Niley Dorit was not only educated on what law I had questions about, but he was professional and always got back to me in a timely manner. My case only took a few short months and even though I had never met him in person I trusted him. I was right to do so. He did everything he said he was going to do. Because of his abilities as a lawyer and experience in the field, we won our case. I am so thrilled that we were able to. I would recommend him to anyone in need of a lawyer. (And I already have twice.)

I was referred to Kevin O'Hara back in the early 1990s for a car accident. His firm was wonderful in assisting me with my case. I was extremely pleased with the outcome. Over the years, I have consulted Mr. O'Hara regarding other legal matters, of which he has been courteous and informative. Mr. O'Hara is always very respectful and cares about his clients. He's well-educated in many areas of the law and always would give direction if my legal advice needed input from another lawyer in a particular field.

David took the time even after 6 lawyers had decided to not accept my case for being injured on the job and the treating Doctor not doing his job, sat down with me for over an hour and explained why it would be very hard to prove that I was not treated correctly after being injured, even though he thought I was not treated quickly enough to save my shoulder. He said that even if I won in court, and that the judgement would have been cut in half, and he did not want me to go through all of that for such a small judgement, and it made total sense. I think David is a top tier Lawyer, as my daughter Jaime is a Lawyer for one of the biggest firms in Fresno, she said she has heard nothing but great things about him. He will look you straight in the eye and tell you straight how it is.

I have known Gary for 15 years, and I don't know who was responsible for that ridiculous rating but they obviously do NOT know Gary Roberts and his fantastic accomplishments. I worked for Gary through a malpractice suit. and he is one of the best trial lawyers I've ever been associated with. He is extremely competent, and knowledgeable in so many areas of the law. He is also a kind, compassionate, empathetic gentleman. He is behind his client from the word go and does his best from the first word of the trial till the last gavel falls. If ever again I need an attorney Gary is on my speed dial and I would highly recommend him to any one with a legal problem because I know he would work harder for them than any other lawyer in the state of Florida..

I have been a practicing attorney for a few years and recently I received a complaint from a former client. The former client made a number of unfounded allegations and demanded a large sum of money to settle the claims. I called my malpractice carrier feeling nervous and worried; shortly after that call I met with June Laird. She was professional, compassionate and intelligent. After reviewing the complaint, facts and documents with June I felt much better about the case. She wrote a concise, thoughtful and easy-to-understand letter to the Attorney Regulation Counsel. She explained why each of my former client's claims was without merit. June kept me in the loop as she wrote the letter and regularly sought my input. Unfortunately, June was injured during the course of my case. Despite her injury, she still kept me well informed. She told me that she was in the hospital and would be working on my case and still met the deadline. Shortly after submitting the letter in response to the complaint, we received a letter from ARC informing us that even if the client were able to prove his/her claims, they did not represent a violation of the law or the professional rules of conduct. It felt good to have a third-party neutral validate my feelings. June was exceptional - as an attorney I hope to provide the same level of competence and commitment to my clients.

I was working for an employer who suddenly stopped paying me for my work and tried to get out of paying me at all. When I ended our contract for nonpayment, I found out he hadn't paid anyone who had left the company. I banded together with a few other people who no longer worked there and went to Daniel, who was highly recommended. Despite having much bigger accounts, Daniel was professional, helpful, and always looked out for our best interests and asked us before contacting the client. I highly recommend Daniel to anyone who needs help with employment law or any other type of case. He is an excellent lawyer to have in your corner!

I had an insurance claim that the insurance company quickly denied coverage for. An attorney friend referred Mr. Les Robertson to me because he's an expert in insurance coverage and has a great reputation. Since the first conversation, Mr. Robertson was warm, empathetic, and very clear at explaining the law related to my situation. He told me the insurance should have provided the coverage and was willing to help. In a surprise turn, the insurance company changed their mind a couple of days later and decided to cover for the claim. I didn't need to work with Mr Robertson further but I will not hesitate at all to reach out to him again if there is a need. Highly recommend him!

