After working with Jeff on a personal dispute we solicited his guidance on three very important business consulting contracts. He reviewed the contracts presented and made suggestions and edits to better protect our small LLC with these three contracts. With his guidance we have been able to make a concerted effort to protect our business. We would recommend Jeff for his ability to quickly understand complex issues and address all of our concerns in a timely and professional matter.

I turned to Jon for some outside-the-box thinking on an interesting problem related to multiple (potential) foreclosures. He was not judgmental about the situation, but instead quickly turned his focus on how to help, given the very difficult circumstances. In the end, he was able to give me everything I needed in about two hours and was able to refund me part of my deposit after doing so. I'm very impressed and will send clients his way in the future.

I wish words could express how thankful I am for Justin Berg and his work as my attorney on my construction defect case.  If I could give him more stars, I would. I highly, highly recommend Justin Berg. I built a house that had numerous and significant construction defects, and I have had the extreme good fortune to work with Justin for about four years to get my house repaired and hold the builder accountable.  Among other things, Justin is an expert on construction contracts, construction defect cases and insurance coverage, so he was able to help me in all three areas. When the defects in my house started appearing, Justin knew exactly what to do. If I had tried to begin this process and/or go down this road on my own, I would not have done it correctly nor would I have gotten the results I wanted. Justin is incredibly knowledgeable about the law in general and business litigation, insurance coverage, construction defect and construction contract cases specifically, so he guides us down the path that is the most legally effective and financially responsible.  He is strategic, patient, honest and ethical. He is very smart, and he is great at explaining complex legal issues.  He always has his clients’ best interests in mind.  I know attorneys are expensive, and Justin is worth every penny and so much more. Justin will assess your case and create the most effective strategy given the facts of your situation just as he did with mine. Justin has cared as much about my case as I do. He earned my trust with his extensive knowledge about the law, his willingness and ability to explain it to me, the fact that he was very conscientious about what the lawsuit was costing me, and by genuinely having my best interests at heart. I was very anxious, and Justin was incredibly patient about answering all my questions so I could understand what was going on. Justin is an excellent listener, respectful, empathetic and a great communicator - both verbally and written. He genuinely wants to help his clients achieve the best possible outcome. If you find yourself in need of a lawyer, I hope you are as lucky as I am and get to work with Justin. I cannot thank Justin Berg and everyone at Berg, Hill, Greenleaf and Ruscitti enough for helping me with such a complex and stressful experience.  They seem to understand how overwhelming and expensive a lawsuit is, and they work to make it easy as possible for the client.  I hold them in the highest regard, and I cannot recommend them highly enough. I will be forever thankful for Justin Berg and everyone at BHGR.

I really can't emphasize enough my appreciation for my recent experience working as a client with Brad Peterson representing me. He assisted me in a very challenging time with litigation relating to my professional services business. Brad is rock solid. He is thoughtful; when he considers a course of action, he will have thoughtfully viewed matters from a perspective of someone looking in from the outside. He will not tell you just what you want to hear, but vastly more helpfully, he will offer insight and concrete direction and a suggested course of action. You should listen and soon enough, I think you will learn that his counsel and recommendations are wise, and restrained and invaluable. At the same time, Brad and his firm are absolutely there to take matters to the mat if the other side is unwilling to be reasonable. I am accustomed to the costs of lawyers and his talent is not inexpensive. But the billings I received were absolutely fair to me. I found them completely reasonable. I think anyone who selects Brad to help them (and whom he agrees to help), will never look back and will soon enough realize how fortunate they were to secure his representation. I remain so grateful for his consummate professionalism and effective representation.

From the moment I met Mr. Kaple he ask me to call him Kurt and I felt that I had found a lawyer that I could confide in. On the verge of bankruptcy I went to Kurt for advise. He gave me the information I needed to make the right decisions but just as important he did not press me into proceeding without weighing the pros and cons of filing a chapter 7 or 13. I wanted to avoid bankruptcy so Kurt suggested we negociate at a pace that would give me enough time to survive my financial crisis. When I got to the point that I could handle it myself and save lawyers fees Kurt refunded the remainer of my retainer to help me in my quest to gather as much funds for settlement as possible. That unselfish act convinced me that I could confidently refer Kurt to my family and friends without thinking twice. In this world of greed and self-serving business men and women Kurt Kaple came across as a breath of fresh, clean air and although he may not have all the answers (beware of lawyers that say they do) he vows to do his best. Thanks Kurt!

I discovered at a very late date that I was uncomfortably close to my statue of limitations for a personal injury case - which I found out creates numerous complications that would not be there were there more time. My case was complex. Mr. Landry was caring and compassionate in listening to my details and he reached out to me numerous times over a week-plus trying to help. Many, many other lawyers turned me down because of the time limits and Mr Landry was willing to take my case even though some of the specifics of it were out of his practice range. He was willing to do simply because he knew that I had a good case but had not been able to find another lawyer at such a late date. He offered many suggestions and was always positive and willing to try different options, and he researched areas he did not know well. At all times he was humorous and understanding. I ultimately found a lawyer who had much experience in the nuances of my case so I did not end up hiring Mr. Landry. When I told him, he was gracious even though he had spent a fair amount of time with me. He then sincerely wished me the best - and even asked me to let him know how things turned out. To my mind, the mark of a great lawyer is one with heart and a willingness to help, as well as a willingness to think out of the box. You will find this - and more - in Mr. Landry.

