He takes forever to do anything on a case. He knew nothing about my file. He give me very broad and general information that I am sure he feed all his clients. When you ask something specific about your case he can't answer you. And the more questions you as the louder he gets with you like your a bother and he uses the "I've been doing this for years" speech. If you disagree with him and try and voice your opinion you get the well I can just withdraw from your case and you will be stuck with no attorney. He is very unprofessional and I would never recommend him to anyone and just tell everyone stay away.

Drew did a phenomenal job with my case and achieved the best possible outcome, which I know wouldn't have been possible had I not been represented. Drew was very communicative throughout the process and provided extremely detailed notes in every invoice, so I was well aware of how my case was proceeding. The rates were fair and reasonable; I received service above and beyond what I expected.

Please listen and do not use this firm. They will rack up large bills without any quality work to support their charges and fees. In a matter of a few months I owed them close to $45,000 and had nothing to show for it. When I asked for consultation with other attorneys or advice my pleas were not followed through with. I ended up settling my own case and my ex-husband took me back to court within a few months. The entire case was a waste and very hard lesson to learn. I was completely taken advantage of.

I talked to "Meghan"(not sure the spelling is correct) about a family member (cousin) whose will was being handled with Ames Law. She and I agreed that I could receive a copy of the will. My cousin's last wishes were being carried out by two trusted friends, who checked on him frequently because he was blind and not able to farm or do things for himself. Story behind this is not the issue. I waited 10 business days and no will was mailed so far. I attempted to call on 3 occasions each afew days apart with No return call. (It was the beginning stages of the pandemic so I would've thought the Law staff might be working from home). I the tried to contact by an Email to the Website, again with no response. I thought, "You'd think if they were representing a client or receiving a call from a pertinent question they would be courteous to return call or email. Not professional practice and "rinky dinky" things like, "we'll answer your questions for $50".

Mr. Caffey was designated as the prosecuting attorney for the city of Alton in my case about various ordinance violations. Upon explaining my case, Mr. Caffey was empathetic and worked with me to find a resolution to satisfy the city while still taking my situation into consideration. While it is probably unorthodox to give a positive review to an attorney that is prosecuting me, I felt it was important to let it be known. He is empathetic and very professional. Thank you.

Rodney Caffey took on my medical negligence case. I recently had a frustrating experience with my case, primarily due to how it was handled by Muldoon. From the start, I felt I wasn’t adequately represented; my concerns seemed to take a backseat to other priorities. The situation became even more complicated when it was revealed that the third party involved didn’t carry proper insurance. Rather than advocating for my interests, Muldoon appeared more focused on closing the case quickly, which left me feeling sidelined. Overall, I expected a more proactive approach, but instead, I felt dismissed and unsupported throughout the process.

I was referred to Patrick Tallon in 2005. Settled in 2008, after having a 6 fusion. When we settled, Pat was negligent in the writing of my future medical. Thus, the insurance company jumped all over his stupidity, and has to this day, never paid me any medical Bill's or treatment I desperately need. I asked him to rectify his mistake, but since there was no more money to be made he declined to help. I was forced to go downtown every month for a year and represent myself just to keep my case open. The Commissioner was not happy with him, as he stated I was the first civilian to represent myself in fof him. But he understood my predicament. WARNING when hiring Pat. Have a real lawyer go over your settlement before ALLOWING HIM TO SIGN. My new lawyer was allowed to represent me from the same firm that let Pat go. BEWARE, BEWARE, BEWARE.

After explaining my accident Mr Baker asked if I wished to proceed. I waited several days for papers in the mail. I signed and sent baking the same day. I waited over 2 weeks and never receiving a response I called his office. Understanding that the Christmas holiday was upon us that things would not be expedited at the normal pace. So impatiently and in great pain, I waited until the 2nd of January where again I had to initiate contact where I was informed that my signed paperwork was still in his office not filed and that he was not sure that he washould to proceed on my behalf. My only question is when I agreed to proceed verbally over the phone and signing and returning paperwork to his office where there would be any misunderstanding. I was informed the morning of 02 JAN 17 that I would receive a call from Mr Baker later that day only to have to call back the morning of 03 JAN 17 to just be put off again.. company motto " big enough to serve, small enough to care" needs to be changed.