My practice has retained Mindy McLaughlin and several malpractice defense cases. We have found Mindy to be an OUTSTANDING medical malpractice defense attorney. She is always extremely well prepared, presents her case in a logical and thorough manner. Mindy uses her intelligence, experience and great knowledge of medicine to “overpower” lesser attorneys. I would use her again in an instant if the need arises. I have seen a very few attorneys that are on her skill level. Thanks

I went to Sergio Rufo because I am a small business owner that needs timely and mostly simple advice. He never tries to oversell me or make things too complicated, he just takes what I say and does it exactly as it should. I have complete confidence and trust in Sergio Rufo and would count on him for my small and even larger needs. I just know that I will get the results I need with him.

Boris and the team at the Law Offices of Boris E. Efron proved their admirable commitment and prestige expertise during a 4.5-year long settlement on personal injury case. After the settlement, Boris continued to work hard at no extra cost, and was able to successfully reduce the entire lien amount that was held for medical bills covered by insurances during my injury period. His unwavering support and exceptional legal work made a significant difference on my life; and my family and I are eternally grateful for that. I am honored to endorse Boris for his great expertise, noteworthy commitment to his clients, and for his transparent communication and genuine demeanor throughout lengthy and difficult legal processes.

Jim Cardea diligintley, professionally, and compassionately guided our family through a difficult time after the unnecessary loss of our mother after not being properly treated by both cardiologist and nurse during a severe heart attack . He provided realistic expectations and goals for the case and clearly explained the factors affecting such cases in Maryland. With a well crafted plan he and his team presented the truth of our case before the court to provide not just a successful day there, but more importanly, peace of mind for myself and our family.

Mr. Mastin actually defended me as a Public Defender about ten years ago and was able to get me a WAY better deal than a paid lawyer was going to who I'd paid $5000! And it's because ge actually cares about ALL of his clients and is not afraid to stand up and fight for not only their rights but their absolute best interest to reach the most fair and personally relevant and advantageous resolution and outcome for moving forward in one's life. I would not hesitate to have Jeff on my side again, no matter the cost!

I was put in contact with Ryan after sending an inquiry to the Primerus website. After receiving an e-mail response, Ryan and I spoke over the phone discussing aspects of my concerns with a previously signed Non-disclosure Agreement. Ryan was extremely helpful in presenting a clear explanation of my options as well as knowledge pertaining to such an agreement in its generality. At the time of leaving this review, I had not moved forward with the matter due to the conclusion that it would be un-necessary. However, I would not hesitate to proceed on subsequent steps with Ryan should the necessity arise.

What a Medical Malpractice Lawyer Can Do for You

A medical malpractice lawyer specializes in helping individuals who have been harmed due to the negligence or misconduct of healthcare professionals, such as doctors, nurses, or hospitals. These lawyers assist in cases where a healthcare provider deviates from the accepted standard of care, resulting in injury or death. Medical malpractice cases can involve misdiagnosis, surgical errors, medication mistakes, birth injuries, and other forms of medical negligence.

If you or a loved one has suffered harm due to improper medical treatment, a medical malpractice lawyer can help you understand your legal options, file a lawsuit, and pursue compensation for medical expenses, pain and suffering, lost wages, and other damages.

When Should I Hire a Medical Malpractice Lawyer?

Hiring a medical malpractice lawyer is essential if you’ve been seriously injured due to the negligence of a healthcare provider or institution. Situations where you should seek legal representation include:

  • Misdiagnosis or delayed diagnosis: If a doctor fails to diagnose or delays diagnosing a medical condition, leading to harm or progression of the illness.
  • Surgical errors: Harm resulting from surgical mistakes such as operating on the wrong site, leaving instruments inside the body, or performing unnecessary procedures.
  • Medication errors: Injuries caused by prescribing the wrong medication or dosage, or mistakes made by pharmacists in dispensing drugs.
  • Birth injuries: Injuries to a newborn due to medical negligence during labor and delivery, such as failing to perform a timely C-section or improper use of delivery instruments.
  • Anesthesia errors: Complications arising from improperly administered anesthesia, which can lead to serious injury or death.
  • Inadequate follow-up or aftercare: Suffering due to lack of proper monitoring or care after a medical procedure, leading to complications.
  • Hospital or nursing home negligence: Harm caused by the negligence of hospital staff, nurses, or administrators who failed to provide adequate care.

