My HOA has this firm on retainer. I sent an email asking our attorney how much he would charge us to write a contract for a project. The reply was 4 quick lines and we were billed $81 for their "services". I can't figure out how else I would have found out the cost of the project without asking. Insane and insulting....we may be shopping for new legal counsel shortly!!

Attorney Blake Lange with Morgan and Morgan was referred to me by a friend who also happens to be a previous client of his. Initially I was very hesitant to reach out to an attorney with a big firm; I was worried my case would not get the attention it deserved. I can honestly say, nothing could be further from the truth. Mr. Lange and his team were incredibly professional, responsive and most importantly compassionate. I highly recommend.

We called Morgan and Morgan for a workman's comp case. They took our case and assigned us to Attorney Blake Lange .From the beggining this has been a nightmare. They never give you answers, they take weeks to return calls, and the assistants Carlos and Alisha are horrible. They can never answer any questions. They lead you on with incorrect information .They don't care about cases unless they are big money makers and are laid out for them so they barely have to do any work .My husband is being left with a bunch of bills, no help, no answers, and behind on all our bills because he was out of work and owes medical bills .They are not even getting the medical bills covered or lost wages. It has been 6 months now with them doing nothing. Were about to loose our home and everything we worked hard for and they don't even have the decency to return a phone call. If you are hurt do not go here. Call a smallrs firm that is still hungry enough to fight for you and still believes in justice for the injured. Morgan and Morgan and Attorney Blake Lange only want big settlement cases that are blatantly easy so they get a big pay out. Because they take half of what you get! They are the worst ever .

First off this claim is from 2016, I had injured my knee while working and when workers comp began to give me issues I unfortunutly decided to lawyer up. I choose Morgan and Morgan after going through several previous cases and thought this would be the easiest and most simple way of handling my situation. Man was I wrong, 2 years later I'm unable to work becuse the injury was never fully fixed becuse MR. Lange advised me to settle becuse I had a previous injury that was fully fixed and documented. On top of it all I also have a medical bill that surfaced on my credit report 6 months ago, I have been trying to reach Mr. Lange to help me resolve this small issue and have had no response. I don't know if it's becuse I was 18 and and easy paycheck for him, or whether the case helped his standings, but I feel extremely neglected and taken advantage of, not once did I ever meet Mr. Lange in person. please return my call and at least help me fix this issue so I can put this nightmare behind me.

I AM SPEAKING ABOUT MY EXPERINCE WITH THIS LAWYER THEY CALL JOSEPH ODATO. FIRST ON THE LIST IS NOT LACK OF COMMUNICATION BUT NO COMMUNICATION AT ALL. WHICH WAS THE MAIN ISSUE I HAD WITH HIM. WHEN I CALLED TO CHECK ON THE UPDATE OF MY CASE I NEVER GOT AN ANSWER ABOUT MT CASE. HE NEVER SET ME DOWN AND GUIDED ME THROUGH MY CASE. NEVER DISCUSSED THIS IS WHAT YOU ARE LOOKING AT WHEN IT COMES TO YOUR CASE. THIS IS WHAT YOU ARE ENTITLED TO CONCERNING YOUR CASE. HE LFET ME IN THE BLIND SO WHAT I DID I TRIED TO WORK IT OUT WITH HIM ONE ON ONE THAT DIDN'T WORK. I THEN WENT TO THE MORGAN AND MORGAN CLIENT EXPERINCE HOTLINE THEY PUT ME ON THE RUN AROUND. I TOLD THEM I WANTED HIM OFF MY CASE THEY SAID OK TOOK MY INFO AND SAID THEY WILL SUBMIT IT. KEEP IN MIND I BEEN TRYING TO FIRE HIM SINCE LAST YEAR 2021. COME TO FIND OUT THE HOTLINE WASN'T SENDING MY REQUEST IN. I KEPT CALLING AND ON FEB. 7 2022 THEY SAY THEY PUT IT IN AND IT WAS DENIED AND I FOUND THAT OUT BY CALLING TO SEE WHY IT WAS DENIED. BUT IN MAY OF 2022 HE FILED A MOTION TO WITHDRAW FROM MY CASE AND IT WAS APPROVED. BUT IT'S FUNNY HOW FOR MONTHS I BEEN TRYING TO FIRE THIS ODATO GUY AND I COULDN'T BUT SOON AS HE DOES IT IT GETS APPROVED. FROM MY EXPERINCE WITH HIM HE IS NOT FOR THE PEOPLE. THIS IS SPECIFICALLY DIRECTED TO JOSEPH ODATO NO ONE ELSE AT MORGAN AND MORGAN. IF YOU DECIDE TO HIRE MORGAN AND MORGAN FOR A WORKER'S COMP CASE DO NOT I REPEAT DO NOT HIRE THAT JOSEPH ODATO GUY. YOU WILL WALK AWAY WITH NO RESULTS AND MAD. REVIEW IS WRITTEN BY FONY'A CHISHOLM 2022.

