I have worked with David Pratt on several real estate deals, ranging in complexity from raw land purchases to joint venture projects to acquisitions involving over a dozen entities. He understands all legal issues but cuts through the jargon and bickering to get deals done efficiently and effectively. I highly recommend this attorney.

I was a client of Mr. David Urteago. The following brief paragraph is an objective review of my experience working with him: Mr. Urteago is the definition of the word "attorney". He does not have any flashy advertisements, but he fights for his clients in a manner unparalleled by anyone. Mr. Urteago is an extremely sharp man who is absolutely fully dedicated to his clients' success. He puts his clients first to a degree that's in its own elevated category. Of course, I recommend this attorney - he'll take great care of you. (My statements are all based on facts from personal experience working with this attorney.)

I had an issue with a very good client of my company regarding a reduced flat rate agreement we had entered into for an upcoming project. The agreement was for 1/2 up front and 1/2 at the end of the project. The project was about 65% complete when they decided to pull the plug. The client then did not want to pay the remaining 1/2 they agreed to. Joe helped us resolve this issue with our client in such a way that we received our money and were able to keep our relationship the client intact.

The matter moved to closing quickly and Mr. Elam's responsiveness was a big part of why we were able to meet our preferred time table. I would recommend Mr. Elam for any business matter.

I purchased my first house a year ago and found out shortly after that the seller did not disclose water leaks or mold and in fact tried to cover this up. Collen came to the rescue and helped me through every step in the process. Collen and his team were there whenever I had questions regarding the case and issues from the remediation company all the way to the contractor that finished the build out. Every step of the way Collen was there. Being that it was my first house I really did not want to take this case to trial and it be dragged out for years. Collen was able to settle the case after a couple of months and the settlement was very satisfactory to me. I felt that in any situation Collen would always make time for his clients. I would highly recommend Collen to anyone that has dealt with construction problems. He really knows his stuff and the process.

I have had the opportunity to work with Patricia on two separate occasions: a contentious and complicated partnership dissolution, and a subsequent real estate transaction. In both matters she exhibited a very high level of organization and attention to detail. She acted proactively to initiate communications with myself and outside 3rd parties to secure decisions and arrange documents necessary to keep the ball moving. She kept me informed with concise and frequent communications which was incredibly valuable since I was 1,200 miles away during the entire process. Her legal knowledge and counsel provided me clarity and options which made my decision making much easier. Throughout it all she conducted herself with professionalism and grace and was always available to speak with me when I called. I could not be happier with the outcome of both matters that she worked on for me and I highly recommend to her to any client, current or future employer without reservation. She is a credit to her field and her firm!

I had the privilege of retaining Mr. Bishop for a Civil matter that I was involved with in Texas, even though I a resident from out of state. He came highly recommended from a lawyer that I knew in another state and he did not disappoint. Exceptional knowledge of the law and obvious experience in dealing with all manner of cases. He treated my case like it was the most important one and treated me with respect and courtesy, and as a client, that is all I could ask. Even though the majority of our communications were telephonically, I always felt that Mr. Bishop was engaged and had my best interest in mind. I have dealt with others lawyers in the past who I felt could care less other than cashing the retainer check, so I had a wary feeling at first. However, Mr. Bishop is unusual in the fact that he "cares" and "listens" to what an his client says. I would recommend highly as well. Ultimately, my case was settled and I thank Mr. Bishop and his exceptional staff for a job well done.

