I needed a good lawyer when fighting an illegal eviction attempt by an unscrupulous landlord in SF. Dan Berko came recommended and immediately I knew I had come to the right place. He explained aspects of my case to me and potential pitfalls, never overconfident or selling. In the end we prevailed, but I should mention it was an impressive litany of legalese that this man had at his fingertips and observing him explaining case law nuances was frankly impressive. His junior associate Carlos Jato was equally sharp and attentive to detail. Overall I have no doubt that I received some of the best legal counsel available and under adverse circumstances and timelines. His fees were beyond reasonable, he was willing to work with us of meager means at that period. His personal advice to me during that period was reassuring and helped me navigate the ordeal. I thank him for his knowledge, his pragmatic demeanor and ultimately his candor. I would recommend him to anyone and I'm definitely understating my praises. A consummate professional.

As a small business owner, unbelievably, I found myself in a David v. Goliath situation, against a well-known Fortune 500 Company, who committed fraud. I was blessed with one of the finest attorneys in San Francisco, Kevin P. Dwight. Not only did he protect us, we ended up settling very favorably against this Big, Bad Corporate Giant. He was recommended by a seasoned paralegal friend, who worked with many well reputed experienced San Francisco attorneys. She convinced me to switch lawyers because Kevin was "Golden”. She was RIGHT! Kevin displayed "exceptional levels of skill and tenacity". He is confident and shows his great abilities in litigation. My best interests always came first and foremost every time. Kevin and his professional team worked hard to achieve results that 2 other firms couldn't. He laid out the options and we brainstormed together. He is a brilliant attorney, who has the "Trial Lawyer threat" with a big name firm behind him. That is what you want your attorney to have if you want to prevail based on fact and the truth. He is a brilliant writer and the most effective communicator. Few peers can equal Kevin’s commitment to the cause of justice and his ethical standards are unparalleled. Kevin Dwight takes "No Prisoners" and his strategy got us AMAZING Results and Resolution!

I had several bad experiences with lawyers. Not only I was not pleased with the result they all promised but also they also charged me ton of attorney's fees for poor result. After carefully seeking referral from two real estate agents and asked questions, I decided to use Mr. Hendrickson. It's the first time I tried him for small matter. I have issues with the tenants who have been battling with me last 2 months and half with one dispute after another. Not able to resolve it. I was very stressful like having a world war III. Mr. Hendrickson handled the case very well. The matter was resolved very quickly. I was absolutely very satisfied with the result and his hourly rate is reasonable low. Very professional! I definitely will use him again.

Mark Epstein worked miracles and did it with the most amount of professionalism and thoughtfulness of anyone I have ever worked with. Every single juror walked up to me after the trial and complimented me on my representation in the courtroom. Mark knew how much was on the line and was sensitive to that. He always called or emailed me back in a timely manner. He was completely in control of everything, which was an enormously calming factor for me in an extremely stressful situation. I did not realize how difficult Mark's job was going to be. Looking back, it was a much tougher battle than I would have thought in the beginning. We went to trial and we won, but it was Mark's confidence that made me believe that we were going to win. He was supremely confident in his ability and in what he was going to do. At no point was losing even a possibility. He said that there was no margin for error. I felt an obligation to be as confident as he was in terms of the facts, and that had a positive effect on my testimony. I highly recommend Seiler Epstein Zeigler & Applegate. You would be lucky if the firm chose to take your case.

I have been involved in real estate my whole life. I am a third generation real estate broker and have been licensed to sell since 1982. My business encompasses everything from property management and selling apartment buildings to developing property as well as being involved with large and small TIC projects. I rely on the lawyers I choose to make sure my transactions are safe and my clients and I are protected from potential problems. I have been working with Andrew Wiegel's law firm for about 15 years. They have taken care of everything from Ellis Act procedures and tenant issues to litigating and/or negotiating settlements when a contract has not gone "as originally expected". Andrew is a well rounded, natural litigator. Immediately when you meet him, his presence is calming. His understanding of the law and level of integrity is obvious when he starts to talk. One thing I have learned is that you do not want to pick a lawyer by their price tag, neither high nor low, but by the value received. Because of Andrews extensive knowledge and his command of the language of the law his value is through the roof. Another great things about working with Andrew Wiegel is that you know the other side is nervous right off the bat. His reputation in the real estate community is high level and absolutely deserved. You will be well protected with your choice of Andrew Wiegel.

