Donna Hung absolutely saved my life as a father. There is no attorney in central Florida that can think on their feet, and actually make things happen, the way Donna does. I truthfully believe from the bottom of my heart that she is the best there is, and I would recommend her to anyone that actually wants the best outcome. Any past complaints on pricing, or whatever…. You honestly get what you pay for. Thank you, to Donna and your team. You guys are absolute rockstars.

I hired Ms. Donna Hung about two years ago and my experience with her and her stuff exceeded my expectations. Their prompt responses, attention to detail, preparation, and knowing that they have your best interest in mind was comforting and key to ultimately win my family law case. I would highly recommend this law firm to anyone seeking true professionalism and legal expertise.

I highly NOT recommend Mrs. Kay-Ann Waite. I hired her in April and at the beginning she told me it wasn’t going to take too long and it seemed she was going to work hard for me. Then, I had to constantly ask for updates since she didn’t provided any without me asking. It is June now and since 2 weeks ago, I have been calling to her office and sending emails and text messages asking for updates but it seems pointless. If she is not planning to get the job done, I would like to get a refund and hire another lawyer.

I immediately came to leave a review for this attorney. This is based strictly off of her personality and not legal work. I was referred to her through my job's EAP service. After doing a quick google search to see if she would be a good choice, I set up the free consultation. Initially she seemed nice and like she was interested in what I had to say. However, after discussing my current legal matter, which is very serious, she then tells me as she is smacking her food, that she doesn't give second opinions behind another attorney. Now, I had mentioned several times that I currently have an attorney and that is partly why I was in the situation I was in. At that point, she could have cut me off and stated she doesn't go behind other attorneys to give advice. But no, she waited right until 2 mins before the 30 mins was up to cut me off and say, I don't give second opinions, sorry to waste your time, bye" and hung up. With all the pain that I endure with my legal battles; I will not let her rudeness discourage me. Compassion goes a long way, luckily if one lawyer doesn't work the EAP will find another one, hopefully one that will not be as dismissive as she was. I hope no one else experience what I just did with her. I would also hope that if she is ever in a predicament that is giving her pain, that someone will show her compassion. Maybe if I was a paying client, then just maybe she would have shown humility. Good luck

I was referred by my EAP to Veronica for legal consultation on what my options were in my marriage. I was a bit nervous at first because we all know how random the recommendations can turn out to be. Needless to say that after just a few minutes into my consult with Veronica I knew that she was the right choice no matter what path I chose. She was extremely knowledgeable, understanding and even took the additional time to simplify and explain each option and it’s correlated processes. I whole heartedly would recommend her to anyone looking for a lawyer.

If you value your time, money, and sanity, avoid Avard Law Firm and Carol Avard like the plague. My experience with them from February 13, 2024, to June 5, 2024, was nothing short of a nightmare. In just four months, they managed to completely derail my SSDI case, setting it back to the point where I’m now forced to appeal to the Appeals Council just to get a hearing—a step that wouldn’t even be necessary if they had done their job right. When they took my case, it was already in a precarious state. I had already gone through the reconsideration process on my own, which took a year, only to be denied. Despite this, Avard Law Firm proceeded to re-file the same appeal I had already done, wasting even more time. The worst part? They filed the wrong paperwork! When I called Social Security myself, I was told explicitly that Avard had filed the wrong documents. When I confronted the firm about this, they flat-out lied to my face, claiming they had filed the correct paperwork, just not the “one Social Security was looking for.” What does that even mean? If it’s not what they were looking for, it’s wrong! This wasn’t a simple mistake; it was gross negligence. They clearly didn’t care enough to even review my case properly before filing. After I called them out, they finally filed the correct paperwork, but by then, the damage was done. They botched it so badly that my request for a hearing was filed late. Now, thanks to their incompetence, I don’t even get the hearing I deserve unless I go through the Appeals Council—a highly unusual and completely unnecessary step, had they just done their jobs correctly. I’ve been battling this case since July 2020, and this has been the worst experience by far. To think that in just four months, Avard Law Firm didn’t just fail to move my case forward—they actually ruined it. Their handling of my case was so reckless that it’s hard to believe they are still in business. Thankfully, I’m now under new representation, and I can only hope they can undo some of the damage Avard Law Firm has caused. Save yourself the agony and choose a different law firm. Avard Law Firm is a disaster waiting to happen

