Graham has been an invaluable resource not only for my business, but also for my sanity. He's professional, concise, and incredibly sharp. Graham represented me for my home purchase and has also advised me on landlord/tenant law. As a first time homeowner and landlord, it's been a really challenging and oftentimes stressful experience, but Graham's legal counsel and guidance has been invaluable and has been crucial in my decision making for my business.

This is a very respected medical malpractice defense attorney. I am a surgeon, and Tim helped when I was involved in a case three years ago. We thought it would settle, but I was found not guilty. He is extremely hardworking and realistic about the trial.

High praise for attorneys is rare- but John Kobus Jr. stands apart from the Chicago Legal community in many meaningful ways. I have had the pleasure of working with John for the past two years, and during that time he has taken whatever real estate challenges are thrown at him, and handles the matters efficiently, effectively and promptly. This wouldn’t be a true review unless I mentioned his one of a kind sense of humor, and his ability to make me laugh and make light of even of the toughest of situations. John’s strong work ethic, knowledge of real estate law, and personality make it an easy decision to come back to Burke, Warren, MacKay & Serritella, P.C. for our leasing real estate legal needs.

Ben Schneider was a very calm and trustworthy person. He heard our situation and put up with our insecurity. We never wanted to file for bankruptcy but we had no other choice. Yet, we try to delay our desition in the hope that we could balance our financial situation. When we realize that we couldn't balance it, we spoke to Ben again, and he reasured us and guided us through the process. Then without realizing it was all over. Later there were other questions that he resolved quickly. We didn't even realized what and/or how everything happened. Up to now I still can't believe that is over. We are not sure what and how it happen but everytime we have a question or dubt We feel confortable calling him and asking him what to do. We have regained a peace of mind and we owe it to Ben Scneider.

Scott Clair is a excellent attorney and a great person who cares about his clients: the kind of tireless advocate with ninja legal skills that seem to flow effortlessly at the right moment when needed. Scott is honest and refreshingly uncluttered by personality. I appreciated that he always kept me informed and up-to-date on my case. It is very clear that Scott understands that legal matters requiring lawyers to assist can be stressful and humiliating; his take on matters helped to create much needed clarity. I'm very pleased with the results which were delivered every step of the way with professionalism, respect, and kindness.

Joshua Karsh is a brilliant, highly skilled and experienced litigator. Joshua's work ethic embodies professional civility, strong communication skills and class. He is a hardworking, focused attorney that was always available to advise me of the issues relating to my case. I was proud of the painstaking work he did on my behalf. He represented me victoriously during all stages of the litigation - during the adminstrative hearing, on appeal to the circuit court, appellate court and evidently the state supreme court. His many briefs and oral arguments demonstrated his excellent legal ability and grit under fire. More importantly, he was an absolute pleasure to have as my attorney. Outstanding advocate!!!!

I contacted Laura J Hoover after being forced into an emergency move from what had seemed like a dream apartment. I had moved into a beautiful gut rehab in Chicago's up and coming West Wicker Park neighborhood and it seemed like my dream apartment. During my eight months there, however, the place turned into a nightmare. Just a couple of months after moving in, the place flooded with backed up sewer water during a really bad storm. The landlord brought over a carpet cleaner right away and ripped up the carpet. He promised to come back to replace the carpet padding and fix the very damaged walls, but never did. A few months later, the water heater in the apartment broke and damaged more walls. Again the landlord promised to come back at a later date to fix the damage and never did. As the winter approached the apartment started to get colder and colder, even though I kept turning up the thermostat. At one point it was so cold in my bedroom that I could see my breath! To top it off, my 2yr old daughter kept getting sick! I called the landlord and wrote him letters, but he refused to do anything stating that all I needed to do was turn the furnace up. I called the city inspector and it was found that the average temp of my apartment was way below the legal limit even though the thermostat was set to 85! After I moved out, the landlord refused to give me back my security deposit instead claiming that I owed rent for not finishing the lease. That's when I contacted Laura J Hoover. She was really great about explaining my rights to me and agreed to take my case. I was worried that it would be too time consuming to file a suit along with working and raising my daughter. I wondered if getting my security deposit back would even be worth it. But after I gave her my documentation, Laura took care of the rest. I barely lifted a finger. She even managed to track down the landlord after the address I gave her turned out to be false. It did take a little while to get things rolling, mostly because it was so hard to serve the landlord, but I never had to appear in court or even speak to that landlord again. Laura was really great about keeping me updated throughout the whole thing. Best of all, she got me my security deposit back along with her court fees, so I didn't actually end up paying anything! I am very happy with the way things turned out. I hope I never have to go through such an awful experience again, but if I have any problems in the future, I won't hesitate to call her!

Marion was my real estate lawyer when I bought my first condo. I was nervous as it was my first property purchase and Marion explained everything to me and made sure I closed when I needed too. Years later, I've hired Marion again to handle the closing of my condo. She is extremely knowledgeable and responsive. The whole process of selling real estate and moving across the county can be daunting. However, I know I am always in good hands with Marion because she is always keeping me informed and I am at ease because I fully trust her.