Scott assisted me with due diligence and purchase agreements on three pieces of vacant land on the west slope of Colorado, one of which was an environmentally impaired mining claim. Scott's assistance with these matters was outstanding. Although I was a relatively small client, Scott was exceptionally responsive and dependable. His deliverables were accurate and language precise. Although small, the purchases were complex and required an attorney with expertise in environmental matters. I depended on his amendments to the purchase agreements to protect my interests and learned a lot about real estate law in the process. A few years later, I completed an additional vacant land purchase in a different state (using different local attorneys as a result). In this later matter, the attorneys that I worked with were far from the caliber of Scott, further increasing my appreciation for the fine work that Scott performed in Colorado. I highly recommend Scott for real estate and environmental/natural resource matters.

We became involved with a very sticky and technical legal matter and another lawyer referred us to Max. We found Max to be very knowledgeable, bright, professional, and timely throughout the entire process. Beyond legal issues, he gave fantastic advice on strategy (short and long) and followed through with brilliant execution. As a teacher of negotiation skills I found Max to be a worthy partner as well - and to top if all off, we were successful. In short, while no one wants to be involved with legal issues, we couldn't have asked for a better experience.

I was going to lead you through all we were up against, and how we cam about choosing. Instead, just the facts. Steve instilled confidence in our initial phone call, which led to the first free consultation. We spent an hour talking, and during this time, Steve laid out what the game plan, and what could happen all the way around. During the next few months, Steve did as he laid out, moved quickly over and through a very difficult and complex situation with the construction team that left us high and dry. Worked well with our slow insurance agent, getting and gathering information so we could come to a final settlement. Steve not once got out of line, even though I did at one point with the construction personnel. Very professional, straight up. Communication was constant, and if I had questions, he was there to talk to, and if out of office would call back when he was back in the office. We could not have done better picking an attorney. Through this whole 2 year fiasco with our home, this was the only positive we can look back on. the fire was bad, everything after was worse. Steve gave us a leg to stand on, and worked to get us our home back clear and free of the construction folks. If we had tried on our own, we would either still be fighting or would have settled for far, far less than what we did. Steve was worth every penny, his staff was always helpful. Attention to detail was incredible, nothing left to chance. His outside team that he consulted with on the construction details of our home was above and beyond, knowledgeable, and to the point. This was a win all the way around.

I hired Jim during a very difficult divorce and custody battle. Jim was able to do everything I asked of him. I started out with only have a few hours a week with my son, and after hiring Jim that few hours turned into me having 365 overnights a year and 100% decision making. It was the best move I could have made. Jim is worth every penny, and he is willing to work with you. If you want a lawyer that will go to work for you and always have your best interest at heart Jim should be your first choice. He fought tooth and nail and everything paid off in the end. He will let you know straight forward and wont sugar coat it. He will look out for you and your family. I am truly thankful for everything Jim has done for my family. He is the best in town in my opinion. I cannot say enough good things about Jim and his law firm. Each and every one of them from Max at the front desk to Julie wants nothing but the best for you and your family. Jim is a very good lawyer and knows what he is doing. He is at ease and relaxed in the court room. When he is in court he is in his element and knows what has to be done to get the job done. I am in his debt for what he has done for my family.

What a Real Estate Lawyer Can Do for You

A real estate lawyer provides legal assistance in transactions and disputes involving property, including residential and commercial real estate. Whether you're buying, selling, leasing, or developing property, a real estate attorney can help ensure that your transactions are legally sound and your rights are protected. They review contracts, perform due diligence, resolve disputes, and provide legal representation in negotiations and litigation involving property matters.

Real estate lawyers are crucial in safeguarding your investment by ensuring compliance with local, state, and federal real estate laws, as well as protecting you from potential legal pitfalls related to property ownership and transactions.

When Should I Hire a Real Estate Lawyer?

Hiring a real estate lawyer is beneficial in various scenarios, including:

  • Buying or selling property: When navigating complex real estate contracts, it’s advisable to have a lawyer review and ensure that the terms are favorable and legal.
  • Commercial property transactions: For leasing, purchasing, or selling commercial properties, a lawyer can help manage the intricate legal aspects of such transactions.
  • Zoning or land use issues: If you're planning to develop property or change its use, a real estate lawyer can guide you through zoning laws and land use regulations.
  • Resolving property disputes: For boundary disputes, title issues, or disagreements over property rights, a lawyer can help mediate or litigate the matter.
  • Foreclosures or evictions: If you're dealing with foreclosure or managing a tenant eviction, legal representation ensures that the process adheres to local laws and protects your interests.
  • Title and deed issues: Lawyers can help clear title disputes, ensure the legitimacy of property deeds, and handle transfers of ownership.