Real truth! I kept seeing 444’s everywhere. I was praying for a lawyer because I needed professional help. Although I was physically delivering my paperwork at the disability office, I was being told that the paperwork wasn’t being received timely and/or I missed the deadline Via denials. It was stressful to complete by myself! I decided I needed representation. One day I watching TV. On TV there was a commercial for an attorney that also said their contact was 444-444-4444. I called the number they advised because they couldn’t rep me. However, they suggested Jessica Dumas! I gave her office a call, I provided the needed information. The girl call me back and advised Jessica Dumas said yes they can rep me in my case on January 23rd 2020. They sent me the paperwork via USPS! When I got it, i took all my paperwork, medication and etc that I had collected since 2016 when I started applying for disability, after my mom passed away and I became ill, I was stressed and in constant chronic pain after having a major back Infusion surgery due to Arthritis, degenerative disc, spinal issues, back, leg, & neck pain. Which is the reason I’m applying for disability! Well, to make a longer story short...after accepting my case in October of 2019, Jessica Dumas is now saying she won’t....not that she can’t....she said she won’t represent me! I feel...the only reason I can think that she won’t is because when her office sent me two sets of papers via mail to take to my doctors to fill out & complete! I inquired & asked her when she finally called me, after two months, why couldn’t her office have sent the paperwork directly to the Drs...Jessica became offended it seemed!!! She Then advised me that she doesn’t think she can represent me abruptly!!! The reason I am reviewing her is that the 2 months her & her office sat on my case & didn’t do a thing, something could’ve been done! But here at crunch time & close to my court date she advised me she will not represent me! I feel like she got cold feet! I am so disappointed in Jessica Dumas & her law firm right now! Everything that was promised didn’t happen! The young lady that helped me when I first walked in to meet her & her team (In the office to the right when you walk into her law firm)and take the paperwork in advised me of the steps. She said someone would call me to get other evidence, to disgust the case, talk about the court date and more! However, none of that happened! Why would her law firm take the case if they couldn’t handle it! I could have continued searching & looking for another Lawyer! Now I’m very close to the court date with no representation! In all of this timeframe(2 months) of hiring Jessica Dumas..... I met Jessica Dumas the day I initiated it by dropping by the paperwork myself voluntarily at her office after she accepted to represent me in court and I really only spoke to her the day via phone when she advised me she will not take my case! So basically I was in contact with her twice out of two months! She did send me a letter that I need to get representation ASAP...well DUH!!! The letter also states I do not owe her anything....DUH again! This was Not a good client/ attorney relationship/privilege from the start.....aka A RED FLAG! How could she??? Why is bad always present when you trying to do the right thing?

We are so grateful for Tim Rudge and his paralegal, Mitzi for their work on our case. To start, they rescued our stalled case from our own bad choice of first attny. Tim took over and got our case going in the correct direction right away. He clearly explained every step and option we had in our case and executed our choices promptly with no ego or agenda. Tim and Mitzi were always easy to reach, we never waited more than 24hrs for answers. Mitzi copied us on documents and emails, usually the same business day, and always made sure we understood them and didn't have any questions. For our first legal experience, we couldn't be happier to have found these two to represent us.

I want to address my gratefulness and appreciation for having met Kevin S. Rabin, Esq., Litigation Director for Three Rivers Legal Services. He provided incredible support and assistance in the matter of the settling a lawsuit about the sale of our principal residence in Suwannee County. Our case was not a simple one as the closing company failed to do its job (sending mortgagee payment minus 1 days interest) and the house, after being sold, was taken back by a foreclosure by way of the mortgagee (Sherrel McCall). She acted in bad faith for not receiving one days interest – and in turn was able to extort over $90,000 (he learned) from the title closing and insurance companies. Without TRLS assistance, we (my ex-wife and the author) would have been up the creek without a paddle as the title insurance company was now suing us for reimbursement of the extorted funds based off of a invalid premise that we did not provide a clear title at closing. With his invaluable guidance and assistance, we were able to settle the matter for a fraction of this amount and are able to breathe in the future knowing that your agreement settled the matter for good. I would highly recommend TRLS for professional, ethical and incredibly smart advise!

Knew nothing of my case and to my knowledge did nothing to advocate on behalf of me. Assumed he knew everything about me generally-knew nothing and when I became upset bc he had done nothing for me, he withdrew bc he doesn't get involved in the appeal process at this stage and we are in stage 3 of 5. When does he get involved? In my case he didn't. At all.