Elsa helped me during my divorce, which was a little complicated since it was between the US and France. The competence, compassion and humanity of Elsa are off the chart. To make a long story short, there was a dispute of jurisdiction between the two courts (California and France), Elsa was so good that the Judge in France mentioned her work in the sentence (which attributed the competence to California). But it was not only during this international dispute that Elsa was extremely helpful, even during the preparation of the hearing in California she was really valuable and supportive. You have always the feeling that she is genuinely caring about the best possible outcome for you. I don't know how to say it again, but if you are in the unfortunate situation that you need a divorce lawyer, Elsa is the best you can find!

We met with Richard Beckman and his associate Justin Goodman about a small claims judgment that was wrongly entered against us for $10,000.00. After reviewing the judgment and the plaintiff’s case and our defense, he believed the judgment would be reversed if we appealed it, though he was concerned that the cost of legal fees could be a concern, since the amount in the case was ‘only’ $10,000.00. However, he agreed to represent us for a flat fee, which we thought was reasonable. We went to the appeal court trial, with his associate Justin, who convinced the judge to overturn the prior judgment and award the tenant plaintiffs nothing. We were very pleased with Mr. Beckman’s handling of our case, and the efforts by his associate Justin. We would be happy to recommend them both to any of our friends.

Mr. WIngfield represented my husband in an adversarial proceeding case that was brought against us after we filed bankruptcy. It was a terrifying time for us. We are so thankful for Mr. WIngfield and his professionalism, knowledge of the law, foresight and his care in our case. Our case was a difficult one, one that could have gone either way. Mr. Wingfield was so prepared before trial and thought of every angle the opposing side may take. We were prepared for a 2 day trial. At the end of the first day he made motions to dismiss all 3 charges against us and because for his preparation, understanding of the law and care in our case, the judge threw out all three charges. He won our case without even having to present our side. We are so thankful for him! Best Lawyer ever!

What a Real Estate Lawyer Can Do for You

A real estate lawyer provides legal assistance in transactions and disputes involving property, including residential and commercial real estate. Whether you're buying, selling, leasing, or developing property, a real estate attorney can help ensure that your transactions are legally sound and your rights are protected. They review contracts, perform due diligence, resolve disputes, and provide legal representation in negotiations and litigation involving property matters.

Real estate lawyers are crucial in safeguarding your investment by ensuring compliance with local, state, and federal real estate laws, as well as protecting you from potential legal pitfalls related to property ownership and transactions.

When Should I Hire a Real Estate Lawyer?

Hiring a real estate lawyer is beneficial in various scenarios, including:

  • Buying or selling property: When navigating complex real estate contracts, it’s advisable to have a lawyer review and ensure that the terms are favorable and legal.
  • Commercial property transactions: For leasing, purchasing, or selling commercial properties, a lawyer can help manage the intricate legal aspects of such transactions.
  • Zoning or land use issues: If you're planning to develop property or change its use, a real estate lawyer can guide you through zoning laws and land use regulations.
  • Resolving property disputes: For boundary disputes, title issues, or disagreements over property rights, a lawyer can help mediate or litigate the matter.
  • Foreclosures or evictions: If you're dealing with foreclosure or managing a tenant eviction, legal representation ensures that the process adheres to local laws and protects your interests.
  • Title and deed issues: Lawyers can help clear title disputes, ensure the legitimacy of property deeds, and handle transfers of ownership.

What Does a Real Estate Lawyer Do?

A real estate lawyer provides a range of services to help with property transactions and disputes, including:

  • Contract drafting and review: Ensuring that purchase agreements, leases, and other contracts are legally binding, fair, and protect your interests.
  • Title search and clearance: Conducting a thorough title search to ensure that the property has no legal claims or liens that could affect ownership.
  • Facilitate closing: Managing the closing process in real estate transactions, including reviewing final documents and ensuring that everything is in order before the transfer of ownership.
  • Resolve disputes: Handling legal disputes related to property ownership, boundaries, zoning, or tenants.
  • Assist in financing: Reviewing loan agreements and mortgage documents to ensure the terms are fair and legally sound.
  • Zoning and land use advice: Guiding clients through the complexities of zoning laws and building regulations for property development or renovation projects.