Ryan told me once, "Part of my job as an attorney is also as counselor. The best way to handle this stress and this feeling of being overwhelmed is to break things down to smaller issues. Try not to focus on the car wreck or what you've been through, focus on what you are doing now. Your goal should be to keep working and functioning so that you can get a paycheck -- first priority. Second priority -- work with your doctors to find a treatment plan to help you. Third priority -- find ways to clear your mind of all the negativity and stress, whether it be through meditation, quiet time, or long walks... this is more important than people realize." I was able to get on with my normal life and all the obligations without worrying about the case or whether I was supposed to be doing something. He'll do his best to look out for you as my client, but also with anything else that may or may not be related to your case. Everything is in your best interest. He is insightful, experienced and well versed in the harsh realities of the legal system and its outcomes. I am 27-yr-old head of household and have so many responsibilities and stressors in my life. I support my family and was trying to graduate college when I was involved in this accident. I had been thru two really crappy lawyers working on my case before, who didn't do anything but kept telling me to go get chiropractic surgeries with preferred clinics no doubt. Anytime I would call to ask for an update they would brush me off or tell me they would call back when they got something. They were not doing a single thing. And here I am sharing my potential reimbursement. Ryan worked around my schedule and scheduled meetings that would work for me. Ryan quickly reorganized their mass of copies and wrapped up calling the necessary people right away. Anytime I would call with a question or status update, he would return my call via phone or mail within 1 day (2 if he was in court). Don't let his age fool u. He's knowledgeable, professional and very thourough in working his cases to the full extent.

I was having an issue with a home builder claiming I was in breach of the purchase agreement. I found Hunter McClean on Avvo and he referred me to his associate Patrick. I contacted them Thursday around midnight and they responded early Friday morning. We discussed the issue, formed a plan of actions, and acted on it that same day which was just fantastic. My home builder dispute ended the following day! They were fast, knowledgeable, and very accommodating to my needs. This was my first experience with lawyers but if I ever have a problem again I'm definitely going to them!

Tony is not only a rare breed among lawyers, but among individuals providing a service as well. He is responsive, knowledgeable and interested in his clients. I started working with him about eight or nine months ago on several business projects. He helped me work a number of situations that I thought would not work out in my favor. He told me what he would do and then he did what he said he would do. If he had an associate working with him, he ensured that that individual did what had to be done. I could not have asked for more. I have been extremely happy with his services and wish every "vendor" that I work with was as conscientious and diligent as Tony.

What a Real Estate Lawyer Can Do for You

A real estate lawyer provides legal assistance in transactions and disputes involving property, including residential and commercial real estate. Whether you're buying, selling, leasing, or developing property, a real estate attorney can help ensure that your transactions are legally sound and your rights are protected. They review contracts, perform due diligence, resolve disputes, and provide legal representation in negotiations and litigation involving property matters.

Real estate lawyers are crucial in safeguarding your investment by ensuring compliance with local, state, and federal real estate laws, as well as protecting you from potential legal pitfalls related to property ownership and transactions.

When Should I Hire a Real Estate Lawyer?

Hiring a real estate lawyer is beneficial in various scenarios, including:

  • Buying or selling property: When navigating complex real estate contracts, it’s advisable to have a lawyer review and ensure that the terms are favorable and legal.
  • Commercial property transactions: For leasing, purchasing, or selling commercial properties, a lawyer can help manage the intricate legal aspects of such transactions.
  • Zoning or land use issues: If you're planning to develop property or change its use, a real estate lawyer can guide you through zoning laws and land use regulations.
  • Resolving property disputes: For boundary disputes, title issues, or disagreements over property rights, a lawyer can help mediate or litigate the matter.
  • Foreclosures or evictions: If you're dealing with foreclosure or managing a tenant eviction, legal representation ensures that the process adheres to local laws and protects your interests.
  • Title and deed issues: Lawyers can help clear title disputes, ensure the legitimacy of property deeds, and handle transfers of ownership.

What Does a Real Estate Lawyer Do?

A real estate lawyer provides a range of services to help with property transactions and disputes, including:

  • Contract drafting and review: Ensuring that purchase agreements, leases, and other contracts are legally binding, fair, and protect your interests.
  • Title search and clearance: Conducting a thorough title search to ensure that the property has no legal claims or liens that could affect ownership.
  • Facilitate closing: Managing the closing process in real estate transactions, including reviewing final documents and ensuring that everything is in order before the transfer of ownership.
  • Resolve disputes: Handling legal disputes related to property ownership, boundaries, zoning, or tenants.
  • Assist in financing: Reviewing loan agreements and mortgage documents to ensure the terms are fair and legally sound.
  • Zoning and land use advice: Guiding clients through the complexities of zoning laws and building regulations for property development or renovation projects.

How Are Real Estate Lawyers Paid?