This person did absolutely NOTHING to defend my case against my ex wife in our divorce proceedings. He also did absolutely NOTHING to defend me against her allegations, that I wasn't disabled, during a divorce hearing, no less. I was found to be legally disabled almost 8 years prior, by a 3 Judge panel, with a Degenerative disease. He charged me thousands of dollars, for me to get information from Social Security, that he should have known, as a supposedly Attorney for Social Security claims. The only thing he knows how to do correctly, is stand in front of the Judge, and say his name, and that he charges $350 per hour. Then he sits down. I will regret hiring this person for the remainder of my life.

Sharon was incredibly motivated, but obviously operating under very immense stress levels. My case was very high conflict with many complexities, but Sharon often seemed annoyed when I asked for advice. In the short time she represented me, she frequently complained that she would rather be doing anything else than deal with my case. This made it very difficult for me to approach her with anything, and the working relationship quickly deteriorated. Regardless, I really liked her, and I believe Sharon is a good attorney. I still sincerely wish we could have worked things out. I think maybe she has just reached the burnout level in her career and should consider retiring or doing mediation full-time instead.

This woman lost my disability case, then quit when I criticized her poor effort and multiple acts of negligence in my case. Not only that, but she's stealing money set aside for lawyers by Social Security which is preventing me from hiring competent legal representation to help me win my case; it's proving an uphill battle trying to do it alone from my bed. Even while she was in an ongoing Bar Association complaint from me, she lied to Social Security about which day she quit, milking even more money from my potential backpay. I have no idea how this evil, heartless woman still has a license. I can't say anything about her associate Peter Helwig, but if this firm is your only option, PLEASE DON'T CHOOSE HER, YOU'LL REGRET IT!

He said nothing. Did nothing. In presented my case, answered questions of judge. Was approved and got the 3-4 years or arrearage also. So my payout was quite large. Which meant he got a huge percent. He was so excited $$$$.. But did no work to earn that money. Just kept telling me I would be denied and did not work to get evidence to prove. I did my own research, got others to help me. I have held a job most of my life and the judge only went back one year. The 3 years before I was hurt bad in a accident. And had no choice but to go on SS.

He was my lawer for work comp. case for almost two years and I felt like I had to pull him across the finish line! I literally was on a call with him(because he was late) , the work comp lawer, and the judge and he had me do all the talking! Get any lawer but, this Guy!

Divorce, now that is a proposition that nobody looks forward to, I know I did not. When the other person in the marriage has given up on you and refuses to work on the marriage anymore you kind of run out of options though and as hard and daunting as that seems, divorce is sometimes the only option left. This was my case after almost 20 years, a paid off home, no debt and four beautiful children. Honestly, as a Christian man divorce was certainly not something I ever wanted or thought I would do in my lifetime. So, I hung in there (probably a little too long) hoping things would or could get better but I was only living in a fog and one day finally realized things were never going to change. Yes, I prayed for her and for God to help our marriage, but the answer was no. Simply put It takes two. Both people in the relationship must be willing to work on it or it just will not work, and she wasn’t interested in fact she had already lined my replacement. I had heard the ads on the radio for years about a divorce lawyer specifically for Dad’s but after paying a 150.00 consultation fee and meeting with one of their attorneys in Orlando I was not really impressed. It just did not feel like they would represent me well after our meeting. I remember leaving there quite unsure and discouraged about moving forward. To be honest, I do not like attorneys in general because of past experiences. I contemplated and really wished I could of just do it all myself but that was just not realistic with the complex nature and lack of wisdom on my part. That is when a friend recommended me to Kelly Duncan’s office in Cocoa Village. I called and was able to get in and speak with her the following day. I explained my situation as there were many complications. The most important part that I conveyed to Kelly that day was my desire to have an ongoing, continuing relationship with my children like I always have. She reassured me about everything and was very knowledgeable. After speaking with Kelly, I knew immediately that she was the right choice. She offered me a payment option or a flat fee for the whole thing which was nice. She totally took charge and guided me through every step. She helped me like I was a close friend from beginning to end. Everyone on her team was also very kind, respectful and supportive towards me throughout the whole process. I am very happy with the outcome and my divorce which is thankfully behind me now. I have referred a good friend to her and he is also very impressed with her knowledge and skill navigating through everything. If you are looking for a great Attorney that will fight for you and your rights as a Father Kelly Duncan will not disappoint you. She really knows her stuff; she cares a lot and does not like to lose. Remember I mentioned earlier how I did not really like attorneys that much? Well, that has changed a little, because of Kelly, she was not just my attorney, and I was not just another client she genuinely cared for me, and my family and I am happy to now call her, friend.