This is the most remarkable law office- and I have such a high opinion of Attorney Michael Zink. First and foremost, I am in shock at how honest and kind he is. I own a condo in Chicago, but live in NYC. You would never find an attorney in NYC who is anything like Michael Zink (except for my good friend who is a diamond in the rough in terms of NYC attorneys- message me if you need a NYC attorney). In NYC I would be taking out a small loan to pay for the services he has provided. And instead- I am BEGGING him to take my money because I think he is doing too much work without being compensated. The amount of integrity he has is so inspirational. I have have recently had a multitude of problems with the Chicago condo, and he has been an absolute rock in terms of the support he has provided. I swear this attorney is half lawyer and half psychologist- its impressive that he is so patient with my constant anxiety. But probably the most important is the fact that he is extremely knowledgable and bright. I think he will always be able to steer you in the right direction. I can't imagine ever using a different law firm for my Chicago legal needs.

Sherri represented me during the purchase of my South Loop condo. Her keen attention to detail was invaluable. While at the closing table she identified yet another mistake in the documents prepared by the sellers attorney. Having had legal representation a number of times I would be remiss to not also mention that her availability is an anomaly, in that she is always available or responds to let you know when she will be. If you are in need of a savvy negotiator who will advocate relentlessly for you I highly recommend Sherri.

Schuyler Geller is the lawyer you want in the area when facing the most difficult times in your life. He will tell you as it is, and believe me at the end of the journey you will be thankful for not just a fighter but a friend who is on your side. He will work countless hours meet strict deadlines, have all procedures memorized on the top of his head while the opposing firm is scrambling for answers. You can have a room full of lawyers ready to get your hands on you, but with Schuyler siting to the left or right of you... trust me you will be fearless and most importantly you will win. Life is grand when you have the biggest shark in the tank.

My daughter was charged with felony filing a false police report and Insurance fraud. She was in nursing school at the time, but unfortunately she lied t protect someone close to her. Her case was related to a murder investigation, so my daughter was very afraid of the consequences to her record and her life. Attorney Walker set out to get her case amended to a misdemeanor so that she could still practice as a nurse. At first, it seemed an impossible feat, but surprisingly enough Attorney Walker turned a no from the States Attorney into a yes! Me and my daughter were so happy that we hired an attorney who was talented, persistent, aggressive and most important to me cared enough about my daughter to be persistent! My daughter has now finished school and as she prepares for her boards, I am so happy that Attorney Walker was able to avoid a felony conviction for her and that she is now able to be in the profession that she chose and went to school for!

He educated me along the way and I feel confident that my decisions were well-informed. The outcome was not the one I expected, but it was a positive one and in the end, both parties were happy with the result.

We hired Louis to represent us on the recommendation of our day to day attorney. We had been sued over a real estate transaction that occurred over 15 years ago. Although the title company was representing us, we were not comfortable with their sense of urgency in the case and we did not want it to drag on for years. Lou came up with a strategy that ensured our case was heard in housing court in a very timely manner. We won the case. With his expedient handling of the issue, we saved thousands of dollars in legal fees. I HIGHLY recommend him without hesitation. Lou Bernstein achieves excellent results in a no-nonsense, professional manner.

Dartesia exhibited great professionalism in handling my real estate transaction. She stayed in constant communication throughout the process, returned calls in a timely manner, explained and researched pertinent information for me, and was extremely thorough in explaining my real estate paperwork as I signed it. This was not my first real estate transaction, but I would definitely recommend her to a first time buyer because she will help you feel comfortable about what you are signing. Great work!

What a Real Estate Lawyer Can Do for You

A real estate lawyer provides legal assistance in transactions and disputes involving property, including residential and commercial real estate. Whether you're buying, selling, leasing, or developing property, a real estate attorney can help ensure that your transactions are legally sound and your rights are protected. They review contracts, perform due diligence, resolve disputes, and provide legal representation in negotiations and litigation involving property matters.

Real estate lawyers are crucial in safeguarding your investment by ensuring compliance with local, state, and federal real estate laws, as well as protecting you from potential legal pitfalls related to property ownership and transactions.

When Should I Hire a Real Estate Lawyer?

Hiring a real estate lawyer is beneficial in various scenarios, including:

  • Buying or selling property: When navigating complex real estate contracts, it’s advisable to have a lawyer review and ensure that the terms are favorable and legal.
  • Commercial property transactions: For leasing, purchasing, or selling commercial properties, a lawyer can help manage the intricate legal aspects of such transactions.
  • Zoning or land use issues: If you're planning to develop property or change its use, a real estate lawyer can guide you through zoning laws and land use regulations.
  • Resolving property disputes: For boundary disputes, title issues, or disagreements over property rights, a lawyer can help mediate or litigate the matter.
  • Foreclosures or evictions: If you're dealing with foreclosure or managing a tenant eviction, legal representation ensures that the process adheres to local laws and protects your interests.
  • Title and deed issues: Lawyers can help clear title disputes, ensure the legitimacy of property deeds, and handle transfers of ownership.