How Are Real Estate Lawyers Paid?

Real estate lawyers typically charge for their services in the following ways:

  • Flat fee: Many real estate transactions, such as reviewing a sales contract or assisting with a closing, are charged on a flat-fee basis.
  • Hourly rates: If a lawyer is handling complex disputes or litigation, they may charge by the hour. Hourly rates can vary significantly based on the lawyer’s experience and location.
  • Contingency fees: In rare cases, such as property disputes or claims for damages, a lawyer may work on a contingency fee basis, meaning they only get paid if you win or settle the case.
  • Retainer: For ongoing legal support, some clients may pay a retainer, which is an upfront fee used as a deposit for future legal services.

It's important to clarify the fee structure with your attorney before hiring them to avoid any surprises.

How Much Does a Real Estate Lawyer Cost?

The cost of a real estate lawyer varies based on the complexity of the matter, the location of the property, and the lawyer’s experience. Key factors that affect pricing include:

  • Type of transaction or issue: Simple tasks, like contract reviews, typically cost less than handling a complex property dispute or litigation.
  • Experience and location: More experienced lawyers or those in high-demand areas, like urban centers, often charge higher rates.
  • Billing structure: Lawyers may charge a flat fee for basic services like document review or hourly for more time-intensive work such as disputes or litigation.

Flat fees for straightforward services like closing assistance may range from $500 to $1,500.

Hourly rates can range from $150 to $400 or more, depending on the attorney’s experience and location.

Always discuss fees upfront to understand the overall cost of the legal service you're receiving.

Top Questions to Ask a Real Estate Lawyer

Before hiring a real estate lawyer, ask the following questions to ensure they are the right fit for your legal needs:

  1. What experience do you have with real estate law?
Ensure the lawyer has experience in the type of real estate transaction or dispute you’re facing, whether residential, commercial, or development-related.
  2. What is your fee structure?
Ask how the lawyer charges for services - whether it's a flat fee, hourly rate, or retainer - so there are no surprises later on.
  3. How long will the process take?
Especially important for real estate transactions or disputes with deadlines, ask for a general estimate of how long the process will last.
  4. Have you handled cases similar to mine?
Experience with similar transactions or disputes can give you confidence that the lawyer knows how to handle your case.
  5. Will you handle my case personally, or will it be passed to another attorney?
Confirm who will be handling the bulk of your case work, especially in larger firms where junior lawyers may take on some responsibilities.
  6. Can you provide references?
Speaking with past clients can give you insight into the lawyer's experience and how they handle cases.

How to Check the Credibility of a Real Estate Lawyer

To ensure you’re hiring a reputable real estate lawyer, take these steps:

  • Check with the state bar association: Verify that the lawyer is licensed and in good standing with no disciplinary actions on their record.
  • Read online reviews and testimonials: Look for reviews on legal directories and platforms like Avvo or Martindale-Hubbell to see what past clients have said.
  • Ask for references: A credible lawyer should have past clients willing to share their experiences.
  • Review their track record and expertise: Look at the lawyer’s website or LinkedIn profile for information about their experience in real estate law and any relevant cases they’ve handled.
  • Membership in professional organizations: Lawyers who are members of respected legal or real estate organizations, like the American Bar Association’s Real Property Division, often signal credibility and expertise.

What Should I Prepare for My First Consultation?

To make your first meeting with a real estate lawyer productive, you should prepare the following materials:

  • Relevant property documents: Bring purchase agreements, lease contracts, mortgage documents, zoning permits, or any other paperwork related to your case.
  • A summary of the issue or transaction: Be ready to explain the situation, whether it's a property dispute, contract negotiation, or development issue.
  • Questions about the legal process: Prepare a list of questions about how the lawyer will handle your case and what steps are involved.
  • Financial documents or loan agreements: If the case involves financing or a mortgage, bring any related documents for the lawyer to review.
  • Your goals and timeline: Be clear about what outcome you're hoping for, and if there are any deadlines that need to be considered, such as closing dates or legal filings.

By coming prepared, you can ensure that your consultation is efficient and informative, allowing you to assess whether the lawyer is the right fit for your real estate needs.