She is a great lawyer. She took great care of my parents affairs. Never took advantage. She is a very professional and caring attorney. She even took time out of her busy schedule to attend their funeral. She ensured I had a good and fair estate attorney to handle my parent's affairs. I would highly recommend her without a second thought.

Kelly was absolutely amazing with my case. She was so detailed and gave me great advice that helped us win my case. Her knowledge of family law was amazing and I will refer her to anyone I can. Her and her office staff great, you can truly tell they all care deeply for their clients. As for the bad review that’s in here. He contract clearly states the money that’s due up front is not refundable. Even if your mind is changed to not go forward. A lot of time and work goes in to the first two weeks for her that you may not know or see. They all do a lot behind the scenes we don’t necessary see and I know they did that with my case and it all paid off.

I hired this firm to represent me in a social security disability case. I was initially assigned an inexperienced Immigration attorney to handle my case. SMH. Further, I was eventually granted another attorney and he FAILED to properly handle/litigate my case. He was ill prepared for the hearing even though I asked him to send me a list of questions prior to the hearing. Btw, I lost my case after waiting 3 years for my hearing. There were other issues as well. Do NOT recommend! Note: I hired this attorney outside of Avvo.

Attorney Richard Culbertson personally handled a Social Security Denial Appeal on my behalf. He was professional, enthusiastic, articulate, well spoken, thorough and prepared. Appearing before the administrative law judge, I was confident that Attorney Culbertson would present an outstanding case and he exceeded expectations! As a retired Orange County Deputy Sheriff, I do not frequently write reviews and have very high standards. That being said, if you are in need of a social security lawyer, this is the attorney you need!

Never gives a status even after three years. He waits on insurance companies to motivate him to move. I can only assume he will file suit when his diary alerts him the 4 yr FL statute is about to expire. Then, of course, he is able to charge his clients more for filing suit. DON'T HIRE!

Mr. Finelli took the time to learn about my disabilities and how they affected my life and my family's life. He was compassionate, always returned my email or phone calls, and showed up to every hearing; on time and ready with a detailed action plan. After a disastrous experience with another lawyer, Mr. Finelli and his firm got the job done.

Our experience with Sean and SSDI was great! Sean walked us through the entire process. He always kept us informed of what was going on with the case. This case was complicated with years worth of documentation to sort through. But in the end, the judge approved the SSDI. I would highly recommend Sean McCormack for anyone seeking a Disabilty attorney

I just read the two reviews below, and pondered the question how could I have had the most amazing experience with Ms. Jodi Zacaria, and then actually felt saddened to read two “not favorable” reviews? Yes, my heart actually dropped. Here it is in a nutshell. If you win your case, you have amazing things to say about your lawyer. If not, well you feel compelled to bash them. People be disappointed with the “system”, not this lawyer. I found her to be exact, prompt in her responses to me, and a beast with the judge. (Beast is a positive btw) As soon as the judge asked his first question, I heard her defend me. I literally sat back took a deep breath, and knew if I won my case, it wasn’t going to be on my own merit. Her skill was abrupt! The judge even said after she (Ms. Zakaria) questioned me “Iv heard enough”. Another words, you don’t need to go on, I can see this women’s suffering. Do you know how that makes you feel after fighting an unmovable beast, to finally see that light at the end of a very dark tunnel?! Yes, if your reading this, I know you do know how that feels. Please know ever lawyer learns from “the system” the longer they’ve been in it. Ms. Zakarias skill has been refined. Maybe a few years back, she still had something to learn? But today? Today shes got it about as ‘down pat’ as it gets. I adored everything about her. I wish I could thank her more honestly. Ms. Zakaria if your reading this, I thank you from the bottom of my heart!