Carla Campbell, Joseph's paralegal mentioned he was very busy with an overload of cases. She also said it would take time to get ahold of him. After waiting a week since I signed the retainer, I had my first call with him yesterday. After 15 minutes he rudely said "how can I help you here? Then he said he had to go, and maybe I would be better off on my own." I was shocked that he would not take interest in my needs and was treated this way after signing a contract where he would earn 25%. I immediately asked to switch to a different attorney yesterday after this experience. The man who took my call said he filed a request for a new attorney to be assigned. I did not receive a follow up so I called back and was told I would need to request the change with Joseph. So they transferred me back to him, an todays conversation went worse than yesterday. He spent 4 minutes on the phone and said "I have to go I have mediations to attend to" he showed absolutely no concern for me or my needs. He then said to find another firm. I asked to speak with his supervisor as I want to stay with the firm and simply have an attorney who will be considerate of my needs as I am disabled and need more help understanding thing due to this. He then said he was denying my case which now means I'm not allowed to be represented by Morgan and Morgan further, all because I complained of the lack of service he gave me. I should not be dismissed from being represented on an injury that is worth representation simply because I asked to be transferred to another attorney. Joseph Odato does not take personal interest in his clients. If your not seriously injured or surgical, where the money piles up, he won't bother with you. Terrible experience with Joseph, and when I complained Morgan and Morgan, they didn't act on my behalf as the client. I called Berlin law firm the next day, and Stephen Berlin gave me personal top notch service and will be assisting me with my workers comp claim.

I made the mistake of hiring the services of attorney Jesús Ravelo, but it has been a burden for me and it continues to weigh me having hired him to represent me in a Workers Comp case. It seemed that I had hired the services of a lawyer to defend my employer and Workers Comp itself. I think the counterpart offered him more than what he could get by defending me.

Tyler has been an excellent attorney for myself and my business. His legal knowledge is sharp, he's fair, and he's the first attorney that actually works quickly and communicates regularly. Tyler has consulted on a number of issues for our business such as reviewing our agreements, providing logical legal strategy and most of all suggesting appropriate action (and reaction) to certain situations. Keith is a fantastic lawyer. Worked on my case for 3yrs and really fought for my case! I had horrible doctors and he kept working to get me a compitant one. He always replied to my emails fast. And as far as being a small firm, that makes them that much more one on one and not shoved somewhere on the back burner. To much corporate america these days if you ask me. When I moved out of state before my case was finished he worked and got me a case manager and hunted down a doctor from my new state that would take my out of state case. Amazingly this doctor was compitant as he wasn't paid off by the ins co and then just dump me. Finally got a settlement and couldn't be happier.

