First off, this review is about the law in the state of Florida and then the attorneys that take advantage of it. My wife filed for divorce on March13th of this year. My response was to obtain the services of an attorney and Mr. Gufford ended up being 1 of 2 I interviewed. As most participants in a divorce, you are in a vulnerable position because of the uncertainty of the future. In my case, and in haste, I signed a retainer agreement not knowing much about the process. I also gave 10% of the agreement to deposit in a “trust fund”. Here is where I find issue with the law and Mr. Gufford. My wife and I ended up reconciling our differences and we both agreed to voluntarily dismiss our case. My wife’s attorney put the majority of her retainer in her case’s trust fund, sent notices and gave a periodic statements. With the dismissal, her firm also agreed to refund part of the retainer because they did not bill the full hours the retainer was to cover. An honest firm. On my side of the coin, Mr. Gufford’s office hadn’t sent any statement of expenses and in fact didn’t contact me directly (since my initial consultation) until I emailed them to notify of the dismissals. Then I was told they used my trust fund for expenses and I would get half back and so sorry they are going to keep the whole retainer. How can this be a legal, where a full retainer can be kept when 1/3rd the agreed upon effort was given? My retainer said I was paying for 20 hours effort by Mr. Gufford’s firm. Instead, when all was said and done, I ended up paying triple for 7+ hours of services. I get the law says attorneys can make the retainer non-refundable, but the law needs to be changed… honest people work honestly, not take advantage of laws in place to screw people in bad situations. Now I have a credit card bill to pay… thank God my wife has agreed to help me with her retainer refund. Watch out for this Gufford Law Firm. Still took money not earned!

Joseph Gufford is a straight shooter that spent 20 minutes on the phone with me even though he was not available on the date I needed him. He gave me great advise and very good referrals.

I have known Joe for over 20 years. He is a terrific Family Law attorney. He is always prepared and covers all aspects thoroughly in every case he handles.