I WENT TO JODI TO FILE A SOCIAL SECURITY CLAIM FOR DISABILITY SEEN HER MAYBE 3 TIMES ALL TOGETHER IN 2 YEARS. WENT TO HER THE DAY BEFORE MY HEARING WITH A JUDGE AND SHE TOLD ME WHAT TO EXPECT, WHAT SHE WOULD ASK ME AND SO ON. WELL, THE NEXT DAY BEFORE THE JUDGE IT DID NOT HAPPEN AT ALL LIKE SHE SAID. SHE DID NOT ASK ME BUT LIKE 2 THINGS WE HAD DISCUSSED AND DID NOT TELL THE JUDGE THINGS SHE SHOULD HAVE. SHE HAD NOT EVEN LOOKED UP THIS JUDGE TO SEE HER RATINGS WHICH MOST LAWYERS DO - THIS JUDGE 80% OF THE TIME DOES NOT GIVE WOMEN SOCIAL SECURITY BENEFITS. IF JODI HAD LOOKED THAT UP MAYBE SHE WOULD HAVE KNOWN SHE HAD TO GO IN FULL FORCE. ANYWAY, WHEN RECEIVED THE LETTER THAT I HAD LOST WITH THE JUDGE, I CALLED JODI'S OFFICE BECAUSE IT SAID IF I WANTED TO APPEAL I HAD SO MUCH TIME TO DO IT IN. I WAS ASK BY THE SECURITY WHY I NEEDED TO TALK TO JODI, I TOLD HER, SHE THEN SAID I COULD TALK TO JODI'S ASSISTANT BUT NOT JODI AND THAT JODI DID NOT DO APPEAL AND THAT MY CASE WAS OVER WITH THEM AND THAT THE LETTER I HAD PROBABLY HAD A NAME OF AN APPEALS LAWYER ON IT I COULD FIND AN APPEAL LAWYER ON THE BOTTOM OF THE PAGE IF NOT SHE GAVE ME A NUMBER TO ONE. SERIOUSLY MY CASE WAS DONE AND I COULD NOT TALK TO JODI. THEN I RECEIVED A LETTER FROM JODI'S OFFICE TELLING ME I OWED HER LIKE " $150.00. FOR WHAT THEY ARE NOT SUPPOSE TO GET MONEY "UNLESS" YOU WIN. I LOOKED IT WAS AN ITEMIZED BILL WITH FORS FOR LETTERS SHE MAILED TO ME, EVERY STAMP SHE SENT ME A LETTER IN. EVERY FAX SHE DONE, EVERYTHING SHE CLAIMS SHE HAD TO ASK THE DOCTORS TO SEND. BUT GET THIS EVERY TIME I WENT TO ANY DOCTOR I WENT TO HER OFFICE OR MAILED HER OUT ANY PAPERWORK I COULD GET FROM THEM ABOUT WHATEVER THEY DONE WITH ME SO WHAT WAS IT THAT SHE HAD TO GET FROM THEM ??? AND WHEN IT SAYS YOU DO NOT PAY IF WE DO NOT WIN AND SHE DIDN'T, SO WHY AM I BEING CHARGED ????? SHE HAS A FAX MACHINE IN HER OFFICE SO WHY CHARGE ME TO SEND A FAX. JUST CRAZY. AND WAITED 2 YEARS TO GET THE HEARING BEFORE THE JUDGE TO FIND THAT THE JUDDGE

As a client I found Jodi Zakaria to be untrustworthy, not totally true in her responses to questions asked by me the client. Her paralegal, Amy, joined my case in the last 3 months and did not provide a professional or courteous attitude but, she provided red tape. They made NO attempts to contact me to provide updates. They sold me on the fact that "Jodi Zakaria" would be there through the whole process but, after an unfavorable decision by the ALJ, Deborah A. Arnold, her paralegal told me that they could NOT handle the appeal after being assured by Michelle, which was the first point of contact when my case began! Jodi did NOT even tell me this in my follow-up after I received my denial letter. I guess she was too afraid to talk to her client. Under the guise of hearing preparation and attorney client privilege I was involved in preparation 2 months before my hearing she asked questions but, somehow the questions and answers were recorded verbatim under the facts of the unfavorable decision. Jodi and her paralegal did not even request required records to support claim but, she did request records to show me in a negative light instead for a positive decision. When asked why? Jodi gave no answers but, her paralegal said we are limited to the amount of records we can request. So, if your evidence is from more than 2 yrs. back they won't retrieve it eventhough it supports your claim. On top of that, one date of the records they did request was for a date in which I wasn't even being seen by my doctor but, she used those records which were inconsistent. They were friendly until confronted with their errors and lack of knowledge then they didn't want to answer or come up with excuses or red tape. For the amount that any attorney charges for a disability case which is usually 25% the services are NOT equivalent to what you are paying for. When an attorney doesn't want to answer questions, beware......they aren't on your side. I failed to recognize this sign and other signs along this 2 1/2 year journey for a case that has been ongoing for 5 yrs. Jodi Zakaria even had the nerve to have her paralegal hand me a letter declining her involvement with an appeal with two attorney's listed who may handle my appeal. Why would this attorney think I would choose one of her referred attorney's for my appeal when I don't trust or recommend her services? Would I recommend this attorney? NO! My overall rating in review of this attorney is exactly what I got ZERO. Had to give her 1 star in order to post this review but, ZERO is the recommend stars. Sorry, when I cannot trust an attorney who is providing services for me on my behalf seriously jeopardizes her crediblilty!