What Does a Real Estate Lawyer Do?

A real estate lawyer provides a range of services to help with property transactions and disputes, including:

  • Contract drafting and review: Ensuring that purchase agreements, leases, and other contracts are legally binding, fair, and protect your interests.
  • Title search and clearance: Conducting a thorough title search to ensure that the property has no legal claims or liens that could affect ownership.
  • Facilitate closing: Managing the closing process in real estate transactions, including reviewing final documents and ensuring that everything is in order before the transfer of ownership.
  • Resolve disputes: Handling legal disputes related to property ownership, boundaries, zoning, or tenants.
  • Assist in financing: Reviewing loan agreements and mortgage documents to ensure the terms are fair and legally sound.
  • Zoning and land use advice: Guiding clients through the complexities of zoning laws and building regulations for property development or renovation projects.

How Are Real Estate Lawyers Paid?

Real estate lawyers typically charge for their services in the following ways:

  • Flat fee: Many real estate transactions, such as reviewing a sales contract or assisting with a closing, are charged on a flat-fee basis.
  • Hourly rates: If a lawyer is handling complex disputes or litigation, they may charge by the hour. Hourly rates can vary significantly based on the lawyer’s experience and location.
  • Contingency fees: In rare cases, such as property disputes or claims for damages, a lawyer may work on a contingency fee basis, meaning they only get paid if you win or settle the case.
  • Retainer: For ongoing legal support, some clients may pay a retainer, which is an upfront fee used as a deposit for future legal services.

It's important to clarify the fee structure with your attorney before hiring them to avoid any surprises.

How Much Does a Real Estate Lawyer Cost?

The cost of a real estate lawyer varies based on the complexity of the matter, the location of the property, and the lawyer’s experience. Key factors that affect pricing include:

  • Type of transaction or issue: Simple tasks, like contract reviews, typically cost less than handling a complex property dispute or litigation.
  • Experience and location: More experienced lawyers or those in high-demand areas, like urban centers, often charge higher rates.
  • Billing structure: Lawyers may charge a flat fee for basic services like document review or hourly for more time-intensive work such as disputes or litigation.

Flat fees for straightforward services like closing assistance may range from $500 to $1,500.

Hourly rates can range from $150 to $400 or more, depending on the attorney’s experience and location.

Always discuss fees upfront to understand the overall cost of the legal service you're receiving.

Top Questions to Ask a Real Estate Lawyer

Before hiring a real estate lawyer, ask the following questions to ensure they are the right fit for your legal needs:

  1. What experience do you have with real estate law?
Ensure the lawyer has experience in the type of real estate transaction or dispute you’re facing, whether residential, commercial, or development-related.
  2. What is your fee structure?
Ask how the lawyer charges for services - whether it's a flat fee, hourly rate, or retainer - so there are no surprises later on.
  3. How long will the process take?
Especially important for real estate transactions or disputes with deadlines, ask for a general estimate of how long the process will last.
  4. Have you handled cases similar to mine?
Experience with similar transactions or disputes can give you confidence that the lawyer knows how to handle your case.
  5. Will you handle my case personally, or will it be passed to another attorney?
Confirm who will be handling the bulk of your case work, especially in larger firms where junior lawyers may take on some responsibilities.
  6. Can you provide references?
Speaking with past clients can give you insight into the lawyer's experience and how they handle cases.

How to Check the Credibility of a Real Estate Lawyer

To ensure you’re hiring a reputable real estate lawyer, take these steps:

  • Check with the state bar association: Verify that the lawyer is licensed and in good standing with no disciplinary actions on their record.
  • Read online reviews and testimonials: Look for reviews on legal directories and platforms like Avvo or Martindale-Hubbell to see what past clients have said.
  • Ask for references: A credible lawyer should have past clients willing to share their experiences.
  • Review their track record and expertise: Look at the lawyer’s website or LinkedIn profile for information about their experience in real estate law and any relevant cases they’ve handled.
  • Membership in professional organizations: Lawyers who are members of respected legal or real estate organizations, like the American Bar Association’s Real Property Division, often signal credibility and expertise.

What Should I Prepare for My First Consultation?

To make your first meeting with a real estate lawyer productive, you should prepare the following materials:

  • Relevant property documents: Bring purchase agreements, lease contracts, mortgage documents, zoning permits, or any other paperwork related to your case.
  • A summary of the issue or transaction: Be ready to explain the situation, whether it's a property dispute, contract negotiation, or development issue.
  • Questions about the legal process: Prepare a list of questions about how the lawyer will handle your case and what steps are involved.
  • Financial documents or loan agreements: If the case involves financing or a mortgage, bring any related documents for the lawyer to review.
  • Your goals and timeline: Be clear about what outcome you're hoping for, and if there are any deadlines that need to be considered, such as closing dates or legal filings.

By coming prepared, you can ensure that your consultation is efficient and informative, allowing you to assess whether the lawyer is the right fit for your real estate needs.