Unfortunately, I made the huge mistake of hiring this layer/ law firm! He got nothing for me after several years of representation, while telling me my case was worth a couple hundred thousand. Not only did this lawyer deceive me, he caused tremendous hardship for me and my life/ future. I consulted other attorneys and they advised me he committed malpractice. He used to be a good attorney years ago. However, he is not anymore and his resources are limited. I would strongly recommend you hire a different attorney or law firm in the area or in a bigger city with better resources and or outcomes of cases. They talk a great talk when you call their office and lead you to believe you are making a great decision when hiring them, but DO NOT FALL PREY to this attorney/ law firm. Just to let you know, I found out later this person is his wife. They have one lawyer, one paralegal and one assistant. Thirty plus years as a layer sounds great on the surface, but when you think about it, that usually means they are old and operate in/ on old school ways (meaning they do not have the desire, ambition, or energy/ not in the prime of their career) plus if they are so great, why are they still working and not retired by now????

I hired Donna almost a year ago for a child support modification. My ex-husband is currently 9 months behind on child support and at times refuses to bring my child back after visitation has ended. Donna at first appeared to be a go for lawyer and I thought she was very aggressive. But here I am almost a year and $20,0000 later and this situation has not changed at all and she has changed scheduled court dates twice because she is ill prepared... She continuously has to be versed on what the law says during certain situations, (because of research I conducted) she claims to tell me something she never has, (which she then sees in an email in her drafts that she never sent) and she keeps siding with my ex-husband on things that clearly are not expectable, i.e., my sons father not bringing him back to me for over 6 hours after he was supposed to be back with me, not paying one cent in child support (she claims she understands because he has bills to pay, etc….) Donna is very incompetent in what she does, as far as family law goes. I would strongly advise anyone considering hiring a family law lawyer to defiantly go elsewhere. I spent a lot less money on my entire divorce and I am already at $20,000 on a simple child support modification… We have had 4, yes F O U R mediations… And they are not cheap… I feel as if Donna has basically been doing all of unnecessary things that she could think of in order to obtain the maximum amount of money out of me and my family as she can… It’s so frustrating.

I just read the two reviews below, and pondered the question how could I have had the most amazing experience with Ms. Jodi Zacaria, and then actually felt saddened to read two “not favorable” reviews? Yes, my heart actually dropped. Here it is in a nutshell. If you win your case, you have amazing things to say about your lawyer. If not, well you feel compelled to bash them. People be disappointed with the “system”, not this lawyer. I found her to be exact, prompt in her responses to me, and a beast with the judge. (Beast is a positive btw) As soon as the judge asked his first question, I heard her defend me. I literally sat back took a deep breath, and knew if I won my case, it wasn’t going to be on my own merit. Her skill was abrupt! The judge even said after she (Ms. Zakaria) questioned me “Iv heard enough”. Another words, you don’t need to go on, I can see this women’s suffering. Do you know how that makes you feel after fighting an unmovable beast, to finally see that light at the end of a very dark tunnel?! Yes, if your reading this, I know you do know how that feels. Please know ever lawyer learns from “the system” the longer they’ve been in it. Ms. Zakarias skill has been refined. Maybe a few years back, she still had something to learn? But today? Today shes got it about as ‘down pat’ as it gets. I adored everything about her. I wish I could thank her more honestly. Ms. Zakaria if your reading this, I thank you from the bottom of my heart!