I had a dog bite injury case in 2010. This lawyer took 5 years to do anything regarding insurance on this case. I always had to make calls for updates over the years. I felt like I was completely unimportant to James or Dan. They asked for pictures, years later, which I sent numerous times. Yet they demanded I come all the way downtown for more pictures. I explained to them I can't drive due to my health, and Chicago is an hour an a half from me. Plus $20-40 in parking and has money, I couldn't afford for a 10 minute meeting was a ridiculous request but they didn't care. They barely did any work on my case, and 5 years to get only a 5k increase. FIVE YEARS. Then they expect to get paid when they didn't do anything and I'm no longer a client. Find a better lawyer than Jame's firm that will actually make you a priority and so actual work.

After being shot twice on a foot patrol as an armed security Metro Enforcement Officer in Rockford Illinois, it was assumed the case was a no brainer. Considering I had no fault in the manner you would think things like Physical therapy, mental health services, on time TTD benifits (weekly pay through Illinois Workers Comp) and getting the bullet removed from my shoulder along with other needed surgeries would have been a non issue. Gesmer along with Brad promised to go after Auburn Manor, the place where I was shot, and get me the services, medications and doctors appointments that were desperately needed but over the course of almost a year Gesmer law did not successfully accomplish one thing they promised to handle, this is not an exaggeration, it is a fact, they did not accomplish one single things for me. After almost loosing my leg these lawyers couldn't even manage to get me a single session of Physical therapy for it. With a bullet lodged in my shoulders I waited six months while they stood by and let me suffer through the pain, sending their emails and accomplishing absolutely nothing in my favor. Jim and Brad did nothing but go along with what Illinois Workers comp told them to and rob me of 20% of the pathetic settlement that was reached for sending emails. After doing the math I found that a fair settlement would have been over one million dollars, I walked away with less than 10% of that. Phone calls and emails often went unreturned for days even weeks as they were on vacation. They were not there for me they were there to help the insurance company deal with me and collect their fee. Not one thing was successfully completed by Gesmer law, they failed me at every turn, and shamelessly collected their fee. The insurance stopped paying me April 7th 2015 and did not send my settlement check until July 21st, for 3 months I didn't get a dollar of the pay I was entitled to, I almost lost everything. Feel free to contact me for an 11 page document with dates and pictures. There was no benefit to hiring these people they did nothing I couldn't have done for myself if the insurance wasn't allowed to ignore my phone calls and only respond to attorneys. By far the biggest and most expensive mistake I have ever made.

Starshak was one of the lawyers with Horwitz and Horwitz that represented me for a bus accident I had at Ohare airport. Starshak was assigned to the case much later after the accident happened so, he can't be blamed for not talking to witnesses right after I signed up with the firm but, time does cause memories to fade. He was good at returning calls, emails and scheduling meetings when I requested. There were problems though that no client would want to experience. You would think that a lawyer would depose the police that wrote the accident report that backed up my position of how the accident happened and what the witnesses on the bus told him. You would think that a lawyer would depose my Supervisor that wrote up a separate report from when he was on the scene about the injuries witnesses on the bus told him they had. That didn't happen. Instead of Starshak showing up in court on status hearings, a stand by lawyer would usually show up and that resulted in an instance where the stand by lawyer had to refute via an Affidavit allegations Opposing Counsel alleged the stand by lawyer made in a proceeding. The Judge in response to the Affidavit issue ended up ruling in favor of Opposing Counsel as to his medical expert. The settlement discussion went down the drain at that point. When a lawyer has time management issues they use stand by lawyers. I never even found a Notice of Appearance for any of the stand by lawyers. The discovery judge tired of stand by lawyers and Starshak started showing up. It seemed that Starshak failed to conference with prior lawyers within his firm regarding an IME appointment I showed up for and the fact that I personally told him I showed up for the IME and had my camera out to film it but, the doctor cancelled the IME even though I told him I'd put my camera away. Then there was the issue of Opposing Counsel alleging that Starshak and crew failed to notify him of the current address of a out of town witness that was on the bus and that Starshak and crew failed to tell Opposing Counsel what the witness would testify to. The Judge Sandra Ramos barred the witness. This was the only witness on the bus Starshak scheduled for a deposition even though there were other flight attendants, executives and a ground transportation witness on the bus. One witness went to the hospital. The deposition was scheduled for when Starshak returned from Gerry Spences ranch. Opposing Counsel told the witness that the Judge had told Horwitz that the witness could not be deposed and Opposing Counsel also alleged in a motion that the subpoena was invalid as it related to contempt. I was shocked at the discovery Opposing Counsel came in alleging he didn't get. Even when the Judge asked Atty. Carter ( lead counsel ) what happened to the discovery sought via a subpoena in 2017 , Atty. Carter's answer was " I don't know." Opposing Counsel also alleged that Horwitz sent out a subpoena for discovery to a 3rd party and failed to send Opposing Counsel a copy of the request. I also had to ask Starshak to watch his language in front of me on at least 2 occasions when he referred to a particular individual using a section of the male anatomy during the conversation. As a result of misrepresentations I alleged that Horwitz and Opposing Counsel made to the court, Horwitz did not want to represent me any longer and walked into court on what was suppose to be the 3rd day of trial with a Motion to Withdraw. The Motion was denied but, Horwtiz said they couldn't represent me so, the Judge told me I either had to represent myself or work Horwitz even though they had said they didn't want to. The Judge wouldn't allow me to complete my sentence when I was trying to ask for time to get a new lawyer. Horwitz and Opposing Counsel suggested I could dismiss with leave to refile. I did that after a 5 minute conference in the hallway with Horwitz. No lawyer wanted to take the case on after looking at the sanctions the Judge dished out.