What a Social Security & Disability Lawyer Can Do for You

A Social Security and Disability lawyer specializes in helping individuals navigate the complex process of applying for and securing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. These lawyers assist clients in filing applications, gathering necessary medical evidence, appealing denied claims, and representing them in hearings before administrative law judges. A lawyer can help maximize the chances of approval by ensuring that the paperwork is accurate, deadlines are met, and legal standards are addressed.

If you are disabled and unable to work, or if your Social Security Disability claim has been denied, a Social Security and Disability lawyer can guide you through the legal process to obtain the benefits you’re entitled to.

When Should I Hire a Social Security & Disability Lawyer?

You should consider hiring a Social Security and Disability lawyer in the following situations:

  • Applying for SSDI or SSI benefits: The application process for disability benefits can be complex, with strict requirements and documentation. A lawyer can assist in completing the application correctly and submitting the required medical evidence to improve your chances of approval.
  • Denied disability claim: If your initial claim for SSDI or SSI benefits has been denied, a lawyer can help file an appeal and represent you in hearings. Many claims are denied initially, and having legal representation during the appeal process significantly increases the chances of success.
  • Requesting reconsideration: After an initial denial, you have the right to request reconsideration of your claim. A lawyer can help present new medical evidence or correct any errors in your original application.
  • Hearing before an administrative law judge (ALJ): If your reconsideration request is denied, you may request a hearing before an ALJ. A lawyer can represent you during the hearing, preparing you to answer questions and presenting a strong case based on your medical and work history.
  • Proving medical conditions: If your disability involves complex medical conditions, a lawyer can help gather expert medical testimony or additional evidence to demonstrate that your condition meets the legal criteria for disability.
  • Overpayments and cessation of benefits: If the Social Security Administration (SSA) claims you were overpaid or attempts to terminate your benefits, a lawyer can assist in challenging the decision and protect your right to continue receiving benefits.
  • SSI for low-income individuals: If you are applying for SSI, which is based on financial need in addition to disability, a lawyer can help ensure that your financial records are correctly submitted to meet SSA’s strict income and asset limits.

Hiring a lawyer early in the process can help you avoid mistakes that could delay or jeopardize your claim.

What Does a Social Security & Disability Lawyer Do?

A Social Security and Disability lawyer provides a range of services to help individuals navigate the application and appeals process for SSDI or SSI benefits. Their responsibilities often include:

  • Filing initial applications: A lawyer can help prepare and file your SSDI or SSI application, ensuring that all necessary forms are completed accurately and medical evidence is included.
  • Gathering medical evidence: A lawyer works with your doctors and healthcare providers to collect medical records, treatment histories, and expert opinions to support your disability claim.
  • Filing appeals: If your initial application is denied, a lawyer can file an appeal and guide you through the reconsideration process, ensuring that any additional documentation or evidence is provided.
  • Representing you in hearings: A lawyer will represent you in front of an administrative law judge, helping you prepare for the hearing and arguing your case to demonstrate that your disability prevents you from working.
  • Handling deadlines and paperwork: A lawyer will ensure that all deadlines are met, and that any requests for additional information from the SSA are responded to promptly.
  • Negotiating settlements (for private disability insurance claims): If your disability benefits claim involves private disability insurance (in addition to or instead of SSDI/SSI), a lawyer can help negotiate a fair settlement with the insurance company.
  • Fighting benefit terminations or overpayment claims: If the SSA attempts to terminate your benefits or claims you were overpaid, a lawyer can defend you in administrative proceedings or file for a waiver or reconsideration.