I WENT TO JODI TO FILE A SOCIAL SECURITY CLAIM FOR DISABILITY SEEN HER MAYBE 3 TIMES ALL TOGETHER IN 2 YEARS. WENT TO HER THE DAY BEFORE MY HEARING WITH A JUDGE AND SHE TOLD ME WHAT TO EXPECT, WHAT SHE WOULD ASK ME AND SO ON. WELL, THE NEXT DAY BEFORE THE JUDGE IT DID NOT HAPPEN AT ALL LIKE SHE SAID. SHE DID NOT ASK ME BUT LIKE 2 THINGS WE HAD DISCUSSED AND DID NOT TELL THE JUDGE THINGS SHE SHOULD HAVE. SHE HAD NOT EVEN LOOKED UP THIS JUDGE TO SEE HER RATINGS WHICH MOST LAWYERS DO - THIS JUDGE 80% OF THE TIME DOES NOT GIVE WOMEN SOCIAL SECURITY BENEFITS. IF JODI HAD LOOKED THAT UP MAYBE SHE WOULD HAVE KNOWN SHE HAD TO GO IN FULL FORCE. ANYWAY, WHEN RECEIVED THE LETTER THAT I HAD LOST WITH THE JUDGE, I CALLED JODI'S OFFICE BECAUSE IT SAID IF I WANTED TO APPEAL I HAD SO MUCH TIME TO DO IT IN. I WAS ASK BY THE SECURITY WHY I NEEDED TO TALK TO JODI, I TOLD HER, SHE THEN SAID I COULD TALK TO JODI'S ASSISTANT BUT NOT JODI AND THAT JODI DID NOT DO APPEAL AND THAT MY CASE WAS OVER WITH THEM AND THAT THE LETTER I HAD PROBABLY HAD A NAME OF AN APPEALS LAWYER ON IT I COULD FIND AN APPEAL LAWYER ON THE BOTTOM OF THE PAGE IF NOT SHE GAVE ME A NUMBER TO ONE. SERIOUSLY MY CASE WAS DONE AND I COULD NOT TALK TO JODI. THEN I RECEIVED A LETTER FROM JODI'S OFFICE TELLING ME I OWED HER LIKE " $150.00. FOR WHAT THEY ARE NOT SUPPOSE TO GET MONEY "UNLESS" YOU WIN. I LOOKED IT WAS AN ITEMIZED BILL WITH FORS FOR LETTERS SHE MAILED TO ME, EVERY STAMP SHE SENT ME A LETTER IN. EVERY FAX SHE DONE, EVERYTHING SHE CLAIMS SHE HAD TO ASK THE DOCTORS TO SEND. BUT GET THIS EVERY TIME I WENT TO ANY DOCTOR I WENT TO HER OFFICE OR MAILED HER OUT ANY PAPERWORK I COULD GET FROM THEM ABOUT WHATEVER THEY DONE WITH ME SO WHAT WAS IT THAT SHE HAD TO GET FROM THEM ??? AND WHEN IT SAYS YOU DO NOT PAY IF WE DO NOT WIN AND SHE DIDN'T, SO WHY AM I BEING CHARGED ????? SHE HAS A FAX MACHINE IN HER OFFICE SO WHY CHARGE ME TO SEND A FAX. JUST CRAZY. As a client I found Jodi Zakaria to be untrustworthy, not totally true in her responses to questions asked by me the client. Her paralegal, Amy, joined my case in the last 3 months and did not provide a professional or courteous attitude but, she provided red tape. They made NO attempts to contact me to provide updates. They sold me on the fact that "Jodi Zakaria" would be there through the whole process but, after an unfavorable decision by the ALJ, Deborah A. Arnold, her paralegal told me that they could NOT handle the appeal after being assured by Michelle, which was the first point of contact when my case began! Jodi did NOT even tell me this in my follow-up after I received my denial letter. I guess she was too afraid to talk to her client. Under the guise of hearing preparation and attorney client privilege I was involved in preparation 2 months before my hearing she asked questions but, somehow the questions and answers were recorded verbatim under the facts of the unfavorable decision. Jodi and her paralegal did not even request required records to support claim but, she did request records to show me in a negative light instead for a positive decision. When asked why? Jodi gave no answers but, her paralegal said we are limited to the amount of records we can request. So, if your evidence is from more than 2 yrs. back they won't retrieve it eventhough it supports your claim. On top of that, one date of the records they did request was for a date in which I wasn't even being seen by my doctor but, she used those records which were inconsistent. They were friendly until confronted with their errors and lack of knowledge then they didn't want to answer or come up with excuses or red tape. For the amount that any attorney charges for a disability case which is usually 25% the services are NOT equivalent to what you are paying for. When an attorney doesn't want to answer questions, beware......they aren't on your side. I failed to recognize this sign and other signs along this 2 1/2 year journey for a case that has been ongoing for 5 yrs. Jodi Zakaria even had the nerve to have her paralegal hand me a letter declining her involvement with an appeal with two attorney's listed who may handle my appeal. Why would this attorney think I would choose one of her referred attorney's for my appeal when I don't trust or recommend her services? Would I recommend this attorney? NO! My overall rating in review of this attorney is exactly what I got ZERO. Had to give her 1 star in order to post this review but, ZERO is the recommend stars. Sorry, when I cannot trust an attorney who is providing services for me on my behalf seriously jeopardizes her crediblilty!