Real estate lawyers typically charge for their services in the following ways:

  • Flat fee: Many real estate transactions, such as reviewing a sales contract or assisting with a closing, are charged on a flat-fee basis.
  • Hourly rates: If a lawyer is handling complex disputes or litigation, they may charge by the hour. Hourly rates can vary significantly based on the lawyer’s experience and location.
  • Contingency fees: In rare cases, such as property disputes or claims for damages, a lawyer may work on a contingency fee basis, meaning they only get paid if you win or settle the case.
  • Retainer: For ongoing legal support, some clients may pay a retainer, which is an upfront fee used as a deposit for future legal services.

It's important to clarify the fee structure with your attorney before hiring them to avoid any surprises.

How Much Does a Real Estate Lawyer Cost?

The cost of a real estate lawyer varies based on the complexity of the matter, the location of the property, and the lawyer’s experience. Key factors that affect pricing include:

  • Type of transaction or issue: Simple tasks, like contract reviews, typically cost less than handling a complex property dispute or litigation.
  • Experience and location: More experienced lawyers or those in high-demand areas, like urban centers, often charge higher rates.
  • Billing structure: Lawyers may charge a flat fee for basic services like document review or hourly for more time-intensive work such as disputes or litigation.

Flat fees for straightforward services like closing assistance may range from $500 to $1,500.

Hourly rates can range from $150 to $400 or more, depending on the attorney’s experience and location.

Always discuss fees upfront to understand the overall cost of the legal service you're receiving.

Top Questions to Ask a Real Estate Lawyer

Before hiring a real estate lawyer, ask the following questions to ensure they are the right fit for your legal needs:

  1. What experience do you have with real estate law?
Ensure the lawyer has experience in the type of real estate transaction or dispute you’re facing, whether residential, commercial, or development-related.
  2. What is your fee structure?
Ask how the lawyer charges for services - whether it's a flat fee, hourly rate, or retainer - so there are no surprises later on.
  3. How long will the process take?
Especially important for real estate transactions or disputes with deadlines, ask for a general estimate of how long the process will last.
  4. Have you handled cases similar to mine?
Experience with similar transactions or disputes can give you confidence that the lawyer knows how to handle your case.
  5. Will you handle my case personally, or will it be passed to another attorney?
Confirm who will be handling the bulk of your case work, especially in larger firms where junior lawyers may take on some responsibilities.
  6. Can you provide references?
Speaking with past clients can give you insight into the lawyer's experience and how they handle cases.

How to Check the Credibility of a Real Estate Lawyer

To ensure you’re hiring a reputable real estate lawyer, take these steps:

  • Check with the state bar association: Verify that the lawyer is licensed and in good standing with no disciplinary actions on their record.
  • Read online reviews and testimonials: Look for reviews on legal directories and platforms like Avvo or Martindale-Hubbell to see what past clients have said.
  • Ask for references: A credible lawyer should have past clients willing to share their experiences.
  • Review their track record and expertise: Look at the lawyer’s website or LinkedIn profile for information about their experience in real estate law and any relevant cases they’ve handled.
  • Membership in professional organizations: Lawyers who are members of respected legal or real estate organizations, like the American Bar Association’s Real Property Division, often signal credibility and expertise.

What Should I Prepare for My First Consultation?

To make your first meeting with a real estate lawyer productive, you should prepare the following materials:

  • Relevant property documents: Bring purchase agreements, lease contracts, mortgage documents, zoning permits, or any other paperwork related to your case.
  • A summary of the issue or transaction: Be ready to explain the situation, whether it's a property dispute, contract negotiation, or development issue.
  • Questions about the legal process: Prepare a list of questions about how the lawyer will handle your case and what steps are involved.
  • Financial documents or loan agreements: If the case involves financing or a mortgage, bring any related documents for the lawyer to review.
  • Your goals and timeline: Be clear about what outcome you're hoping for, and if there are any deadlines that need to be considered, such as closing dates or legal filings.

By coming prepared, you can ensure that your consultation is efficient and informative, allowing you to assess whether the lawyer is the right fit for your real estate needs.