What Does a Real Estate Lawyer Do?

A real estate lawyer provides a range of services to help with property transactions and disputes, including:

  • Contract drafting and review: Ensuring that purchase agreements, leases, and other contracts are legally binding, fair, and protect your interests.
  • Title search and clearance: Conducting a thorough title search to ensure that the property has no legal claims or liens that could affect ownership.
  • Facilitate closing: Managing the closing process in real estate transactions, including reviewing final documents and ensuring that everything is in order before the transfer of ownership.
  • Resolve disputes: Handling legal disputes related to property ownership, boundaries, zoning, or tenants.
  • Assist in financing: Reviewing loan agreements and mortgage documents to ensure the terms are fair and legally sound.
  • Zoning and land use advice: Guiding clients through the complexities of zoning laws and building regulations for property development or renovation projects.

How Are Real Estate Lawyers Paid?

Real estate lawyers typically charge for their services in the following ways:

  • Flat fee: Many real estate transactions, such as reviewing a sales contract or assisting with a closing, are charged on a flat-fee basis.
  • Hourly rates: If a lawyer is handling complex disputes or litigation, they may charge by the hour. Hourly rates can vary significantly based on the lawyer’s experience and location.
  • Contingency fees: In rare cases, such as property disputes or claims for damages, a lawyer may work on a contingency fee basis, meaning they only get paid if you win or settle the case.
  • Retainer: For ongoing legal support, some clients may pay a retainer, which is an upfront fee used as a deposit for future legal services.

It's important to clarify the fee structure with your attorney before hiring them to avoid any surprises.

How Much Does a Real Estate Lawyer Cost?

The cost of a real estate lawyer varies based on the complexity of the matter, the location of the property, and the lawyer’s experience. Key factors that affect pricing include:

  • Type of transaction or issue: Simple tasks, like contract reviews, typically cost less than handling a complex property dispute or litigation.
  • Experience and location: More experienced lawyers or those in high-demand areas, like urban centers, often charge higher rates.
  • Billing structure: Lawyers may charge a flat fee for basic services like document review or hourly for more time-intensive work such as disputes or litigation.

Flat fees for straightforward services like closing assistance may range from $500 to $1,500.

Hourly rates can range from $150 to $400 or more, depending on the attorney’s experience and location.

Always discuss fees upfront to understand the overall cost of the legal service you're receiving.

Top Questions to Ask a Real Estate Lawyer

Before hiring a real estate lawyer, ask the following questions to ensure they are the right fit for your legal needs:

  1. What experience do you have with real estate law?
Ensure the lawyer has experience in the type of real estate transaction or dispute you’re facing, whether residential, commercial, or development-related.
  2. What is your fee structure?
Ask how the lawyer charges for services - whether it's a flat fee, hourly rate, or retainer - so there are no surprises later on.
  3. How long will the process take?
Especially important for real estate transactions or disputes with deadlines, ask for a general estimate of how long the process will last.
  4. Have you handled cases similar to mine?
Experience with similar transactions or disputes can give you confidence that the lawyer knows how to handle your case.
  5. Will you handle my case personally, or will it be passed to another attorney?
Confirm who will be handling the bulk of your case work, especially in larger firms where junior lawyers may take on some responsibilities.
  6. Can you provide references?
Speaking with past clients can give you insight into the lawyer's experience and how they handle cases.

How to Check the Credibility of a Real Estate Lawyer

To ensure you’re hiring a reputable real estate lawyer, take these steps:

  • Check with the state bar association: Verify that the lawyer is licensed and in good standing with no disciplinary actions on their record.
  • Read online reviews and testimonials: Look for reviews on legal directories and platforms like Avvo or Martindale-Hubbell to see what past clients have said.
  • Ask for references: A credible lawyer should have past clients willing to share their experiences.
  • Review their track record and expertise: Look at the lawyer’s website or LinkedIn profile for information about their experience in real estate law and any relevant cases they’ve handled.
  • Membership in professional organizations: Lawyers who are members of respected legal or real estate organizations, like the American Bar Association’s Real Property Division, often signal credibility and expertise.

What Should I Prepare for My First Consultation?

To make your first meeting with a real estate lawyer productive, you should prepare the following materials:

  • Relevant property documents: Bring purchase agreements, lease contracts, mortgage documents, zoning permits, or any other paperwork related to your case.
  • A summary of the issue or transaction: Be ready to explain the situation, whether it's a property dispute, contract negotiation, or development issue.
  • Questions about the legal process: Prepare a list of questions about how the lawyer will handle your case and what steps are involved.
  • Financial documents or loan agreements: If the case involves financing or a mortgage, bring any related documents for the lawyer to review.
  • Your goals and timeline: Be clear about what outcome you're hoping for, and if there are any deadlines that need to be considered, such as closing dates or legal filings.

By coming prepared, you can ensure that your consultation is efficient and informative, allowing you to assess whether the lawyer is the right fit for your real estate needs.