Court appointed lawyer to my DCF case. He had me sign a consent to dependency, which was basically admitting to be a child abuser, neglect, and/or abandonment, or the potential for being one. I had not idea I was signing that, he presented that to me a few minutes before pre-trial and told me he negotiated with DCF to get my kids back, and that it would make the case close out and I would be with my kids again, and long as I signed I would be the best father I could possibly be, and when I tried to read the rest, he pulled the paper from me after I signed it, and would not let me catch the most important part. He did mention answer yes to all the judges questions, which was the final nail in the coffin of me admitting to being something I never was.

Mr. Adan, is simply the worst attorney I ever hired to work for my sports marketing agency as our legal counsel/ sports marketing agent of baseball. He does not follow thru sufficiently on tasks at hand, messed up an eeoc complaint for me not once but twice in submission, does not return phone calls on time or stick to his word. I hired Mr. Adan in 2013 as an independent contractor to potentially eventually become a partner in SMG if he proved himself worthy on percentage which is the way agents work. He could not complete one single deal in a 2 year span or do one simple transaction properly being an ada and corporate attorney or as an agent. It seems he is more concerned with his personal life of having fun and games rather than working hard being a hustler on percentage as an agent.

I have three stars for keeping me informed only because his staff was helpful. As for my attorney I did not ONCE speak with or even see David Sullivan except during my hearing. And even then he barely muttered a few sentences. I was in complete shock on how my hearing was handled. He didn't argue on my behalf. He didn't even talk to the voc rehab witness, much less the judge. I decided to research social security hearing information and I was shocked to learn how much Mr Sullivan did NOT do for me. Also, after asking Mr Sullivan my questions after the hearing, I felt he was unable to give me a direct answer which leads me to believe he was completely unprepared for the hearing. I also found out that he did not give the judge important medical records from my neurologist. I noticed this when I got my denial from the judge. It was not listed in the list of medical records she used to base my denial on!! Ihad to find out the hard way of my mistake in hiring Mr Sullivan. So avoid my mistake do NOT hire this man.

A Cadillac truck hit me because of an illegal I turn I did. I explained to him I do t what surgery for anything for me to win the case.. he said that he can still win the case for me. I had to keep calling him to get an update and to have the case moving forward because I wouldn’t hear from him for months. If I didn’t call him most of the steps I had to take would’ve never happen. At the end of Case he calls me telling me he didn’t win the case and I’m not getting anything. He full of crap and a este of time!! I would never recommend him!!

It was a simple case. Nothing complicated. When came time to settle he told me something very different leading me to believe a different outcome. When I have tried repeatedly over 3 weeks to reach him to see if it could be fixed, he is vanished. Won’t answer calls or texts. I feel I was misled to accept something just so he could cash out. Would not recommend him.

Didn't like to settle the case. Told me one thing and later told me something opposite. Dragged out the case without making a good fair effort in trying to settle.

I literally just got off the phone with this guy and I can not believe the degree of apathy and disregard I was met with. Bear in mind the fact that I have never met him before and this is the first time that I have ever contacted him. As a potential first time client you would expect to be met with more than a generous degree of welcoming care and concern and professional regard for whatever your case may be. Now granted, I had not done my homework however - the response I got to my inquiries was appalling. In a tone thick with apathy and sarcastic disregard - he carelessly grilled me over some discrepancies with my case and then - in so many words - he let me know that either he didn't want to be bothered. He blew me off, instructing me to go down to the Social Security office and apply, saying and I quote "when they turn you down give me a call." Excuse me? I thought it was the attorney's job to fight for the client - not to tell him to take a hike. I know that my case looks like a mess at first glance, to be frankly honest - however this is the first time that I had ever met this person and spoke with him and he would not even extend the professional courtesy of offering me an initial consultation so that we could discuss my case at length. I don't know - maybe he was having a bad day, as it was nearing the close of the business - however, that was no excuse for him just blowing me off. Totally unprofessional, and totally unacceptable. Recently I heard in the news that a judge of all people asked an attorney, quote "if he wanted to take it outside" and then promptly punched him in the face upon exiting the courtroom. Maybe things are getting heated and job stress is at an all time high in the legal profession, I don't know - maybe you would like to give him the benefit of the doubt, however - No I would NOT recommend this lawyer.