How Are Social Security & Disability Lawyers Paid?

Social Security and Disability lawyers are typically paid on a contingency fee basis, meaning they only get paid if your case is successful, either through the approval of your disability benefits or winning an appeal. Here's how it generally works:

  • Contingency fee: The fee is usually 25% of your past-due (backpay) benefits, but no more than $7,200. This fee structure is set by the SSA, and lawyers cannot charge more than this amount for SSDI or SSI cases.
  • No cost for future benefits: Lawyers are not entitled to any portion of your future monthly disability benefits. Their fee is strictly limited to a percentage of your backpay.
  • Additional costs: In some cases, you may need to pay for additional expenses, such as obtaining medical records or expert witness testimony. These costs are usually minimal, but it’s essential to ask your lawyer about any additional expenses upfront.

It’s essential to confirm fee arrangements with your lawyer during the initial consultation to avoid misunderstandings.

How Much Does a Social Security & Disability Lawyer Cost?

The cost of hiring a Social Security and Disability lawyer is typically structured around the contingency fee system outlined by the SSA. General cost information includes:

  • Contingency fee: The lawyer’s fee is capped at 25% of your backpay, with a maximum of $7,200. For example, if you are awarded $10,000 in backpay, the lawyer will receive $2,500 (25%), and you will receive the remaining $7,500.

Overall, there is no financial risk in hiring a Social Security and Disability lawyer, as they only get paid if your case is successful.

Top Questions to Ask a Social Security & Disability Lawyer

Before hiring a Social Security and Disability lawyer, it’s important to ask the right questions to ensure they have the experience and expertise to handle your case effectively. Key questions to ask include:

  1. What experience do you have with Social Security Disability cases?
Ensure the lawyer has experience handling SSDI and SSI cases similar to yours, particularly if you have a complex medical condition.
  2. How do you charge for your services?
Confirm that the lawyer charges a contingency fee and that you won’t owe any fees unless your claim is successful. Ask if there are any additional costs for medical records or other expenses.
  3. What is the likelihood of success in my case?
Ask the lawyer for an honest assessment of your case and the potential challenges you may face.
  4. How long will the process take?
Disability claims can take time, especially if you’re appealing a denial. Ask the lawyer how long they expect the process to last and what the typical timeline is for cases like yours.
  5. How will you help me prepare for my hearing?
If your case is going to a hearing before an administrative law judge, ask the lawyer how they will help you prepare for testimony and present your medical evidence effectively.
  6. What happens if I’m denied again?
Ask about the next steps if your reconsideration or appeal is denied, including the possibility of further appeals to federal court.

How to Check the Credibility of a Social Security & Disability Lawyer

To ensure you are hiring a reputable Social Security and Disability lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed to practice law and has no history of disciplinary actions.
  • Look for Social Security experience: Review the lawyer’s website or profile to ensure they specialize in Social Security and Disability law and have successfully handled cases like yours.
  • Read client reviews and testimonials: Look for reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s professionalism and success rate.
  • Ask for references: A credible lawyer should be able to provide references from past clients who have worked with them on Social Security Disability matters.
  • Check for memberships in relevant organizations: Membership in organizations like the National Organization of Social Security Claimants' Representatives (NOSSCR) can indicate that the lawyer is committed to representing disability claimants.

What Should I Prepare for My First Consultation?

To get the most out of your first consultation with a Social Security and Disability lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Medical records: Bring copies of your medical records, including doctor’s notes, test results, treatment histories, and any disability-related diagnoses.
  • List of medications and treatments: Provide a detailed list of any medications you are taking, treatments you have received, and ongoing medical care related to your disability.
  • Denial letters (if applicable): If your disability claim has been denied, bring a copy of the denial letter from the SSA, along with any documentation related to your appeal.
  • Work history: Provide information about your previous jobs and work history, including details about how your disability has impacted your ability to work.
  • Social Security application (if already filed): If you’ve already submitted an application, bring a copy of the application and any correspondence you’ve had with the SSA.
  • List of questions: Prepare a list of questions you have about the legal process, the lawyer’s fees, and what to expect in terms of timelines and outcomes.

By preparing thoroughly for your consultation, you can help the lawyer assess your case more effectively and provide the best possible legal advice tailored to your situation.