Leon will exaggerate, twist and downright lie in his guardian ad litem reports. If you have the opportunity to choose, stay away from this dude. He’s lazy, he does the bare minimum, he has no clue what is “in the best interest of the child” as he suggests “equal shared parenting” is not an option for an child under his personal bias and preference. Leon spent his time “interviewing” family members and friends by chatting about stories about their family members, partying and old drunken memories, with minimal talk about the child, or the child’s needs and wishes. If you’re a father hoping to be just that, a father, this guy will be sure you don’t get that opportunity as he believes what’s best for a child is 14% visitation time turning you into an acquaintance to your child! Sadly, a father himself, stealing children away from loving dads in the name of money!

What a Workers’ Compensation Lawyer Can Do for You

A workers’ compensation lawyer specializes in helping employees who are injured or become ill as a result of their job to receive the benefits they are entitled to under workers' compensation laws. These lawyers represent injured workers in claims for medical benefits, wage replacement, and other compensation related to workplace injuries or illnesses. They also help when claims are denied, benefits are delayed, or disputes arise with the employer or the insurance company.

Whether you've been injured on the job, developed an occupational illness, or are dealing with a denied workers' compensation claim, a workers’ compensation lawyer can help you navigate the claims process and ensure you receive the full benefits you deserve.

When Should I Hire a Workers' Compensation Lawyer?

You should consider hiring a workers' compensation lawyer in several situations, especially when complications arise during the claims process or when your rights as an injured worker are being challenged. Some common reasons to hire a workers' compensation lawyer include:

  • Claim denial: If your workers' compensation claim has been denied, a lawyer can help you appeal the decision and represent you in hearings or litigation.
  • Inadequate benefits: If the insurance company offers you a settlement that doesn’t cover your medical expenses, lost wages, or other damages, a lawyer can negotiate on your behalf for a fair amount.
  • Delay in receiving benefits: If your benefits are being delayed, a lawyer can help expedite the process to ensure you receive timely compensation.
  • Permanent disability: If your injury leads to permanent disability (partial or total), a lawyer can help you navigate the more complex process of securing long-term benefits.
  • Retaliation by employer: If your employer retaliates against you for filing a workers' compensation claim (e.g., by firing or demoting you), a lawyer can protect your rights and pursue legal action.
  • Third-party liability: If a third party (e.g., a contractor or equipment manufacturer) was responsible for your injury, a lawyer can help you pursue additional compensation through a personal injury lawsuit.
  • Pre-existing conditions: If your employer or the insurance company claims that your injury is related to a pre-existing condition, a lawyer can help you present evidence showing that the injury was work-related.

Hiring a lawyer early in the process can prevent delays, avoid mistakes, and ensure you receive all the benefits you’re entitled to under workers' compensation law.

What Does a Workers' Compensation Lawyer Do?

A workers' compensation lawyer provides a range of legal services to injured workers, ensuring that they receive the benefits they deserve. Their tasks often include:

  • Filing claims: Helping injured workers prepare and file their workers' compensation claims to ensure accuracy and timeliness.
  • Appealing denied claims: Representing workers whose claims have been denied and guiding them through the appeals process, including hearings and court appearances.
  • Negotiating settlements: Negotiating with insurance companies to secure fair compensation for medical expenses, lost wages, and other damages.
  • Handling disputes: Resolving disputes between the injured worker, the employer, and the insurance company regarding the amount of compensation or the nature of the injury.
  • Coordinating medical evidence: Gathering and presenting medical records, expert testimony, and other evidence to support the workers' compensation claim.
  • Advocating for benefits: Ensuring that injured workers receive all the benefits they’re entitled to, including temporary or permanent disability benefits, vocational rehabilitation, and medical treatment.
  • Filing third-party lawsuits: In cases where a third party is responsible for the injury, a workers' compensation lawyer may also pursue a personal injury lawsuit to recover additional damages.

