyer should have past clients willing to share their experiences.
  • Review their track record and expertise: Look at the lawyer’s website or LinkedIn profile for information about their experience in real estate law and any relevant cases they’ve handled.
  • Membership in professional organizations: Lawyers who are members of respected legal or real estate organizations, like the American Bar Association’s Real Property Division, often signal credibility and expertise.

What Should I Prepare for My First Consultation?

To make your first meeting with a real estate lawyer productive, you should prepare the following materials:

  • Relevant property documents: Bring purchase agreements, lease contracts, mortgage documents, zoning permits, or any other paperwork related to your case.
  • A summary of the issue or transaction: Be ready to explain the situation, whether it's a property dispute, contract negotiation, or development issue.
  • Questions about the legal process: Prepare a list of questions about how the lawyer will handle your case and what steps are involved.
  • Financial documents or loan agreements: If the case involves financing or a mortgage, bring any related documents for the lawyer to review.
  • Your goals and timeline: Be clear about what outcome you're hoping for, and if there are any deadlines that need to be considered, such as closing dates or legal filings.

By coming prepared, you can ensure that your consultation is efficient and informative, allowing you to assess whether the lawyer is the right fit for your real estate needs.