I hired Mr. Cohen. He was or seemed to be pleasant to me at first until i advised him i had bipolar disorder. He then did not communicate at all. I did try to explain to him that i had no control over going off topic that it was part of disorder but he did not work with me, just stopped communicating and said if i needed anything to email his paralegal. It was a pretty (or i thought it was ) easy case. I fell at work and sustained a very serious injury. The company did not provide me with a dr for over a month. At what i was told was the first mediation via phone, Mr. Cohen seemed like he was on the side of the insurance company and not working for me. I don't know how else to word it any nice for Avvo. If you need an attorney that communicates with you and explains things to you but lets you ask the questions you have, then you do not not want this attorney. He does not do that. The mediation was no sooner completed and even though on the phone he stated he would be filing for addl petitions, he instead withdrew from the case. That is a fact.

What a Workers’ Compensation Lawyer Can Do for You

A workers’ compensation lawyer specializes in helping employees who are injured or become ill as a result of their job to receive the benefits they are entitled to under workers' compensation laws. These lawyers represent injured workers in claims for medical benefits, wage replacement, and other compensation related to workplace injuries or illnesses. They also help when claims are denied, benefits are delayed, or disputes arise with the employer or the insurance company.

Whether you've been injured on the job, developed an occupational illness, or are dealing with a denied workers' compensation claim, a workers’ compensation lawyer can help you navigate the claims process and ensure you receive the full benefits you deserve.

When Should I Hire a Workers' Compensation Lawyer?

You should consider hiring a workers' compensation lawyer in several situations, especially when complications arise during the claims process or when your rights as an injured worker are being challenged. Some common reasons to hire a workers' compensation lawyer include:

  • Claim denial: If your workers' compensation claim has been denied, a lawyer can help you appeal the decision and represent you in hearings or litigation.
  • Inadequate benefits: If the insurance company offers you a settlement that doesn’t cover your medical expenses, lost wages, or other damages, a lawyer can negotiate on your behalf for a fair amount.
  • Delay in receiving benefits: If your benefits are being delayed, a lawyer can help expedite the process to ensure you receive timely compensation.
  • Permanent disability: If your injury leads to permanent disability (partial or total), a lawyer can help you navigate the more complex process of securing long-term benefits.
  • Retaliation by employer: If your employer retaliates against you for filing a workers' compensation claim (e.g., by firing or demoting you), a lawyer can protect your rights and pursue legal action.
  • Third-party liability: If a third party (e.g., a contractor or equipment manufacturer) was responsible for your injury, a lawyer can help you pursue additional compensation through a personal injury lawsuit.
  • Pre-existing conditions: If your employer or the insurance company claims that your injury is related to a pre-existing condition, a lawyer can help you present evidence showing that the injury was work-related.

Hiring a lawyer early in the process can prevent delays, avoid mistakes, and ensure you receive all the benefits you’re entitled to under workers' compensation law.

What Does a Workers' Compensation Lawyer Do?

A workers' compensation lawyer provides a range of legal services to injured workers, ensuring that they receive the benefits they deserve. Their tasks often include:

  • Filing claims: Helping injured workers prepare and file their workers' compensation claims to ensure accuracy and timeliness.
  • Appealing denied claims: Representing workers whose claims have been denied and guiding them through the appeals process, including hearings and court appearances.
  • Negotiating settlements: Negotiating with insurance companies to secure fair compensation for medical expenses, lost wages, and other damages.
  • Handling disputes: Resolving disputes between the injured worker, the employer, and the insurance company regarding the amount of compensation or the nature of the injury.
  • Coordinating medical evidence: Gathering and presenting medical records, expert testimony, and other evidence to support the workers' compensation claim.
  • Advocating for benefits: Ensuring that injured workers receive all the benefits they’re entitled to, including temporary or permanent disability benefits, vocational rehabilitation, and medical treatment.
  • Filing third-party lawsuits: In cases where a third party is responsible for the injury, a workers' compensation lawyer may also pursue a personal injury lawsuit to recover additional damages.