How Are Workers’ Compensation Lawyers Paid?

Workers' compensation lawyers typically charge a contingency fee, meaning they only get paid if they successfully recover benefits for you. This fee is usually a percentage of the benefits awarded, and the specific percentage is often regulated by state law. Here's how it generally works:

  • Contingency fee: The lawyer's fee is typically between 15% and 25% of the total benefits awarded to you. You don’t have to pay any upfront legal fees, and the lawyer’s fee comes out of the settlement or benefit award.
  • No fee if no recovery: If the lawyer doesn’t recover any benefits for you, you generally don’t have to pay for their services.
  • State regulations on fees: Many states cap the percentage that workers' compensation lawyers can charge, and some states require the fee to be approved by the workers' compensation board or judge.

Be sure to discuss the fee structure with your lawyer during the initial consultation to understand how much you will owe if your case is successful.

How Much Does a Workers' Compensation Lawyer Cost?

The cost of hiring a workers' compensation lawyer typically depends on the contingency fee arrangement, meaning the lawyer’s fee will be a percentage of the benefits you receive. General cost estimates include:

  • Contingency fees: Most workers' compensation lawyers charge between 15% and 25% of the total settlement or benefits awarded. For example, if you receive $50,000 in benefits, the lawyer’s fee would range from $7,500 to $12,500.
  • State regulations: Some states limit the percentage that workers' compensation lawyers can charge. In these cases, the fee is usually capped, often at 20% to 25%, depending on state law.
  • Additional costs: Some lawyers may charge for out-of-pocket expenses, such as filing fees, medical records retrieval, and expert witness testimony, though these costs are typically deducted from the settlement after the case is won.

You should always ask for a clear explanation of fees and potential additional costs during your consultation so you understand the financial arrangement.

Top Questions to Ask a Workers' Compensation Lawyer

Before hiring a workers' compensation lawyer, it’s important to ask the right questions to ensure they are the best fit for your case. Key questions to ask include:

  1. What experience do you have with workers' compensation cases?
Ensure the lawyer has experience handling cases similar to yours, especially if your injury is severe or the case involves disputes.
  2. How do you charge for your services?
Clarify whether the lawyer charges a contingency fee and whether there are any additional costs you need to be aware of.
  3. What is the likelihood of success in my case?
Ask for an honest assessment of your case, including the potential challenges and outcomes.
  4. Have you handled cases like mine before?
Find out if the lawyer has experience dealing with cases involving similar injuries or disputes, such as denied claims or permanent disability.
  5. How long will the process take?
While it’s difficult to predict an exact timeline, the lawyer should be able to provide a general estimate based on their experience with similar cases.
  6. Will you personally handle my case?
In larger firms, junior attorneys or paralegals may handle parts of your case. Make sure you know who will be working on your claim.

How to Check the Credibility of a Workers' Compensation Lawyer

To ensure you are hiring a reputable workers' compensation lawyer, follow these steps to verify their credentials and track record:

  • Verify their bar status: Check with your state bar association to confirm that the lawyer is licensed and in good standing, with no disciplinary actions against them.
  • Look for workers' compensation experience: Review the lawyer’s website or professional profile to ensure they specialize in workers' compensation law and have successfully handled cases similar to yours.
  • Read client reviews and testimonials: Look for client reviews on platforms like Avvo, Martindale-Hubbell, or Google to see what previous clients have said about the lawyer’s expertise and service.
  • Ask for references: A credible lawyer should be willing to provide references from past clients who can speak to their experience in workers' compensation cases.
  • Check for professional affiliations: Membership in organizations like the Workers' Injury Law & Advocacy Group (WILG) or local bar association committees on workers' compensation can indicate the lawyer’s commitment to this area of law.

What Should I Prepare for My First Consultation?

To make the most out of your first consultation with a workers' compensation lawyer, it’s important to come prepared with relevant documents and information. Here’s what you should bring:

  • Accident report or incident documentation: Bring any documentation related to your workplace injury or illness, including accident reports or notifications to your employer.
  • Medical records: Provide copies of medical records, including treatment notes, doctor’s reports, and any information related to your injury or condition.
  • Employer correspondence: Bring any letters, emails, or forms related to your claim from your employer or the workers' compensation insurance company.
  • Wage and benefits information: Provide information on your wages, benefits, and any lost income due to the injury.
  • List of questions: Prepare questions about your case, the process, costs, and what to expect moving forward.