Medical malpractice cases are complex, and hiring a lawyer early can help ensure your rights are protected and your case is handled effectively.

What Does a Medical Malpractice Lawyer Do?

A medical malpractice lawyer provides various legal services to help injured patients hold negligent healthcare providers accountable. Their responsibilities include:

  • Evaluating your case: Reviewing medical records and consulting with experts to determine if you have a viable claim based on the standard of care and harm suffered.
  • Filing a lawsuit: Initiating legal action by filing a complaint against the responsible parties in the appropriate court.
  • Gathering evidence: Collecting medical records, expert testimonies, and other relevant evidence to build a strong case.
  • Negotiating with insurance companies: Working to secure a fair settlement that compensates you for your injuries without the need for a trial.
  • Litigating in court: Representing you during trial proceedings if a settlement cannot be reached, presenting evidence and arguing your case.
  • Calculating damages: Assessing the full extent of your losses, including medical expenses, lost income, pain and suffering, and future care needs.
  • Handling expert testimony: Coordinating with medical experts who can testify on how the standard of care was breached and how it led to your injuries.

How Are Medical Malpractice Lawyers Paid?

Most medical malpractice lawyers work on a contingency fee basis, which means they only get paid if they recover compensation for you. Key aspects of this payment structure include:

  • Contingency fee percentage: The lawyer's fee is typically between 25% and 40% of the settlement or award.
  • No upfront costs: You do not pay any legal fees unless the lawyer successfully recovers compensation on your behalf.
  • Case expenses: Costs for expert witnesses, medical record retrieval, and court fees may be deducted from your settlement or award in addition to the lawyer's fee.

Always discuss the fee arrangement during your initial consultation to understand your financial obligations.

How Much Does a Medical Malpractice Lawyer Cost?

The cost of hiring a medical malpractice lawyer is usually based on a contingency fee model. General estimates include:

  • Contingency fee: Lawyers typically charge between 25% and 40% of the total recovery amount.
  • Case expenses: Additional costs such as expert witness fees and court expenses can range from $5,000 to $50,000 or more, depending on the case complexity.

Ensure you receive a clear explanation of all potential fees and expenses before proceeding with your case.

Top Questions to Ask a Medical Malpractice Lawyer

Before hiring a medical malpractice lawyer, consider asking the following questions:

  1. What experience do you have with medical malpractice cases like mine?
Confirm the lawyer has a successful track record with similar cases.
  2. How do you charge for your services?
Understand the contingency fee percentage and any additional costs you may incur.
  3. What is the likelihood of success in my case?
Seek an honest assessment of your case's strengths and potential challenges.
  4. How long will the process take?
Get an estimate of the timeline for settling or taking the case to trial.
  5. Will you handle my case personally?
Ensure you know who will be managing your case and their level of involvement.
  6. Have you worked with expert witnesses?
Verify the lawyer's experience in collaborating with medical experts essential for your case.

How to Check the Credibility of a Medical Malpractice Lawyer

To ensure you're hiring a reputable lawyer, take the following steps:

  • Verify their bar status: Check with your state bar association for their license and any disciplinary actions.
  • Review their experience: Look for specialization in medical malpractice and a history of successful cases.
  • Read client reviews: Consult platforms like Avvo or Martindale-Hubbell for testimonials and ratings.
  • Ask for references: Request contact information of previous clients willing to discuss their experience.
  • Check professional affiliations: Membership in organizations like the American Association for Justice (AAJ) indicates a commitment to the field.

What Should I Prepare for My First Consultation?

To maximize the effectiveness of your initial meeting, bring the following:

  • Medical records: All documents related to your treatment and injury.
  • Evidence of harm: Photos, medical bills, and records of lost wages.
  • Communication records: Any correspondence with healthcare providers or institutions.
  • List of healthcare providers: Names and contact information of all involved medical personnel.
  • Questions for the lawyer: A prepared list to address all your concerns.
  • Timeline of events: A detailed chronology of your medical care and the issues encountered.

Being well-prepared helps the lawyer assess your case accurately and advise you on the best course of action.