How Are Workers’ Compensation Lawyers Paid?

Workers' compensation lawyers typically charge a contingency fee, meaning they only get paid if they successfully recover benefits for you. This fee is usually a percentage of the benefits awarded, and the specific percentage is often regulated by state law. Here's how it generally works:

  • Contingency fee: The lawyer's fee is typically between 15% and 25% of the total benefits awarded to you. You don’t have to pay any upfront legal fees, and the lawyer’s fee comes out of the settlement or benefit award.
  • No fee if no recovery: If the lawyer doesn’t recover any benefits for you, you generally don’t have to pay for their services.
  • State regulations on fees: Many states cap the percentage that workers' compensation lawyers can charge, and some states require the fee to be approved by the workers' compensation board or judge.

Be sure to discuss the fee structure with your lawyer during the initial consultation to understand how much you will owe if your case is successful.

How Much Does a Workers' Compensation Lawyer Cost?

The cost of hiring a workers' compensation lawyer typically depends on the contingency fee arrangement, meaning the lawyer’s fee will be a percentage of the benefits you receive. General cost estimates include:

  • Contingency fees: Most workers' compensation lawyers charge between 15% and 25% of the total settlement or benefits awarded. For example, if you receive $50,000 in benefits, the lawyer’s fee would range from $7,500 to $12,500.
  • State regulations: Some states limit the percentage that workers' compensation lawyers can charge. In these cases, the fee is usually capped, often at 20% to 25%, depending on state law.
  • Additional costs: Some lawyers may charge for out-of-pocket expenses, such as filing fees, medical records retrieval, and expert witness testimony, though these costs are typically deducted from the settlement after the case is won.

You should always ask for a clear explanation of fees and potential additional costs during your consultation so you understand the financial arrangement.

Top Questions to Ask a Workers' Compensation Lawyer

Before hiring a workers' compensation lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with workers' compensation cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your injury is severe or the case involves disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges a contingency fee and whether there are any additional costs you need to be aware of.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including the potential challenges and outcomes.
  4. Have you handled cases like mine before?
Find out if the lawyer has experience dealing with cases involving similar injuries or disputes, such as denied claims or permanent disability.
  5. How long will the process take?
While it’s difficult to predict an exact timeline, the lawyer should be able to provide a general estimate based on their experience with similar cases.
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your claim.

How to Check the Credibility of a Workers' Compensation Lawyer

To ensure you are hiring a reputable workers' compensation lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no disciplinary actions against them.
  • Look for workers' compensation experience: Review the lawyer’s website or professional profile to ensure they specialize in workers' compensation law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s expertise and service.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their experience in workers' compensation cases.
  • Check for professional affiliations: Membership in organizations like the Workers' Injury Law & Advocacy Group (WILG) or local bar association committees on workers' compensation can indicate the lawyer’s commitment to this area of law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a workers' compensation lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Accident report or incident documentation: Bring any documentation related to your workplace injury or illness, including accident reports or notifications to your employer.
  • Medical records: Provide copies of medical records, including treatment notes, doctor’s reports, and any information related to your injury or condition.
  • Employer correspondence: Bring any letters, emails, or forms related to your claim from your employer or the workers' compensation insurance company.
  • Wage and benefits information: Provide information on your wages, benefits, and any lost income due to the injury.
  • List of questions: Prepare questions about your case, the process, costs, and what to expect moving forward.
  • Timeline of events: Prepare a timeline of the incident, your injury, and any medical treatment or communication with your employer and the insurance company.

Being well-prepared for your consultation will allow the lawyer to assess your case more effectively and provide you with the best possible legal advice.
